A RESOLUTION AMENDING THE ASSESSMENT ROLL FOR THE
IlVIPROVEMENT OF THE INTERSECTION OF TRUNK HIGHWAY 12 AND
650 FEET NORTH ON WILLOW DRIVE
WHEREAS, Resolution No. 3642, adopted November 27, 1995, established the
assessments to be levied on the above referenced project for the Otten property, identified as
PID 34-118-23-22-0014, in the amount of $19,348.30, and
WHEREAS, the Ottens subsequently commenced an action against the City contesting
the amount of the assessment, and �
� WHEREAS, the City and Ottens have agreed to settle the action by reducing the
assessment from $19,348.30 to $12,500.00,
NOW, THEREFORE BE IT RESOLVED, that the original assessment, identified on
Hennepin County records as levy number 13628, on the Otten parcel be reduced from
$19,348:30 to $12,500.00, and that a reduction of $833.33 be credited for the principal
installment paid in 1996 on the amended assessment, and that a further reduction of$938.79 be
credited for the portion of the installment paid in 1996 by the Ottens which exceeds the amount
that would have been due and payable under the reduced assessment, and that the assessment
remaining after said reductions shall be respread over the remaining 14 year commencing with
the installment due in 1997, at the original interest rate of 6.50%.
