RESOLUTION OF THE CITY COUNCIL

' A RESOLUTION VACATING AN
� � � UNUSED PORTION OF CHARLES STREET
WITHIN TflE PLAT OF ORONO ORCHARDS
SECTION 2, TOWNSHIP 117, RANGE 23
IN TAE CITY- OF ORONO, MINNESOTA
Whereas, the City of Orono is a municipal corporation organized and
existing und'er the laws of the State of Minnesota; and
Whereas , on May 20, 1983, Maurice W�gener and Charles Dettloff
petitioned the City Council for vacation of an unused portion of Charles Street in
the plat of Orono Orchards, Section 2, Township 117, Range 23 in the City of Orono ,
Minnesota except for that portion lying within the dedicated right of ways of
Woodhill Road and Lyman Avenue (formerly Lane) ; and
Trlhereas , the only affected adjoining property owner the Woodhill
County Club has submitted a petition in favor of said vacation; and
Whereas, after due published and posted notice, a public hearing was
•held before the City Planning Commission on June 2�1 , 1983 , regarding said vaca.tion
and all persons interested were given an opportunity to be heard; and _ .
Whereas , after due study and consideration, the Planning Commissiori
recommended approval of the requested vacation and the City Council of the City of
Orono finds that it will be for the best public interest to approve such vaca�ion.
Now, Therefore , Be It Resolved , that such Petition is hereby granted
and that Charles Street as legally described above is hereby vacated pursuant to
the following finding of fact : , .
1 . The vacation does not affect access to or use of any affected or
adjoining property.
2. The City has not and does not intend to develop, improve or use the •
property in any way. �
3. The property as it exists serves no public purpose .

This resolution was passed by a vote of 3 ayes and 0 nays on the
8th day of August, 1983.
