CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance
to Municipal Zoning Code Section 10.61, Subdivision 5 (A) to permit the construction of a
parkir:g lnt to be located in the requin:~d front y?.:·d where. a parking lot is norm,1.lly not ~dlowed
in I.be RR-lB District, subject to the following conditions :
1. Parking lot shall generally adhere to the design and site plan attached as a Exhibit
A.
2 . The parking Jot shall be striped for proper traffic flow.
3. The existing informal gravel parking area on thr, north side of the building shall
b e reverted to grass.
4. Authorities granted by this variance run with the property not with the applicant,
hut are permissive only and must be exercised by application for a building
permit within one year of the date of Council approval, or this variance ,viii
expire on !hat date (November 28, 1995).
5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.

B. The post office has never had a fonnal parking lot and a formal parking
lot with a drive through Jener drop will eliminate th e current pattern of
parking o n the sho uld er of Brown Road.

playground area . An in gress/egress driveway would have to cross the
front yard in order to reach such a parkin g lot.
D. Construction and use of a parking lot mee ting the front setback
requirement would have a severe negative impact on the existing use and
l ayo ut of the Crystal Bay park and pla ygro und area and further wo ul d
require additio nal hard cover.
E. There is existing screc~ning to the south s ide of th e park in g lot which 1s
appropriate as a buffer to the neighboring residence to th e so uth.
F. Construction of th e parking l ot wi ll allow elimination of parking on the
shoulder of Brown Road, resultin g in a safer siruation for po st office
customers. Placement of the parking lot in a conforming locat ion to th e
rear of the pos t office would likely re s ul t in continued unsafe parking on
the shoulder of Brown Road .
4. The City Council has considered this application including the finding s and
r ecommendati ons of the Planning Conunis s ion, reports by City s taff, comments
by the applicant and the effect of the proposed var iance on the health, safety and
welfare of the community.
5. The City Council finds that the conditions ex ist in g on this property are peculiar
to it and do not apply generally to ocher property in this zon.ing district; that
granting the variance would not adversely affect traffic condi ti ons, light , air nor
pose a fire hazard or other danger to neighboring property: would not merely
serve as a com·enience to the applicant. but is n ecessa ry to alleviate a
demonstrable hardship or difficulty: i s necessary lO preserve a s ubstantial property
right of the applicant; and would be in keeping with th e sp irit and intent of the
Zon.ing Code and Comprehensive Plan of the City .
