Mabusth DATE: September 17, 1981 SUBJECT: #652 Lachlan Reed, 1499 Brackett's Point Road - Variance Zoning District - LR-lA Area - Lot 3, Block 1 - 3.59 acres Application - Variances a) Hardcover Variance 0-75' area = 1.93 acres or approximately 82,764 sf existing = 9456.16 sf allowed = 0 proposed increase = 56 sf Breakdown of existing hardcover guesthouse = 620.16 sf pool area = 2030 sf house = 691 sf driveway = 5,580 sf house patio = 535 sf 9456.16 sf b) Lakeshore Setback required = 75' existing = 60' proposed = 46' variance = 29' or 39% Review of Application The kitchen area of the Sweatt Mansion was not designed to handle the needs of a large family. The applicant would like to construct a kitchen dining area abutting the existing kitchen. The interior design of the house will only allow expansion on the west side of the house. A review of the hardcover calculations will show that the actual increase in hardcover is minimal. The proposed 14' x 22' ground floor kitchen will be built upon an existing paved driveway, roofed entrance, planters and cobblestone walk areas. Review of Hardships 1 - Location of house on lot - peninsula 2 - interior design of house requires expansion on west side or lakeside 3 - 1.93 acres of total 3.59 acres is unbuildable Staff Recommendation To approve the hardcover and lakeshore setback variances application of Lachlan Reed for the proposed construction of a 22' x 14', 2 story addition to his residence at 1499 Brackett's Point Road subject to the condition that all drainage from the roof of the new addition will be directed away from the lake. Hammerel moved to approve the cunditi..•al use permit for maintenance dredging of Richard Ledstrom's wildlife pond subject to the following findings and conditions: 1 - The pond is of -en water and is not supporting any wetland vegetation therefore dredging would not remove any existing assimilative capacity. 2 - with removal of the culvert, there is no direct flowage from the pond into the adjacent wetlands. 3 - The proposal would not increase pond size nor reduce retention capacity. 4 - Application is "maintenance dredging". Adams seconded. Vote: Ayes (6), 'Nays (0). Applicants were not present. The Lundquists are the new JOAN LUNDQUIST owners of the Mexican Inn in Navarre. The Mexican Inn was 3416 Shoreline Dr. never recognized with a formal conditional use permit and Conditional [Ise staff has asked the owner to apply for the required permit. Permit Planning Commission found no problems. 0650 Jabbour moved to approve the conditional use permit for Joan Lundquist, owner of the Mexican Inn. Hammerel seconded. Vote: Ayes (6), Nays (0). Lachlan Reed and Dick Hassel, applicants attorney, were present. Jabbour stated that he was surprised that the City would accept an application that allowed expansion of a non conforming structure in consideration of the Orono Code and the recent State Supreme Court ruling. Mabusth advised Jabbour to consult Section 31.110 distin- guishing the differences in interpreting code for non- conforming uses and non -conforming structures. Dick Hassel explained that of the total 3.59 acres 1.93 is excluded from the building envelope. He noted for the Planning Commission that the actual increase in hardcover was 56 sf because of the existing hardcover the addition would be placed on. Rovegno suggested a trade off of hardcover to allow for the additional hardco�,er. fie questioned the existing drainage or manhole in the west corner of the paved area. Mabusth noted that the existing pool house already had a bathroom and that it was just, a matter of relocating it. Review of hardships - 1 - Location of house on peninsula. 2 - Interior design of house and desire to preserve integrity of original house design requires expansion on west side or lakeside. 3 - 1.93 acres of total 3.59 acres in unbuildable. The Planning Commission asked staff to review the drainage culvert on the west side of house. The drainage structure is a catch basin or grade level manhole to the west of proposed addition that takes drainage through tiles directly to the lake below. An inspection of the site by staff determined that the localized watershed was very limited and consisted of a small portion of the paved area and the corner of the grassed patio area. The majority of the drainage from west side paved area and garage drain down the access drive to the north and eventually to the low grassed area in front of the house. All roof drainage from the new addition will be taken to the front of the house and follow the same path to the low grassed area. Staff sees no real problem and would recommend no changes in drainage structures on west sine of house.
