Regular Meeting of the Orono Council, 7:30 P.M.
May 24, 1976
The Orono Council met on the above date with
the following members present: mayor Searles,
Councilmembers Butler, Massengale, and welsh.
Councilmember Paurus absent. Also present:
City Administrator Beason, Building & Zoning
Administrator Muhich, and City Attorney rfalkerson.
Butler moved, Searles seconded, that the Minutes MINUTES
of the Regular Meeting of stay 10, 1976, be approved
as amended. t-sotion, Ayes (4) - Nays (0).
Butler moved, Massengale seconded, that the lot VARIANCE
width and area variance for Lester Raskob, 4220 4220 Chippewa Lane
Chippewa Lane, be referred to the Planning
Commission. Motion, Ayes (4) - Nays (0).
Butler moved, Massengale seconded, that the lot VARIANCE
width and area for addition to nonconforming 1085 Brown Road South
residence for Phillip Jansen, 1085 Brown Road
South, be referred to the Planning Commission.
Motion, Ayes (4) - Nays (0).
Butler moved, Massengale seconded, that the CONDITIONAL USE PERMIT
conditional use permit for grading for Tom 1060 Tonkawa Road
Ryan, 1060 Towkawa Road, be referred to the
Planning Commission. Motion, Ayes (4) - Nays (0).
Butler moved, Massengale seconded, that the CONDITIONAL USE PERMIT
conditional use permit for filling and grading 4051 Highwood Road
for W. J. Sime, 4051 Highwood Road, be referred
to the Planning Commission. Motion, Ayes (4) -

Henry Muhich, Building i Zoning Administrator, VARIANCE
stated that Mr. Dick Edwards has applied for a 3485 Shoreline Drive
variance and fill permit to place the fill from
the Super Valu Store's new construction on his
property at 3485 Shoreline Drive. Representatives
for the Super Valu Stores stated that there would
not be any excess fill. Upon learning this, Mr.
Edwards withdrew his request. Mr. Muhich returned
tor. Edward's check that had been submitted by him
for the variance.

Mr. Jansen is resting a variance for two additions on an existing
dwelling located on a nonconforming lot, as well as a variance from: the
required setback for his proposed addition.

Road South, as recommended by the Planning
Commission, Hotion, Ayes (5) - Nays (0).
Henry Jluhich, Building i Zoning Administrator,
stated that W. J. Sime, Jr., 4051 ighwood Road,
has obtained about 90 yards of fill from his
neighbor's construction project and deposited
it in t*,a low area of his property along Highwood
Road. a is requesting approval of a conditional
use permit to partially fill and grade this low
area.
Several problems could result from this project
unless the following conditions are met:
1. Remove excessive fill from around existing
trees to prevent destroying them.
2. Protect graded banks against erosion.
3. Agree tc proc; properly designed drainage
to prevent flooding prohlems on adjoining
roperties or property across the street.
