As requested, Svoboda Ecological Resources (SER) visited the above ·referenced property on
' August 14, 2000, to iden!ify areas meeting wetland criteria as specified in the 1987 U:S. Army
Corps of Engineers Wetland Delineation Manual.
Thi;; site was initially delineated in a SER report (No. 98-060-03) dated December 22, 1998 on
the same'parcel ofland. A second delineation was performed in April of 2000 by Frank
Svoboda. This delineation line, a modification of the northwest wetland boundary of basin #1
was field reviewed on August 29, 2000 by JohnSmythe ofBonestroo & Associates and the City
of Orono. The City of Orono represented by Mr. Paul Weinberger recommended on August 29,
2000 that Mr. Jim Hafner from the Minnehaha Creek Watershed District make the final wetland
boundary decision along with Mr. Wayne Jacobson of SER, which occured on September 9,
2000. The delineation data presented ih this report supports the final wetland delineation line on
the parcel which was agreed to in the field. : ·
The Routine On-Site Delineation Method along with atypical investigation procedures was used
for this analysis. Iri this method, the following procedures were used to dete.rmine the wetland
boundary: '

The vegetative community was sampled in 411 present strata to determine whether 50% of
the do.minant plant species were hydrophytic.
Soil pits were dug using a.bobcat-and a post hole auger to a depths of 23. to 44 inches,

noting soil profile and any hydric soil. characteristics.

3) Signs .of wetland hydrology were noted and compared to field criteria such as depth to
. shallow water table and depth of soil saturation found in the soil pits.
Wetland edges were marked with sequentially numbered 4-foot wood lath and flagged with
orange "wetland boundary" flagging tape.
Sample points were taken on the up Land.and wetland sides-of the boundary. Data sheets were
completed describing these sample points which ar~ representative of each wetland bqsin and its
corresponding upland. These data sheets are found ii1 Appenqix A. The wetland boundary
stakes and sample points.were surveyed in using a Trimble Ag 132 GPS equipped with a Juniper
Systems field data collector. This system produces sub-meter accuracy in the horizontal plane
t1sing real time differential correction.
Wetland .classification follows the methods used by the National Wet_lands Inventory. The
· Circular 39 classification is also given.
Results and Discussion
The National Wetland Inventory (Excelsior Quadrangle) had mapped one wetland on the north
and east according to Figure 1. The soil survey of Hennepin County indicates hydric soils are
beneath the site according to Figure 2. Figure 3 is the Minnesota Department of Natural
Resources Protected Waters map of Hennepin County which depicts no prot_ected water wetlands
on the subject property. ·
Climatological data in the form of a.\YETS table analysis may prove useful if this wetland
boundary is contended, but at this fone WETS is not provided in our letter reports.
Figure 4 is an aerial photograph of the area with the wetland boundary and soil pit locations
shown on it. · ·
Soil Pit Data Sheets with detailed sampling information-appear in Appendix A. Photographs of
wetland'basin #1 are presented in Appendix B.
Basin 1 .
Basin 1 is a Type 2 wet meadow vegetated principally by Reed Canarygrass and underlain by
peaty muck. The northern and northwestern boundaries of this wetland have receded due to lack
of hydrology which was lowered in the area over 20 years ago through channdization of the
· creek to the south and by installati~n of.a ditcl). system which appears on the 1991 aerial
pho_tographs, and exists today.

The rcsu'lt of the lowered hydrology is aerobic dcconiposition of the upper portion of the organic
soil profile, resulting in soil recedance from tree roots in what was previously wetland. Upland
conditions now prevail to the northwest of Basin# 1 due to the lack of wetland hydrology and the
presence of species like Stinging Nettle, Canada Thistle, Common Bur Dock, and Ground [vy in
what was pre";'iously wet meadow or wooded swamp.' · ·
Basin 2
Basin 2 is unchanged from the previous report completed in 1998.
Recommendations
Activiti~s which impact or potentially impact wetlands are currently regulated at several levels of
government.. In Minnesota, the three primary jurisdictions are aovered at the state and federal
levels by the followip.g:
Sfate of Minnesota jurisdiction by the Wetland Conservation Act of 1991 (WCA)
administered by the WCA Local Governmental Unit (LGU) which in this ca_se is the
Minnehaha Creek Watershed District. Mr.· Jim Hafner of the District was on-site on
.September 7, 2000 to jointly inspect the soil pits and the wetland boundary of basin # 1.
He agreed with the boundary as presented in this report.
:tv:Iinnesota DNR jurisdiction over inventoried protected waters.
Federal jurisdiction by the Clean Water Act of 1972 and subsequent amendments.
Wetland permitting and protection is implemented by the U.S. Army Corps of Engineers
(USCOE).
No grading or filling in wetland basins should commence until all necessary permits have been
obtained. Violation of wetland regulations has resulted in substantial civil and criminal · ·
penalties. Local ordinances may regulate wetland modifications such as brush and tree removal
and burning in addition to grading and filling.
A wetlands functions and values anal)·sis may be required if alterations are proposed to these
wetlands. SER staff is experienced \i.ith several methods of functions and values assessment
including the M1nnesota Rapid Assessment Methodology (fyiNRAM) ..
To avoid project delays associated \\ith wetland regulations, it is essential that you acquire .
necessary permits from all jurisdictional agencies before initiating activities. A WCA Combined
Project Application form, and a DNR permit apphcation are among the materials that you may be
required to submit if impacts are proposedlor the delineated wetlands. By initiating-the permit
process as soon as possible, potential costly delays to the project may be avoided. Svoboda
Ecological Resources has experienced staff available to prepare wetland permit applications and
the process if necessary.

The purpose of this letter is to provide you with an update regarding the above project. To briefly review
its status, this parcel wa~ visited by Svoboda Ecological Resources (SER) on October 14, 1998. At this
time, two areas were determined to be jurisdictional wetland and were delineated by SER (see SER
Report No. 98-060-03 for more detail). The edges of these wetlands were located by SER using a
Trimble Ag 132 GPS equipped with a)uniper Systems field data collector. Positions were differentially
corrected in real-time using signals transmitted by the Coast Guard station in Alma, Wisconsin. This
system is ca:pable of su~-meter accuracy when using real-time differential correction in the field.
In 2000, SER determined that the boundaries of Basin l needed revision due to factors that were not
evident at the time of field visitation. The northern boundary was r~drawn and reduced (Figure 1). This ,
revision was due to the presence of sand and gravel fill found in this area, which indicated that it would
,not meet jurisdictional wetland status. In addition, the boundary of the northwestern finger of this basin
was redrawn and reduced (Figure 1). This reed c'anary grass dominated area recently has become drier
due to the presence of a drainage ditch. Thus, the extent of the wetland boundary as was determined in
1998 'was decided to over-exaggerate the scope of the northwestern wetland edge. Please note that the
~odified boundaries on Figure 1 are not exact and are subject to field verification.
