The Council agreed to recind the original condition of resolution f2877 that would require the owner of Lot 2, Block 1, Byfield, Maureen Steele Bellows, to make certain land alterations within the existing access serving that lot. Such actions were deemed unnecessary by the City Engineer, the Building and Zoning Administrator and the Public Works Director. Please let me know if there is other inf orrnation or action that will be necessary on the part of the City to finalize this rather long, drawn out process for Ms. Bellows. Mr. Morrison recently entered into an agreement with Maureen Bellows respecting the pr6perty described above~-· As part of that agreement, Mr. Morrison was deeded Lot 1, Block 1, Byfield, Hennepin County, Minnesota and Ms. Bellows continues to own Lot 2. Originally under city of Orono Resolution #1985, the city council approved the final plat for a two lot subdivision for these two particular lots. That particular resolution provided that these two lots have a shared driveway access and was a condition to the split of the parcel into two lots. At the time of the agreement between Maureen Bellows and John Morrison, the parties decided that it would be in everyone's best interest to have a separate access at County Road 146 for each of these two particular lots. That, of course, necessitated an amendment to Resolution #1985 from the City of Orono. The City of Orono i~sued Resolution #2877 (copy enclosed) which amended Resolution #1985 and allowed for two separate accesses for Lot 1 and Lot 2, Block 1, Byfield, subject to certain terms and conditions. As you can see from the enclosed Resolution #2877, this required the owner of Lot 2 (Maureen Bellows) to obtain a land alteration permit for the purpose of upgrading the existing access to Lot 2, as well as providing a filling and grading plan to be approved by the city engineer. The access improvements were to be completed by December 1, 1990. Maureen Bellows did not apply for or obtain a land alteration permit nor did she provide a filling and grading plan to be FAX (612) 542-8617 approved by the city engineer. Instead, she went to the public works director, John R. Gerhardson, who reviewed the site in person and provided to Ms. Bellows a letter dated November 26, 1990 (a copy of which is enclosed). As you can see, it appears that the public works director determined that additional filling or raising of the existing driveway at Lot 2 would not be practical because of limitations and space. This letter does not, however, constitute a resolution of the city council of Orono which would allow for two separate driveway accesses to County Road 146 for Lots 1 and 2 as contemplated by both Ms. Bellows and John Morrison. Would you please consider assisting Ms. Bellows in obtaining another City of Orono resolution further amending Resolution #1985 which eliminates the first three sentences of section 1, page 2, of Resolution #2877? It would then be clear that the owner of Lot 1 will be entitled to receive a separate driveway access to County Road #146 so long as the owner of Lot 2 maintains all shrubs at three feet height or less within an area located between the traveled road and the utility pole, and the future owner and developer of Lot 1 obtains an access permit from the Hennepin Department of Transportation prior to application for a building permit for new residential construction on Lot 1. Unfortunately, I do not believe Ms. Bellows understands the legal necessity to receive such a resolution in order to ensure that the owners of Lot 1 and Lot 2 will, in fact, be able to receive a separate driveway access to each lot. It is my opinion that as things stand now, Ms. Bellows has not complied with Resolution #2877 making it impossible to get a permit for a separate driveway for Lot 1. In addition, I would like to be kept advised as to any progress you make in obtaining from the City of Orono an additional amendment to Resolution #1985 clarifying this matter. The enclosed resolution has been drafted based on the approval recommendation of the Council that includes the special findings and conditions of that approval. A RESOLUTION AMENDING RESOLUTION 11985 THAT GRANTED FINAL APPROVAL OF THE BYFIELD PLAT FILE 1998 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, on April 28, 1986 the City Council granted final plat approval of a two-lot subdivision application of Maureen S. Bellows (hereinafter the "subdivider") for a plat known as the Byfield plat; and WHEREAS, the City Counci 1 has considered a request of the subdivider that would seek to amend a condition of plat approval that would require a shared driveway access for Lot 1 and Lot 2, Byfield and has asked for separate accesses at County Road 146; and WHEREAS, the Council has considered the written comments of the Hennepin County Department of Transportation and the written and oral comments of staff and noting the following findings: 1. The Byfield plat provided 509 lineal feet of frontage along County Road 146. Lots 1 and 2, Byfield satisfied the required lot width to the rear of the front yard setback area at 200'+ each. 2. The Byfield plat did not require variances to the standards of the RR-lB, rural residential zoning district. 3. There is already an existing driveway access approved by Hennepin County that serves Lot 2. 4. There is adequate sighting distance based on the 40 MPH allowed speed for County Road 146 to provide safe access to Lot 1. NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota hereby approves an amendment of Resolution #1985 that granted approval of the Byfield plat that would allow single/separate accesses to Lots 1 and 2, Byfield, Hennepin County, Minnesota, subject to the following conditions: Page 1 of 2 l. Owner of Lot 2 shal 1 obtain a land alteration permit for the purpose of upgrading the existing access to Lot 2 (265 Brown Road South). Upon application for the land alteration permit, owner shall provide a filling and grading plan to be approved by the City Engineer. Such access improvements to be completed by December 1, 1990. A perspective buyer seeks separate access rather than a shared one with Lot 2. In reviewing the staff memos and the application file, Exhibit C, there is no record of a report from Hennepin County requiring a shared access. It would appear that the developer had preliminary discussions with the County concerning the use of a shared access because of their concern with the potential hazards posed in use of the existing access serving their residence. As the future residents of Lot 1, they would have had no problem in the installation and use of a shared access. In a recent letter from the County (Exhibit D), the County staff advised that it is a matter really for the City to decide if a shared access will be required as the existing house already has an approved curb cut/access. The report also identifies specific sighting problems of existing access. Staff has reviewed the access on site. We are concerned with visibility of the access from the County road and the sighting problems that result with exiting property from the vegetation that has grown out into the right-of-way of the County road. Upon preliminary review staff would recommend that the shrubs be trimmed back in line with telephone poles and that stopping area adjacent to the street right-of-way be raised so that cars traveling north at 40 MPH can see a car waiting to approach the public road. Prior to the Council meeting, staff will ask Glenn Cook to review the existing access within Lot 2 to determine if there may be other ways to make the existing approach safer. Byfield Plat September 6, 1990 Page 2 As for the City staff (Public Works Director and Zoning Administrator), we see no problem with separate accesses for both sites. There is 509 lineal feet of frontage along County road right-of-way. The subdivision did not involve lot width variances. There is already an existing driveway access approved by the County. Safe access to Lot 1 will be no problem as sighting becomes easier as you move northward towards the Luce Line. Staff would recommend approval of the owners request for single separate accesses to Lots 1 and 2 subject to the current owner completing specific improvements to the existing access within Lot 2 to improve sighting. Council Action To provide staff with conceptual direction so that an appropriate resolution can be presented to Council for formal action at their upcoming meeting. This resolution would amend the original resolution that approved the plat of Byfield (Resolution 1985). The wetland/buildable land boundary was established by the applicant's soil scientist, Steve Shirmers, based on observed soil types, vegetation, and topography, and verified by staff. Although the airphoto wetland maps indicate a somewhat larger area of Hamel soils, actual borings on the site along with the 2 • contour map have verified that the wetlands map is incorrect. Alao note that Long Lake Creek passes through the property. City Engineer Glen Cook haa reviewed the project and the watershed to determine the extent of flood plain, and recommends the edge of the wetland conservation and f lowage easement be established at the 935' contour, which closely coincides _with the dry buildable _line. Access to any County State Aid Highway (CSAH) cannot be denied unless the right of access has been purchased or alternate access, such as a city street or private road, is available. We do try to limit .county road access in the interest of safety and efficiency, and in this case would strongly encourage eliminating the existing driveway at 265 due to the limited sight distance, and having a shared entrance with 255. These driveways would split at the common property corner so no encroachment would occur, therefore relieving any easement requirement. However, since the properties are already split, only the City of Orono can make this requirement; Hennepin County can only recommend. Please call with any further questions.
