Thanks for the sketch. Yes, Chris told me that John stopped in today. As you know, we haven't had a pre-application
meeting regarding this project with John or anyone to discuss the request or requirements. A pre-application meeting is
a requirement and we don't accept applications without one. The purpose of the pre-ap meeting is to review and provide
input on requirements etc ahead of time -we also try to avoid having a last-minute meeting at the counter because that
is (in my opinion) when we miss crucial details.
Chris will be calling John to let him know that the application -although technically accepted this AM -will be returned to
him and won't be accepted for today's February deadline. She will also be returning his fee. We can meet any time to
discuss the project and he can submit a more complete application (with completed survey) on or before February 22 nd
for the March PC meeting.
Sorry for the inconvenience.
I'm available Thursday between 1-2 (and can have our engineer available at this time as well) or Friday afternoon
between 1 and 3 as well as pretty open next week. Let me know what works for you.

Recitals

3. The City is willing to commence its review of the application and incur costs associated with said
review only if the Applicant establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. 'D(:POSIT OF ESCROW Fl:1NDS. Contemporaneously with the execution of this Escrow
Agreement, the Applicant shall deposit $ 1.f1 OD with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guatantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consultant review) or will
incur in meeting with the Applicant,. reviewing the plans, and preparing agenda packet material for City Council
review of application # I L -,:281:.3 . Eligible expenses shall be consistent with expenses the
Applicant would be responsible for under a zoning and subdivision application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Applicant. Applicant shall be responsible for payment to the City within 30 days of the
Applicant's receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Applicant does not make
payment to the City within the timeframe outlined in #3 above, the City may draw from the escrow account without
further approval of the Applicant to reimburse the City for eligible expenses the City has incurred. The City shall
notify the Applicant of such draw and the nature of the expense for which the reimbursement is being made. If
the Escrow amount falls below 75% of the orlglnal escrow amount the Applicant shall deposit additional sums as
directed by the City, or the City shall discontinue all review.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Applicant when the review has been completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Applicant, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid
balance e subject property pursuant to Minn. Stat. §§ 415.01 and 366.012.

PRACTICAL DIFFICULTIES DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application will not be considered
complete or placed on any meeting agendas until this form is complete and submitted to the City.
Minnesota State Statutes Section 462.357, Subdivision 6(2) requires that practical difficulties be demonstrated in
order for a variance to be granted. The difficulties must be unique to the property as variances run with the land
and not the land owner. Personal and economic situations are not considered valid practical difficulties. In order
for an application to be heard by the Planning Commission and City Council practical difficulties having merit must
be demonstrated.
HOW DO I PROVE A PRACTICAL DIFFICULTY?
This form has 12 points outlining the basis City staff uses to determine if practical difficulties exist and how the
variance will affect the surrounding community. To prove practical difficulties, address all the relevant points
listed below and answer them as clearly as posslble.
Since you are requesting the code exception, you have the burden of proving that the variance is justified.
The information the City receives is what is used in determining a denial or approval recommendation. If you
leave something out it will not be considered.
Please address each of these difficulties criteria as they relate to the-request, if they do not apply, write NIA in the
space provided:
1. "The property owner proposes to use the property in a reasonable manner not permitted by the Zoning
Chapter."

Description of Request
Requesting approval for a reasonable building footprint on a lot that was developed in 1971 as
part of a single-family home subdivision and has been assessed and taxed at a rate equivalent
to buildable vacant lakeshore for forty years. A combination of new regulatory additions since
the lot boundaries were established has made the buildable footprint extremely small and
impractical to support the intended use. Property is categorized at vacant-land lakeshore and
has an irregular shape and unique contour. Although taxes have declined from a peak of
$675,000 in 2010, the property conti,nues taxed at a market value of $585,000.
