The Reeds propose a 3 lot plat of .-approximately 8 acres (lots
7 and 8, Bracketts Point). There are existing residences on
each lot. Lot 1 uonta'_ns the caretaker's house for the Sweatt
mansion. At Lome time in the future Lot 1 will be sold for
a new homesite. The Reeds will retain ownership of the lot as
long as the caretaker lives at the residence. The applicant
will sell their home on Lot 2 and move to the house on Lot 3.
Each lot has access off an existing public road (unimproved
public dedicated road). The Public works Director has been
asked to review the plat and comment on the current status of
the existing road.
Gaffr,in will report on the existing septic systems and the need
for additional septic testing to secure future alternate sites
fLr each of the three lots.
There is a guest cottage on Lot 3 that has been there for many
years. Lot 3 has only 3.59 acres as proposed. The realigned
lot line 'Aas not afforded the necessary 4 acres for the ad-
ditional residence or guest house. Please note the _.-i final
Lot 8 hac less than 3.59 acres. Planning Commission Aikl be
expected to make a recommendation concerning the future ust
of the guest house. Gaffron reports the quest house has a
separate septic system. He has been asked to review the
existing septic system in his report.
A public hearing has been scheduled for Monday, AuUust 17, 1981,

Final Subdivision - Resolution
The applicant has completed all required i,iprovements and
submitted all necessary submittals setforth at preliminary
approval. Staff recommends final plat approval subject
to the findings and conditions setforth .in the enclosed
staff resolution.

SUBJECT: #642 Lachlan Reed, 1500 Bracketts Point Road -
Subdivision - Septic Systems Review
I have reviewed the existing septic systems and the proposed
lot line arrangement and wish to make the following comments:
Lot 1 - contains 2 existing buildings with septic systems,
and a tennis court. The garage/greenhouse building
has a functional septic tank and drainfield which
is probably at least 50' back from the lake and
probably about 3' above the water table. Both
these systems appear to be functioning adequately,
although the caretaker house system does not appear
to strictly meet shoreland septic system setbacks.
In the absence of soil test data, it would appear that a
sufficient area of suitable soils (Hayden lo,im) exists on
the lot for use as drainfield if/when a new house is built
in the future. Realistically speaking, a full Site evaluation
should be done for this lot even though it has an existing
house.
Lot 2 - The existing house on its lot has a series of septic
tanks/cesspools northwest of the garage. Exact
locations are unk<<own, but it is likely that all are
within the lot boundaries. Drainfield is unknown and
may not exist. The system appears to be functional.
Testing for an alternate drainfield site should be
done. There appears to be ample area `or systei,i
expansion when it becomes cessar,,.
Lot 3 - Existing house has a septic system/drainfiela •::!.ich
appears to meet all location requirements. Exact
tank and drainfield sizes are unknown. This lot also
contains a Gwimming pool and a cot*age near the
!-,d ine uotn of which ha,,e existing septic systems.
. _ .k.,i, in, drainfieV are unknown,
however, the system for the cottage de_initely does
not meet shoreland standards and should be re^laced
or modified to meet code. Any added informat-.i the
applicant his on these systems will be helpful.
Lot 3 has previously existed as a separate lot in
approximately the same configuration as proposed.
While technically it may not be necessary to test for
an alternate site, testing will be necessary to find
a new location for drainfield for the cottage.
In conclusion, I recommend approval of the subdivision as
proposed, providing that site evaluation information is
satisfactory and the system servinq the cottage is suitably
upgraded.

Staff recommendation -
To approve the three lot plat of Lachlan Reed based on the
following findings:
1 - All lot standards of the LR-lA zoning district have
been satisfied.
2 - All existing structures meet the required setbacks
from all newly created lot lines.
3 - Each lot abutts a public road.
4 - Existing septic systems serving each residence
satisfy all standards of the septic code and that
a preliminary review of the soils makeup of the
area reveals suitable soils and adequate area for
future septic expansion.

1 - City will not grant setback variances to Lots 1, 2,
and 3 for any future construction.
2 - Prior to preliminary approval from Council the following
testing mus'-. be completed and reviewed by staff:
a) Complete set of septic tests (main & alternate)

Mrs. Hollander noted that she is involved in a corporation HOLLANDER (CUNT)
and that she doesn't want her homestead with the corporation
and that she would like to keep it separate. She stated
that she would consider the Planning Commission's
suggestion.
Rovegno stated that he felt that the school district lines
should follow the City boundaries and section lines.
Callahan moved to approve the 5 lot subdivision. of Hildur
Hollander of 250 Hollander Road subject to the following
conditions:
1 - Lots 3, 4 and 5's lot lines be adjusted to assure
suitable building sites and adequate setback distance
for all septic drainfields from all lot lines per
alternative plans suggested by staff.
2 - Outlot B has two resider, lal units that are non
conforming uses and subject to all pertinent ordinances.
3 - Lots 1, 2, 3 and 4 must access via Hollander Road.
Lot 5 is the only lot to have direct access to
County Road 6. An access permdt must be obtained
from Hennepin County for Lot 5.

Mr. Pillsbury found no problems with the proposed subdivision
Jabbour noted that one of the lots is on the edge of an
additional subdivision. Mabusth noted that th=re was 3.59
acres in the referenced '_ut, and that unless a future Council
was willing to grant an area lariance that this was not
a problem.
Mabusth reviewed the septic testing that would be required
-rior to the scheduled Council meeting for preliminary

present. Ms. Comstock reviewed with the Planninq Commission
the history of the application. She confirmed that in 1961
there was some dredging done. It was done with a DNR permit.
She stated that they were bringing it back to the Planning
Commission because they felt that they ha4i met the: standards
for maintenance dredging. LMCD and MCWD have also given
their approval along with the DNR for a maintenance dredgt.
Goetten asked if this property was dredged in 1961 then why
wasn't it done again 10 years later?

The Reeds propose a 3 lot plat of approximately 8 acres lota
7 & 8, Bracketts Point. There are existing residences on
each lot. Lot 1 contains the caretaker's hou- f-ir the Sweatt
mansion. The Reeds will retain ownersrip of a lot as loraq
as the caretaker lives at the :esilence.
Access for all three lots is via a public: road of a 20' width

The septic testing has been completed requiring no lot line
changes in the preliminary plan apprfived by the Planning
Commission. Staff required a complete set of septic tests
for lot 1, the caretaker's lot, f.,r ,t will support a new

for an alternate drainfield site. A complete set of septic
tests was required for the septic system serving the •guest
house and pool changiny rooms. The existing system door not

ings taken on each of the 3 proposed lots on the Abo7e property. ,or

the 936 contour line.

Conditions of Preliminary Approval
1 - 3 lot subdivision per survey dated 4-3-81, revised 7-24-81
2 - Access to all three lots will be via an unimproved public
dedicated 20' wide right of way.
3 - Existing septic systems serving each of the three residences
satisfy all standards of the septic code. The septic testing
required for this review reveals suitable area for septic
expansion on Lot 1, Block 1 and for the guest house on Lot 3,
Block 1.
4 - All future construction must meet all the standards of the
LR-lA zoning district.
5 - To grant a conditional use permit for the existing guest
house on Lot 3, Block 1 with a total area of 3.59 acres.
6 - Lot 2 and %ot 3, Block 1 are riparian to Lake Minnetonka.
Lot 1, Block 1 is not riparian to Lake Minnetonka.
Improvements Required
1 - Prior to final plat approval a new septic system is to be
installed to serve the guest house and changing rooms at
poolside. The septic design must be reviewed by the City
staff prior to the issuance of a septic permit.

A RESOLUTION APPROVING THE PLAT OF
BRACKETTS POINT
WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota! and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development
of land within the City; and
WHEREAS, the City Council has considered the application for
a subdivision plat by Lachlan Reed, the subdivider, and
WHEREAS, the proposed plat has been found to satisfy all
standards of the LR-lA zoning district and the Orono septic code and that
each lot can exist as a residential unit without the need of variances;
and
WHEREAS, the subdivider has completed all requirements of the
platting regulations of the City, including:
1) Dedication on the plat of drainage and utility
easements.
2) Installation of a new septic system now located
above the Flood Plain elevation of Lake Minnetonka
at 931.5 contour serving the guest house and
poolside changing rooms on Lot 3, Block 1,
Bracketts Point.
3) Payment to the City for the legal review and
filing fee of the plat and accompanying documents
in the amoui,t of $75.00.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City
of Orono hereby approves the plat of Bracketts Point, Hennepin County,
Minnesota, subject to the condition that the aforesdLd plat shall be
filed by the City of Orono with the Hennepin County Recorder's Office
on or before February 23, 1983, together with a certified original copy
of thla resolutica.
