S � A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZO1vING CODE SECTIONS 10.22', SUBDIVISIONS 1 AND 2; 10.55, SUBDIVISION 8; 10.24, SUBDIVISION 5(B); AND . 10.56, SUBDIVISION 16(L) FILE #2272 WHEREAS, W. Wyatt Moe and Nancy Moe (hereinafter "the applicants") are owners of the property located at 1230 Spruce Place within the City of Orono (hereinafter � "City") and legally described as follows: Exhibit A attached (hereinafter "the properry"); and • WHEREAS, the applicant has applied to the City for variances to Municipal Zoning Code Section 10.24 Subdivision 5(B) to permit construction of a new residence on a lot 0.49 acres in area and 58 feet �in width where 1.0 acre in area and 140 feet in width are norma.11y required; and a variance to Sections 10.22, Subdivisions 1 and 2; 10.55, Subdivision 8; and 10.56, Subdivision 16(L) to perinit.the construction of a new residence constituting hazdcover in the 75-250' zone in excess of the 25% hardcover normally allowed in that zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: . FINDINGS 1. This application was reviewed as Zoning File #2272. � 2. The property is located in the LR-1B Single Family Lakeshore Residential Zoning District. 3. The Orono Planning Commission reviewed this application on August 18, 1997, and on a vote of 5-0 recommended approval of the proposed variances based upon the following findings: • Page 1 of 6 z � � . � • . The property currently contains a small cabin which is individually served with municipal sewer and has been individually assessed for • sewer. B. The property is• the subject of a concurrent lot line rearrangement application which increases the property in area from a pre-existing 10,300 s.f. (0.24 acre) to 21,000 s.f. (0.49 acre), resulting in a lot which is similar in area to many other developed residential lots in the LR-1B District generally, and which is larger than a majority of developed residential lots in the immediate neighborhood including Spruce Place and Loma Linda Avenue. C. The lot width of 58 feet is sufficient to allow construction of a single . family residence which meets the required 75' lakeshore setback, required 10' side setbacks, and which will not encroach the average lakeshore • setback. D. Hardcover in the 75-250' zone is proposed to increase from the � conforming pre-existing level of 10.9% to 37.7% where only 25% is normally allowed.. This level of hardcover is similar in magnitude to levels approved for other lots of similar size in the LR-1B zone. Adherence to the 25% limitation would not allow for construction of the residence as proposed unless the driveways or garage were eliminated or severely reduced. No hardcover will be located in the 0-75' zone. 4. The City Council has considered this application including the findings and recommendations of the Planning Coinmission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and � welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect tr�c conditions, light, air nor � pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a ` Page 2 of 6 , . , ' ' „ • . � O� _ O O . ��. . �b� - CITY of ORONO � � �'� G'�� RESOLUTION OF THE CITY COUNCIL , � � ��kESH�4��' . � � NO. � � 9 � � � � demonstrable hardship or difficulty; is necessary to preserve a substantial � properry right of the applicant; and would be� in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants variances to Municipal Zoning Code Section 10.24 Subdivision 5(B) to permit construction of a new residence on a lot 0.49 acres in area and 58 feet in width where 1.0 acre in area and 140 feet in width are normally required; and a variance to Sections 10.22, Subdivisions 1 and 2; 10.55, Subdivision 8; and 10.56, Subdivision 16(L) to permit the construction of�a new residence � constituting hardcover in the 75-250' zone of 37.5%, subject to the following conditions: 1. No hardcover will be allowed in the 0-75' zone. Hardcover in the 75-250' zone shall not exceed 37.5% per the site plan and hazdcover worksheet attached to :� this resolution as Exhibit B. Applicant is advised that hardcover on the properry based on this approval will exceed the normal limits, and any future proposal to increase hardcover on the property will likely not be approved, but might be ' approved only in conjunction with the concurrent removal of pre-existing hardcover, resulting in no increase or a net decrease in hardcover on the property. 2. Applicant shall provide adequate grading and drainage plans for the proposed ', residence which must be approved by the City, prior to issuance of a building permit for the proposed new residence. 3. Authorities granted by this variance run with the property not with the � � applicants, but aze permissive. only and must be exercised by application for a � building permit within one year of the date of Council approval, or this variance � will expire on that date (August 25,�1998). . , � 4.
