Dear Greg:
I have enclosed copies of amended Hold Harmless Agreements and a Covenant Not To Sue
prepared by the City Attorney] Kevin Staunton. Copies of the Hold Harmless Agreement and
Covenant Not To Sue have also been sent to Whitney MacMillan and David MacMillan.
The City Attorney has asked that you as applicant execute a Hold Harmless Agreement releasing
City from any liabilities associated with the failure of your antenna/tower structure.
Your application will be presented before the Council at their July 25, 1994 meeting. Please
note that meeting starts at 7:30 p.m. The enclosed approval resolution will be presented for
Council's review and formal action at that meeting. If you have any questions pertaining to the
findings and conditions set forth in that resolution, please contact staff prior to the meeting.
