The Orono Planning Commission met on the above date with the following members present:
Chair Elizabeth Hawn , Commissioners Dale Lindquist, Daniel Kluth, Sandra Smith, and
Jeanne Mabusth . Commissioners William Stoddard and Janice Berg were absent. The following
represented City Staff: Planning Director Michael Gaffron, Zoning Administrator Paul Weinberger,
Zoning Administrator Wendy Bottenberg , and Recorder Jackie Young. City Council Representative
Richard Flint was present.
Chair Hawn called the meeting to order at 6:30 p .m.
OLD BUSINESS
(#1) #01-2664 MITCH AND KIM OLSON, 3265 CARMAN ROAD, VARIANCE
Mitch and Kim Olson, Applicants, were present.
Botten berg stated the Applicants appeared before the Planning Commission at their March 19, 2001
meeting, where they requested it be tabled to allow them time to revise their plan. The Applicants are
proposing to construct a 360 square foot attached garage on the street side of the residence . As a result
of discussions with Staff, the Applicants have reduced the size of the garage from what was originally
submitted. The depth of the garage has beei:i revised and will be located approximately 36 feet from
the front property line where 35 feet is required, which has eliminated the need for a setback variance.
Variances to hardcover and lot coverage are being requested. The garage addition is located in the
75-250' setback zone. Hardcover in the 75-250' setback zone is currently 4,685 square feet or 54.4
percent (excluding rock/plastic which must be removed). The Applicants are proposing to remove a
large portion of the deck on the lake side of the residence in order to reduce hardcover and structure,
and will be rearranging driveway and sidewalk hardcover. After the proposed removals, hardcover in
the 75-250' setback zone will be 4,501 square feet or 52.2 percent , which is a reduction of 2.2 percent.
Bottenberg stated hardcover in the 0-75 ' zone would also be decreased due to the removal of deck
portions as well as a stairway and some retaining wall sections. Existing hardcover is 584 square feet
or 8 .3 percent. The Applicants are proposing 249 square feet or 3 .5 percent hardcover in the 0-75'
zone . Bottenberg stated the Applicants notified City Staff via fax last Friday that they wished to keep
a portion of the retaining walls in the 0-75' zone, which will increase the amount of hardcover in this
zone to 288 square feet or 4.07 percent.
Currently the structural coverage on the lot is 3,416 square feet or 21.8 percent. The garage addition
and removal of a portion of the decks will result in structural coverage of 3,280 square feet or 20 .9
percent. The deck and pool comprise 8 .1 percent of this amount, with the remaining 12.8 percent
consisting of the existing house and garage addition.
Bottenberg stated this property was granted a variance in 1978 to allow construction of a pool three feet
from the side lot line. The previous property owners also received an after-the-fact permit for decks
constructed around the pool area and along the lake side of the house without permits. The Council , as
a result of that variance approval, requested removal of certain portions of the new decks, while certain
segments of the deck were considered as non-hardcover due to height above ground, board spacing,
and permeable grass below. A third application was approved in 1997, for a conditional use permit to

reconstruct retaining walls in the 0-7 5' zone .
Bottenberg stated the current survey received by the City shows that the required deck removals were
never completed by the previous property owner, although the decks were inspected in 1986 . The
current owners have agreed to remove all unapproved portions of deck as well as additional portions
as part of the current request. The deck segments approved as non-hardcover in 1985, are now
considered hardcover under current code, and have been included in the hardcover calculations.
City Staff feels the Applicants have made a good faith effort to reduce the size of the garage addition
and bring the decks into conformity with the prior approvals. Although hardcover and lot coverage
will still exceed City standards , the Applicants' proposal does result in slight reductions of hardcover
and lot coverage. Staff would like the Planning Commission to determine whether the proposed
reductions are adequate and appropriate given the stated hardships and the nature of the site.
The Applicants had no comments in addition to Staffs report.
Lindquist inquired what the hardcover would be in the 0-75' zone.
Botten berg stated the hardcover in the 0-75' zone would be reduced to 288 square feet rather than
249 square feet. Bottenberg stated the App!icants have indicated they would like to retain some of the
retaining walls in this area.
Hawn inquired what the hardcover would be had the previous property owner complied with the
agreement pursuant to the variance request.
Bottenberg stated the portion of the deck that was to have been removed amounts to 384 square feet.
Hawn questioned whether the rock and plastic are included in the hardcover numbers.
Bottenberg stated the Applicants are planning on removing all existing rock and plastic underlayment.
Hawn inquired whether the rock located at the rear of the house is the rock that will be removed .
Olson stated they would be removing all rock and plastic. Olson stated they were unaware of the
requirement to remove a portion of the deck until only recently.
Mabusth inquired whether the two keystone retaining walls are the walls that will be removed.
Olson stated the keystone wall bordering the two properties would not be removed.
Mabusth inquired whether the small deck would be removed.
Olson stated that it would be.
Mabusth inquired what the orange-colored structure located under the deck was.

Olson stated it is a hot tub. Olson indicated he is unsure at this time where exactly the hot tub will be
located. Olson stated the current garage has a ceiling height of 6 .5 feet with a post in the middle , which
makes it impossible to park two cars in the garage. Olson stated the foundation is also cracked , with
the garage door not being able to close level with the driveway which allows raccoons and other
animals access into the garage . Olson stated they also experience water runoff into the garage at the
prese nt time.
Hawn co mmented the structural coverage and hardcover on this lot are already high on this property,
which makes it difficult to approve a variance. Hawn stated in order to approve the variance, the
Planning Commission needs to have a hardship demonstrated which is imposed by the land . Hawn
inquired what hardship the Applicant has.
Olson stated quite a slope does exist which causes water runoff into the garage .
Hawn inquired whether it would be possible to renovate the existing garage.
Olson stated in his view it would not be possible to renovate the existing garage due to the height of the
garage and a pole being located in the middle of the garage.
Haw:1 noted the Applicants' proposal does reduce the amount of hardcover and structural coverage on
this lot from what currently exists. Hawn inquired whether it really is a reduction if the new part of the
garage is offset against the additional amount that the Applicant has indicated he is willing to remove.
Olson stated he was told to remove as much hardcover as possible to offset the new garage.
Gaffron stated Exhibit A shows the existing lot coverage of 3,416 square feet, which does not include
portions of the deck that are illegal. With removal of a portion of the deck, the lot coverage will be
reduced to 3,280 square feet, which results in a reduction of approximately 150 square feet. Gaffron
stated the Applicants would be removing a portion of the deck that is legal.
Hawn inquired whether a drainage plan has been submitted.
Olson stated he was not aware a drainage plan was required . Olson stated in his view he does not feel
the drainage will be affected.
Lindquist stated the Applicant , as a condition of approval, will need to submit a drainage plan for
review and approval by City Staff.
Hawn inquired whether a conditional use permit would be required in connection with this project.
Weinberger stated a conditional use permit is not needed .
There were no public comments regarding this application.
Kluth stated he would like to see additional hardcover removed .

Lindquist inquired what the time period is for removal of the illegal portions of the deck.
Olson stated he was told the deck had to be removed by the end of construction or the garage addition
would not be approved .
Hawn moved, Lindquist seconded, to recommend approval of Application #01-2664, Mitch and
Kim Olson, 3265 Carman Road, granting of a variance to lot coverage and hardcover in the
75-250' setback zone, subject to all plastic and rock being removed on the property, a drainage
plan being submitted for review and approval by City Staff, the portion of the illegal deck being
removed prior to completion of the project, and with the understanding hardcover will be
limited to 288 square feet in the 0-75' setback zone and 4,501 square feet in the 75-250' setback
zone. VOTE: Ayes 5, Nays 0.
NEW BUSINESS
(2) #01-2673 GARY GERMUNDSEN, 4101 IDGHWOOD ROAD, RENEWAL OF
VARIANCES, 7:00 p.m. -7:05 p.m.
Gary Germundsen, Applicant, was present.
The Certificate of Mailing and Affidavit of Publication were noted.
Bottenberg stated the Applicant has applied to renew variances for street setback, west side setback,
east side setback, lot area and Jot width to permit the construction of a new residence to replace the
existing residence on the property. On April 22, 1996 , owners of this property were granted the
variances and were renewed on April 28, 1997.
Botten berg stated the current property owner is planning to make some revisions to the floor plan but
will be staying within the size previously approved. Bottenberg noted a suitable drainage plan will
need to be submitted for review and approval by City Staff.
City Staff is recommending approval of the renewal.
Germundsen indicated he has recently purchased this property but has resided elsewhere within the
City of Orono. Germundsen stated he has met with both adjoining property owners to discuss the
drainage situation, which is a problem along that street. Germundsen stated he intends to continue
working with the neighbors in an effort to improve drainage in this area. Germundsen indicated he
would like to start construction this year.
Hawn inquired whether it was the intention of the Applicant to stay with the same outer perimeter as
previously approved.
Germundsen said it was .
There were no public comments relating to this application.

Hollander requested the City address th e h igh speeds on County Road 6 by better enforcement.
Mayor Peterson indicated City Staff should be able to address all of Hollander's concerns .
Gary Welsh, 1214 Wildhurst Trail, indicated he is appearing at tonight's meeting in order to address
the statements by the Lines. Welsh stated the character of the neighborhood has changed very little
since the Lines have moved to this area and that in his view it is merely a matter of personal taste.
Welsh commented if the Lines are not satisfied with the appearance of the _neighborhood, they could
have purchased property elsewhere.
Welsh noted the Lines' statements that they follow the City 's Ordinances ls not totally accurate.
·welsh noted the City did grant some variances to the Lines in order for them to construct their
residence. The neighborhood did not contest these variances and welcomed the Lines to the
neighborhood.
Welsh stated in his opinion the Lines are complaining about normal lifestyles and activities that are
found throughout this diverse community. Welsh commented the residents have experienced loud
noise from some of the various gatherings put on the Lines, which they have tolerated without
complaint. Welsh stated in his opinion the taking of numerous photographs of the various
residences in the neighborhood and displaying of them in a public forum is a violation of their
privacy. Welsh stated the Lines could have undertaken some due diligence prior to purchasing their
property in order to better ascertain what the character of the neighborhood was.
Welsh commented in his view Orono is a diverse community where people of all kinds should be
able to get along.
Sansevere commented in his view it sounds like this issue may be more of a neighborhood conflict
and that really should be worked out between the local residents. Sansevere stated if there is a
violation of an ordinance , the City can become involved. Sansevere commented he is unsure what
involvement Welsh would like the Council to have in this matter.
Welsh stated in his view the Lines are attempting to get the Council involved in this matter. Welsh
stated it is his understanding none of the neighbors have been before the Council to complain about
the noise generated from the numerous parties put on by the Lines and the number of cars. Welsh
stated they are attempting to be good neighbors.
Rick Meyers, 2195 Bayview Place, indicated he was present at the Council meeting when the Lines
addressed the City Council. Meyers stated in his view both sides have some issues that should be
addressed, and that everyone needs to follow the City's ordinances. Meyers stated it is the City 's
duty to enforce the ordinances and it is the responsibility of the property owners to see that their
properties are properly maintained .
A resident of Wildhurst in dicated she was on the Lines' list of people who have been cited as being
in violation of the City's O rdinances. The resident stated for the past year she has been in
compliance with the City's Ordinances but apparently does not meet the standards of the Lines. T h e

resident inquired what action she could take in order to stop the Lines from taking photographs of
her residence and invading her privacy.
Sansevere stated there are avenues beyond the City Council that the resident could pursue.
The resident indicated she would like the City to step in and say that they may be violating their
pnvacy.
Sansevere stated in his opinion this may be a matter that the Council has little authority over and
that the local residents will have to pursue other avenues . ·
Tom Barrett, City Attorney, stated any citizen has the right to petition the Council for redress of
· their grievances if they perceive they exist. Barrett stated if they exceed the boundaries of some
other private right, then it may become a private action and the residents would need to take other
steps to protect themselves or to address their concerns.
White stated the City would become involved in situations where there are legitimate concerns that
need to be addressed.
Sansevere stated he would like to review the City's Ordinance regulating storage of boats .
Gabriel Jabbour, 985 Tonkawa Road, stated he has been a resident of Orono for 30 years and at one
time lived next door to Curt Carlson. Jabbour stated every time one of his neighbors would be
hosting a large gathering, they would notify the other residents in the neighborhood and would try to
be a good neighbor.
Jabbour stated it is opinion there is a fear among some of the residents of Orono that they are not a
part of the "elite" group in Orono and that they are being forced to change their lifestyle. Jabbour
stated he is grateful for the quality of life and the diversity that exists in Orono. Jabbour encouraged
the Council to continue to preserve that quality of life and diversity .
Mayor Peterson thanked the residents for their comments.

master bedroom/master bath/closet suite. This will be a continuation of the main floor of the existing
house . The attic will be used for additional storage space .
Bottenberg noted a small portion of the existing residence and approximately one-half of the new
addition is located lakeward of the average lakeshore setback line as drawn between the two
adjacent r-'!sidences . The adjacent residence to the north is on higher ground, and may currently
enjoy minimal views over the existing residence, which may be reduced by the second story addition .
However, the main views of the lake for that house are to the east and are not affected.
Existing mature vegetation and the ch~ge in grade already act to limit the neighbors' vie\vs , so it
is unlikely that the average lakeshore setback is a significant issue for this property. No neighbors
have indicated a problem to Staff with this application.
Botrenberg stated a hardcover variance is not required for the addition, which lies in the
250-500' setback zone . Even though the proposed hardcover in the 250-500' setback zone is
34 .3 percent of the allowed 30 percent, the Applicant has not used all of the 25 percent in the
75-250' setback zone . The City does allow credit for unused hardcover allotment to be
transferred to zones further from the lake .
Bottenberg noted this lot is a lakeshore lot and is sewered . Bottenberg indicated other improvements
have been made on this lot since 1970 , which have required different variances over the y ears.
City Staff recommends approval of the variance to the average lakeshore setback to allow the
addition to encroach 20 feet into the average lakeshore setback.
Hanson indicated he did submit a letter of hardship . Hanson stated if they would be required to move
this addition further to the west to avoid encroaching into the average lakeshore setback,
access to the existing lower level garage and auto-court would be eliminated . Hanson stated the y
would be forced to move the driveway to the west as well , which would necessitate major excavation
and construction of retaining walls , which would add to the hardcover.
There were no public comments regarding this application .
Hawn moved, Smith seconded, to recommend approval of Application #01-2665,
Y &A Architecture on behalf of Glen and Marilyn C. Nelson, 500 Tonkawa Road,
granting of a variance to the average lakeshore setback. VOTE: Ayes 5, Nays 0.

SECTION 10.03. SUBDIVISION 14 (C),
SECTION 10.22, SUBDIVISION 2, AND

WHEREAS, Mitchell D. Olson and Kimberlee M. Olson, husband and wife,
(hereinafter "the applicants") are the owners of the property located at 3265 Carman Road within the
City of Orono (hereinafter "the City") and legally described as follows:
Lot 5, Block 1, Carman Cove, Hennepin County, Minnesota (hereinafter "the
property"); and
WHEREAS, the applicants have applied to the City for variances to Municipal
Zoning Code Section 10.03, Subdivision 14 (C) to allow 3,280 s.f. (20.9%) structural lot coverage
where 3,416 s.f. (21.8%) exists and 2,352 s.f. (15%) is allowed; Section 10.22, Subdivision 2 and
Section 10 .56, Subdivision 16 (L)(2) to allow 4,501 s.f. (52.2%) hardcover in the 75-250' setback
area where 4,685 s.f. (54.4%) exists and 2,152 s.f. (25%) is allowed to permit construction of an
attached garage on the street side of the residence.
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on April 16, 2001, at which time all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota: Metro Legal Services Inc.
FINDINGS Box 491
1. This application was reviewed as Zoning File #01-2664.
2. This property is located in the LR-1B Zoning District, where 1 acre or 43,560 s .f. is
the minimum lot area. The property consists of approximately .36 acres or 15,679
s.f.

3. The Orono Planning Commission reviewed this application on April 16, 2001 and
recommended approval by a vote of 5 to 0.
4. The Planning Commission made the following findings of fact:
A . The structural coverage on the lot is decreasing from 3,416 s.f. (21.8%) to
3,280 (20.9%).
B. The hardcover in the 0-75' setback zone is decreasing from 584 s.f. (8.3%) to
288 s.f. (4.07%).
C. The hardcover in the 75-250' setback zone is decreasing from 4,685 s.f.
(54.4%) to 4,501 s.f. (52.2%).
D. The proposed reductions in hardcover and structural coverage are in addition
to the areas which were to be removed ay a prior owner under the terms of a
prior variance and which the current applicant has agreed to remove.
E. The lot is extremely undersized for LR-1B.
F. Massing is not an issue. The garage addition is on the street side of the
residence and the two adjacent properties will not be adversely affected by
the addition.
G. The residence was built prior to current zoning standards being adopted.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variances would not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and

recommendations of the Planning Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variance on the health , safety and
welfare of the community .
CONCLUSI ONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings , the Orono City Council hereby grants
variances to Municipal Zoning Code Section 10.03 , Subdivision 14 (C) to allow 3 ,280 s.f. (20.9%)
structural lot coverage where 3,416 s.f. (21.8%) exists and 2,352 s.f. (15%) is allowed ; Section
10.22 , Subdivision 2 and Section 10 .56, Subdivision 16 (L)(2) to allow 4,501 s.f. (52.2%) hardcover
in the 75-250' setback area where 4 ,685 s .f. (54.4%) exists and 2 ,152 s.f. (25%) is allowed to permit
construction of an attached garage on the street side of the residence . Approval is subject to the
following conditions:
1. Council approval is based on the site plan submitted by the applicants attached to this
r e solution as Exhibit A . Any amendments to the site plan may require further
Planning Commission and City Council review.
2. A suitable drainage plan shall be submitted by applicant and approved by City staff
prior to issuance of a building permit. All landscape fabric /plastic on the property
and decks (as shown on Exhibit A) shall be removed prior to final inspection. Upon
completion of the project the hot tub shall be located on the deck adjacent to the pool
so as not to constitute a separate item of hardcover.
3. Authorities granted by these variances run with the property not with the applicants ,
but are permissive only and must be exercised by application for a building permit
within one year of the date of Council approval, or these variances will expire on that
date (April 23, 2002).
4. Violation of or non-compliance with any of the terms and conditions of these
variances shall constitute a violation of the zoning code , shall automatically terminate
any authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read, understood and hereby agree to the terms of
this r e solution and on behalf of themselves, their heirs , successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.

W H EREAS, Mitchell D. Olson and Kimberlee M. Olson, husband and wife ,
(hereinafter "the applicants") are the owners of the property located at 3265 Carman Road within the
City of Orono (hereinafter "the City") and legally described as follows:
Lot 5 , Block 1, Carman Cove , Hennepin County, Minnesota (hereinafter "the
property"); and
WHEREAS, the applicants have applied to the City for variances to Municipal
Zoning Code Section 10.03 , Subdivision 14 (C) to allow 3,280 s.f. (20.9%) structural lot coverage
w here 3 ,416 s.f. (21.8%) exists and 2,352 s .f. (15%) is allowed; Section 10.22, Subdivision 2 and
Section 10.56 , Subdivision 16 (L)(2) to allow 4,501 s.f. (52.2%) hardcover in the 75-250' setback
area where 4 ,685 s.f. (54.4%) exists and 2 ,152 s.f. (25%) is allowed to permit construction of an
attached garage on the street side of the residence.
WHEREAS , after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes , the Orono Planning
Commission held a public hearing on April 16 , 2001, at which time all persons d esiring to be heard
concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono ,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #01-2664 .
2 . This property is located in the LR-1 B Zoning District, where 1 acre or 43,560 s.f. i s
the minimum lot area. The property consists of approximately .36 acres or 15 ,679
s.f.

3. The Orono Planning Commission reviewed this application on April 16, 2001 and
recommended approval by a vote of 5 to 0.
4. The Planning Commission made the following findings of fact:
A. The structural coverage on the lot is decreasing from 3,416 s.f. (21.8%) to
3,280 (20.9%).
B. The hardcover in the 0-75' setback zone is decreasing from 584 s.f. (8.3%) to
288 s.f. (4.07%).
C. The hardcover in the 75-250' setback zone is decreasing from 4,685 s.f.
(54.4%) to 4,501 s.f. (52.2%).
D. The proposed reductions in hardcover and structural coverage are in addition
to the areas which were to be removed ay a prior owner under the terms of a
prior variance and which the current applicant has agreed to remove.
E . The lot is extremely undersized for LR-1B.
F . Massing is not an issue. The garage addition is on the street side of the
residence and the two adjacent properties will not be adversely affected by
the addition.
G . The residence was built prior to current zoning standards being adopted.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variances would not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants ;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City .
6 . The City Council has considered this application including the findings and

recommendations of the Planning Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variance on the health , safety and
welfare of the community.
CONCLUSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants
variances to Municipal Zoning Code Section 10.03 , Subdivision 14 (C) to allow 3 ,280 s.f. (20 .9%)
structural lot coverage where 3,416 s.f. (21.8%) exists and 2,352 s.f. (15%) is allowed; Section
10 .22, Subdivision 2 and Section 10.56, Subdivision 16 (L)(2) to allow 4,501 s .f. (52.2%) hardcover
in the 75-250' setback area where 4 ,685 s.f. (54.4%) exists and 2,152 s.f. (25%) is allowed to permit
construction of an attached garage on the street side of the residence. Approval is subject to the
following conditions:
1. Council approval is based on the site plan submitted by the applicants attached to this
resolution as Exhibit A. Any amendments to the site plan may require further
Planning Commission and City Council review .
2 . A suitable drainage plan shall be submitted by applicant and approved by City staff
prior to issuance of a building permit. All landscape fabric/plastic on the property
and decks ( as shown on Exhibit A) shall be removed prior to final inspection . Upon
completion of the project the hot tub shall be located on the deck adjacent to the pool
so as not to constitute a separate item of hardcover.
3 . Authorities granted by these variances run with the property not with the applicants ,
but are permissive only and must be exercised by application for a building permit
within one year of the date of Council approval, or these variances will expire on that
date (April 23 , 2002).
4. Violation of or non-compliance with any of the terms and conditions of these
variances shall constitute a violation of the zoning code, shall automatically terminate
any authority granted herein , and shall be punishable as a misdemeanor.
5. The undersigned applicants have read , understood and hereby agree to the terms of
this resolution and on behalf of themselves , their heirs , successors and assigns ,
hereby agree to the recording of this resolution in the Chain of Title of the property.

To allow 4,501 s.f. (52.2%) of hardcover in the 75-250' lakeshore setback, where 4,685 s.f. (54.4%)
exists, and 2,152 s.f. (25%) is allowed.
Application Summary: The applicants asked that their application be tabled at the March 19,
2001 Planning Commission meeting. This will be the first time the Planning Commission has
reviewed this application.
The applicants are proposing to construct a 360 s.f. [(31' x 12') -12 s.f.] attached garage on the street
side of the residence . As a result of discussions with staff, the proposal in front of the Planning
Commission is significantly smaller than what was originally submitted. The garage depth has been
reduced from the initial submittal and as revised will be located approximately 36' from the front

property line where 35' is required, so a setback variance is no longer needed. Lot coverage and
hardcover variances are requested, although each currently exceeds the standards and shows a slight
reduction from existing levels.
Hardcover
The garage addition is located in the 75-250' setback zone. Hardcover in the 75-250' setback
zone is currently 4,685 s.f. or 54.4 % ( excluding nonconforming rock/plastic which must be
removed). The applicants are proposing to remove a large portion of the deck on the lake side of
the residence in order to reduce hardcover and structure , and will also be rearranging driveway
and sidewalk hardcover. After proposed removals, hardcover in the 75-250' setback zone will be
4,501 s.f. or 52.2 %.
Hardcover in the 0-75' zone is also decreasing via removal of deck portions as well as a stairway
and some retaining wall sections. Existing legal 0-75' hardcover is 584 s.f. or 8.3 %. Proposed 0-

The structural coverage currently on the lot is 3,416 s .f. or 21.8 %. The garage addition and
removal of a portion of the decks will result in structural coverage of 3,280 s.f. or 20.9 %. Of
this amount, 12.8% is the existing house and garage addition, while 8.1 % is deck and pool
structure which are structure by definition due to their heights above grade, a result of the slope
of the site.
Prior Applications
Three prior owners of this property have made previous zoning applications for the site. This
property was granted a variance in 1978 to allow the pool to be constructed 3' from the side lot
line. The property was again the subject of a variance request in 1985-86, this time for after-the-
fact decks. The owner constructed decks around the pool area and along the lake side of the
house without permits. The result of that variance approval was a requirement to remove
portions of the new decks, while certain segments of deck were considered as non-hardcover due
to height above ground, board spacing and permeable grass below ( a quirk in Orono's hardcover
policies that lasted only for a year or two in the mid-1980s). A third application was approved in
1997 for a CUP to reconstruct retaining walls in the 0-75' zone.
The current survey when compared to the approved 1985 deck plan shows that the required deck
removals were apparently never completed by the then property owner, although the decks were
inspected in 1986 . The current owners will be removing the unapproved portions of deck as well
as additional portions, as part of the current request. Note that the deck segments approved as
non-hardcover in 1985 are considered as hardcover under current code, and have been included
in the hardcover calculations.

Statement of Hardship:
The applicants have included their statement of hardship in Exhibit B. The applicants should
also be asked for their testimony regarding this issue.
Issues for Consideration:
1. Massing is not an issue in this proposal in staffs opinion. The garage addition is on the
street side of the residence and the two adjacent properties will not be adversely affected by the
addition.
2. The lot is undersized for the LR-1 B zoning district.
3. The residence was built well before current zoning standards were adopted.
4. The applicant is proposing to remove structure on the lakeside of the property reducing
hardcover in the 0-75' and a portion of the driveway reducing the hardcover in the 75-250'
setback area .
5. Can the applicant confirm that the portions ofretaining walls to be removed are not necessary
for drainage or erosion control on the site?
6. Does the Planning Commission have additional issues or concerns with this proposal?
Staff Recommendation:
The applicants have made a good faith effort to reduce the size of the garage addition and bring
the decks into conformity with the prior approvals. Although hardcover and lot coverage still
will greatly exceed City standards , the applicants' proposal does result in slight reductions of
hardcover and lot coverage when compared to the legally existing levels. Planning Commission
must determine whether the proposed reductions are adequate and appropriate given the stated
hardships and the nature of the site.
Options for Action:
1. Recommend approval of hardcover and lot coverage variances for the garage addition with
removals as proposed .
2. Recommend denial of variances.
3 . Table for further review or further specific information, advising the applicant what other
possible revisions will make the application acceptable.

PER MUNICIPAL ZONING CODE
SECTION 10.03, SUBDIVISION 19 AND

WHEREAS, Raymond J. Kosak (hereinafter "the applicant") is
the owner of the property located at 3265 Carman Road within the City
of Orono (hereinafter "City") and legally described as Lot 5, Block 1,
Carman Cove, {hereinafter "property"); and
WHEREAS, the applicant has made application to the City of
Orono per Section 10.03, Subdivision 19 and Section 10.55, Subdivision
8 to permit installation of a new retaining wall and replacement of an
existing wall located within the 75 foot lakeshore protected area and
per Section 10.21, Subdivision 1 and 2 to seek variances for spaced
wooden deck areas located 65 feet from the lakeshore instead of the
required 75 feet, hardcover variances within the 0-75' setback area of
315 s.f. where none is allowed and within the 75-250' setback area of
3,583 s.f. or 28% hardcover where only 25% is allowed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #1053.
2. The property is located in the LR-lB Lakeshore Residential
Zoning District.
3. The property is approximately 19,985 s.f. or .45 acre in
area.
4. The Orono Planning Commission reviewed this application on
July 21, 1986, and recommended approval of the conditional use
permit and variance for the installation of a retaining wall and
replacement of an existing wall based on the following findings:
A) steep slopes within lakeshore yard require retaining
wall to stabilize bank and prevent erosion;
B) current slopes prevent maintenance of green grassed
area;

C) decrease in hardcover of 1% with type of retention wall
to be constructed;
and to approve variances to the hardcover and setback standards
for lakeshore properties based on the following findings and
hardships:
A) steep sloping topography immediately adjacent to house
requires flat area for safe utilization of pool and rear
yard -access to lake requires series of access stairs over
steep sloped areas;
B) adjacent yards do not have steep slopes as those found
in the applicant's lakeshore yard;
C) the improvements create no view barrier nor do they pose
hazards for neighboring properties;
D) the improvement does not alter the character of the
neighborhood and would appear the improvements are similar
to the improvements within other lakeshore properties with
steep sloped lake yards;
E) the proposed improvements will have a positive effect on
the surrounding property values;
F) the location of the 75 foot setback line in relation to
rear of house;
G) the visual impact of structures within 75 foot setback
area is lessened, for property is located on a lagoon and
not visible from main lake.
5. The City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally to other
property in this zoning district; that granting the variances
would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring properties;
would not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the appli-
cant; and would be in keeping with the spirit and intent of the
Zoning Code and Comprehensive Plan of the City.

6. The City Council finds that granting a conditional use permit
to allow the installation of retaining walls in applicant's
lakeshore yard will not be detrimental to the health, safety or
general welfare of the public, would not adversely affect light,
air nor pose a fire hazard or other danger to neighboring
properties , nor will it depreciate surrounding property values
and that the proposed level of use of the property will be in
keeping with the intent and objectives of the Zoning Code and
Comprehensive Plan of the City.
CONCLUSIONS , ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City
Council hereby grants variances to Municipal Zoning Code Sections
10 .21, Subdivision 1 and 2, and Section 10.55, Subdivision 8 to allow
spaced wooden decking and retaining wa 11 s within the lakeshore
protected area where no structures, hardcover or land alterations are
permitted and grants a conditional use permit per Section 10.03,
Subdivision 19 to permit the installation of retaining walls within
applicant's lakeshore yard subject to the following conditions:
1 . Ground areas under approved decking must remain pervious to
runoff. Any changes proposed in these areas must be approved by
the Orono staff to assure the improvement will not inhibit
penetration and treatment of runoff .
2 . Erosion control must be installed at the time the lakeshore
retaining walls are installed. Orono staff to inspect prior to
land alterations.
3. The maximum hardcover on the property sha 11 be as f o 11 ows:
0-75' setback zone= 315 s .f. or 4.3%
75-250' setback zone= 3,583 s.f. or 28%
4. The applicant is advised that no additional hardcover above
these limits will be approved, and any future proposals for
additional hardcover might be approved only with concurrent
removals of existing hardcover.
5. Authorities granted by this resolution run with the property
not with the applicant, but are permissive only and must be
exercised by application for a building permit within one year of
the date of Council approval, or the special conditions of this
resolution will expire on that date (August 11, 1987).

6. Violation of or non-compliance with any of the terms and
conditions of this resolution shall constitute a violation of the
zoning code, shall automatically terminate any authority granted
herein, and shall be punishable as a misdemeanor.
7. The undersigned applicant has read, understood and hereby
agrees to the terms of this resolution and on behalf of himself,
his heirs, successors and assigns, hereby agrees to the recording
of this resolution in the chain of title of the property.
