MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, August 28, 2006 7:00 o'clock p.m. (#06-3220 Jule and Elizabeth Hannaford, Continued) Murphy commented in his view the trade-off for the reduction in the hardcover is a good situation . Murphy moved, White seconded, Application #06-3220, Jule and Elizabeth Hannaford, 1220 Bracketts Point Road, to direct Staff to draft a resolution allowing the new deck to stay within the footprint of the existing deck, but to allow the steps to encroach around the edge of the deck as shown in the applicants' plan, with the hardcover being reduced as proposed by the Applicants. VOTE: Ayes 4, Nays 1, Peterson Opposed. Peterson indicated she was opposed to the motion given the lack of a hardship for the further encroachment into the 0-75 foot area. *13. #06-3222 MICHAEL J. MAYOR/COUNCIL REPORT Sansevere inquired whether the City has received anything on the reimbursement of the local police department expenses incuned in connection with a fundraiser relating to President Bush's visit. Moorse stated a letter has been sent indicating that a special event permit should have been obtained and that the City's out-of-pocket costs should be reimbursed. Moorse stated they have not received a response . Sansevere suggested that the Long Lake firefighters be invited to attend a joint meeting of the Orono and Long Lake City Councils . This application was reviewed as Zoning File #06-3222. 2. The City has no utilities in these easements and does not need them for drainage. 3. Letters have been received from CenterPoint Energy (gas), Xcel Energy (electricity), Qwest Communications (telephone) and Mediacom (cable) stating they have no objection to the vacation. 4. The easements proposed to be vacated were intended to provide for drainage and utilities for a house on each lot and are unnecessary because there will be only one house on the two lots. CONCLUSIONS, ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVED, that based upon the findings noted above, the City Council of the City of Orono hereby vacates the drainage and utility easements described as follows: The east five feet of Lot 1 Block 1 Lehman Lagoon, Hennepin County, Minnesota except the north 10 feet and the south 5 feet thereof. and The wast five feet of Lot 2 Block 1 Lehman Lagoon, Hennepin County, Minnesota except the north 10 feet and the south 5 feet thereof. subject to Lots 1 and 2 being legally combined. Pertinent Zoning Ordinance Sections Sec. 78-9. Vacation of streets, alleys and public grounds. Vacation of streets, alleys and public grounds shall follow the procedures set forth in this chapter; except that such vacation shall require a petition by a majority of the landowners abutting the property to be vacated, and a hearing preceded by two weeks' published and posted notice, all as required by Minn. Stat. § 412.851. The house was constructed on one lot; the second was acquired later. The applicant proposes to construct two additions to the house. The house would no longer satisfy the setback requirements so the two lots would need to be legally combined. The addition would also encroach into the drainage easements that are five feet on each side of the common lot line so they need to be vacated. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required · to supply the requested data; (c) any known consequence arising from his supplying or refusing to supply private or confidential data; and ·(d) the identity of other persons or entities authorized by state or federal law to receive the data.
