Brown Road Variance - Side Yard Setback Mr. Jansen previously requested a variance to approve a side yard setback of 15' so an addition could be made to his existing dwelling. Council approved the variance June 14, 1976 (#133). During construction, Mr. Jansen has found sane difficulty in arranging the kitchen as he had originally anticipated. Ile finds lie needs an additional 2' width in his kitchen. This would reduce the side yard setback from the originally approved 15' to 13'. lie came in voluntarily to apply for another variance. The property to the north does have a residence, but it is not located anywhere near this corm property line. UIWTES OF A PLANNING CGtIISSION MEETING OF SEPT MER 20, 1976 - PAGE 4 Hank Which presented a side elevation sketch to the CHARLES FARLEY Planning Commission which was submitted by the Farley's 2700 CASCO POIIT ROAD lr.te this afternoon. Indications on the sketch are that the VARIANCE - SIDE LOT addition would be 5' higher than the existing house. The SETBACK Farley's were present at the meeting. Van Nest moved, Hosfield seconded, to recommend approval of the variances required for the proposed addition to the non- conforming re-idence based on the sketch provided, addition is 5' higher than present ridge line and does not extend beyond present extremities of the house. Motion - Ayes (8), Nays (0) . The Planning Commission took action on the following work session items. he Nelson's are requesting approval to replace their existing garage which is badly in need of repair. rlcDonald moved, Hannah seconded, to recommend approval to replace the existing garage based on the fact that the new structure would be located at the same setback points and any other location for this garage would require more fill. Also, this new garage would be a great improvement to the property as t' existing structure is badly in need of repair. Motion - Ayes (8) , Nays (0) . Olson's were present. They are requesting approval for an addition to an existing non -conforming situation. ORONO COUNCIL IIEETING IiELD SEPTE14BER Z 7, 1976 Page 10 Henry iluhich, Building & Zoning Administrator, stated that Terry Olson, 3640 Bayside Road, is requesting approval for an addition to an exist- ing non -conforming situation. The property is located in a 2-acre zoning district. A 50' street setback is required. The existing dwelling is only 35.8' from the right of way. Therefore, a variance would be necessary before the existing dwelling can be expanded. I would recom.end approval as the addition itself would meet the required 50' setback requirement. Planning Commission fleeting - September 20, 1976 The Planning Commission recommended approval of this variance based on the fact that the proposed addition to the existing residence would meet all setback requirements and the Olsons have sufficient lot area.
