Peterson commented that the Park Commission reviewed the sketch plan and did not
propose a trail on the property but would ask for normal park dedication fees . The
applicant was informed that this amount would be 8% of the lot area or cash in the
equivalence of 8% of the fair market value before development.

PLAN OF A 3-LOT RESIDENTIAL SUBDMSION
Mr. Flatterer was present.
Mabusth reported that the plan is for a division of a 6 .37 acre homestead, located to the
north side of Sugar \Voods development , into three lots . All structures would be
removed . The property is accessed via a platted road . The property is on a natural
environment lake to the northwest, the OHW is at 985 .5 elevation . .4 of the total
property is a type 3 wetland adjacent to the normal high water level. Each lot is shown
meeting the two acres of dry buildable . It was noted that if the road were moved to the
west , the lots would not have the 2 acres of dry buildable required. Lot 2 requires a lot
width variance in its present configuration.
Mabusth reported that the septic would be mound-type systems , and 3 were tested at an
8% slope. The septic code specifically states that mound systems must be placed on a
slope no greater than 6%. Staff could not recommend approval of 3 lot plat based on
septic limitations . The property is not located within MUSA
Mabusth asked the Commission if they would recommend approval of current layout? A
lot width variance would be required for lot 2 that gains access via a long platted conidor.
The lakeshore lot meets 200 ' at the lake and the 150' setback.
Flatterer said he has owned the property for 20 years. The MUSA line is adjacent to the
property to the south. The property contains alot of sandy area. The applicant selected
the building sites based on the views , maintenance of trees and slopes, and then
constructed the lot lines to meet the codes.
The applicant was informed that with a 150-200' long road , his likely choices would be for
3 executive lots or 2 hobby farms , with contemplation for larger cul-de-sacs required by
the fire department.
Peterson said it was his opinion that the property consisted of two lots , not three, as there
would be too much crowding in order to gain the proper septic. Berg agreed with this
conclusion .

Lindquist said he would not agree to an area variance but would probably approve a width
vanance.
Mabusth said the applicant does not have the acreage to allow lot 2 to be realigned and
the road outlot extended to the west.
The applicant inquired about a lot next to his property consisting of only one acre. He
was told it could only be rebuilt in the original footprint but septic approval would
determine whether it was buildable or not.
Platterer was informed that the Park Commission recommended asking for park dedication
fee.

The Planning Commission did not support a 3-lot plat as there is inadequate area to allow for
a cul-de-sac to be extended westward enabling Lot 2 to meet the required lot width to the rear
of the 50' front/street setback line. Staff also notes that three of the six septic test sites would
be at an 8% slope. The City's code would allow a 6% maximum slope. In previous
subdivisions the City has approved one system in excess of 6 % slope but not 50 % of the sites.
The Planning Commission encouraged you to consider a 2-lot plat (back lot/front lot format).
The back lot would have to meet 150% of the area and width standards. Access would be
provided by a 30' driveway outlot. The area of the driveway outlot must be excluded from the
dry buildable area of each proposed residential lot.
Please contact the City staff if you have any questions pertaining to the preparation of your
formal plat.

Please accept the enclosed application for subdivision of the
residential property at 809 North Brown Road to permit the
construction of three new residences.
BACKGROUND
The property is approximately 6.95 acres in total size,
including approximately 0.15 acres of easement for North
Brown Road.
Originally the homestead of the Dickey's in the late 1800's,
the property until 1975 served three separate residences.
We purchased the property as our home and have raised Arabian
horses here since 1977. We intended to raise and enjoy our
horses until the area became too developed at which time we
planned to subdivide the property, develop three or four
executive home sites and relocate our Arabian horse farm
further west.
With the development of 11 The Farm" to our east, the Fruen
property to our west, the Cox farm across the lake, Salem
Court and now Sugar Woods it has become apparent that it is
now time to develop our property and move on.
PROPOSAL
We wish to develop three lots of 2+ acres each which will
accede to the present zoning, preserve the maximum wooded
acreage, not intrude into the tranquility and privacy of
Dickey Lake and harmonize with the Sugar Woods development.
We anticipate that each of the homes to be built on these
unique lots will be in the $1,000,000 plus range.
Marketing these exceptional home sites is being done through
selective direct contact with only the best architects and
builders in order to assure that these homes extend the Sugar
Woods quality to the natural boundary of Dickey Lake.

Orono Planning commission
While best served by an extension of City water and sewer, we
understand Orono's policy is to encourage private water and
septic systems. Preliminary investigation and survey by
Steven Schirmers suggests that the primary and alternative
mound systems can be laid out in an area of 6 to 8% gradient
while minimizing the adverse environmental impacts of
clearing existing wooded areas.
The building sites were chosen at the southern reaches of the
property to minimize any intrusion into the lake and natural
wet land areas, while still affording privacy and views to
the residences.
The existing home built in 1974, the main barn built in 1977
and the auxiliary barn will be completely removed and
relocated to new sites to provide for the three new home
sites.
Access to the property would be via paved private roadway
from North Brown Road. To protect the privacy of the three
new residences and minimize the amount of hard cover, we
would prefer a joint use paved driveway approximately 15 feet
wide to accommodate cars meeting or passing and emergency
vehicles such as fire trucks.
While an urban road with a cul de sac could be constructed it
requires greater hard cover and does not provide any better
access for emergency vehicles. At the same time, it reduces
the available high and dry acreage and may impact upon
optimal septic area selection.
The private roadway would follow the location of the present
driveway and would avoid impacting existing trees.
Lot 1 will be planted with trees relocated from other
portions of the property to increase the wooded areas and
allow for new growth in the existing woodlots.
Both lots 2 and 3 are currently heavily wooded. While all
three lots will have lake views only lot 3 will be considered
a lake lot. All three lots have topography that will
accommodate walk out designs.

SUMMARY
We believe the proposed three lot subdivision blends with and
enhances the environment of Dickey Lake, meets the spirit of
Orono's expansion and development goals, harmonizes with and
extends the quality of the Sugar Woods neighborhood to the
natural boundary formed by Dickey Lake to the north.
We appreciate your consideration and granting of any
variances you believe would be necessary in order to minimize
disruption of existing wooded areas and permit the homes to
be located as far back from Dickey Lake as is reasonable.
