Variance - Stable Setback Variance 6 Conditional Use Permit
For Horses
Mr. Platteter has submitted the attached application foi a variance to
construct a stable which would not conform to the setback requirements of
150 ft (Exhibit A).
I have checked the file and found no record of a conditirlial use permit
approved for the proposed animal unit use. Therefore, tl. conditional use
permit for horses on the property must also be addressed. We might also
address the maximum number of animal units, as the proposed barn would
be 1,980 sq. ft. in area.
Exhibit B (survey of property) indicates proposed location of stable.
The required setback for a stable is 150 ft. from lot lines. This application
would require approval of 2 setback variances as the location as proposed
would be 130 ft. from the south property line and 90 ft. from the corner
of the Lawrence property. Respective 20' and 60' variances would be
necessary. Exhibit B also indicates property dimensions. The area is
slightly under 7 acres.

Exhibit D - floor plan of proposed stable (7 stalls and 2 other bays).
Our ordinance requires 1 acre of pasture over and above the minimum lot
area requirement for each animal unit.
The lot area requirement in this zoning district is 2 acres. Since this
parcel consists of almost 7 acres, five animal units could be considered
for approval of the conditional use permit. If we approve the conditional
use permit for more than five animal units we should address it as a
separate variance along with the conditional use permit.
We should also address security measures to protect the trees and foilage
on the neighboring properties. We received numerous complaints from
Mrs. Lawrence in the past. Horses owned by the previous owner had damaged
most of the Lawrence trees within reach of the hor:;es.
I'm enclosing copies of several of the inspection reports and letters
regarding these previous complaints. Also enclosed are several police
reports and photos.

The Platteters were present.
The Planning Commission reviewed the proposal. They addressed the proposed
setback of 90 ft. from the Lawrence property. Mr. Platteter explained that
the topography of the land somewhat dictated this location to eliminate
the possibility of waste runoff directly into Dickey's Lake. He also
requested a 5 ft. extension in the proposed length of the stable from
the projected 55 ft. to 60 ft. - the barn components come in modulars
of 4 ft.
The Planning Commission expressed extreme concern for securiLJ for protection
against property damage on neighbor's property.
The Platteters ensured the Commission that proper fencing would be
erected to provide for that protection.
The Planning Commission also addressed the variance of two animal units
over and above the permitted number of 5 horses.
The Planning Commission recommended approval of the varf.ances necessary
for the stable size and location and approval of the conditional use
permit, for five horses only (no variance for 7 horses) conditioned on
compulsory review for renewal of permit if complaints of violation
are registered.

The Planning Commission recommended approval of this variance and
conditional use permit conditioned only upon review if complaints are
received. Because of my personal experiences with this property, I
would like to suggest the following additional conditions:
1) The erection of fencing acceptable to the Zoning Administrator,
to protect neighboring properties prior to issuance of a building
permit.
2) That the entire properry be used for pasturage, or the pasturage
rotated, so as not In confine the animals to a small area, especially
not the area to the front of the lot.
3) That the property be kept clean of manure buildup, particularly at
spring melt.
4) That the h:~rses be properly fed and cared for at all times.
5) That the Council consider regulations on the use of electric fencing
within the City.

Mr. Platteter was present.
The Zoning Administrator stated the proposed
location of the stable will require a 60 ft. and
a 20 ft. variance from the east and south lot
lines respectively. He noted that in the past
the City has had problems with the horses on
this property extending over the fence and eating
the neighbor's vegetation before Mr. Platteter
owned this property.
Mr. Platteter pointed out on the survey the location
of the fence and stated he is proposing to remove
all the old fencing and replace it. He explained
there is a great slope which dictates why he
is requesting a variance. He did not feel he could
move the barn. He stated he plans to have 2 mares,
2 gildings and 2 arabians.
The Zoning dministrator stated on this 7 acre
parcel, 5 horses would be allowed with a conditional
use permit.
Mr. Platteter stated he has talked with some
builders who suggested the barn be 60 ft. x
60 ft. to accommodate the 4 ft. modulars. He
explained these horses are show horses and do not
eat off the bround because they are on a constant
high protein feed. He added that he plans to keep
any ponies for 1 - 2 years.
Tim Adams asked how many acres of pasture there
would be. Mr. Platteter replied about 3 - 4
acres.
The Commission discussed the amount of dry land
which could be used for pasture and how much
was wetlands.
Tim Adams stated they are only pasturing about �
of the property, adding that the wetlands is good
for pasture and that the horses are there
frequently.
Chairwoman McDonald asked how much would be fenced.
Mr. Platteter replied they plan 3 pastures, each
1/3 of the total area. Commissioner Hammerel
asked if the fence would keep the horses from
the neighbor's vegetation. Mr. Platteter assured
the Commission this would not be a problem.

Commissioner Wilson stated he felt some provision
should be included to take care of any complaints.

The Commission informed Mr. Platteter that with a
conditional use permit if there are any complaints
after one year the conditional use permit may
not be renewed.
Commissioner Hannah moved, Commissioner Hammerel
seconded, a motion to recommend approval of the
variance request by Dennis Platteter with the
following conditions:
1) the barn be located 90 ft. from the east lot
line and 130 ft. from the south lot line
2) the barn be 60 ft. x 60 ft.
3) 5 horses only be allowed
4) approval be conditional that if any complaints
are received from the neighbors the conditional
use permit be reviewed
Motion - Ayes (6); Nays (0). The motion passed.
Tim Adams, developer for the project, was present.
The Zoning Administrator instructed the the
Commission that along with the variance request,
Mr. Adams is also requesting final plat approval.
He informed the Commission that Mr. Adams did not
submit the final plat until 2-23-78 which was not
adequate time for staff to prepare a recommendation
prior to the meeting.
He stated that one condition when the Planning
Commission originally approved the subdivision was
that there be only two riparian lots and that the
lot meet the 200 ft. minimum lot width requirement.
He explained that Mr. Adams appeared at the Council
meeting and was advised to come back to the
Planning Commission and apply for a variance for
three riparian lots.
Commissioner Hurr stated the setback requirements
in this zoning district are 50 ft. from the front
lot line and 50 ft. from the side lot line.
Tim Adams stated he is asking for a 35 ft. variance
for Lot 6 and explained this lot has a considerable
amount of wetlands and would be better for a
smaller house. There is a total of 565 ft. along
the shoreline and each of the corner lots, Lots
1.6 and 7, will meet the required 200 ft. lakeshore
Width. He reviewed the lakeshore situation.
He stated they have a 10 ft. easement along the
lot line and the dock will be built along this
easement and will serve only the owners of Lots
16 and 7.

This letter is to advise you that the Orono City Council I3s
approved your request to construct a stable for 5 horses subject
to the following conditions:
1. 36' x 60' stable located according to survey submitted
2. Maximum 5 horses
3. The erection of fencing acceptable to the Zoning Administrator,
to protect neighboring properties prior to issuance of a building
permit for the stable
4. That the entire property be used for pasturage, or the pasturage
rotated, so as not to confine the animals to a small area,
especially not the area to the front of the lot
5. That the property be kept clean of manure buildup, particularly
at spring melt
6. That the horses be properly fed and cared for at all times
7. All subject to Council review upon complaints of neighbors
or evidence of runoff pollution to Dickeys Lake
Condition #3 above must be completed and you must apply for a
building permit with all information as required by the building
inspector prior to 3-16-79 or the variance will expire at that time.
