NOTICE IS HEREBY GIVEN that the Orono Planning Commission, City of Orono, Minnesota,
will hold a Public }Tearing in the Council Chambers on Monday, April 18, 1971, at 7:45 p.m.
on the matter of the subdivision application of ,James If. Kallestad for property located
at 140 S. Brown Road and legally described as follows:
That part of Northwest quarter of Northeast quarter of Section 3, Township 117
North, Range 23 West of the Sth Principal `ieridian, bounded by a line described
as follows: Beginning at a point on the West line of said Northwest quarter of
the Northeast quarter distant 460.8 feet South of the Northwest corner of said

A RESOLUTION APPROVING K.ALLESTAD ACRES
INIIERF-kS, the City of Orono is a municipal corporation organized and
existing under the laws of the State of Minnesota; and
WIEREAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of land within the
City; and
MERE S, the City Council has cons .Iered the application for a sub-
division plat for Kallestad Acres by ,lames II. Kallestad;
NOW, -IIIEREFORE, BE IT RESOLVED, that the City Council of the City of
Orono hereby approves the plat for Kallestad Acres, Hennepin County, Minnesota;
subject to the following:

Subdivision (Preliminary)
Request to divide parcel exceeding 6 acres into two lots both of which would exceed
the 2 acre minimum area. 'Che sq. ft. areas are not indicated on the plan.
The proposal includes the proposed location of the main structure and two accessory
structures. The location for the proposed tennis court is only 30' from the north
lot line which runs adjacent to the private access road to the Ilan Eeckhout
property. This access might at some time in the future become a public road to
other parcels resulting from future subdivisions. Our ordinance requires a SO'
setback from the road so the proposed location of the tennis court would require
a 20' setback variance.
I have not as yet received the topog and proposed drainage plans.
A public hearing has been scheduled for April 18, 1977, at 7:4S p.m. A Park
Dedication Fee of YSOS (S2SO/lot) x,o ul(l he forthcoming if the subdivision is
approved.
Copies of the proposal havo been forwarded to the llenn.�pin County Public Works
Department, ''M, 11VR, Police Department, City Public Works ')epartment, Finance
Department, City Ingineer and City Attorney for comments.

The Cmmission was also concerned about the proposed dredging.
Applicants were requested to submit certification of approval
f)r the dredging, seawall and riprap from John James, the
owner of the lagoon.
A public hearing was scheduled for Monday, May 2, 1977,
at 7:30 p.m.
Work session only. Mr. Lobben from Hennepin County Vo-
Tech Schools was present and the Planning Commission
reviewed the application with him. Mr. Lobben assured
the Commission that this application was a separate
matter from the Vo-Tech proposal. This is the same
basic application as approved last year. Only difference
is proposed new access off County Road 16 which appears
to have been in existence for many years. Mr. Lobben
stated that this access would be used by a couple of
pick up trucks only. The Commission was concerned about
this new access and the potential use it could provide
to the Medina area.
Mr. Lobben informed the Commission that Vo-Tech was con-
sidering using the old barn in Medina for storage of
farm equipment. No access would be necessary from City
or County roads as these vehicles would travel back and
forth over the farmland between Medina and Orono. Clark
Engineering is researching the possibility of providing
a bridge over the creek for this purpose.
Work session ,,-mly. After reviewing this applicatioi,
the Planning Commission suggested replacement of dead
trees with larger trees and the planting of vines. Also
require larger trees on any new planning. Applicant
would be required to submit professional landscape plan
indicating size and species of trees and bushes.
Commission determined professional planner is necessary
for the new building plan proposal. They also felt
professional landscaper may be able to suggest trees
for this type of soil to alleviate the current problem
with the trees dying.
A public hearing is scheduled for Monday, April 18,
19770 at 7:45 p.m.
James Hawley was present. He stated that he received
prior approval from the Planning Commission and Council
for a building permit. This approval was based on the
assumption that this property contained 2 full acres.
Now it appears that there are not two acres. The Zoning
Administrator stated that Mr. Hawley would have to sift -
mit a new application along with a survey.

1. Dedicate an additional seven feet of rigl;'_ of way

of CSAH 146.
2. An approved entrance permit is required before beginning
construction of any new or revised access to the County
Road. Permit forms and information on access require-
ments are available from our Traffic Section.

Chairwoman McDonald announced that this was the tijie and
place for a Public Hearing on the petition of .Ta;r;es
Kallestad for a subdivision of property located at 2732
Caroline Avenue. The Zoning Administrator presented the
Notice of Public (Tearing and the Affidavit of Publication.
The Zoning Administrator stated that the applicant is
requesting approval to subdivide his parcel exceeding
six acres into two lots both of which would exceed the
minimum !-acre dry buildable area.
Proposed location for the tennis court is only 30' from
the north lot line which runs adjacent to the private
access road to the Van Eeckhout property. This access
could become a public road resulting from fixture sub-
divisions. The present ordi ance requires a 50' set-
back from the road, so the ..iposed location of the tennis
court requires a 20' variance.
Mr. & Mrs. Kallestad were present. They stated that their
property falls off and any other location for the tennis
court would require a considerable amount of grading.
After all the public were heard, the public hearing u-as
closed at 8:00.
After a brief discussion, Dunlap moved, Hassel seconded,
to recoimnend approval of the preliminary plat subject to
the following:
(1) 10' easement across the north boundary of the
property to provide for utilities and adequate
width for a 50' wide access in the event of more
dense development of the property to the east.
(2) Park Dedication Fee ($250 per lot).
(3) Approval of a 20' variance from the 50' street
setback requirement for the proposed location

abstract property. This means that when you buy a piece
of land and get an abstract for it, it is a complete
record of the history of the land. All entries against
that piece of property are included in this. M abstract
company will get this information from the court house
and enter it in. When an abstract is brought up to elate
all entries are put into there and such things as
mortgages, sheriff sales, warranty deeds and village
regi.lations are put in.

The proposal includes the proposed location
of the main structure and two accessory structures.
The location for the proposed tennis court is

Haglund were present. The Asst. Zoning Administrator
reviewed the history of o%,T,ers' , for Lots 1, 2 and 3.
It appears they were in single, separate ownership
since 1967.
Mr. Gullickson, Sr. stated that Mr. Thompson cn,ns Lot 1
which is the subject lot. fie further stated that his
son was trying to buy this lot and was requesting
approval t- build a home. He has since al-)ndoned this
application.
A lengthy disctLssior followed. There ;teemed to be some
confusion as to what was being proposed at this time.
Mr. Gullickson, Sr. stated that he wanted a decision
on the buil(lability of his lot which : 1nt 2. 'IT.
Thompson advised t}iat he wanted to tale r the
appl icat ion on Lot I, but that the arm) Ica before
the Commission was not his.
Commission advised that the application before the �s

Approved preliminary plat and variance subject to

park dedication fee and final mylars and hardshells.
Planning Commission Meeting - June 8, 1977
Reviewed final plat drawings whict included the
requested access easement along the north property
line. Recommended approval subject to payment
of the park dedication fee, and title opinion
sent to the City.

dated April 2, 1977 John Gullickson
Request for lot area variance to build a new home.
Area requirement - 43,560 sq. ft. This lot is only
19,500 sq. ft. in area. A variance of slightly over
24,000 sq. ft. is necessary.
There is somewhat a problem here. We have three
vacant lots right in a row. This lot is the middle
one so we have one substandard lot on either side
of this one. Each of the three lots is slightly
less than 1/2 the required area. To combine the
three lots as one buildable site would result in
two lots of about 14 acres. We might consider
having the three lots rearranged into.t.wo huildinq
sites if we can.
