State law provides that Cities shall make decisions on zoning requests within 60 days
from the date of application, and that this review period may be extended by notification
to the applicant. Your application was received on October 19 and was considered to be
complete on November 1, and the 60-day review period would end on January 1, 2005.
However, due to scheduling the earliest potential date of final Council action for your
application falls after the 60-day period expiration . Therefore, the 60-day review period
is hereby extended cm additional 60 days to March 1, 2005.

White moved, Sansevere seconded, to adopt RESOLUTION NO. 5274, a Resolution Granting
Hardcover and Structural Coverage Variances for Mark and Bonnie Hector, 3265 Carman Road.

MAYOR/COUNCIL REPORT
McMillan suggested the City have a process in place where a letter signed by the mayor and council
members is sent to a resident that donates something to the City.
Peterson stated the Long Lake Fire Department and Orono Police Department did a great job on handling
the fire at her neighbor's residence.

Essen stated the upper deck would probably not be used for parties, but that in his view twisting the house
has now given the applicant a clear view to his residence.
White inquired whether the house could be rotated slightly.
Vogstrom stated he would prefer to look at the lake and not his neighbor's house and that he will attempt
to re-orient the house slightly to help preserve his neighbor's privacy. Vogstrom stated he did locate the
garage on that lot to take advantage of the best view of the lake. Vogstrom indicated he also would like to
preserve his privacy.
White inquired how far off the lot line the Essen residence is located.
Jeff Essen stated their house is located approximately 20 or 25 feet from the property line. Essen stated
he also has been in favor of a variance on the hardcover, but the fact that the house is proposed 15 feet
closer to his property line and is larger than the cunent structure is the basis for his concerns regarding
runoff.
McMillan inquired whether the City has received a grading plan on this project.
Gaffron stated the City has not received anything that could be considered a final grading plan and that it
would be required at the time the building permit is applied for. Gaffron indicated the Council could
require specific items relating to drainage.
Vogstrom stated he did agree to the downspouts and gutters and that Essen has agreed to replace the
shrubs and bushes in between the two homes to help with the privacy. Vogstrom indicated he would not
be opposed to those two items being included in the development agreement.
White moved to direct Staff to prepare a resolution to accept the current revised plan submitted as
part of Application #04-3052, 2618 Casco Point Road, and to bring the resolution back for approval
on January 24, 2005, with the inclusion of a requirement for the installation of down spouts and
grading plan.
Moorse recommended at the time the Council approves the resolution on the 24 1
\ a signed agreement
should be in place for the tree replacement.
White amended his motion to include the condition that a signed agreement be submitted

Mrs. Ingvalson indicated the driveway was there when they purchased the property. Ingvalson noted
they do have five children and that there is not room for eleven cars.
Jurgens indicated he was including two stalls in the garage and that he personally would like to see the
driveway reduced somewhat.
Bremer noted the applicant has agreed to reduce an additional 86 feet of hardcover. Bremer pointed out
this amount of hardcover is typical for this neighborhood .
Jurgens stated residents of this neighborhood are fighting water problems and water runoff, which is
attributed to hardcover and that the residents need to reduce hardcover wherever possible.
Mr. Ingvalson stated the hardcover on the lot was pre-existing.
Bremer moved, Leslie seconded, to recommend approval of Application #04-3064, Douglas &
Deborah Ingvalson, 3460 Birch Lane, granting of a harclcover variance, with the stipulation that
the 656 square feet of plastic be removed as well as 86 square feet in concrete pads be removed
along both of the garages. VOTE: Ayes 6, Nays 1, Jurgens opposed.
Jurgens indicated he would like to see further reductions in hardcover.

Curtis stated the applicants are requesting a structural coverage variance and hardcover variances in the 0-
75' zone and 75'-250' zone in order to rebuild and reconfigure a lakeside deck on the existing home.
Curtis indicated the structural coverage variance is being requested to increase structural coverage by 194
square feet above the amount approved as part of a variance granted in 2001 for a total of 3,474 square
feet or 22.1 percent structural coverage. The amount approved in 2001 was 3,280 square feet or 20.9
percent. Hardcover variances are also being requested for 6.7 percent within the 0-75' setback and
55.5 percent within the 75'-250'. Existing hardcover within the 0-75' zone is at 4.07 percent and 55.2
percent in the 75'-250', both of which were previously approved in 2001.
Curtis indicated following discussions with Staff the applicants have submitted a revised proposal with
alterations and a slight reduction to their initial request. Curtis stated the applicants are willing to
reconfigure their plan slightly in order to not exceed the levels approved in 2001.

approved, why it is necessary for the Planning C01mnission to vote on this item.
Curtis indicated the applicants are rebuilding the entire deck.

Curtis stated the applicants are requesting a side setback variance in order to reorient the roof of the house
and the garage within the 10' side setback and are also requesting a lake setback variance in order to add a
second story over a pmtion of the existing home within 7 5' of the ordinary high water level. Curtis noted
although the applicants are not requesting hardcover variances, they are proposing some reductions in
hardcover as part of this application.
Staff recommends approval of the side setback and the lake setback variances as requested in conjunction
with the removal of hardcover within the 0-75' and 75'-250' setback zones as the Planning C01mnission
deems appropriate. Staff finds there is a hardship given the location of the existing home and garage with
respect to the 10' side and 75' lake setbacks . Curtis noted the existing home at one time did meet the 75'
lake setback requirement prior to some erosion that has occtUTed on the prope1ty.
Rouse had nothing to add to Staffs report.
Rahn called for public comments.
There were no public coinments regarding this application.
Leslie inquired what the value of the improvements is relative to the value of the house.' Leslie
questioned whether this should be considered a rebuild or new construction.
Curtis indicated she does not know the value of the improvements and that Staff is viewing it as a
remodel and addition.
Rouse stated they are adding up above the east side of the house and basically taking a one-story rambler
and making it a story and a half cape cod. Rouse indicated two bedrooms would be constructed above the
east side, with the roofline being changed to meet the upper story.
Fritzler inquired whether there is presently a room upstairs.
Rouse indicated there is not.
Fritzler inquired whether the first floor ceilings are being raised as part of this project.
Rouse indicated a portion of the ceiling on the first floor is being raised to ten feet and pait of it is
re maining at eight foot.
Rahn inquired where the eight-foot walls are located.

Application Summary: The applicants have proposed to rebuild and reconfigure an existing lake
side deck which contains a swimming pool. The applicants have proposed to rebuild and reconfigure
the deck within the existing hardcover and structural coverage levels.
In 2001 variances were granted for structural coverage and hardcover. The actual square footage
numbers approved in 2001 do not match up with the numbers from the most recent survey. However,
staff has determined via site inspection that the areas of removal required in 2001 sufficiently match
the existing site conditions. Therefore, in order for the applicants to rebuild and reconfigure their
lakeside deck they require a structural coverage variance and hardcover variances within both the 0-
75' setback and 75'-250' setback zones. The current proposal results in no net hardcover increase.

WHEREAS, David Mark Hector and Bonnie Kay Bohn Hector, husband
and wife (hereinafter "the applicants") are the owners of the property located at 3265
Carman Road within the City of Orono (hereinafter the "City") and legally described as
follows:
Lot 1, Block 5, Carman Cove, Hennepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicant has made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-330 Subdivision B to allow a
lakeside deck to be rebuilt at the current setback within the side yard where a O' setback
exists and a 1 O' setback is required; and
WHEREAS, the applicant has made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1288 Subdivision A and B to
allow 6.7% hardcover within the 0-75' setback where 5.83% currently exists and where
0% is normally allowed and 55.5% hardcover within the 75'-250' setback where 54.68%
currently exists and 25% is normally allowed in order to rebuild and reconfigure an
existing lake side deck; and
WHEREAS, the applicant has made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1403 to allow structural coverage
in excess of 15% in conjunction with a rebuild of an existing lake side deck.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #04-3065.

2. The property is located in the LR-1B, One Family Lakeshore Residential
Zoning District which requires a minimum lot area of one acre and a
minimum lot width of 140'.
3. The Planning Commission reviewed this application at a public hearing
held on November 15, 2004 and recommended approval of variances
based on the following findings:
a. The property contains 15,679 s.f. or 0.36 acre in area and has 95' in
width.
b. The property was granted variances in 2001 for structural coverage
and hardcover by Resolution No. 4644.
c. The proposed rebuild and reconfiguration of the lake side deck will not
result in a net increase in structural coverage or hardcover within the
0-75' or 75'-250' setback zones from those levels approved in 2001.
d. The 2001 structure and hardcover removals resulted in an orientation
of the deck which did not allow for safe staging in the pool area.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to neighboring
property; would not merely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants a variance to Orono Municipal Zoning Code Section 78-330 Subdivision B,
Section 78-1288 Subdivisions A and B, and Section 78-1403 to allow the reconstruction
and reorientation of the existing lake side deck, subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibit A. Any
amendments to the site plan which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardcover in the 0-75' zone shall not increase above the level of 5.83% or 412
s.f.. Hardcover in the 75-250' zone shall be limited to 4,708 s.f. or 54.68% per
the proposed plan and hardcover allowance summary as depicted on Exhibit A .
Applicants are advised that any future requests to increase hardcover or change
the nature of existing/approved hardcover shall require City approval, and
increases in hardcover will not likely be approved without concurrent reduction in
existing hardcover.
3. Applicants shall remove all plastic or fabric liner material from the decor~tive
landscape beds on the property to ensure their permeability as non-hardcover
surfaces.
4. Required removals of structure and hardcover shall be completed by the footing
inspection.
5. Authorities granted by this resolution run with the property not with the
applicants, but are permissive only and must be exercised by obtaining a building
permit for the new construction within one year of the date of Council approval,
or the variance will expire on that date (January 10 , 2006).
6. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code , shall automatically
terminate any authority granted herein , and shall be punishable as a misdemeanor.

of this resolution and on behalf of the applicants and the applicants' heirs,

During the review staff was unable to replicate the exact hardcover and lot coverage
levels as were approved in 2001 . Staff was able to verify however, that the structural
reductions which were required with the 2001 approval were completed, as were the
hardcover reductions with the exception of the plastic liner under the rock and landscape
beds . If the liners were removed , they have since reappeared. Therefore , the numbers
used for this current variance request are the result of the most recent survey and
hardcover analysis as updated on October 19 , 2004.
Structural Coverage Variance
In 2001 , a structural coverage variance was granted in order to construct an addition in
conjunction with significant removals from the lakeside deck. The applicants are
requesting to increase the structural coverage level 194 s.f. above that which was
approved in 2001.
Hardcover Variance
In 2001 , variances were granted to allow hardcover within the 0-75' zone and 75' -250 '
zone to exceed the allowed levels. The applicants are requesting variances to exceed the
previously approved limits by 282 s.f. in conjunction with the rebuild and reorientation of
their lakeside deck. The plastic liner in the rock landscape areas was to be removed as
part of the 2001 variance approval. It appears from the most recent survey that the plastic
is still there or has returned.
Hardship StateIDent
Applicant has completed the Hardship Documentation Form attached as Exhibit B , and
should be asked for additional testimony regarding the application.
Hardship Analysis
In considering applications for variance, the Planning Commission shall consider the effect of the
proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in
the surrounding area. The Planning Commission shall consider recommending approval for variances
from the literal provisions of the Zoning Code in instances where their strict enforcement would cause
undue hardship because of circumstances unique to the individual property under consideration, and
shall recommend approval only when it is demonstrated that such actions will be in keeping with the
spirit and intent of the Orono Zoning Code.
Staff finds that there is no hardship by which to grant hardcover variances in excess of
the 2001 approval. Additionally, there is no hardship for increasing the already excessive
level of structural coverage on the property. The deck and pool could be rearranged to
utilize the previously approved hardcover and structural coverage levels .

Staff has received a faxed proposal for hardcover and structural reductions from the
applicant, at the time of this report staff has not had the opportunity to provide the
Planning Commission with a detailed numerical analysis of this revised plan, but one will
be provided at Monday's meeting.

This form is a required submittal for ALL variance applications. An application
wil l not be considered complete or placed on any meet ing agendas until this form is
complete and submitted to the City .
Minnesota State Statue Section 394.27 , Subdivision 7 requires that a hardship be
demonstrated in order for a variance to be granted . The hardship must be unique to the
property as variances run with the land and not the land owner. Personal and economic
situations are not considered valid hardships. In order for an application to be heard by
the Planning Commission and City Council a hardship having merit must be
demonstrated .
HOW DO I PROVE A HARDSHIP?
This form has 12 points outlining the basis City staff uses to determine if a hardship
exists and how the variance will affect the surrounding community . To prove a hardship ,
address all the relevant paints listed below and answer them as clearly as possible.
Since you are requesting the code exception, you have the burden of proving that the
variance is justified . The information the City receives is what is used in determining a
denial or approval recommendation . If you leave something out it will not be considered .

(hereinafter "the applicants") are the owners of the property located at 3265 Carman Road within the
City cf Orono (hereinafter "the City") and legally described as follows:
Lot 5 , Block 1, Carman Cove, Hennepin County, Minnesota (hereinafter "the
property"); and
'WHEREAS , the applicants have applied to the City for variances to Municipal
Zoning Code Section 10 .03, Subdivision 14 (C) to allow 3,280 s.f. (20.9~/o) structural lot coverage

The Orono Planning Commission reviewed this application on April 16, 2001 and
recommended approval by a vote of 5 to 0.
4. The Planning Commission made the following findings of fact:
A The structural coverage on the lot is decreasing from 3,416 s.f. (21.8%) to
3,280 (20.9%).
B. The hardcover in the 0-75 ' setback zone is decreasing from 584 s.f. (8.3%) to
288 s.f. (4.07%).
C. The hardcover in the 75-250' setback zone is decreasing from 4,685 s.f.
(54.4%) to 4,501 s.f. (52.2%).
D. The proposed reductions in hardcover and structural coverage are in addition
to the areas which were to be removed ay a prior owner under the terms of a
prior variance and which the cunent applicant has agreed to remove.
E. The lot is extremely undersized for LR-lB.
F. Massing is not an issue. The garage addition is on the street side of the
residence and the two adjacent properties will not be adversely affected by
the addition.
G. The residence was built prior to ctment zoning standards being adopted.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variances would not adversely affect traffic conditions, light, air, nor pose a fire

convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.

CONCLUSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings , the Orono City Council hereby grants
variances to Municipal Zoning Code Section 10.03, Subdivision 14 (C) to allow 3 ,280 s .f. (20 .9%)
structural lot coverage where 3,416 s.f. (21.8%) exists and 2,352 s.f. (15%) is allowed; Section
10.22, Subdivision2 and Section 10.56, Subdivision 16 (1)(2) to allow4,501 s.f. (52.2%) hardcover
in the 75-250' setback area where 4,685 s.f. (54.4%) exists and 2 ,152 s.f. (25%) is allowed to permit
co.!1struction of an attached garage on the street side of the residence. Approval is subject to the
following conditions :
1. Council approval is based on the site plan submitted by the applicants attached to this
resolution as Exhibit A. Any amendments to the site plan may require further
Planning Commission and City Council review.
2. A suitable drainage plan shall be submitted by applicant and approved by City staff
prior to issuance of a building permit. All landscape fabric /plastic on the property
and decks (as shown on Exhibit A) shall be removed prior to final inspection. Upon
completion of the project the hot tub shall be located on the deck adjacent to the pool
so as not to constitute a separate item of hardcover.
3. Authorities granted by these variances run with the property not with the applicants ,
but are permissive only and must be exercised by application for a building permit
within one year of the date of Council approval, or these variances will expire on that
date (April 23, 2002).
4. Violation of or non-compliance with any of the tem1s and conditions of these
variances shall constitute a violation of the zoning code, shall automatically terminate
any authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read, understood and hereby agree to the terms of
this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.

HARDSHIP DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application
will not be considered complete or placed on any meeting agendas until this form is
complete and submitted to the City.
Minnesota State Statue Section 394.27 , Subdivision 7 requires that a hardship be
demonstrated in order for a variance to be granted . The hardship must be unique to the
property as variances run with the land and not the land owner. Personal and economic
situations are not considered valid hardships. In order for an application to be heard by
the Planning Commission and City Council a hardship having merit must be
demonstrated.
HOW DO I PROVE A HARDSHIP?
This form has 12 points outlining the basis City staff uses to determine if a hardship
exists and how the variance will affect the surrounding community. To prove a hardship,
address all the relevant points listed below and answer them as clearly as possible .
Since you are requesting the code exception, you have the burden of proving that the
variance is justified. The information the City receives is what is used in determining a
denial or approval recommendation . If you leave something out it will not be considered .

Sec.13 .04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or to
be stored shall be as set forth in this section. ·
Subd . 2. Information required to be given individual. An individual asked to supply
private or confidential data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system ; (b) whether he may refuse or is legally required to supply the requested data;
(c) any known consequence arising from his supplying or refusing to supply private or
confidential data; and (d) the identity of other persons or entities authorized by state or federal
law to receive the data . This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13 .82 , subdivision 5, to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision in the
individual income tax or property tax refund instructions instead of on those forms .
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored data on individuals, and whether
it is classified as public, private or confidential. Upon his further request, an individual who is
the subject of stored private or public data on individuals shall be shown the data without any
charge to him and, if he desires, shall be informed of the content and meaning of that data.
After an individual has been shown the private data and informed of its meaning, the data need
not be disclosed to him for six months thereafter unless a dispute or action pursuant to this
section is pending or additional data on the individual has been collected or created . The
responsible authority shall provide copies of the private or public data upon request by the
individual subject of the data . The responsible authority may require the requesting person to
pay the actual costs of making, certifying, and compiling the copies .
The responsible authority shall comply immediately, if possible, with any request made
pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays ,
Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request within that time, he shall so inform the individual, and may have an additional five
days within which to comply with the request , excluding Saturdays, Sundays and legal holidays .
Subd . 4. Procedure when data is not accurate or complete. An individual may
contest the accuracy or completeness of public or private data concerning himself. To exercise
th is right , an individual shall notify in writing the responsible authority describing the nature of
the disagreement. The responsible authority shall within 30 days either: (a) correct the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individual; or (b) notify the individual that he
believes the data to be correct. Data in dispute shall be disclosed only if the individual's
statement of disagreement is included with the disclosed data .
The determination of the responsible authority may be appealed pursuant to the provisions of
the administrative procedure act relating to contested cases.
