TI1e application involves the excavation of 1650 cubic yards of fill for a 6' depth pond. The property is within the rural zoning with on-site septic and house pad. The Engineer has asked that the top soil be retained and placed on the disturbed land to restore the natural vegetation . Mabusth noted that the Planning Commission was emphatic about the pond maintaining a natural look. It is located in the middle of a type I wetland, which is not suppose to be altered . The iv1n.!DOT 250 mixture is recommended . Hurr asked if the resolution noted any effect on a future owner if they would desire to mow the area. Mabusth said the mowing limitations will be noted on the chain of title as well as in the resolution. There are also covenants on the property regarding protection of type 1 wetlands. Mowing will not be allowed within 1 O' of the pond area. Mabusth said the ty pe 1 wetlands cannot be moved or disturbed. Hurr asked what material would be used around the house . Mark Gronberg said 2' of black dirt with clay underneath would be used in the lawn and the clay under the grass areas. Mabusth noted that the Corp of Engineers permit will stipulate the the drainage from the residence cannot run back to the pond area. Silt fencing will be used to prevent this from occurring . The owner was present and confirmed that the conditions were understood and was agreeable with the resolution. Hurr moved, Kelley seconded, to approve Resolution #3597 for a conditional use permit . Ayes 3, Nays 0. (#6) #2045 .JOHN STEINMETZ, 1155 BROWN ROAD SOUTH -VARIANCES - RESOLUTION #3598 Mabusth noted an amended survey has been done to show the traveled road and the right-of-way . The application requires setback variances from Willow and South Brown Roads. The Planning Commission had asked that there be at least 45' from the traveled right-of-way but the amended survey shows it to be at 42'. The proposed addition is to be 8' from the side lot line but also includes a 6' covered roof deck with no overhang, which would be 2' from the side lot line and 44' from the traveled road and 48.6' from Willow Drive. Mabusth said the Planning Commission recommended the structure not exceed the 15% allowable lot coverage. The proposal was originally for 16 .3% coverage and is now amended at 14 .2%. There is no problem with hardcover though the property is subject to the shoreland area controls. The property is also subject to the 501 setback on three sides as it is a corner lot requiring a rear lot line of 50'. 3 MINUTES OF THE REGULAR ORONO CITY COUNCIL l\1EETING HELD ON SEPTEMBER 11, 1995 (#6 -#2045 John Steinmetz -Continued) The applicant was present . Hurr inquired if the County had the adequate right-of-way . Mabusth said the County did have the adequate right-of-way with 66', adding that most of the road is located on the east 33'. Mabusth said Dave Zetterstrom from Hennepin County was unable to give any minimum setback from the road but did say the distance from the traveled road was adequate . Callahan noted that an adjustment was made at the Planning Commission regarding the size of the porch . Mabusth said the porch was to be 81 with 10' at the roofline with a 2' overhang and located at the O' lot line. Hurr moved , Callahan seconded, to approve Resolution #3598 . (#7) #2048 JAMES & JOANN JUNDT, 1400 BR.\.CKETTS POINT ROAD - CONDITIONAL USE PER.J.viIT1VARIANCE -RESOLUTION #3599 Scott Crawford of Kraus Anderson Construction represented the applicants . Mabusth reported that the application is for a third residential urut in the oversized accessory structure for a studio apartment, which already contains a 3-bedroom, 2-le v el , caretaker urut and a 2-bedroom guest house. The one room studio will bring the total bedrooms to six, all of which will be served by one septic system . The application was approved by the Planrung Commission with conditions placed on the septic systems. The sewage system was to have been updated by the 199 5 construction season . A petition for sewer is under consideration . The Planning Commission has asked for septic testing every two months . If failure is found , the system must be pumped out on a regular basis. Limitations would be placed on the property should t his fail . Kelley asked if Staff knew where the septic tank was located . Mabusth said they did , and it has been found not to meet the separation required . Tests have been conducted to show there is adequate area to serve the usage. Kelley asked what would occur if the MUSA line is not extended to this area. A new septic system would be installed . Mabusth suggested stipulating a deadline date for installation of septic sh ould the MUSA line amendment fail . Callahan asked if the applicant agreed to update the septic in the original resolution . Mabusth said this was true. Callahan said no deadline should then be needed. Hurr asked what kind of septic was on the site at present . There are two mound-type septic systems, one for the main residence and one for the accessory structures. Four septic sites were tested . Hurr asked if it is realistic to have six-bedrooms within the accessory structure, and Mabusth said it was. 4 ,_ .. CITY OF ORONO P.O. Steinmetz (hereinafter "the applicant") is the owner of the property located at 1155 Brown Road South within the City of Orono (hereinafter "City") and legally described as follows: Refer to Exhibit A attached (hereinafter "the property"); and WHEREAS, the applicant has applied to the City for variances to Municipal Zoning Code Section 10.28, Subdivision 5 (B) to permit construction of a 6.2'x12' single story addition and 6' roofed deck along the entire exterior of existing residence that will be located 2' from the street lot line adjacent to County Road 146 and 48.8' from the street lot line at Willow Drive where a 50' setback is required. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #2045. 2. The property is located in the RR-lB, Rural Residential Zoning District requiring 2 acres in area. The property consists of 19,827 s.f. or .46 acres. 3. The Orono Planning Commission reviewed this application on August 21, 1995, and recommended approval of the variances as amended based upon the following findings: A. Traveled County Road is located 42' from the street lot line. B. The existing residence is located 52' + from traveled road. C. Northeast corner of the addition will be located 2' from the street lot line but 44' from the traveled right-of-way of the County Road. Page 1 of 5 D. The property is located approximately 6-7' above the County right-of-way. E. Location of house on odd shaped lot. F. Lot is a corner lot and subject to three 50' setbacks (side street, front street and rear). 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to Municipal Zoning Code Section 10.28, Subdivision 5 (B) to permit construction of a 6.2'x12' single story addition to the principal structure and a 6' roofed deck along the entire exterior of the residence and grants a 48' or 96 % street setback variance from County Road lot line and 1.2' variance or 24% to Willow Drive street lot line, subject to the following conditions: 1. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (September 11, 1996). 2. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property. Applicant had originally proposed an 8' roofed deck with 2' overhang to be constructed around the exterior of the existing residence. The addition would be located O' from the County Road street lot line and 44.8' from Willow Drive lot line. The proposed improvements resulted in 1. 3 % structural coverage excess. Planning Commission noted the extreme drop in elevations to the County Road and noted that there was at least 45' to the edge of the lot line to the traveled road, review Exhibit H. Applicant has submitted an amended survey locating the traveled roads of both the County Road and Willow. The County Road is located 42' from the street lot line. The Planning Commission recommended that this structure be reduced so that the structural coverage allowance of 15 % would not be exceeded and also recommended that the new structure be located no closer than 2' to the street lot line adjacent to the County Road. It will be located 8' from the right-of-way of County Road 146 . The existing residence is located 10.1'. The proposed improvement includes the installation of an 8' wide deck along the entire exterior of the existing residence. The deck will have a roof with a 2' overhang. The deck with overhang will be located O' from the County Road right-of-way and 44.8' from Willow Drive. Improvements result in a structural coverage excess of 260. 6 s. f. or 1. 3 % (total structural coverage is proposed at 16. 3 % ) . Review Exhibit I, note the majority of applicant's east street yard is located within the right-of- way of the county road . Staff will ask the Hennepin Department of Transportation to comment on the request for a O lot line setback. The house was constructed prior to the adoption of zoning or building code standards . There is no record of building permits being issued for additions to residence. The topographic map shows the original driveway that accessed the property at the County Road. In 1994 applicant installed the new detached garage with the relocated access drive at Willow. Note structural coverage was not an issue at the time of the issuance of that permit. There are no improvements -within the 75' setback A structural on a OHW requires a 150' setback . There are some hardcover improvements at 75'. The proposal requires an average lakeshore setback variance. The house is within the 50' street setback. The proposed deck requires a setback variance. The deck exists at 137' and is proposed at 131 '. The proposal requires a 3' average lakeshore setback variance. Peterson read into the minutes a letter from the DNR which recommends the proposal, with two conditions. They ask for screening and relocation of the deck to another area of the home. Peterson did not see where the deck could be repositioned . Mabusth said the setting is very natural and no visual screening is needed. It was detennined that the DNR had not been on site in reviewing the proposal . Schroeder asked if the deck could be smaller. Nlrs . Frank said , although it could be a little smaller, the steps for the deck allow access to the driveway, and the deck only extends 61 from the house. Mr. Frank said the hardcover is within the 25% allowable at 19.14% and ask for approval as proposed. Mr. Steinmetz was present. 8 ' . :MINUTES OF THE ORONO PLANNING COl'vINilSSION MEETIN'G HELD ON AUGUST 21, 1995 (#7 -#2045 John Steinmetz -Continued) Mabusth reported that this propeny is located at the intersection of Brown Road South and Willow Drive with the house on higher elevations from adjacent roadways . The original driveway has been relocated to Willow Drive along with a new detached garage. New landscaping has also been done . The proposal requires structural coverage and street setback variances for a covered deck to be installed around the entire residence along with a single story addition at the NE corner of existing residence. Dave Zetterstrom of the Hennepin DOT said there was no minimum setback requirement from a county road . The deck is proposed at 8' width with a 2' overhang extending over the deck and would be located approximately 44' from Willow Drive and O' from Brown Road South. The structural coverage variance is magnified by the new addition. It exists at 9 .3% and is proposed at 16 .3% for 260 s.f or 1.3% excess . No hardcover problems exist. Commissioners discussed ways to eliminate the structural coverage problem. The code allows 15% of area for properties under 2 acres. Peterson suggested the deck and overhang be used on three sides of the home. Hawn suggested eliminating the deck from the Brown Road side of the residence. The applicant emphasized a four-sided deck and overhang for consistency and for an aesthetically pleasing look. It was suggested to recalculate the deck at 6' in order to maintain the consistency in look, to move back away from the county road, and stay within the structural coverage guidelines. Schroeder noted the considerable hardships. The higher elevation at the road side was noted. Lindquist said downsizing 1-1/2' all around would meet the requirements . There were no public comments. Lindquist moved, Smith seconded , to approve Application #2045 with the condition the structure is within the maximum of 15% lot coverage to allow the applicant flexibility, and to be at least 2' off the setback line to the county road and the Brown Road right of way .
