Motion, Ayes (4) - Nays (0). i1r. Ronald D. Ross, 1960 Lakeview Terrace stated that: "I have considered your proposal and I have decided against signing off an easement: 1. The barn is located on Lot 1, the proposed easement +s for Lot 2. I cannot see any relevance between the two topics. 2. Signing off an easement for Lot 2 would not put me in compliance with any Orono ordinance that I am now breaking. 3. Lot 2 is considered by Orono as wetlands and unbuildable. The apparent reason why I am being asked to sign this easement is to assure Orono that no building can ever be placed on that lot. But since the Village has the power to grant or deny building permits anyway, this easement proposal appears redundant and unnecessary to the Village. 4. There is no apparent advantage to me in doing so. The reason I initially considered the proposal is that I had heard that sometimes Village or County or State authorities allow development or even develop themselves wetlands property to make it more suitable for certain types of wildlife (like a duck pond or etc.) if that property is sold to or given to them or if an easement is granted. This proposal has no such implications. Since all these things have virtually nothing to do with my request for a conditional use permit, I respectfully request consideration of my permit based on its own merit and on its own compliance." Nfuhich Apri 1 29, 19 76 James Abbott - loon South Brown Road Mr. Abbott is requesting a variance from our Marsh and wetlands Ordinance and a conditional use permit to fill and grade within the 26' setback require- ment from marshlands. Ne has started some of the grading and it appears to be extending somewhat into the marsh or up to the very edge of the marsh. The attached plans show the existing grades and the section plans show proposed grades. Although the plans show adequate elevation, site inspection reveals aquatic vegetation along the edge of the graded area. ADJO1UW#1 T ORONO COUNCIL MENTING HELD MAY 10, 1:,5 Page 13 I would recommend this be referred to the Planning Commission. This would give us ample time to correct any errors and review the proposal before action is taken. On April 26, 1976, Mr. Wells submitted the new, correct survey of the property. This survey shows the property to be quite a bit smaller than the original. The parcel does, however, exceed minimum area and lot width requirements and all side yard setbacks meeting the requirements. This request consists of 2.5 ft. variance from the street setback requirement only. I see no big problem here. I would suggest we not delay the project and recommend waiving work session review and approval of the variance. Planning Co mission Meeting - May 3, 1976 Planning Commission recommended approval of a front setback variance due to the lay of the land and the location of the existing residence. Searles moved, Massengale seconded, to approve the variance for Patrick Wells, 951 Spring Hill Road, as per the Planning Commission minutes of Ilay 3, 1976. Motion, Ayes (5) - Nays (0) . VARIANCE 951 Spring Hill Road (Continued) Henry Muhich, Building i Zoning Administrator, CONDITIONAL USE PERMIT stated that James Abbott, 1000 Brown Road South, 1000 Brown Road South is requesting a variance from our marsh and wetlands ordinance and a conditional use permit to fill and grade within the 26 ft. setback requirement from marshlands.
