9. #02-2782 Professional Properties of Orono, 2765 Kelley Parkway -Proposed Dental
Office -Conceptual Rezoning and Site Plan Review ·
Gaffron reported that the applicants propose to construct a one story, 15,000 s.f. dental office and
professional building on the 2.0 acre existing lot at the NE comer of Old Crystal Bay Road and
Highway 12. The request is for a PUD rezoning of the property from RR-lB Single Family Rural
Residential to B-6 Highway Commercial District.
Gaffron summarized that the actions requested this evening were to consider conceptual approval
for PUD rezoning and the preliminary proposed use, review and comment on the commercial site
plan, and direct staff to draft a Resolution Granting Concept Plan Approval for action on June 10.
The Planning Commission had concluded that the dental office use was consistent with the 2000-
2020 Community Management Plan guiding of this site for office use, and that B-6 was the
appropriate zoning district for this use. Gaffron noted that the Planning Commission not only
recommended approval of the rezoning 7-0, but recommended the Concept Plan Approval as well.
Gaffron pointed out several questions for consideration; is Council satisfied with the percentage of
green space, the site circulation and parking , should a greater buffer be required between the existing
trail and parking, should the northerly row of parking more closely meet the 20' setback
requirement, should a traffic study take place, and several others as noted in his memo.
Sansevere inquired as to the approximate number of clients that could potentially be in and out of
their offices daily.

The Orono Planning Commission met on the above date with the following members present: Chair
Elizabeth Hawn, Commissioners Jeanne Mabusth, Sandra Smith, David Rahn, Cynthia Bremer, Daniel
Kluth, and J. Mark Fritzler. The following City Staff were present: Planning Director Michael Gaffron,
Zoning Administrator Paul Weinberger, Zoning Administrator Wendy Bottenberg, and recorder Kristi
Anderson. City Council Representative Bob Sansevere was present.

Please arrange to sign the 3 original resolution copies and restrictive covenant at the City
Offices (Monday through Thursday 7:30 AM-5:00 PM and Friday 7:30 AM-11:30 AM). All
persons with an interest in the property must sign the resolutions.
You must apply for and obtain a permit prior to the commencement of construction. (The permit
application is separate application from the zoning variance application).
Conditional Use Permit is limited to the extent shown on the approved plan and as noted in the
approval resolution. Changes in approved plans are subject to further review by the City. Variance
approval expires one year after date of approval. Permit application must be submitted no later than
May 28, 2003.

Staff Recommendation:
Staff recommends approval for a Conditional Use Permit for plumbing in an accessory building
for property located at 809 Brown Road North based on the structure meets the requirements
established by the Municipal Code for an "accessory structure with plumbing" CUP subject to the
following condition:
The property owner has agreed to filing the two appropriate restrictive covenants on the

WHEREAS, Jerad Hahn and Leslie Hahn, husband and wife, (hereinafter
"the applicants") are the owners of the property located at 809 Brown Road North within the
City of Orono (hereinafter "the City") and legally described as follows:
The South 354.75 feet of the East 990 feet, except the North 150 feet of the East
323.4 feet thereof, of the Southeast Quarter of the Southwest Quarter of Section 27,
Township 118 North, Range 23 West of the 5th Principal Meridian, Hennepin County,
Minnesota (hereinafter "the property"); and
WHEREAS, the applicants have made application to the City of Orono to permit a
"Plumbing in Accessory Structure -Conditional Use Permit" to allow a toilet, sink and shower to
be installed into an accessory structure.
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on May 20, 2002, at which time all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #02-2779.
2. This property is located in the RR-lB Zoning District where 2 acre is the minimum
required lot area. The property consists of approximately 300.564 s.f. or 6.9 acres.
3. The Orono Planning Commission reviewed this application on May 20, 2002 and
recommended approval by a vote of 7 to O of a conditional use permit for plumbing
in an accessory structure to allow for a toilet and sink based on the following

findings:
A. The proposed use of the accessory structure with plumbing will not be
detrimental to the residential character of the neighborhood.
B. The plumbing fixtures proposed are in keeping with the intended use of the
accessory structure.
C. The property location, size, and height meet minimum requirements to allow
a conditional use permit to be granted.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City Staff, comments by
the applicants and the effect of the proposed conditional use permit on the health,
safety and welfare of the community.
5. The City Council finds that granting a conditional use permit to allow plumbing in
an accessory structure, to include one toilet and one sink will not be detrimental to
the health, safety or general welfare of the public, would not adversely affect light,
air nor pose a fire hazard or other danger to neighboring properties; nor will its use
depreciate surrounding property values and that the proposed level of use of the
property will be in keeping with the intent and objectives of the Zoning Code and
Comprehensive Plan of the City.
CONCLUSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
conditional use permit to allow plumbing in an accessory structure to include a toilet and sink,
subject to the following conditions:
I. The property owner agrees to the filing of a covenant for plumbing in an accessory
building in the title of the property providing the following:
A. The accessory building will not be used for a home occupation unless
specifically approved by the City or if allowed by City Code.

B. The accessory building will not be used as a dwelling unless a guest house
conditional use permit is obtained.
C. The accessory building will not be rented, leased or otherwise provided for
use as a dwelling under any circumstances.
2. The property owner agrees to the filing of a covenant for an oversized building in the
·title of the property.
3. Authorities granted by this resolution run with the property not with the applicants,
but are permissive only and must be exercised by application for a building permit
within one year of the date of Council approval or the special conditions of this
resolution will expire on that date (May 28, 2003).
4. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read, understood and hereby agree to the terms of
this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.
Adopted by the City Council of the City or Orono, Minnesota at a regular meeting held on the 28th

THIS COVENANT, made and entered into this __ day of __ , 2002, by
Jerad and Leslie Hahn (husband and wife), (hereinafter referred to as "Applicants") and the City
of Orono, a Minnesota municipal corporation (hereinafter referred to as the "City").
WITNESSETH:
WHEREAS, Applicants have made application to the City for the installation
of limited wastewater plumbing in an accessory building on property in Hennepin County, State
of Minnesota, legally described as:
The South 354.75 feet of the East 990 feet, except the North 150 feet of the East 323.4 feet
thereof, of the Southeast Quarter of the Southwest Quarter of Section 27, Township 118 North,

WHEREAS, 'limited wastewater plumbing' for purposes of this Covenant shall

the building proposed for the installation of limited wastewater plumbing has met the standards
established within Section 10.03, Subdivision 9(F) of the Orono Municipal Code to allow
installation of limited wastewater plumbing; and
WHEREAS, Applicants are aware that according to Section 10.03, Subdivision
9(F), specific conditions exist under which limited wastewater plumbing may be allowed within
an accessory building; and
WHEREAS, Section 10.03, Subdivision 9(F) allows issuance of a permit for
installation of limited wastewater plumbing in an accessory building conditioned upon the
execution of this Covenant and its filing in Applicant's chain of title; and
WHEREAS, in order to identify all parties within an interest in the subject
property, the Applicants are required to provide title information to City staff as requested. All
parties with an interest in this property shall sign this covenant.
NOW, THEREFORE, THE PARTIES TO THIS COVENANT AGREE TO THE
FOLLOWING:
1. Applicants' request for installation of limited wastewater plumbing within the accessory
building to include one toilet attd one sink on the Subject Property if approved

conditioned upon the execution of this Covenant by the City and the Applicants.
2. The following conditions shall control the installation and use of the limited wastewater
plumbing:
A) The accessory building shall not be used for a home occupation unless
specifically approved by the City or if allowed by City code.

conditional use permit is obtained from the City.
C) The accessory building will not be rented, leased or otherwise provided for use
as a dwelling under any circumstances.
3. This Covenant shall be binding upon current and future owners of Subject Property, and
shall be filed within the chain of title of the Subject Property.
4. Fee owner(s) of the Subject Property, if not the Applicants, consent to the execution of
this Covenant and to its terms, as shown by their signatures upon this document.

County, State of Minnesota, legally described as:
The South 354.75 feet of the East 990 feet, except the North 150 feet of the East 323.4
feet thereof, of the Southeast Quarter of the Southwest quarter of Section 27, Township 118
North, Range 23 West of the 5th Principal Meridian, Hennepin County, Minnesota (hereinafter
referred to as "Subject Property"); and
WHEREAS, City staff have reviewed Applicant's application and have found
that the structure requested is defined within Section 10.03, Subdivision 9 (C) of the Orono
Municipal Code as an Oversized Accessory Structure ("OAS"); and
WHEREAS, Applicant is aware that according to Section 10.03, Subdivision 9
(C)(3)(c), specific conditions exist for an allowable OAS; and
WHEREAS, Section 10.03, Subdivision 9 (C)(3)(c) allows issuance of a permit
for construction of the subject OAS conditioned upon the execution of this Covenant and its
filing in Applicant's chain of title; and
WHEREAS, in order to identify all parties within an interest in the subject
property, the Applicant is required to provide title information to City staff as requested. All
parties with an interest in this property shall sign this covenant.
NOW, THEREFORE, THE PARTIES TO THIS COVENANT AGREE TO THE
FOLLOWING:
1. Applicant's request for one (1) Oversized Accessory Structure ("OAS") on the Subject
Property is approved conditioned upon the execution of this Covenant by the City and
the Applicant.
2. The following conditions shall control the existence of the OAS:

A) No future subdivision of the Subject Property will be approved that places the
OAS within a lot that has no principal structure.
B) Should Applicant wish to subdivide the Subject Property, the OAS may remain
without a principal structure for a period to be determined by the Orono City
Council. If no principal structure is fully constructed and completed on the
property by the end of the determined period, the OAS must be removed.
C) Should Applicant subdivide the Subject Property, the OAS and the principal
structure shall be located within the same lot, which meets the minimum lot area
requirement based upon the size of the accessory building, which lot area
requirement is detailed in Section 10.03, Subdivision 9 (C)(2) of the Orono
Municipal Code. Setback requirements as defined in Section 10.03, Subdivision
9 (C)(a) shall also apply.
3. This Covenant shall be binding upon current and future owners of Subject Property, and
shall be filed within the chain of title of the Subject Property.
4. Fee owner(s) of the Subject Property, if not the Applicant, consent to the execution of
this Covenant and to its terms, as shown by his/her/their signature(s) upon this
document.

C. Area Restrictions. In all "R" Districts no accessory building shall exceed
1,000 square feet of footprint area except that accessory structures in excess of 1,000 square feet will
be allowed under the following conditions:
1. Not more than one Oversized Accessory Structure (OAS) shall

3. Any Oversize Accessory Structure shall be subject t~ the follo...,ving
a) No such accessory structure shall be located within a
required yard area (principal structure setbacks must be met). Further, no such structure shall be
nearer the front lot line than the front line of the principal residence on the property, and no such ·
accessory structure shall be located less than 30' from the side or rear lot line regardless whether less
strict principal structure setbacks apply.

b) The maximum height for such accessory structure shall be
30' or the defined height of the principal residence structure on the property, v,hichever is less.
c) Such structure shall be allowed only when the property ·
owner agrees and covenants in writing with the City as follows:
i. No future subdivision will be approved that places
the structure within a lot that has no principal structure, except that the City in its sub~ivision
approval may grant a finite time period in which the oversized accessory structure may remain

include all interior wastewater piping and fixtures; and
WHEREAS, City staff have reviewed Applicants' application and have found that
the building proposed for the installation of limited wastewater plumbing has met the standards
established within Section 10.03, Subdivision 9(F) of the Orono Municipal Code to allow
installation of limited wastewater plumbing; and

requirement is detailed in Section 10.03, Subdivision 9 (C)(2) of the Orono
Municipal Code. Setback requirements as defined in Section 10.03, Subdivision
9 (C)(a) shall also apply.

shall be filed within the chain of title of the Subject Property.
