Murphy i 1cated his concern regarding the absence of the applicant and /or a represen ive is that it may create me issues with this application in the future. 4. #09-3402 PIDLIP F. KALEY, 1395 BROWN ROAD SOUTH -VARIANCES Philip Kaley , Applicant, was present. Turner stated the applicant is requesting setback variances to construct a detached garage four feet from the north property line when a 15-foot setback is required and two feet from the property line adjacent to Arbor Street when a 30-foot setback is required as well as a variance to have 15.89 percent structural coverage when the maximum allowed is 15 percent. The Planning Commission voted 7 to O to recommend: 1. Denial of the structural coverage variance , limiting structural coverage to 15 percent. The garage could be no larger than 750 square feet according to the current calculations . 2. Approval of setback variances to allow a 25-foot deep by 30-foot wide garage placed so the south wall of the garage is in line with the north wall of the house ( approximately 5. 8 feet from the north property line) and so the southeast comer of the garage is 10 feet from the house and approximately eight feet from the right-of-way of Arbor Street. KALEY, 1395 BROWN ROAD SOUTH, Continued) The applicant is proposing the pitch of the detached garage roof be similar to the pitch of the house roof. Staff recommends denial of the structural coverage variance and approval of the setback variances. Murphy asked if the applicant agrees with the new numbers. Kaley indicated he does not. Kaley stated by relocating the garage , one of the corners of the garage would be on top of a retaining wall. The house is approximately three feet below the elevation of the street. The second issue is that his sewer line would also be within approximately 1.5 feet of the garage . Kaley indicated he would be fine with a 30-foot garage and that his neighbor does not have an objection to the garage being placed closer to the property line. In addition, the 25-foot garage would not comfortably accommodate a pickup truck. Kaley pointed out the location of some mature trees on the lot, which prevents the garage from being located in a different spot. By locating the garage in this spot, it would require a significant amount of fill. Bremer asked what size garage the applicant would like to have . Kaley stated a 26' x 30' garage would be the bare minimum. Bremer asked where he would like the garage to be located. Kaley stated he would like five feet on the north side and four feet on the Arbor Street side between the wall and the right-of-way , which would prevent some extensive work on the retaining wall. Bremer asked how big the retaining wall is. Kaley stated it is approximately three feet high . McMillan noted in order to extend the garage further east, additional fill would need to be brought in. Kaley stated that would be correct and that the retaining wall would need to be extended. Turner pointed out that due to the closeness of the retaining wall , the garage footings would need to be frost footings. Murphy stated it was his understanding the building official stated that 25 square feet is the maximum for a floating slab. Turner stated the entire perimeter would require frost footings even with a floating slab. Murphy asked if the plan is to construct the garage at street grade or at house grade. KALE~ 1395 BROJt-7\T ROAD SOUTl1, Continued) Kaley stated the garage would be at the elevation of Arbor Street and that he plans to reduce the slope on the east side down to be at the same elevation as Arbor Street. Kaley stated it is his intention to reduce the bulk of the garage as much as possible. McMillan asked what size garage the applicant would like to construct. McMillan noted the Planning Commission approved 750 square feet , which does not necessarily mean the garage has to be 25 ' x 30 '. Kaley indicated a 26' x 40 ' square foot garage would be 830 square feet. Murphy commented this garage would be an improvement over what currently exists and compliment the house. Murphy stated he has a concern with the garage on the Arbor Street side and the impact it would have on the adjoining property. Murphy asked what size garage 830 square feet would allow. Turner stated a 26' x 30' garage would consist of780 square feet. White commented this neighborhood is a fairly quiet neighborhood. Bremer stated she is okay with 780 square feet, but that she would like to have the exact location of the garage determined. Turner stated Staff would like the Council to define the size of the garage and that the applicant should go back to his surveyor, have the garage depicted on the survey , along with the retaining wall and the side setbacks . Bremer indicated she would prefer the garage be located closer to the right-of-way on the Arbor Street side. Turner asked if it should be located closer to the sewer line. Murphy stated it was his understanding the Council wanted to give some additional leeway between the sewer line and the garage. Turner stated the garage should be located five feet off the north property line, no bigger than 26 ' x 30 ', and slab on grade if approved by the building inspector. KALEY, 1395 BROWN ROAD SOUTH, VARIANCES, 7:14 P.M. - 7:50 P.M. Philip Kaley , Applicant, Was present . Turner stated the applicant is requesting setback variances to allow construction of a detached garage located four feet from the north property line when a 15-foot setback is required and two feet from the property line adjacent to Arbor Street when a 50-foot setback is required. Currently there is no garage located on the property. A variance is also requested to allow for 15.89 percent structural coverage when the maximum is 15 percent. The applicant is proposing to replace the deteriorated shed with a new 32-foot wide by 28-foot deep garage. The proposed garage would be placed in the same general location as the shed. A survey of the property shows that it is smaller than shown on the plat. The application was made based on the size of the lot as platted. Staffs initial review of the application was done with the lot size reduced by 1,600 square feet and the garage size was reduced by 64 square feet. The final survey reduced the size of the lot by an additional 800 square feet but changed the garage to the size originally proposed. Based on the final survey, the garage exceeds structural coverage by 146 square feet. Turner requested the Planning Commission discuss the following issues: 1. Would driveway access from Brown Road or North Shore Drive be advantageous in any way? Both are county roads. When a property has frontage on both a county road and a local street, County policies call for driveway access to be from the local street. Maintaining access from Arbor Street would be consistent with the City 's policies. 2. Is the lack of a garage a hardship? This zoning district requires a 2-acre minimum and the lot consists of0 .37 acres. Regardless of its location , a setback variance would be required for the garage. 3. Is the location proposed compatible with the surrounding area? The proposed garage would be eight feet closer to the street than the existing shed . 4. Would a location south of the house be more compatible with the surrounding area? This would not eliminate the need for setback variances from Arbor Street and Brown Road. It would eliminate the need for setback variance from the north property line and from the house . 5. Can the size of the garage be reduced without causing a hardship? The proposed garage is 896 square feet. Without the structural coverage variance a garage of 750 square feet could be constructed. A common two-car garage is about 575 square feet. 6. Would there be an advantage to an attached garage? An attached garage would eliminate the need for a 10-foot separation between the house and the garage. It would not eliminate the need for setback variances. Planning Staff recommends approval of setback variances for a smaller garage if a suitable location that is compatible with the surrounding area is found. If the garage is located north of the house , a setback from Arbor Street of no less than 24 feet, the same as the setback of the house to the north. If the garage is located south of the house , a setback from Arbor Street of no less than 3 8 feet , the same as the setback of the house. Kaley stated they have struggled for a number of years to find an ideal location for a garage and that given the topography and the trees located on the property , the proposed site is the best location in their view . Kaley noted on the south side there is a drop in elevation , which would require a significant amount of fill. If the garage is relocated or reconfigured, that would require additional driveway, which he would like to avoid doing if at all possible , or the construction of a retaining wall , which he also would like to avoid . Kaley noted his wife suffers from a form of lung disease and that he is going to be purchasing a handicap van with a lift, which will require a wider garage. In addition, he would like to retain as many of the trees as possible . Kang asked what type of materials would be utilized in construction of the garage. Kaley stated he would like the garage to look compatible with the house as much as possible . Rice asked what hi s neighbors feel about the project. Kaley stated the neighbors are in favor of the project. Schoenzeit stated he would like this application meet the 15 percent structural hardcover number and meet a 10-foot side setback. Schoenzeit commented it is unlikely the applicant would get approval for access off of the county road, which makes this location , with access off of Arbor Street, more feasible . Leskinen stated she has a concern with the proximity of the garage to the street since it would give the appearance of a great deal of massing. Leskinen raised a concern that it may interfere with the snow plowing activities of the City given the close proximity to the street. Leskinen commented she would prefer the garage be set back as far as the adjacent house . Rice indicated she also has a concern regarding the close proximity of the garage to the street. Schoenzeit asked whether the garage could be attached. Kaley stated attempting to attach the garage would be difficult . The house is situated approximately two feet above the street level and that he is attempting to situate the garage below street level to reduce the impact of the height. Kaley, 1395 Brown Road South, Continued) Turner stated the garage would probably be 15 to 20 feet back from the pavement and approximately 10 feet forward of the existing shed . Curtis noted there would probably not be enough room to park a vehicle in front of the garage on the Kaley 's property. Kempf stated in his view the lack of a garage is a hardship and that Arbor Street is the best access . Kempf noted there are some other garages in the neighborhood that are located in close proximity to the street and that he would be in favor of a garage that is 25 feet deep and 30 feet wide , with the garage being pulled back slightly to the 10-foot setback from the house . Kempf stated he also would like the applicant to meet the 15 percent structural coverage. Kaley stated he drives pickups and that he would prefer a 28-foot depth. Kaley indicated with his storage needs and the handicap van , he is hesitant to reduce the size of the garage. Kempf commented a 30' by 25' garage is not a small garage and would allow extra room on the sides. Kempf stated given the particulars of this application, the size of the garage is sufficient. Turner noted there is between 35 to 36 feet between the north wall of the house and the property line , and that if the garage is located more than five feet from the north property line, the garage would start to overlap the porch, which serves as the front door of the house. Kempf stated he would like to leave the south line of the garage in the same spot it is now and move the garage closer to the house . Kaley indicated he would be willing to live with the 30 feet but that he does not want to relocate the garage further east given the difficulties it would create for construction. Kempf stated it is likely he would need to do some excavating and construct a retaining wall. Schoenzeit asked if the building would be slab on grade . Turner stated theoretically it could be slab on grade but given the close location to the retaining wall, it is likely he would need frost footings . Schoenzeit stated if there are frost footings , he would need to do some excavation . Kaley pointed out it would also reduce the size of the back yard to move the garage closer to the house . Kempf commented this is not an ideal situation and that some compromises are necessary. Schoenzeit stated the applicant would be able to construct a 750 square foot garage but just not in the exact location he is proposing. Kempf stated the Planning Commission also needs to take into consideration the impact the garage would have on the neighbors . Kempf moved to recommend approval of Application #09-3402, Philip F. Kaley, 1395 Brown Road South, granting of setback variances, to allow a 750 square foot garage, or a 30' x 25' garage, subject to the garage being relocated east as much as possible to still meet the setback from the house, with the understanding the south wall of the garage would remain in its proposed location, and subject to the garage being constructed out of similar materials to the house. The final proposed dimensions of the house/garage will need to meet the 15 percent structural hardcover limit for the lot. Kaley asked how far the east wall would be from Arbor Street. Turner commented it would be about three feet farther than he had proposed Schoenzeit noted it would be approximately 11 feet from the Arbor Street property line to the garage. Kempf stated it would be as far east as the setback of the applicant 's house . Curtis stated it would be the minimum of ten fee t from the house. Kang seconded. Background: On June 8, 2009 , Council directed Staff to draft a resolution approving setback and structural coverage variances to allow a 26 foot deep by 30 foot wide garage placed five feet from the north property line and as far from Arbor Street as possible without being so close to the retaining wall around the house as to require footings for the garage foundation. A RESOLUTION GRANTING VARIANCES TO THE ORONO, MINNESOTA, CITY CODE SECTIONS 78-420, 78-1403, AND 78-1436 FILE NO. 09-3402 C ounci! E x hibit A WHEREAS, Philip Frank Kaley and Lorraine Adele Kaley, husband and wife, (hereinafter "Owners") are the owners of the property located at 1395 Brown Road South within the City of Orono (hereinafter "City") and legally described as: Lot 5 Block 1 Markville Hennepin County , Minnesota (hereinafter "the Property"); and WHEREAS, the Owners have made application to the City for a variance to Orono Code Section 78-420 to allow a detached garage less than 30 feet from the right of way of Arbor Street; and WHEREAS, the Owners have made application to the City for a variance to Orono Code Section 78-1403 to allow structural coverage in excess of 15 percent; and WHEREAS, the Owners have made application to the City for a variance to Orono Code Section 78-1436 to allow a detached garage less than 15 feet from the north property line ; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono , Minnesota, City Code , the Orono Planning Commission held a public hearing on May 18 , 2009 , at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono , Minnesota: FINDINGS 1. This application was reviewed as Zoning File #09-3402. 2. The Property is located in the RR-1B zoning district, where 2 acres is the minimum lot area and 200 feet is the minimum lot width. The Property is approximately 0.37 acre in area and 76.89 feet in width. Page 1 of 4 ( 3. The Planning Commission reviewed this application on May 18, 2009 and on a vote of 7 -0 recommended approval of setback variances to allow a 25 foot deep by 30 foot wide garage placed so the south wall of the garage is in a line with the north wall of the house (approximately 5.8 feet from the north property line) and so the southeast comer of the garage is 10 feet from the northwest comer of the house (approximately eight feet from the right of way of Arbor Street). This recommendation is based on the following findings: a. It is a hardship to not have a garage . b . A garage of the size proposed is necessary to accommodate vehicles as well as the equipment necessary to maintain the property. c . The proposed design and approved location is compatible with the surrounding area. There are detached garages across the street that are located very close to the right of way. The adjacent house to the north is located only 24 feet from the right of way. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public , and the effect of the proposed variance on the health , safety and welfare of the community. 5. Notwithstanding the recommendation of the Planning Commission the City Council finds that a 26 foot deep garage is necessary to accommodate vehicles and maintenance equipment and that the topography of the lot makes it unreasonable to place the garage any farther than two feet from Arbor Street. 6. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district ; that granting the variances would not adversely affect traffic conditions , light , air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Owners but is necessary to alleviate a demonstrable hardship or difficulty ; is necessary to preserve a substantial property right of the Owners; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City . Page 2 of 4 ( CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings , the Orono City Council hereby grants variances to Orono Code Section 78-430 to place a 26-foot by 30-foot garage two feet from the right of way of Arbor Street when a 30 foot setback is requried, to Section 78-1403 to have structural coverage of 16. 97 percent when the maximum allowed is 15 percent , and to Section 78-1436 to place a garage five feet from the north property line when a 15 foot setback is required, subject to the following conditions: 1. Council approval is based on the site and building plans submitted by the Owners and annotated by City staff, attached to this Resolution as Exhibits A and B. Any amendments to these plans may require further Planning Commission and City Council review . 2 . Authorities granted by this resolution run with the Property not with the Owners , but are permissive only and must be exercised by obtaining a building permit for the new garage before June 22 , 2010 or the variances will expire on that date. 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code , shall automatically terminate any authority granted herein , and shall be punishable as a misdemeanor. 4. The house was constructed in 1878 and was originally located farther east along North Shore Drive. It is not known when the house was moved. Additions were constructed in 1985 and 1990. Both required setback variances. Mr. and Mrs. Kaley propose to replace a dilapidated shed with a new 32 foot wide by 28 foot deep garage. The proposed garage would be placed in the same general location as the shed . North Shore Drive is the front of this lot. The rear is the north lot line. The area available to construct an accessory structure is shown on Exhibit F. Structural Coverage Variance A complete survey of the property shows that it is smaller than shown on the plat. The application was made based on the size of the lot as platted. Staff's initial review of the application was done with the lot size reduced by 1,600 square feet (based on a partial survey of the property and a survey of the property to the north) and the garage size reduced by 64 square feet per Mr. Kaley. The final survey of the property reduced the lot size by an #09-3402 May 18, 2009 Page 3 of 4 additional 800 square feet but changed the garage to the size originally proposed. Based on this survey the garage exceeds structural coverage by 146 square feet. Hardship Statement The Applicants havecompleted the Hardship Documentation Form attached as Exhibit B, and should be asked for additional testimony regarding the application, in particular the structural coverage variance . Hardship Analysis In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Issues for Consideration Would driveway access from Brown Road or North Shore Drive be advantageous in any way? These are County roads. When a property has frontage on both a Country road and a local street, County policies call for driveway access to be from the local street. Maintaining access from Arbor Street would also be consistent with the City's policies. Is the lack of garage a hardship? Because the property is only 0.37 acre when the zoning district specifies a 2 acre minimum there is no place on the property where a garage may be constructed without setback variances. Even if the shed were reconstructed it could barely accommodate one vehicle and the low roof line might require the driver to use the passenger side door. Is the location proposed compatible with the surrounding area? The proposed garage would be eight feet closer to the street than the existing garage. The house to the north (1380 Arbor Street) is located 10 feet off the common property line. It is setback 23.6 feet from the right of way of Arbor Street. Crystal Bay Playground is north of 1380. On the west side of Arbor Street the detached garages for 2140 North Shore Drive and 1385 Arbor Street have minimal setbacks from the right of way. The right of way for Arbor Street is 60 feet wide. The pavement is about 20 feet wide. Would a location south of the house be more compatible with the surrounding area? This would not eliminate the need for setback variances from Arbor Street and Brown Road. It would eliminate the need for setback variance from the north property line and from the house. The Applicants cite the location of the well and trees as reasons to not locate the garage south of the house. At the pre-application meeting Mr. Kaley indicated the area north of the house is the only good place on the property for a garden. Is there any other location that would be more compatible with the surrounding area? Would it be a hardship to encroach on this garden space or remove the trees? Which would the Applicants consider less onerous? #09-3402 May 18 , 2009 Page 4 of 4 Can the size of the garage be reduced without causing a hardship? The proposed garage is 896 square feet. Without the structural coverage variance a garage of 750 square feet could be constructed. A common two-car garage is about 575 square feet. Would there be an advantage to attached garage? An attached garage would eliminate the need for a ten foot separation between the house and the garage . It would not eliminate the need for setback variances . Structurally it would need to be attached to the north wall of the house (the 1990 addition), the 22.5 foot segment of the south wall or the 12.8 foot segment of the west wall (the 1985 addition). Attachment to the south wall would require replacement of the well. Architecturally it would appear to be difficult to design an attached garage because of the complex roofline of the house. The first floor of the house is below the level of Arbor Street. The garage would need to be above the level of Arbor Street Are there any other issues or concerns with this application? Staff Recommendation Not having a garage would be a hardship , but the location and size of the garage must be carefully considered to be compatible with the surrounding area. Staff would recommend: a. Not approving the structural coverage variance and limiting the garage to no more than 750 square feet. This would reduce the required setback from the north property line from 15 feet to 10 feet. b. If the garage is located north of the house , a setback from Arbor Street of no less than 24 feet , the same as the setback of the house to the north. If the garage is located south of the house, a setback from Arbor Street of no less than 38 feet, the same as the setback of the house. c. The Commission discuss with the Applicants the feasibility of a garage attached to the north side of the porch. d. The Commission consider the possibility that there is no location for a garage that could be compatible with the surrounding area. In the collections of the Western Hennepin County Pioneers Assn. Museum. This oil painting illustrates life during Orono's early years, the "Vic- torian Era " and the late "Glory Years " of the steamboat period on Lake Minnetonka. The scene is on Smith Bay, formerly the site of "Paul's Landing," today the Smith Bay Yacht Club. The farmhouse on the hill still stands, having been moved to the corner in Crystal Bay, today the home of the Richard Kaley family. This house reflects the 19th century cottage style popularized by the writings of Andrew Jackson Downing. The steeply pitched roof recalls the buildings of Northern Europe. According to Mr. Kaley, the home was built by Jon. A . Smith. The home was built for Andrew and Hannah Rosander about 1878. From that year till about 1895 the Rosanders, natives of Sweden, kept a boat landing, pavillion, dancehall and saloon (when times permitted) there on Smith Bay. They were noted for being gracious hosts to the hundreds of summer visitors who flocked out from the cities to relax on beautiful Minnetonka. The artist was a native of Denmark. By 1870 he had established himself as a painter of murals and frescoes in Minneapolis area churches, theaters, and homes. Evidently he painted "Rosander's Landing" either during or after a visit to Lake Minnetonka and made the Rosanders a gift of it. The work turned up about 1950 in a home in Orono, badly in need of cleaning. This was arranged by Roger Stubbs and the lovely painting was donated to the Pioneer Museum. The artist attempted to catch the color and gaity of the times. Note the elegantly dressed ladies under the veranda by the pavillion and aboard the paddlewheeler. Near the farmhouse may be seen two workers in straw hats and overalls. The artist preserved on canvas, a tale of every- day life in Orono, Minnesota, just four years after the new town was formed. "Color photo reproduction by Tom Sullivan" MINUTES OF THE ORONO PLANNING COMMISSION MEETING May 18, 2009 6:30 o'clock p.m. Council Exhibit D 3. 09-3402 PHILIP F. KALEY, 1395 BROWN ROAD SOUTH, VARIANCES , 7: 14 P.M. - 7:50 P.M. Philip Kaley, Applicant , was present. Turner stated the applicant is requesting setback variances to allow construction of a detached garage located four feet from the north property line when a 15-foot setback is required and two feet from the property line adjacent to Arbor Street when a 50-foot setback is required . Currently there is no garage located on the property. A variance is also requested to allow for 15.89 percent structural coverage when the maximum is 15 percent. The applicant is proposing to replace the deteriorated shed with a new 32-foot wide by 28-foot deep garage . The proposed garage would be placed in the same general location as the shed . A survey of the property shows that it is smaller than shown on the plat. The application was made based on the size of the lot as platted. Staff's initial review of the application was done with the lot size reduced by 1,600 square feet and the garage size was reduced by 64 square feet. The final survey reduced the size of the lot by an additional 800 square feet but changed the garage to the size originally proposed. Based on the final survey, the garage exceeds structural coverage by 146 square feet. Turner requested the Planning Commission discuss the following issues: 1. Would driveway access from Brown Road or North Shore Drive be advantageous in any way ? Both are county roads. When a property has frontage on both a county road and a local street , County policies call for driveway access to be from the local street. Maintaining access from Arbor Street would be consistent with the City 's policies . 2 . Is the lack of a garage a hardship? This zoning district requires a 2-acre minimum and the lot consists of 0 .3 7 acres. Regardless of its location, a setback variance would be required for the garage. 3. Is the location proposed compatible with the surrounding area? The proposed garage would be PAGE7 MINUTES OF THE ORONO PLANNING COMMISSION MEETING May 18, 2009 6:30 o'clock p.m. eight feet closer to the street than the existing shed. 4 . Would a location south of the house be more compatible with the surrounding area? This would not eliminate the need for setback variances from Arbor Street and Brown Road . It would eliminate the need for setback variance from the north property line and from the house. 5. Can the size of the garage be reduced without causing a hardship ? The proposed garage is 896 square feet. Without the structural coverage variance a garage of 750 square feet could be constructed. A common two -car garage is about 575 square feet. 6. Would there be an advantage to an attached garage? An attached garage would eliminate the need for a 10-foot separation between the house and the garage. It would not eliminate the need for setback variances. Planning Staff recommends approval of setback variances for a smaller garage if a suitable location that is compatible with the surrounding area is found . Staff would recommend the size of the garage be limited to 750 square feet , which would reduce the required setback from the north property line from 15 feet to 10 feet. If the garage is located north of the house , a setback from Arbor Street of no less than 24 feet , the same as the setback of the house to the north. If the garage is located south of the house , a setback from Arbor Street of no less than 38 feet, the same as the setback of the house. Kaley stated they have struggled for a number of years to find an ideal location for a garage and that given the topography and the trees located on the property, the proposed site is the best location in their view. Kaley noted on the south side there is a drop in elevation, which would require a significant amount of fill. If the garage is relocated or reconfigured, that would require additional driveway , which he would like to avoid doing if at all possible , or the construction of a retaining wall, which he also would like to avoid. Kaley stated he would like the garage to look compatible with the house as much as possible. Rice asked what his neighbors feel about the project. Kaley stated the neighbors are in favor of the project. Schoenzeit stated he would like this application meet the 15 percent structural hardcover number and meet a 10-foot side setback. Schoenzeit commented it is unlikely the applicant would get approval for access off of the county road, which makes this location , with access off of Arbor Street, more feasible. Leskinen stated she has a concern with the proximity of.the garage to the street since it would give the appearance of a great deal of massing. Leskinen raised a concern that it may interfere with the snow plowing activities of the City given the close proximity to the street. Leskinen commented she would prefer the garage be set back as far as the adjacent house. Rice indicated she also has a concern regarding the close proximity of the garage to the street. Schoenzeit asked whether the garage could be attached . Kaley stated attempting to attach the garage would be difficult. Curtis noted there would probably not be enough room to park a vehicle in front of the garage . Kempf stated in his view the lack of a garage is a hardship and that Arbor Street is the best access. Kempf noted there are some other garages in the neighborhood that are located in close proximity to the ~ street and that he would be in favor of a garage that is 25 feet leng and 30 feet wide , with the garage being pulled back slightly to~ the 10-foot setback from the house. Kempf stated he also would like the applicant to meet the 15 percent structural coverage. Kaley stated he drives pickups and that he would prefer a 28-foot depth. Kaley indicated with his storage needs and the handicap van, he is hesitant to reduce the size of the garage. Kempf commented a 30 ' by 25 ' garage is not a small garage and would allow extra room on the sides . Kempf stated given the particulars of this application , the size of the garage is sufficient. Kempf stated it is likely he would need to do some excavating and construct a retaining wall. Schoenzeit asked if the building would be slab on grade . Kempf commented this is not an ideal situation and that some compromises are necessary . Schoenzeit stated the applicant would be able to construct a 7 50 square foot garage but just not in the exact location he is proposing. Kaley stated he has an issue with moving the garage further east. Kempf stated if the applicant does not want to move the garage further east, he will need to reduce the size of the garage .
