A RESOLUTION CONFIRMING THE CITY'S INTENT
TO NOT RE-ASSESS LOT 23,BLOCK 7, CRYSTAL BAY VIEW
' FOR 1963-1965-1970 SEWER AND WATER IMPROVEMENTS
WHEREAS, Lot 23,Block 7, Crystal Bay View,Hennepin County,Minnesota was
acquired by the City of Orono in 1977 through tax forfeiture, retained by the City for Park and
Recreation purposes; and
WHEREAS,at the time of forfeiture,there was an outstaiiding special assessment
balance on the property of$1,535.13 for the 1963-1B interceptor sewer, 1965 LS-1 lateral sewer,
and 1970 LW-1 watermain improvement projects; and
\ WHEREAS, on September 9, 1996 the Orono City Council adopted Resolution
#3768 authorizing the reconveyance of a 20' x 100' portion of said Lot 23 to the County and
approving public sale of said portion to adjacent property owners; and
• WHEREAS, a portion of the$1,513.13 special assessment balance will be recouped
by the City as a result of said public sale; and
WHEREAS,because said Lot 23 including the 20'x 100'portion released for public
sale is not suitable for development of a residence due to acreage and wetland limitations, the
property has not and will not fully benefit from the previously assessed sewer and water
improvements,and it would therefore be unreasonable to re-assess the property to recoup any portion
of the prior unpaid assessments that are not recouped as part of the County's public sale process. .
NOW, THEREFORE, BE IT RESOLVED, by the City Council of Orono,
Minnesota that the CiTy intends to not re-assess Lot 23, Block 7, Crystal Bay View for 1963-1965-
1970 sewer and water improvements.
Adopted by the City Council of Orono,Minnesota this 27th day of January, 1997 by a vote
of 4 ayes and 0 nays.
