This is a request for a side setback ,ai lance to allow zpp14 (--:i1t to
construct an addition to his house to within 10.7' of the side lot line.
Since this is located in a currently non-sewered area within the two
acre zone, the septic system has been reviewed. Staff notes that the
existing septic system is located in the front yard and extends into the
right-of-way, then north to near the property line, with one
drainfield line extending back alorl the north lot line.
The applicant has been advised that the expansion of the house to the
extent proposed would not be allowed based on the encroachment near the
drainfield and the fact that the additional ' iving space would create a
potential for additional water usage with little or no way to expand the
septic system. Applicant is requesting you review this application
based on the city sewer being installed con;:urrently with his
addition.
This application certainly brings to light the inconsistency of the
current two acre zoning with the historically dense Crystal Bay
neighborhood. In a half acre or even a one acre zone, the proposed
addition would not require a vo riance; yet in the "Crystal Bay Sewer
Study area", 60 of 79 existing houses, nr 76%, are on lots of half acre
or less. We will likely be reviewing variance applications in this
neighborhood as long as the two acre standards :ontinue to apply.
Note that no hardcover limitations apply.
Staff recommends you consider approval of this variance application
contingent upon the Crystal Bay Sewer Project becoming a reality. If
the sewer project does not happen, we recommend denial of the
application based on the inadequacy of the lot to support an adequate
septic system indefinitely.

fallowing members present: Chairperson Goetten, Rovegno,
and Sime. Planning Commission members McDonald, Kelley,
and Callahan were not present. Building & Zoning
Admir:-strator Mabusth, Assistant Zoning Administrator
Gaffron, and Recorder Sutton represented the City staff.
Council Representative Frahm was also present.

Tom Bernier was present. Doug Klint arrived while the
Planning Commission wds makirg the motion to approve the
application.
Rovegno moved, Sime seconded, to recommend approval of the
plat of a lot line rearrangement known as Casco Cove finding
the new building envelopes unrestricted and satisfying all
standards of the LR-IC Zoning District and all existing
structures meet the required setbacks. Approval is subject
to the condition that a drainage easement within Lot 3 be
designated on plat Prior to scheduling subdivision fir
Council action.
Motion, Ayes (3), Nays (0).
Rovegno moved, Sime seconded, to table the Asplund variance
application until the applicant can be present. Motion,
Ayes (3), Nays (0).
At the end of the meeting, Randy Asplund sti 11 had not arrived
at the meeting so Planning Commission acted on the
application.
Rovegno moved, Sime seconded, to recommend denial of the
variance applications of Randy Asplund for the fence and the
concrete patios within 75' of the lakeshore based on the fact
that the applicant has demonstrated no hardship for basis of
approval of the variance. Motion, Ayes (3), Nays (0).
Gary and Linda Printup were present. Assistant Zoning
Administrator Gaff ron noted the certificate of mailing and
the affidavit of publication. There was no one present in
the audience for this public hearing. Chairperson Goetten
closed the public hearing at 7:36 p.m.

(I883)GARY PRINTUP Assistant Zoning Administrator Gaffron explained that with
the pending Crystal Bay Sewer Project underway, that it was
staff's opinion that this variance not be approved unless the
sewer project is approved. Gaffron noted that Printup does
wish to add bedrooms and a bathroom.
Sime stated that he would not be able to approve this
application until he was positive that the Crystal Bay SewL r
Project is confirmed. Sime stated that the intent of the
Counc.i l is that the tax payers pay half of the bill for sewer
installation into the Crystal Bay area and that this may not
happen i f the genera 1 tax payer may not want that extra bi 7 1 .
Gary Printup stated that he has a contractor that can do the
work right away and when spring comes that contractor will be
working on another project.
Rovegno suggested directing staff not to present the
application to Council until there has been an affirmative
determination that the Crystal Bay Sewer Project will
commence and so that the timing is such that the sewer
construction would be concurrent with the proposed addition.
Rovegno state) that if the Crystal Bay Sewer Project doesn't
get approval, then the Planning Commission's recommendation
would be for denial.
Rovegno moved, Sime seconded, to recommend appr, 'al of this
variance application contingent upon the Crystal Bay Sewer

Mr. and Mrs. Richard Eller were present. Zoning
Administrator Mabusth noted the certificate rf mailing and
the affidavit of publication. Mabusth presented a petition
that she had just received froma neighbor of Eller. Mabusth
explained that Richard Eller seeks variances to the
residential exterior storage section of the code. Mabusth
stated that Eller seeks a variance to the size standard
because he claims that at least two of his immediate
neighbors have boats over 20 feet in length stored in their
yards. Mabusth stated that a second variance to the
exterior storage section is sought by the applicant claiming
there is no other area on the property to store the boat
because of the sloping topography.

This is a request for a side setback variance to allow applicant to
construct an addition to his house to within 10.7' of the side lot line.
Since this is located in a currently non-seweree area within the two
acre zone, the septic system has been reviewed. Staff notes that the
existing septic system is loc^ted in the front yard and extends into the
right-of-way, then north to near the property line, with one
drainfield line extending back along the north lot line.
The applicant has been advised that the expansion of the house to the
extent proposed would not be allowed ba ,ed on the encroachment near the
drainf ield and the fact that the additional living space would create a
potential for additional water usage with little or no way to expand the
s-ppticsystem. Applicant requested that thi s application be reviewed
based on the city sewer being installed concurrently with his
addition.
This application certainly brings to light the inconsistency of the
current two acrE zoning with the historically dense Crystal Bay
neighborhood. In a half acre or even a one acre zone, the proposed
addition would not require a variance; yet in the Crystal Bz y area, 60
of 79 existing houses, or 76%, arc on lots of half acre or less. Wewill
likely bereviewiny variance applications in this neighborhood as long
as the two acre standards continue to apply.

Staff recommended approval of the application only if the Crystal Bay
sewer was approved. Planning Commission at their January 21, 1985,
meeting recommended approval (3-0) contingent upon the Crystal Bay
sewer project becoming a reality; if the sewer project did not happen,
their recommet►dation was for denial. Commissioner Rovegno suggested
to staff that the application should not be presented to Council until
after the sewer issue was decided, and the rest of the Planning
Commission concurred.
A resolution For approval is attached. Note that the projected date
for individual connection availability is November 1, 1985. The
resolution rcguires the applicant to use care in order to avoid
damaging his septic system during construction of the addition.

SECTION 10.28, SUB ISION 5 (B)

WHEREAS, Gary Printup (hereinafter "the applicant") is
owner of the property located at 1261 Briar Streit within the
City of Orono (hereinafter "City") and legally described as
follows:
Lot 3 and South 1/2 of Lot 2, i' 1 ock 3, Crystal bay,
Minnetonka (hereinafter "the nroperty"); and
WHEREAS, the applicant has appliEd to the City for a
variance to Municipal Zoning Code Section 10.28, Subdivision 5
p (B), to permit construction of an addition to his home, which
addition will be located 10.7 feet from the side nroperty line
where a side yard setback of 30 feet is normally required, and
located 40 feet from the front property line where a 50 foot
front yard setback is normally required.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zoning File No. 883.
2. This property is located within. the RR-lB Single Family
Rural Residential Zoning District.
3. The Orono Planning Commission reviewed this application
on January 21, 1985 and recommended approval contingent on
the installation of municipal sanitary sewers in the Crystal
Bay area, which sewers would serve this property.
4. The City Council on April 22nd, 1985 directed City staff
to draft a resolution approving construction of municipal
sanitary sewers for Crystal "ay.
5. The existing lot area is 0.24 acre in a zoninq district
where 2.0 acres of area is required to construct a new home
and no additional land is available for purchase in order to
allow applicant's proposal to meet the required setbacks.
6. The existing house location and small lot size
constitute a hardship to the property.

7. The proposed addition will not encroach further into the
front. yard setback than the existing house.
8. The City Council has considered this application in-
cluding the findings and recommendations of the Planning
Commission, reports by City staff, comments by the owner and
the effect of the proposed variance on the health, safety
and welfare of the community.
9. The City Council finds that the conditions existing on
this property are peculiar to it and do not apply generally
to other property in this zoning district: that granting
the variance would not adversely affect traffic conditions,
light, air nor pose a fire hazard or other danger to neigh-
boring property; would not merely serve as a convenience to
the owner, but is necessary to alleviate a demonstrable
hardship or difficulty; i,: necessary to prrserve a substan-
tial property right of the owner; and would be in keeping
with the spirit and intent of the Zoning Code and Compre-
hensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council
hereby grants a variance to Municipal Zoning Code Section 10.28,
Subdivision 5 (B) to permit the construction an addition to a
home, which addition will be located 10.7 feet from the side
property line where a 30-foot side yard setback is normally
required,and located 40 feet from the front property line where a
50-foot front yard setback is normally required, subject to the
following conditions:
1. The applicant shall proceed with the construction pro-
ject in a manner so as not to disturb the proper functioning
of the existing septic system, and shall connect to the
municipal sewer within the prescribed time period after the
sewer is available for connection.
2. Authorities granted by this variance run with the pro-
perty not with the owner, but are permissive only and must
be exercised by application for a building permit within one
year of the date of Council approval, or this variance will
expire on that date (May 13, 1986).
3. Violation of or non-compliance with any of the terms and
conditions of this variance shall constitute a violation of
the zoning code, shall automatically terminate any authority
granted herein, and shall he punishable ar, a misdemeanor.

Assistant Zoning Administrator Gaffron felt that the area
question is dry buildable but stated that staff would agai;
check the area to see if it should qualify for wetlands.
Gaffron also noted that testing for an alternate drainfield
site for the existing house had not yet been completed.
Mayor Butler moved, Councilmember Frahm seconded, to table
the Peterson application until May 28, 1985 Counci 1 meeting
in order to allow staff extra time to confirm the area in
question, whether it is dry buildable or wetlands. Motion,
