A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR RECONSTRUCTION OF RETAINING WALLS WITHIN THEO -75 FOOT SHORELAND ZONE PER SECTION 78-966 AND A HARDCOVER VARIANCE FROM MUNICIPAL ZONING CODE SECTION 78-1288 FILE NO. 07-3205 WHEREAS, Mitch and Kim Olson, husband and wife, (hereinafter "the Owners") are the are the owners of the property located at 3275 Carman Road within the City of Orono (hereinafter the "City") and legally described Lot 6 Block 1 CARMAN'S COVE, Hennepin County, Minnesota; and WHEREAS, Concept Landscaping has made application on behalf of the Owners to the City of Orono for a conditional use permit per Orono Municipal Zoning Code Section 78-966 to allow reconstruction of retaining walls within the 0-75 foot shoreland zone;and WHEREAS, Concept Landscaping has made application on behalf of the Owners to the City of Orono for a variance from Orono Municipal Zoning Code Section 78- 1288 for the hardcover associated with the walls; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on February 20, 2007, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #07-3263. Page 1 of 5 2. The Planning Commission reviewed this application on February 20, 2007 and on a vote of 7 -0 recommended approval of the conditional use permit for reconstruction of retaining walls within the 0-7 5 foot shore land zone based on the following findings: a. The property drops about 23 feet from the street yard of the property to the cove. b. The existing retaining walls on the property have deteriorated and are unsightly. c. Because of the location of the house on this property and the on the adjacent property it is impossible to construct a slope in place of the walls. d. An additional tier will be added, reducing the height of the individual walls. It will be easier to screen the shorter walls with vegetation. 3. The Planning Commission also recommended approval of the hardcover variance based on the following findings: a. A conditional use permit has been granted for the retaining walls. b. The additional 51 square feet of hardcover provides for an additional tier. The shorter walls will be easier to screen with vegetation. 4. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the owners and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the owners, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial Page 2 of 5 property right of the Owners; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above :findings, the Orono City Council hereby grants a conditional use permit to allow removal of the existing retaining walls on the property and construction of new walls within the Oto 75 foot shoreland zone, as well as a variance to Orono Municipal Zoning Code Section 78-1288 for the hardcover associated with the walls, subject to the following conditions: 1. Council approval is based on the site and wall plans submitted by the owners and annotated by City staff, attached to this Resolution as Exhibits A and B. Any changes to these plans may require further Planning Commission and City Council review. 2. The terraces between the walls shall be planted with native plant material that will obscure the walls, with the planting plan being approved by the Planning Director. 3. Hardcover associated with these retaining walls shall be limited to 682 square feet (2.07%). Owners are advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 4. Authorities granted by this resolution run with the property not with the Owners, but are permissive only and must be exercised by obtaining a building permit for the new retaining walls before February 26, 2008 or the variance will expire on that date. 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned Owners have read, understand, and hereby agree to the terms of this resolution and on behalf of the owners and the owners' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property. Pertinent Zoning Ordinance Sections Land Alteration Permit: Sec. 78-966. Prohibition. (a) It is unlawful for any person to perform or have performed the following land alteration activities without a conditional use permit issued by the council: (3) Build, alter or repair any seawall or retaining wall, or otherwise change the grade or shore of lakeshore property. Conditional Use Permit: Sec. 78-911. Purpose. In order to give the district use regulation the flexibility necessary to achieve the objectives of this chapter, in certain districts, conditional uses are permitted, subject to the granting of a use permit. Conditional uses include those uses generally not suitable in a particular zoning district, but which may under some circumstances be suitable. When such circumstances exist, a conditional use permit may be granted. Conditions may be applied to issuance of the permit, and a periodic review of the permit may be required. The permit shall be issued for a particular use and not for a particular person. Because of their unusual characteristics, conditional uses require consideration so they may be located properly with respect to the objectives of this chapter and the comprehensive municipal plan and with respect to their effects on surrounding properties. In order to achieve these purposes, the council is empowered to grant and to deny applications for conditional use permits and to impose reasonable conditions upon the granting of these permits. FILE 07-3263 February 20, 2006 Page 2 of 3 (a) The planning commission may recommend and the council may grant a conditional use permit as the use permit was applied for or in modified form, if on the basis of the application and the evidence submitted the city makes the following findings: (1) That the proposed location of the conditional use is in accord with the objectives of this chapter and the purposes of the district in which the site is located and the comprehensive municipal plan; (2) That the proposed location of the conditional use and the proposed condition under which it would be operated or maintained would not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity; and (3) That the proposed conditional use will comply with each of the applicable provisions of this chapter. On the Carman Cove side the property drops about 23 feet from the street yard to the water. Of this drop about half occurs as slope and half in two or three tiers of timber retaining walls. These walls extend along the northeast side property line because the house on the adjacent lot is at the same elevation as 2875 but is located much closer to the street and has a walkout basement. The applicant proposes to replace the deteriorated and unsightly timber walls and steps with stone walls and steps. An additional wall will be added to reduce the height of each wall. A conditional use permit is required because almost all of the walls will be in the 0-75 foot hardcover zone. Because of the additional wall the amount of hardcover within the 0-75 foot zone will increase from 631 square feet (1.92%) to 682 square feet (2.07%). Mitch Olson has an irregular lot. His lot faces south overlooking Carman's Bay and to the east a lagoon with several docks and canopies. Facing east along side of his house is an old retaining wall system made of railroad ties and vertical telephone poles. On the north end of the system his wall separates his property and driveway from his neighbors pool which extends to the property line. The wall system lies more than 75' back from Carman's Bay, but because the lot is irregular the wall encroaches the 75'on the lagoon side. The wall system is very important as it separates Mitch's property from his neighbors, allowing for Mitch's home, which is a much higher elevation. Removing the wall system and sloping the land is not a possibility. The recommended slope is a 3:1. That would mean the toe of the slope would have to be 51 feet waterward of the highest part of the wall system. The slope would encroach over the neighbors property from his pool to the lagoon. He would be most unhappy when we filled his pool with dirt. This slope would require 2416 cubic yards of new fill and encroach the neighbors land for all but the last 40' of the 160' of wall system. We are going to remove his old rotten walls and install new random boulder walls as shown in our future photo which shows the new walls. None of our walls will exceed 4' in height. Where the old walls exceed 4' we will be moving our new wall out 2', excavating down some soil and building back 4'. There will be no need to bring in soil or haul away any soil. The top slope of the system will not exceed a 1:1 slope. All of the flat area planting levels will be planted as shown on the future photo which will cover the walls and be very beautiful. In the winter, other than snow plowing, we only have retaining walls, rip-rap, and wood decks and stairs that we are able to do. We keep our key employees working with this kind of work. By requiring a conditional use permit for this project you have pushed the project start date right thru winter into spring and quite frankly left us high and dry and short on winter work. The hardship has left me wondering, why? I don't understand why this is a conditional use. Mitch's existing walls were built years ago and have been in use up to now. While they are in fact a non-conforming use, they qualify under 2001 State Statute the right to exist and be maintained. To me it would seem that a simple replacement permit would have been justified. Furthermore, demanding a conditional use permit means you are offering a permit based on conditions, which would be totally illegal based on the 2001 State Statute? This letter has nothing to do with my customers desire to proceed with his permit. And, is in fact a only personal question from me.
