CITY ADMJNISTRA TOR'S REPORT (#9) OLD CRYSTAL BAY ROAD BIKE/HIKE TRAIL Moorse updated the Council on where the bike trail plan is at the present time. The Council was provided with a re-drafted agreement with Hennepin Parks and outlined changes. Staff is looking for authorization from the Council to formalize the agreement, and allow Staff to prepare bid specifications and advertise for bids on the first phase of construction of the bike trail. Gerhardson reported the cost will be $4890, wruch includes the planting of additional trees . Gerhardson said the lot has been dealt with as a zoning matter and is part of a lease agreement with the postal service. Gaffron stated th.is application is a request for a front yard setback variance. Because th.is is a two-acre single family zone, a parking lot would normally have to be 50' from the street lot line. This would result in encroachment into the existing Crystal Bay Park area and would still require a driveway in the de.fined front yard. Based on trus, the parking lot plan is to place ir along the side of the building requiring a variance. The Council members felt that the 8-10 stalls nonnally required for this building size is excessive for the use the building receives. Gerhardson said the plan is to install six stall s. Gerhardson said the City is concerned with traffic flow into the post office. At the present time, residents using the drive-up box have to cross the street twice to use ir. It was noted that this lot would also service the park. Gafffron said since the building is in existence, the City has the discretion to choose the number of stalls for the parking lot. Callahan s u ggested this item be tabled to check the lease with the postal service to determine if it includes the number of stalls for the parking lot. Briefly, the Public Works Department is planning to construct a parking lot on the south side of the Crystal Bay Post Office to eliminate parking on the shoulder. Because this is a 2-acre single family zone, a parking lot would normally have to be 50' from the street lot line. However , construction of such a lot for the Crystal Bay Post Office would encroach into the existing Crystal Bay park area , and would still require a driveway in the defined front yard . Planning Commission Recommendation Planning Commission reviewed this at their October 17th meeting and voted 7-0 for approval, noting the existing screening adjacent to the neighboring residence , and noting that it would be inappropriate to force the parking lot to the rear which would have a severe negative impact on the Crystal Bay play area . The hardship is the existing site layout and use pattern, as well as the layout of the existing post office with its only public access door adjacent to Brown Road. Staff Recommendation Staff recommends approval per the Planning Commission recommendation. Vote: ayes, --- nays. ch A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONING CODE SECTION 10.61, SUBDIVISION 5 (A) FILE #1969 WHEREAS, the City of Orono (hereinafter "the applicant") is owner of the property located at 1355 Brown Road South within the corporate boundaries of the City of Orono (hereinafter "City") and legally described as follows: Lots 2 and 3 , Block 1, Markville , Hennepin County , Minnesota (hereinafter "the property"); and WHEREAS, the applicant has applied to the City for a variance to Municipal Zoning Code Section 10 .61, Subdivision 5 (A) to permit the construction of a parking lot to be located within the 50' required front yard where open parking spaces are normally not allowed. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #1969. 2. The property is located in the RR-lB, Single Family Rural Residential Zoning District. 3. The Orono Planning Commission reviewed this application on October 17, 1994, and recommended approval of the proposed variance based upon the following findings : A. The Crystal Bay Post Office was constructed in 1960 and acquired by the City around 1980. It is intended to continue in use as a post office for the foreseeable future . Page 1 of 5 B. The post office has never had a formal parking lot and a formal parking lot with a drive through letter drop will eliminate the current pattern of parking on the shoulder of Brown Road. C. A parking lot meeting the requirement for being outside the 50' required front yard would encroach into the existing Crystal Bay park and playground area . An ingress/egress driveway would have to cross the front yard in order to reach such a parking lot. D. Construction and use of a parking lot meeting the front setback requirement would have a severe negative impact on the existing use and layout of the Crystal Bay park and playground area and further would require additional hardcover. E. There is existing screening to the south side of the parking lot which is appropriate as a buffer to the neighboring residence to the south. F. Construction of the parking lot will allow elimination of parking on the shoulder of Brown Road, resulting in a safer situation for post office customers. Placement of the parking lot in a conforming location to the rear of the post office would likely result in continued unsafe parking on the shoulder of Brown Road. 4 . The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. Page 2 of 5 CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.61, Subdivision 5 (A) to permit the construction of a parking lot to be located in the required front yard where a parking lot is normally not allowed in the RR-lB District, subject to the following conditions : 1. Parking lot shall generally adhere to the design and site plan attached as a Exhibit A. 2. The parking lot shall be striped for proper traffic flow . 3. The existing informal gravel parking area on the north side of the building shall be reverted to grass . 4 . Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within cme year of the date of Council approval, or this variance will expire on that date (November 28, 1995). 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of itself, its heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property . Background The Crystal Bay Post Office was constructed in 1960 and acquired by the City around 1980 . It is the only remaining structure of the Crystal Bay government complex, and is intended to continue in use as a post office for the foreseeable future. The post office has never had a formal parking lot, and its customers, the majority of which are Crystal Bay area residents, have either walked up or parked haphazardly on the shoulder in front of the building . The Public Works Department is proposing to construct a formal parking lot with a drive-through letter drop and eliminate parking on the shoulder. The standards for a parking lot in the RR-lB District require a 50' front setback. Since the existing building is totally within the 50' front yard, and its only public entrance is on the front of the building, a conforming parking lot would have to be directly west and to the rear of the building and would be inconvenient for the public. Further, such parking lot would severely encroach into the existing Crystal Bay park and playground area. An ingress/egress driveway would have to cross the front yard in order to reach such a parking lot. Proposed Layout and Construction Please review the site plan , Exhibit D. The proposed parking lot will be on the south side of the building and provide five parking stalls plus a handicapped stall. A mail drop drive through is proposed with the northerly curb cut as entrance and southerly curb cut as exit. It is anticipated that the parking lot will consist of 8" of gravel base and 3" of bituminous surface. It is intended to be surfaced up to the building with concrete curbs at the head of each stall. The intent is to leave a 5' walkway adjacent to the south side of the building . The parking lot will be striped, and it is anticipated that the apron in front of the building along County Road 146 will be posted no parking. The informal gravel parking area on the north side of the building will be reverted to grass. Note that while the code would require a minimum ten space parking lot for a new post office building, history has shown it is rare to see more than two or three cars at the Crystal Bay Post Office at one time. Use of the post office is not anticipated to increase significantly. Impact on Neighboring Properties At its proposed location, the parking lot will have minimal impact on the existing Crystal Bay playground. The proposed parking lot is 34' from the side lot line with the adjacent residence to the south . There is existing screening south of the parking lot, site which is appropriate as a buff er to the neighboring property. Including Only Lots 1, 2 and 3 south of the closed Prospect A venue, hardcover in the 500- 1,000' zone will increase from 5.6% to 12%, where 35% would be allowed. This area is relatively flat and drains generally eastward to the Dakota Rail right-of-way and then northward eventually to a wetland in the Fox Hill area. No special drainage considerations are anticipated to be needed at this time. Staff Recommendation Please review the description of hardship and unusual property conditions. If Planning Commission agrees that the proposed parking lot location is acceptable, then a recommendation for front setback variance approval would be appropriate. Regulation of off-street parking and loading spaces in this Chapter is to alleviate or prevent congestion of the public right-of-way and so to promote the safety and general welfare of the public by establishing minimum requirements for off-street parking, loading and unloading from motor vehicles in accordance with the utilization of various parcels of land and structures. All applications for an occupancy certificate in all districts shall be accompanied by a site plan drawn to scale and dimensioned indicating the location of off-street parking and loading spaces in compliance with the following requirements: Source: Municipal Code Effective Date: 9-14-67 A. Application of Parking Rules All Districts. C. Existing Parking Not to be Reduced. Off-street parking spaces and loading spaces existing on September 14, 1967, shall not be reduced in number unless said number exceeds the requirements set forth herein for a similar new use. D. Floor Area. The term "floor area" for the purpose of calculating the number of off-street parking spaces shall be the net usable floor area of the various floors, devoted to retail sales, services, off ice spaces, processing and fabrication exclusive of hallways, utility space, storage areas other than warehousing. E. Seat. In stadiums, churches and other places of public assembly in which patrons or spectators occupy benches, pews or other similar seating facilities, each 22 inches of such seating facility shall be counted as one seat for the purpose of determining required parking. F. Size of Parking Spaces. Each parking space shall be not less than nine feet wide and twenty feet in length and each space shall be served adequately by access drives. For purposes of calculating parking space requirements, one parking space for one vehicle shall equal 300 square feet of storage and maneuvering area including access drives. G. Commercial Vehicle Parking. Off-street parking facilities accessory to residential use shall be utilized solely for the parking of passenger automobiles. No motor vehicle over 7,000 pounds gross capacity and no commercially licensed trailer shall be parked or stored in a residential district except when loading, unloading or rendering a service, except that one such vehicle may be parked at the residence of the owner or operator of said vehicle. Under no circumstances shall parking facilities accessory to residential structures be used for open area storage of commercial vehicles nor for open air parking for business purposes of automobiles belonging to the employees, owner, tenant or customers of business or manufacturing establishments other than the home occupation permitted for that property. H. Location of Parking. Required off-street parking in the "R" Districts shall be on the same lot as the principal building. Subd. 5. Setbacks for Parking. Within all "R" Districts all vehicles normally owned or kept by the occupants on the premises must have a garage .stall or open parking space on the same lot as the principal use served. Garage stalls accessory to residential structures may be located anywhere on the lot other than a required yard area except that such garages may be located to within ten feet of an interior side lot line and to within ten feet of a rear lot line subject to Section 10.03. Open parking spaces on iots must have a location other than a required yard except that such parking may be located in a rear yard to within ten feet of an interior side lot line and to within ten feet of a rear lot line. Within the "B-1", "B-3" and "B-4" Districts parking spaces and/or garages shall be located in areas other than a required yard except that parking may be located in a rear yard to within three feet of the rear or side lot line unless the rear or side lot line is in common with an "R" District; then the setback distance shall be the same as required for the "R" District. Within "I" Districts, off-street parking spaces shall be not less than twenty feet from any street right-of-way line nor less than five feet from any interior side lot line or rear lot line, except when a side or rear lot line is abutting an "R" District. Then, off-street parking shall be not less than ten feet from said lot lines. · Subd. 6. Joint Parking. Required parking facilities serving two or more uses in the "B" or "I" Districts may be located on the same lot provided that the total number of parking spaces so furnished shall be not less than the sum total of the separate requirements for each use and provided: A. The proposed joint parking space is within thirty feet of the use it will serve. B. The applicant(s) shall show that there is no substantial conflict in the principal operating hours of the two or more buildings or uses for which joint use of off-street parking facilities is proposed; and, C. A properly drawn legal instrument approved by the City Attorney, executed by the parties concerned for joint use of off-street parking facilities shall be filed with the City Clerk. Said instrument may be a three or more party agreement including the City. ORONO CC 384 (4-1-84) § 10.61 Subd. 7. Control of Parking Facilities. When required accessory off-street parking facilities are provided elsewhere than on the lot on which the principal use served is located, written ·authority for using such property for off-street parking shall be filed· with the City so as to maintain the required number of off- street parking spaces during the existence of said principal use. No such parking facilities at its closest point shall be located more than 100 feet from the premises nor more than 300 feet from the principal use or building served. Subd. 8. Storage Prohibited. Required off-street parking space in all districts shall not be utilized for open storage of goods or for the storage of vehicles which are inoperable, for lease, rent or sale. Subd. 9. Design and Maintenance of Parking Areas. A. Access. Parking areas shall be designed so as to provide an adequate means of access to a public alley or street. Said driveway access shall not exceed thirty feet in width at the public walk center line and shall be so located as to cause the least interference with traffic movement. All off-street parking spaces shall have access off driveways and not directly off of a public street. B. Fractional Spaces. When the determining of the number of required off-street parking spaces results in a fraction, each fraction of one-half or more shall constitute another space. C. Signs. Signs located in any parking area necessary for orderly operation of traffic movement shall be in addition to accessory signs otherwise permitted. D. Surfacing. All of the area intended to be utilized for parking space and driveways for four or more vehicles shall be surfaced with material to control dust and drainage. E. Lighting. If lighting is provided it shall be accomplished in such a manner as to have no direct source of light visible from the public right-of-way or adjacent land. F. Curbing. All open off-street parking areas designed to have head-in parking along any lot line shall provide a tire bumper or curb of adequate height and properly located to ensure that no part of any car will project beyond the required setbacks. Subd. 10. Required Off-Street Parking. Where the principal use of the structure served is as listed, the minimum parking facilities (open or enclosed) shall be as shown. A. Single Family Dwelling. One additional off-street parking space shall be provided for each 2,500 square feet or fraction thereof of land devoted to outside storage. Subd. 11. Application of Loading Rules to All Districts. The regulations and requirements regarding off-street loading and unloading shall apply to the required and non-required loading and unloading facilities in all the districts. If, in the application of these requirements, a fractional number is obtained, one loading space shall be provided for a fraction of one-half or more, and no loading space shall be required for a fraction of less . than one- half. Subd. 12. Location of Loading Berths. All loading berths shall be 25 feet or more from the intersection of two street right-of-way lines. Loading berths shall not occupy any yard requirement bordering a street. Subd. 13. Size of Loading Berths. Unless otherwise specified the first berth required shall not be less than 12 feet in width, and 25 feet in length. Additional berths shall be as specified, but not less than 12 feet in width and 25 feet in length, all loading berths shall maintain a height of 14 feet or more. Subd. 14. Access to Loading Berths. During the negotiations for a five year agreement/lease with the postal serv ice, the need for a parking lot was discussed. A ten stall lot was initially considered because that is what the zoning code calls for. It is staff's determination that the lot be limited to six spaces due to the amount of traffic. The proposed lot has been staked to show the size of the lot and where it will be located on the site. The parking lot will also accommodate a drive-up mail drop . COUNCIL ACTION REQUESTED: Motion to approve a variance to the front setback requirement to enable the construction of a parking lot to serve the Crystal Bay Post Office. The current situation has raised many safety concerns with customers who park right in front of the door and the drive-thru collection box . The post office has had many complaints about parking in front of the drive-thru collection box which is right next to the entrance of the post office. With the collection box being moved to the south side of the building, mailers could just circle the building and drop off their mail and not have to drive in front of the door. Another plus would be the Postal Service could install a drive-through window for citizens of Orono to be able to mail their packages and buy their stamps from their car.
