Zoning District - RR-lB
Mr. Strong proposes a division of his 10 acre homestead.
The subdivision will be a plat of three lots served by a
private road. The road will be designated as a 50' side
outlot. The topography along the south property line requires
a curving of the road and creates an additional outlot.
The ownership of that lot should be clarified.
Septic testing has been submitted for staff review.
Staff's report will be included in the pickets for the public
hearing on May 4, 1981.

Septic System/soil Testing Review
On March 31, 1981, I inspected the Strong property to review
the existing septic system and the proposed drainfield sites
on the 2 new lots to be created.
Lot 1. This lot contains the existing residence on about
1.5 contiguous dry acres, separated from the remainder
of the dry land by a 1+ acre wetland. The house and
well are situated so as to leave suitable area for
a replacement drainfield. The non-contiguous 0.5
acre dry land has no realistic use as future drainfield.
The existing septic system consists of 2 concrete
tanks and an unknown amount of drainfield. I noted
that the 2nd tank had what acpeared to be a hose
(attached to a pump?) leadinq to the wetlands, with
with 3 wooden support structure extending the hose into
the wetlands. This leads one to surmise that the
Strongs may be pumping sewage into the wetland, which
is a violation of the on -site ordinance. The system
appears to need some attention and I would recommend
that subdivision approval include a stipulation that
the existing system be suitably repaired/upgraded
to City standards.
Lot 2. This lot is quite sloped and contains some area not
suited for drainfield due to steep slopes. The tested
drainfield sites indicate fair soils for drainfield,
but this location also appears to lie directly in the
most likely driveway access from the cul-de-sac. I
,Aould recommend approval of this lot as -is, but the
applicant should be forewarned that should the driveway
or house location encroach on the tested drainfield
sites, retestirq would bo reciuired at the time a buildinq
permit is requested.
Lot 3. This lot has an ample area of fair soils for use as
drainfield. house location should not nose any maior
problems.

Jabbour moved to second. Vote: Ayes (6), Nays (0).
Ruxton R. Strong was present. The Planning Commission
asked for clarification concerning the dry buildable
area of each lot and the exact location of the wet
lands. It appears from preliminary review that the
road intercepts the wetlands on the south and that
we may have to recognize a variance setback for the
road. Staff advised that elevation would be required
to designate wetlands. Strong stated that he would
}eve all the necessary information required by the
Planning Commission for the next meeting.
The public hearing was scheduled for May 4, 1981.

Hammerel moved to approve the Planning Commission
minutes of March 16, 1981.

Staff Update
Staff wishes to respond to questions raised at our last
meeting concerning the proposed subdivision.
The wetlands area totals 1.3 acres of land and is located at
the 932.5 elevation. Lot 1. contains 2.04 acres o` dry build-
aLl_e land; only 1.6 acres of this is contiguous. The location
of the wetland and road outlot divides the dry buildable area.
Gaffron states this is no problem since there is ample good
soils to allow future septic expansion. His memo of April 6,
1981, notes concern with the existing system that appeared to
be "non conforming." Gaffron reviewed with the applicant the
irregularities found on the site. Strong noted it was a met-
hod suggested to clear drainfield lines. Gaffron will make
another site inspection; hopefully, I will be able to report
his findings at the meeting.
The wetland is located 18' from south property, line. At that
point an 18' wide road would be located right at the south
property line. A variance of 26' from the wetland will be
required. There are no setback requirements for roads to
property lines. The road will require engineering plans that
will determine adequate sizinq of cul�,ert for drainage way to
the south.
If approved, your recommendation should contain the following,
conditions:
1) Flowage & Conservation casement over the 1.3 acres of
wetlands.
2) City to acquire underlying road and utilities easement over
Outlot B or A.
3) All access to 3 lots via plat road.
4) Ownership of Outlot A must be decided - Plannin(; Commission
may advise applicant to combine this outlot with road out -
lot for benefit of sharec ownership.
5) Payment of Park dedic-at icn fee in the amOiin`_ of $400. 00 -
$200.00 for each undeveloped lot.

Jabbour was concerned with the septic system and the
high water. Raiche noted that he would remove the
gravel road prior to final subdivision approval and
new road constructed along west edge of the property.
Goetten motioned to approve the application subject
to the following conditions:
1) Private driveway to serve all three lots, no direct
access for Lot 1 to Watertown Ltd.
2) Removal of existing road down center of property.
Developer's agreement will be required if improve-
ments not completed prior to final plat approval.
3) City to acquire road and utilities easement over
driveway outlot.
4) All disturbed area to be seeded within 10 days of
grading completion.
5) Payment of park dedication tee in amount of S600.00
$200.00 for each lot.

Jabbour questioned the maximum width of the proposed
driveway and hoped that a minipium of 14 ft. from the
lot line coul.l be maintained because of the proximity
of wet lands. In reality, the road serves two lots
to the rear of the property and therefore could main-
tain the standards of a private driveway. This road
would never be used as a proposed throuch Load. He
would recommend limitin(i the width of the r-;ad out
lot to 30 ft. with the normal cul de sac of 100 ft.
McDonald asked Stronu to describe what was taking
place the day the site. inspector made a site inspec-
tion. Stronq sated that this was an att,mpt to
clear the drainfielci lines, btct that he would check with
the site inspector on questions he had, concerning the
existing septic system.

Adams moved to approve the 3 lot plat of Ruxton R. Strong
approving a setback variance to the wet lands of 26 ft.
for the proposed road outlot based on the hardship of the
location of the wetlands blocking access to rear of the
property and subject to the following conditions:
1) Road out lot B to be no more than 30 ft. width and
to have a `;niched road service not to exceed a 14 ft.
width located ai.,ag at the most southern location.
2) Driveway to be constructed to private driveway standards.
3) Out lot A to be determined a non -buildable lot
and to be owned by lot 2.
4) Dedication of 33 ft. for Brown Road or County Rd. 146.
S) Flowage and conservation easement of the 1.3 acres
over wetlands.
6) All access to these lots via plat road.
7) Payment of the Park Dedication Fee of S400.00;
$200.00 for each lot.
8) Adequate protection of wet lands ;3rovid�d Jurinq con-

final plat approval.

were too ambitious for this size lot. They noted Variance

applicant as to limiting the hardcover.
Bredeson asked for -larification and to give specific
dlr. .(7ti,_)r. as to al1r)wed amound of hardcover for his
proposal.
J-ibbour recommended the following standards:
1) ilouse to be located 25 ft. from cul de sac,
10 ft. from north property line, and to be
limited to a maximum of 2800 sq. ft hardcover.

Planninq Commission Action:
1) to approv( subdivision subject to condition::
2) to approve a 22' setback variance from wetland for
private driveway
Strong proposes a 3 lot plat of his 10 acres homestead lot.
Lot 1 contains 2.04 acres of dry buildable land; only 1.6
acres of this is contiguous. The location of the wetland and
road outlot divides the dry buildable area. saffron states
this is no problem since there are ample good soils to allow
future septic expansion. Lots 2 and 3 contain 2 acres of
dry buildable lands.
The wetland area is 1.3 acres of area and is located 18' f-om
south property line. Planning Commission strongly suggest -
that this road be only a 14' width and constructed along
south property line at that point. Planning Commission notes
this would not be the location for a future expanded east -
west road and that the road outlot be 30' wide to designate
the sensitive area for consideration as to planning of future
City roads.
Please review the Planning Commission minutes of May 4, 1981,
for background and recommendation.

Dear Mark,
This is to confirm our disct.ssion last Fr..lay about the road design on
this plat. I al-o talked with Mr. Strong and with Glenn Cook, City
Engineer. I believe that we are all in accord as to what should be
done.
1. Hennepin County is-anuiring that the access onto County goad 146
be moved somewhat north. The final design will meet their O aht
line requirement.
2. The outlot will be widened on the west end to accomodatp the
relocated access to County Road 146 arid to allow a 24 ft. driving
surface extending "rom Cour•y Road 146 to a .;,'nt past where the
first dr-'vewjy takes off north.
3. The loop will be ea ed somewhat with the radius increased for better
sight lines around the curve. The grade will likely incre.ise to
around 91.
4. The roadway su fface will remain narrow through the wetland and where
necessary to avoid significant trees. Where possible, the surface
will widen out to 16 ft. or so (18 ft. is better) to allow cars to
pass and to allow emergency vehicle access. The ditching does not
have to be within the outlot r4ght-of-way.
5. The platted outlr,t will be revised to accome.date the aoove road changes.
This design should Imrrove the appearance and function of the driveway
without adversely affecting the wetlands, woods, or the intent of the
owner.

GENERAL REQUIREMENTS
Applications for commercial and industrial driveways or driveways servicing parking lots or garages
with five or more vehicular parking spaces must be accompanied by two 12) separate layouts. Such
layouts must meet the requirements of the Rules and Regulations Establishing Design Specifications
for Driveways along the Highway Systems of Hennepin County, Minnesota, Copies available at the
Hennepin County Highway Division 320 Washington Avenue South, Hopkins, Minnesota 55343.
2. Applications for entrances serving private residence, farm or parking lots of less than five vehicular
parking spaces need not submit a sight plan, but shall make an appropriate sketch in the space
provided on the front of this sheet. Such sketch shall generally locate the entrance, indicate its
dimensions, and relate to property lines.
3. No work shall be started until application is approved and permit issued
4. If the installation of this driveway makes it necessary to work on the roadway, traffic must be
protected; lites, signs and proper barricades must be in place.
5. It is expressly understood and agreed that this permit is conditioned upon not placing any materials
on traveled portion of the Countv roadway and that restoration of all disturbed area becomes the
responsibility of the applicant. The area disturbed must be restored to its original or to a satisfactory
condition.
6. After driveway construction is completed, persons requesting rnstallr•ion must notify the
Maintenance Division that such work has been completed and ready for final inspection and
acceptance by the Hennepin County Highway Division
7. No changes or alterations +n entrances may be made at any time without written permission from the
County Engineer.
9. App.oval of this permit does not deny the County Engineer the future right to revise, relocate or
close any entrance to expedite the movements of vehicular or pedestrian traffic. The County retains
the right to close said entrancels) at its discretion, based upon the necessity for traffic regulation and
r.ontrol
9. Existing dnvrrways are not autunythcally perpetuated. In the event of a change in land use or a major
change in the traffic pattern of the existing facility, new driveway applications may be requited by

Our thanks to you and Jean Maybusth for discussing this matter with
Tom Borman and me on March 2nd. At that time, we discussed by con-
ference call the proposed plan for the subdivision of the above de-
scribed property. You asked that we confirm our conversation by
letter to you.
As you know, Ruxton Strong prepared some subdivision documentation
to submit to the City Council over a year ago. At that time, Mr.
Strong was unable to obtain a bond and, therefore, did not receive
final approval for the subdivision. Mr. Strong died March 27, 1982,
and title then passed to his wife, Patricia C. Strong.
Since Mr. Strong's death, Patricia Strong has attempted to sell the
property. As we discussed, there are several judgment liens against
this property. (Please see attached title opinion.) In order to
extinguish those liens and render the title marketable, Mrs. Strong
must preserve her homestead exemption. She will be unable to do so
if the property is platted pursuant to the City subdivision process.

For that reason, we have designed the following plan with your approval
and with the approval of the purchasers, Larry D. and Alvina R. Bader.
Mrs. Strong will close with Baders and convey fee title to the prop-
erty, transferring unplatted land, on March 4, 1983. We will file
the warranty deed immediately after closing. We wii then commence
an action to quiet title and extinguish the judgment liens based upon
Mrs. Strong's homestead exemption. We anticipate the action will go
by default since the issue of the homestead exemption has already been
raised in prior bankruptcy and prcblte proceedings without objection.
The Baderr will submit the following documents to the City Council so
that this matter can be considered at the Planning Commission's March
21st meeting:
1. Declaration of private Road Easement and Declaration of
Covenants for Maintenance of Same;
2. Road and Utilities Easement;
3. Quit Claim Flowage and Conservation Easement and Waiver
of Damages;
4. Mylars.
You indicated that the City would allow the Baders to submit the above
documents and make the appropriate appearances at the Planning
Commission and City Council for final approval of the subdivision. We
very much appreciate your cooperation and that of Ms. Maybusth in
facilitating this process so that the matter can be resolved on a
timely basis. Douglas Klint, attorney for the Baders, and the Baders,
have co;,curred in this plan and also extend their thanks to you, Ms.
Maybusth and the City cf Orono. If you have any questions, please
