The applicants propose the division of their homestead totaling 6.2
acres. 1.5 acres will be dedicated as County and City road right-of-way.
The gerrymandered lot line results from the presumed location of the
existing drainfield that serves the existing residence (review Exhibit D).
The exact location of the drainfield has not been confirmed for this review
and as a result staff cannot confirm that system is located within the
defined lot line. The proposed lots meet the required 200 feet width at
the rear of the front yard setback line. Septic testing confirms principal
and alternate sites for Lot 2 and an alterante site for Lot 1. Accesses
exist and have been previously approved by both County and the City.
Hennepin County Highway Department has been asked to comment on the
plat, staff will report at the meeting. The County may ask for the closing
of the County access and sharing of the access at North Brown Road.
Staff Recommendation -
Staff would recommend that your approval of this 2 lot plat
application be conditioned on applicant submitting confirmation of exact
location of existing drainfield within proposed Lot 1 prior to scheduling
the application for Council's review. If a major adjustment of the shared
lot line is required, staff will reschedule the subdivision before the
Planning Commission.
The following conditions are also suggested for approval of the
division:
1. Payment of a park fee for Lot 2 at $200.00.
2. Approval of accesses (pending determination of Hennepin County
Highway Department):
a) Individual access per existing curb cuts;

At your October 19th, meeting, the application was tabled pending
resolve of the location of the drainfield area in relation to proposed
dividing line. The applicant was asked to excavate a 3-4' depth ditch
along the dividing line as shown on staff sketch, Exhibit A. Gaffron has
confirmed that there was no sign of septic drain'ield lines within the
ditch area. The existing septic system appears to be totally located
within proposed Lot 1.

yard from both the porch and house. She noted that
moving the porch addition further out of the 75'
lakeshore area would require the removal of a large 200
year old oak tree. She questioned applicant about the
plans that show sliding glass doors on east side of
porch with no steps or decking.
Richard and Betty Hanson were present for this matter.
Mr. Hanson stated that the sliding doors are for total
ventilation and they do not plan any further decking
outside of these doors.

RESOLUTION
City Administrator Bernhardson explained that Council
denied the proposed walkout excavation cut at their
January 11, 1988 meeting. Applicant has subsequently
submitted a revised plar. showing a 3' deep flat-bottomed
excavation on the lakeshore yard; and a balcony from the
main floor of the house, with retention of the existing
deck near the lakeshore bank. Staff recommended that
the revised plan be sent back to the Planning Commission
for review. He noted that this plan does not indicate
applicant's plan for restoration of the lakeshore bank.
John Waldron was present for this matter and explained
the intent to create a more level lakeshore yard area.
He then explained that in trying to eliminate the need
for costly retaining walls, he proposes to repair the
lakeshore bank by removing 3' of the slore where the
severe erosion took place and plant the rem :ning bank
with sumac and day lilies to prevent futuie erosion.

of soil disturbance, whereas his proposal would involve
approximately 150 cubic yards of soil disturbance. He
requested Council give some direction regarding this
proposal before referring it back to the Planning

Review of Application -
The applicants proposed the division of theii homestead totaling 6.2
acres; 1.6 acres wi 1 1 be dedicated as County and City road right-of-way.
The proposed lots meet the required 200' width at the rear of the front
yard setback line. Existing structures meet the required setbacks from the
newly proposed lot lines.
Septic testing confirms principal and alternate sites for the newly
created Lot 2 and an alternate site for Lot 1. In order to confirm the
exact location of the existing drainfield serving the present -esidence in
relation to the proposed lot line, the applicants were asked to excavate a
3-4' depth ditch along the dividinq line as shown on staff sketck4 (Exhibit
H). Gaffron has confirmed that there was no siqn of septic drainfield
lines within the ditch area. The existinq septic system appears to be
totally located within proposed Lot 1.

Accesses exist and have been previously approved by both County and
the City (review Exhibit E). The County wants all access from Lot 1 to Lot
2 closed off. Access to Lot 2 must be via North Brown Road only. A single
access use is approved off County Road 6 for Lot 1. Cook, in his report,
asks that unused extensions of driveways be removed within both lots. In
the Planning Commission recommendation, at their meeting of December 21st,
1987, members approved a deadline date of May 1st, 1988 for removal of the
unused extension of the existing driveway (review Exhibit I, the
preliminary plans). The City will ask for the removal of the existing
driveway 20' on either side of the lot line except for the northern
extension within Lot 1 that serves as additional parking area, but the
portion that encroaches Lot 2 along the northern portion of the new
dividing line must also be removed.
Planning Commission Recass endation -
To recommend approval of a 2 lot plat application of Richard 6 Karen
Ziminski finding all standards of the on -site septic, zoning, and
subdivision codes satisfied, subject to the following conditions:
1. Payment of a park fee for Lot 2 at $200.00.
2. Approval of individual accesses as set fort- in the Hennepin
County report as follows: Lot 1 to be served by existing curb cut at
County Road 6 and Lot 2 to be served by existing curb cut off of North
Brown Road.
3. The unused extensions of the existing driveway located now within
the shared lot lines of Lots 1 and 2 are to be removed by May 1, 1988
as a condition of final subdivision approval. Portions to be removed
are specified as 20' on either side of the existing dividing line
along the southern portion of the encroachment and that portion of the

The Ziminski preliminary subdivision application was tabled
when staff was made aware by the applicant that the preliminary
plan (Exhibit A) submitted with your packet information for your
January 25th meeting did not accurately describe the existing
drive areas that serve the property.
Please review exhibit B, the revised plan clearly defines
the paved area in relation to the proposed dividing line. In
order to meet the condition that no though traffic or shared use
of drives be allowed to continue, staff would ask only that the
gravel drive within Lot 2 be removed within a 30' area to the

WHEREAS, Karen & Ri-�hard Ziminiski (hereinafter "the applicants")
on September 25, 1987 filed a formal subdivision application with the
City for a division of 2 lots of a property legally described as follows:
See Exhibit A, (hereinafter "property"); and
WHEREAS, after due published and mailed notice in accordance with
Minnesota Statues 462.358 et. seq. and the City of Orono Zoning and
Platting Codes, the Orono Planning Commission held public hearings on
October 19, 1987 and December 21, 1987 at which times all persons desiring
to be heard concerning this application were given the opportunity to speak
thereon; and
WHEREAS, at their regular meeting held on February 8, 1988 the
Orono City Council considered the subdivision application of the
applicants, noting the following findings of fact:
1. The property is located within the RR-113 Single Family Rural
Residential zoning district requiring a minimum of 2 acres of
contiguous dry buildable land within each newly created lot.
2. The property contains a total of 6.2 acres, all of which is
considered dry buildable.
3. The proposed plat contains 2 lots each meeting the 2 acre minimum
lot area requirement.
4. Each lot shall be served by an existing curb cut. Lot 1 shall
access only off County Road 6 and Lot 2 shall access only off North
Brown Road.
5. All of the lots meet the required 200' width adjacent to the road

residence can be constructed oi, I.ot 2 without the need for any
variances.
6. Septic testing has confirmed that each lot contains adequate and
suitable soils for on -site sewage treatment disposal systems.

of the findings noted above, the City Council of the City of Orono hereby
approves the preliminary plat application of Karen & Richard Ziminski per

January 18, 1988, subject to the condition that prior to the issuance of
building permits for new construction the final plat must be filed with the

The above mortgage was satisfied by a Satisfaction of Mortgage dated
March 1, 1988, filed March 11, 1988 as Document No. 5385611. The next time
the abstract is updated, the Abstractor should be requested to include in the
abstract the Satisfaction of Mortgage and also a Name Change filed June 25,
1987 as Document No. 5123630 indicating that Twin City Federal Savings and

WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
1IORREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic a^d safe development of
land within the City; and
WHEREAS, the City Council has considered the application for a
subdivision of a two lot plat by Richard D. Ziminski and Karen Ziminski,
the subdividers; and

City Administrator Bernhardson explained the commercial
site plan review and request for multiple variances for
Windward Marina. Because this is Proposed as a 3 year
phase plan, he noted that the City Attorney has advised
that instead of granting a variance for 3 years, the
variance should be granted for one year providing
construction is started within that year, the three year
phase may be continued.
James Rivers was present for this matter and showed the
Council the proposed site plan.
Councilmember Goetten stated she was impressed with the
proposal and reduction of hardcover. She voiced concern
with controlling the access and asked if there would be
a crosswalk?
In regarc, o controlling the access, Nor. Rivers stated
that they plan curbing (which currently does not exist)
which should help control the access. Mr. Rivers stated
that he has also met with Hennepin County to request a
crosswalk to serve Windward Marina as well as Minnetonka
Boat Works.
