CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 4 6 6 4 <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B), <br />FILE NO. 01-2681 <br />WHEREAS, Roger A. Day, (hereinafter "the applicant") is the owner of the property <br />located at 1205 Brown Road South within the City of Orono (hereinafter "the City") and legally <br />described as follows: <br />Lot 1, Block 1, Maxwell 's Addition to Crystal Bay Lake Minnetonka, Hennepin <br />County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for variances.to Municipal Zoning <br />Cod e Section 10 .28, Subdivision 5 (B) to permit a 16' X 6' residential kitchen addition to the rear <br />of the existing residence located 20' from Lakeview Avenue where 50' is required and a 22' setback <br />to the side property line where 50' is required; and Section 10 .28 , Subdivision 5 (B) to permit a 12' <br />x 6' porch to the front of the existing residence located 23.2' from Lakeview Avenue where 50' is <br />required . <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes , the Orono Planning <br />Commission held a public hearing on June 18, 2001, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #01-2681. <br />2. The property is located in the RR-1 B, Single Family Rural Residential Zoning <br />District. <br />3 . The Orono Planning Commission reviewed this application on June 18 , 2001 and <br />recommended approval by a vote of 7 to 0 . <br />Page 1 of 5
