The property is also located within the Shoreland Overlay District subject to setbacks and hardcover regulations for Natural Environment Lake, Dickey Lake. Total lot area = 6.8 acres (exclusive of Brown Road North right-of-way) .4 acres = Dickey Lake . 03 acres = Type 3 wetlands 6.37 acres = Total dry acres Pertinent Ordinances 1. Section 12.30, Subdivision 5 (B) (4) -System design/drainfields. Mounds must meet MPCA regulations Chapter 7080 and may not be located on soils with percolation rates slower than 120 MPI nor on slopes greater than 6% without variance. 2. Section 11.10, Subdivisions 5, 6, 7 and 8 -Sketch plan review. 3. Section 10 .28, Subdivision 5 -Lot standards for RR-lB zoning district. 4. Section 10.56 -Shoreland Overlay District. Section 11. 03, Definition 24 -Lot area, minimum. Each lot shall contain the minimum area required for each proposed lot as prescribed in the Zoning Chapter of the City Code. In rural zones not served by sanitary sewer, each lot must contain a minimum of two acres of contiguous dry buildable land exclusive of wetlands, ... surface areas below the Ordinary High Water Mark of any surface water ... All rural lots must comply with the City's on-site septic system provisions of the City Code. List of Exhibits A - B-1-3 C - D - E - F - G - Application Applicant's Addendum Location Map Sketch Plan Staff Sketch -Lot Width Designated Wetland Map Staff Sketch -Amended Access Plan Review of Subdivision Applicant proposes a three lot division of his 6.8 acre homestead located in the rural residential areas on North Brown Road. The property is just to the north of the Sugar Woods plat located within the MUSA (Metropolitan Urban Service Area). The subject property is not located within MUSA. Review Exhibits D and F. Applicant's surveyor has shown the Ordinary High Water Level for Dickey Lake at 985. 5. The survey fails to locate a Type 3 designated wetland just adjacent to the water line of the lake consisting of .03 acres. Each lot is shown meeting the required two acres of dry buildable. Review Exhibit E, Lot 2 as shown does not meet the required lot width of 200' to the rear of the 50' setback. Review Exhibit G, note if road is moved to the west so that Lot 2 would meet the required lot width, the lots would be less than two acres in area as road outlot would be at . 6 acres. Applicant does not have enough dry buildable land to support a conforming private road design. Zoning File #2053 August 15, 1995 Page 3 Staff has also been advised by on-site septic consultant, Steve Schirmers of S-P Testing, that at least three of the mound sites tested were at an 8 % grade. Septic code specifically says that mound systems must be placed on a slope no greater than 6 % . Staff has advised that in subdivisions that if one of the test sites on one lot within a division is located on a slope greater than 6 % that a variance may be considered for one system. The On-Site Septic Manager has advised that it would be inconsistent for the Department to grant variances for three septic sites on the three lot plat. Based on the limitations of dry buildable area, it is doubtful whether there would be enough area to support a drainage retention facility as would be required for all subdivisions in excess of two lots. Refer to Exhibit B, applicant asks that you consider granting variances to allow the three lot division as proposed. A. Will you grant a lot width variance for Lot 2 as proposed? B. If cul-de-sac is extended westward, would you recommend granting area variances for a new subdivision? ... What of the additional needs for drainage retention on the site? There is nothing unique or unusual about this property to suggest a need for granting variances nor would the granting of these variances be consistent with past actions of the City. The lot layout as proposed is contrived to meet the limited area needs. Applicant would be best advised to proceed with a two lot subdivision, with a back lot/front lot configuration. A back lot/front lot configuration would require a minimum of 5 + acres. The 30' driveway outlot can be placed within the profile of the existing driveway minimizing tree removal and any impact on existing elevations. The Planning Commission may advise applicant to contact adjacent property owners to the north to see if there is any land available to enable applicant to meet requirements of a three lot division. lsv A RESOLUTION GRANTING PRELIMINARY APPROVAL OF A PLAT AT 809 BROWN ROAD NORTH FOR DENNIS PLATTETER -FILE NO. 2092 WHEREAS, Dennis L. Platteter on October 27, 1995, filed a formal subdivision application with the City for approval of a two lot residential plat of property legally described as: The South 354.75 feet of the East 990 feet, except the North 150 feet of the East 323.4 feet thereof, of the Southeast Quarter of the Southwest Quarter of Section 27, Township 118 North, Range 23 West of the Fifth Principal Meridian, (hereinafter "the property"); and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono's zoning, platting and on-site septic codes, the Orono Planning Commission held a public hearing on November 20, 1995, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, at their regular meeting held on December 11, 1995, the Orono City Council considered the subdivision application of Dennis L. Platteter noting the following findings of fact: 1. The property is located within the RR-lB Single Family Rural Residential Zoning District requiring a minimum of 2 acres of dry contiguous buildable land within each newly created lot. 2. The property contains a total of approximately 5.64 acres, all of which is considered dry buildable. 3. The proposed plat contains two lots each meeting or exceeding the 2 acre minimum lot area requirement. 4. The property is located in the Shoreland Overlay District. Lot 1 is a lakeshore lot contiguous with Dickey Lake, a natural environment lake. Lot 1 meets the required 200' width at the OHWL, 985.5 elevation, of Dickey Lake and at the 150' building setback line. Page 1 of 4 5. Lot 2 is 155' in width to the rear of the street setback line measured from Brown Road North. The code would require 200' of width and as a result access to Lot 2 shall be via private driveway outlot. 6. The oversized accessory structure at 2,100 s.f. on proposed Lot 2 shall be removed along with all other accessory structures (i.e. pool, shed, etc.). NOW, THEREFORE, BE IT RESOLVED, that based upon either one or more of the findings noted above, the City Council of the City of Orono hereby approves the preliminary plat for Dennis L. Platteter for the property located at 809 Brown Road North per the survey dated 11-15- 95, by Mark S. Gronberg of Coffin and Gronberg, Inc., subject to the following conditions: 1. If the existing principal structure is to remain on Lot 1, north/south lot line shall be adjusted so that structure meets required 75' setback from east lot line. 2. Approval of the 2 lot plat and the lot lines as shown is based on the removal of all existing accessory structures on both Lots 1 and 2. 3. Prior to the removal or demolition of accessory structures and new residential construction, future owners shall be responsible for staking and protecting septic test sites. The following list of final submittals must be submitted to the Zoning Administrator two weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month: 1. Record plat drawings in the form of two (2) mylar copies and one (1) copy reduced to 1" = 200'. Drawing to include: A. Lot lines platted per preliminary survey by Mark S. Gronberg dated 11-15- 95. Dedication of "drainage and utility easements" 10' wide along all perimeter property lines (not to be designated at shoreline of Dickey Lake) and 5' each side of internal property lines. C. Portions of lot located below 985.5 at northwest corner to be designated as Dickey Lake. D. Applicant's surveyor to determine if a Type 2 or 3 wetland exists at southwest corner of property adjacent to shoreline of Lot 1. The City's wetland maps have located a protected area in that portion of the property. If the wetland exists, it should be located as a drainage easement on the plat. E. Dedication of 33' ofright-of-way of Brown Road North. F. Naming of plat. 2. Legal documents required: A. Title opinion addressed to the City. All owners, mortgage holders or others with property interest indicated therein shall sign the plat and all other documents affected by such interest. B. The applicant must provide certified copies of all recorded easements currently affecting the property. 3. Fees to be paid: Total due: $200.00* based on 1995 fee schedule A. Legal review and filing fees = $200.00 B. *Park dedication fee to be determined upon City Assessor's valuation of fair market value of 2 acre rural lot. Park dedication fee payment is due upon the filing of the final plat and associated documents. Dickey Lake {27-161W) is on the property. Any activity below the ordinary high water {OHW) elevation of 986. 82' {NGVD, 1929), which alters the course, current or cross-section of Dickey Lake, is under the jurisdiction of the DNR and may require a DNR permit. The applicant and plans should inform prospective lot buyers that the DNR, Army Corps of Engineers Minnehaha Creek Watershed District and the City Minnetrista have jurisdiction over Dickey Lake. 2. Co., MN November 15, 1995 This On-Site Sewage Treatment System is Designed for a Type 1, five bedroom home Designed in accordance with the Minnesota Pollution Control Agency Chapter 7080 and local ordinances. The soils ~n this site are a clay loam. The seasonally saturated soils were located at 12" to 24" below the ground surface. Due to the seasonally saturated soil, a Pressurized Mound System will need to be installed to treat septic effluent. This site has an existing Non-Conforming System with the bottom less than 3' from mottled soil. The existing tank may be used if water tight, if new construction the existing tank will need to be abandoned, pumped & filled with soil. The soils at a depth of 12" have a percolation rate averaging 15.5 min/inch. A pumping chamber will need to be installed to lift the effluent to the treatment area. The manifold and supply line pipe must have back drainage to the pumping chamber. The distribution pipes shall have their ends capped~ Be sure the rock and sand fill material are clean. The sod layer below the entire mounded area must be turned over, just break up the sod, be sure not to over work. The power supply and switches must be located outside the manhole and pumping chamber in a weather proof enclosure. A warning device must be installed with a light and sound device, this is in case of a pump failure. All neighboring wells are located greater than 75' away from the proposed treatment area. Keep all heavy equipment off of the proposed treatment area before and after construction. The treatment area should be marked off before construction. This Design is not valid & the system will need to be relocated if failure to protect the areas proposed for On-Site Sewage Treatment occurs. CONT'D With proper installation and maintenance, this system should have no problem in treating septic effluent effectively. Nothing other than gray water (laundry, showers, etc.) human waste & toilet tissue should be disposed into the septic tanks. Garbage disposals are not recommended. Excessive amounts of soaps, cleaning agents & chlorine agents may kill the bacteria needed to treat septic effluent. Additives are not recommended. ( ORDINANCE NO. 122 , SECOND SERIES AN ORDINANCE TO Al\1END THE MUNICIPAL ZONING CODE AND SUBDMSION CODE BY DEFINING STANDARDS FOR THE CREATION AND USE OF LOTS WIIlCH DO NOT ABUT A PUBLIC OR PRN ATE ROAD THE CITY COUNCIL OF ORONO ORDAINS AS FOLLOWS: SECTION 1. Municipal Zoning Code Section 10.02 and Municipal Subdivision Code Section 11. 03, Subdivision 2 are each hereby amended by adding the following definitions: "Lot-Back" -A lot typically separated from a public or private road by another lot and which gains access to the public or private road via a narrow corridor. Such a separated lot is considered to be a "back lot" when the corridor is platted as an outlot. A separated lot is considered to be a "flag lot" when the corridor is platted as part of the lot. When the corridor is merely an easement over another lot, the separated lot is considered to be an "easement back lot". "Lot-Front" -A lot abutting a public or private road, across which an outlot has been platted for access to a back lot. SECTION 2. Municipal Zoning Code Section 10.03 is amended by adding Subdivision 27 which shall read as follows: Subd. 27. Special Standards for Back Lots Created After January 1, 1994. Back lots as defined in this section which were created as part of a subdivision that received preliminary subdivision approval after January 1, 1994 are subject to the following special requirements in addition to the standards required in Section 11. 31, Subdivision 5 of the Orono Subdivision Code: A. Dimensional standards for back lots shall be as follows: 1. Lot area shall be 150 % of the zoning district requirement. 2. Lot width measured parallel to the front or street lot line at the street yard setback line of a lakeshore back lot, or at the front yard setback line of a nonlakeshore back lot, shall meet the zoning district width requirement. The street yard or front yard for any back lot will be a yard starting where the narrow access outlot corridor ends and the lot begins. Lakeshore back lots shall meet the lot width standard at the shoreline, at the lakeshore setback line, and at the street yard setback line. 1 3. The depth of the required street yard or front yard shall be 150 % of the zoning district front yard requirement. 4. The required side yard and rear yard depths for back lots shall be 150 % of the zoning district yard requirements. The required lakeshore yard of a lakeshore back lot shall meet the zoning district lakeshore yard requirements. B. Dimensional standards for front lots. A front lot created as part of a front/back lot division shall meet all zoning district area, width and setback standards, except that the required side yard of the front lot adjacent to the access outlot shall be equivalent to the side street yard requirement for that zoning district. C. Access requirements. 1. Access outlets shall be 30' minimum width, and shall be wide enough to accommodate drainage, snow removal and screening without encroaching on neighboring properties. 2. In approving front/back lot divisions, the City may require that both front lot and back lot share a driveway access within the access outlot if Council determines that creating an additional access to the existing street will be a potential safety hazard. 3. Driveways within a back lot shall be located at least 10' from the side or rear lot lines of adjacent lots. 4. No more than two residences may be served by a driveway located within an access outlot. 5. No access outlot may be platted abutting an adjacent access outlot except when the intent is to combine the two access outlots for creation of a public or private road meeting City standards. D. Screening requirements. 1. Driveways constructed in access outlets shall be adequately screened by fencing or vegetation at the discretion of the City, at all points to the rear of the required street yard of the front lot, so as to eliminate intrusion of vehicle headlights into the side or rear yard of adjacent lots. 2 2. The street yard of the back lot shall be adequately screened by fencing or vegetation at the discretion of the City, so as to eliminate intrusion of vehicle headlights into the side or rear yards of adjacent lots. E. Standards for accessory structures. Accessory structures shall adhere to all requirements of the zoning code, with the following additional requirements: 1. Accessory structures within a back lot shall be allowed no closer than 10' to a neighboring property's side or rear yard. 2. · Accessory structures shall not be allowed within the required street yard of a back lot nor within the required rear yard of a front lot which abuts the street yard of a back lot. 3. No accessory structure shall be allowed within an access outlot. SECTION 3. Orono Municipal Code Section 11.31, Subdivision 5 is hereby deleted and the following language substituted in its place: Subdivision 5. Double frontage lots, access to lots, and front/back lot divisions. A. Double frontage lots. Double frontage and reversed frontage lots shall be avoided except where necessary to provide separation of residential development from traffic arterials or to overcome specific disadvantages of topography and orientation. B. Access from any arterial roadway. Lots shall not, in general, derive access exclusively from an arterial roadway. Where driveway access from any arterial roadway may be necessary for several adjoining lots, the Council may require that such lots be served by a combined access drive in order to limit possible traffic hazard on such roadway. Where possible, driveways shall be designed and arranged so as to avoid requiring vehicles to back into traffic on any arterial roadway. C. Front/back lot subdivisions. "Flag lots" and "easement back lots" as defined in this Chapter (see definition of "Lot-Back") shall not be created. Front/back lot divisions shall be allowed only in conjunction with the creation of an outlot to provide access from the back lot to the public or private road. Such outlot shall not be allowed as creditable lot area for either the back or front lots. Front/back lot subdivisions shall adhere to the following standards: 3 ( 1. Applicability. a. Front/back lot divisions may be used when existing property dimensions are narrow and deep, such that lot width does not allow for a side-by-side lot split, but acreage is adequate to provide a "front lot" and a back lot without requiring an area variance when the area of the outlot access corridor is excluded. b. Front/back lot divisions may be used for individual "lot splits", but may not be used when subdividing a large parcel into numerous lots if creation of a back lot is merely a convenience to the developer rather than supported by unique site factors. c. A front/back lot division shall not be allowed when any existing residence on a neighboring property abutting the proposed access outlot is located nearer its affected side lot line than a distance equivalent to the zoning district required front yard depth. 2. Dimensional standards for back lots shall be as follows: a. Lot area shall be 150% of the zoning distric~ requirement. b. Lot width measured parallel to the front or street lot line at the street yard setback line of a lakeshore back lot, or at the rear of the front yard setback line of a nonlakeshore back lot, shall meet the zoning district width requirement.
