Tllrr!er stated Staff had anticipated that the letters of credit_ would be on file and the fees paid prior to the · Council meeting, which have not occurred. Staff is requesting that the Council treat this application as if the resolutions were not before the Council tonight and that it is expected those requirements would be completed prior to the next council meeting, at which time the Council would be able to approve or deny the resolutions. Turned noted the applicants have made some small corrections to the plans from the Planning Commission meeting but that the majority of the items have remained unchanged. The requirements of the Watershed District have been satisfied and the applicants will be providing for an infiltration area that is under a portion of the parking lot, with drainage being diverted into that infiltration area, which would eventually go into the storm water pond. Turner noted the Watershed District would be reviewing this application on November 15 th • Murphy commented that it seems like the Council has not spent very much time on the design of the buildings as compared to other projects. Murphy inquired whether the Council would be reviewing the design of the buildings more closely at a future point in time. Curtis stated the plan that is being presented tonight is the plan that the applicants would like to have approved. Murphy asked what involvement John Terrance Homes would have in this project. Cook indicated John Terrance Homes would be signing the plat because they are the owner of the property. Murphy noted the resolution states that Central Bank and LGL Real Estate are the developers and that John Terrance Homes is the owner. Murphy stated the City has had some issues with John Terrance Homes in the past and inquired whether Central Bank would be buying the property at some point in time: Cook indicated they would be purchasing the property but that John Terrance Homes is the current property owner. VOTE: Ayes 5, Nays 0. OLD BUSINESS · 5. #07-3305 LAKE COUNTRY BUILDERS ON BEHALF OF JAMES ZIMMERMAN, 2745 SHADYWOOD ROAD, VARIANCE, 6:06 P.M. -6:55 P.M. Gregg Graton with Lake Country Builders , and James Zimmerman, Applicant, were present. Curtis stated this application was discussed at the August Planning Commission meeting as well as the September Planning Commission meeting. There were four Commissioners in attendance at the August meeting. At that time the applicant was requesting hardcover and lake setback variances in order to construct additions to the existing home . Following a discussion about the proposal, it appeared there were at least three Commissioners generally supportive of the applicant 's request. A general consensus was reached that the applicant's Option #3 was most favored as long as the roofline was lowered and the proposed porch at the point was removed from the plan. However, one Commissioner remained unsatisfied that the applicant was making a reasonable request, and if a vote would have been taken, at least this one Commissioner would have voted to deny the application. Generally the applicant was given direction and the application was tabled to the September meeting. At the September Planning Commission, the applicant brought two separate revised options forward . Both of these options generally met the direction given at the previous meeting . Only one of the commissioners present at the August meeting was present at the September meeting. Upon reviewing the applicant's revised proposal, the Commission generally felt that the applicant's request was unreasonable and discussed denial. The applicant was taken by surprise at this conclusion, and rather than having the application denied by the four-member commission, they requested their application be tabled. Curtis stated the first option being presented tonight eliminates the screen porch addition at the point end of the property but proposes to retain an existing grade level patio and pergola. The second option proposed has the screened porch and balcony above the patio. These options appear to respond to the direction given by the Planning Commission at the August meeting. The existing pergola over the existing patio does constitute structural coverage and adds to the massing of the lot. Curtis noted while the driveway does not function as a tum-around for the neighborhood, the Fire Marshal does maintain that a residence 150 feet from the public roadway must provide a tum-around for emergency vehicles . The tum-around should not be narrower than 14 or 15 feet in width, which would require that the hardcover for the existing driveway be maintained at a somewhat lower level but kept at the same width. The garage is proposed to access using the existing driveway and is proposed to be located between the principal structure and the street (Brown Road). The proposed detached garage meets the rest of the required setbacks ; however the plumbing requires a conditional use permit. Prior to the issuance of a building permit, the applicant may be subject to the buffer, covenant and easement requirement Orono's Wetlands Protection Ordinance . John Smyth has not reviewed the wetland information as it is not immediately relevant to the variance and conditional use permit as requested. Planning Commission Recommendation On October 15, 2007, Planning Commission voted 5-0 to recommend approval of the variance and conditional use permit on the consent agenda consistent with the staff recommendation. Planning Staff Recommendation Staff recommends approval of the variance and conditional use permit per the attached Resolution. COUNCIL ACTION REQUESTED Adopt or amend the attached Resolution . A RESOLUTION GRANTING AV ARIAN CE TO MUNICIPAL ZONING CODE SECTION 78-1435 AND A CONDITIONAL USE PERMIT PURSUANT TO MUNICIPAL ZONING CODE SECTION 78-303 FILE NO. 07-3326 WHEREAS, Theodore Schultze and Mary Steil Schultze, husband and wife (hereinafter "the Applicants") are the owners of the Property located at 744 Brown Road North within the City of Orono (hereinafter the "City") and legally described as follows: Tract A, RLS No. 1275, Hennepin County, Minnesota (hereinafter the "Property"); and WHEREAS, the Applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1435 to allow construction of a detached accessory structure (hereinafter the "Garage") between Brown Road North and the principal structure; and WHEREAS, the Applicants have made application the City of Orono for a conditional use permit pursuant to Orono Municipal Zoning Code Section 78-303 in order to allow plumbing fixtures for a bathroom within the Garage. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 07-3326. 2. The Property is located in the LR-IA, Lakeshore Residential Zoning District which requires a minimum lot area of 2.0 acres and a minimum lot width of200'. 3. The Planning Commission reviewed this application at a public hearing held on October 15, 2007 and recommended approval of the variance and conditional use permit based on the following findings: Page 1 of 4 a. The Property contains 2.76 acres in area and has ±82'in width at Brown Road North. b. The Property is uniquely shaped and the setback variance as requested will not negatively impact views of the Property. c. The applicants have agreed, as part of this resolution, to enter into a covenant that disallows use of the accessory building for a home occupation, dwelling, or rental/lease of the building as a dwelling. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other Property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring Property; would not merely serve as a convenience to the Applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial Property right of the Applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-1435 to allow construction of a Garage between the principal structure and Brown Road North as well as a conditional use permit pursuant to Orono Municipal Zoning Code Section 78-303 to allow plumbing fixtures for a bathroom within the Garage, subject to the following conditions: 1. Council approval is based on the site plan and building sketches submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibits A & B. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. The applicants hereby agree by executing this resolution and covenant that the accessory building that is the subject of this resolution will not be: Page 2 of 4 a. Used for a home occupation unless specifically approved by the City or if allowed by this Code. b. Used as a dwelling unless a guest house conditional use permit is obtained. c. Rented, leased or otherwise provided for use as a dwelling under any circumstances. The applicants acknowledge that this covenant shall be binding upon current and future owners of the Property, and shall be filed within the chain of title of the Property. 3. The proposed garage shall meet Orono's height requirements. 4. At the time of the Building Permit review the scope of the project will be reviewed by the City Engineer to determine whether or not Orono's Wetlands Protection Ordinance is triggered. If applicable, the Applicants shall comply with the requirements of said ordinance. 5. Authorities granted by this resolution run with the Property not with the Applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (November 13, 2008). 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned Applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the Applicants and the Applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the Property. Approval shall be conditioned on provision of municipal sanitary sewer or a conforming sewage treatment system designed to handle the anticipated flows from the building plumbing. Sec. 78-1435. Location. No detached garages or other accessory building shall be located nearer the front or street lot line than the principal building on that lot except on lots which have frontage on a lake and rear yard adjacent to a street, accessory buildings located within the street or rear yards of such lots are subject to the setback requirements of section 78-305(b ), section 78-330(b) and section 78-350(b); except that detached garages may be located ten feet from the street or rear lot line when doors face away from the street and a turnaround is provided on the site. Variance: Accessory Building ahead of Principal Building The applicants' property has a very unique configuration; a width of 82' at Brown Road which widens out to approximately 180' where the house (and proposed garage) is located. Further the location for the proposed garage and the existing home are over 800 feet from Brown Road and significantly screened from views from the street or adjacent properties. Conditional Use Permit Analysis Zoning Code Section 78-418 (16) states that approval shall be granted only when the following criteria are met: The proposed use of the accessory structure with plumbing will not be detrimental to the 2 FILE #07-3326 10 October 2007 Page 3 of 3 residential character of the neighborhood. The accessory structure will serve as detached garage and will not alter or be detrimental to the residential character of the neighborhood. The plumbing fixtures proposed are in keeping with the intended use of the accessory building. The plumbing fixtures proposed are toilet and lavatory. They are appropriate for the use within the detached garage. The property is 2.0 acres in area or larger. The property is 2. 76 acres in area. This criterion is met. The accessory building is conforming in location, size and height. The accessory building meets the side and rear setbacks and is proposed to be meet the City's height requirements. The property owner agrees to the filing of a covenant in the title of the property providing that the accessory building will not be: a. Used for a home occupation unless specifically approved by the city or if allowed by this Code. b. Used as a dwelling unless a guest house conditional use permit is obtained. c. Rented, leased or otherwise provided for use as a dwelling under any circumstances. Staff finds that the conditions of approval have been met and the property owners will agree to a covenant stating the above stipulations upon Council approval. The garage will not interfere with the current septic mound, nor will it interfere with the alternate mound location. Additionally, the plumbing within the proposed detached garage is not considered an expansion to the current septic usage as usage is regulated by the number of bedrooms. There will not be a bedroom within the proposed garage. Issues for Consideration Are there any other issues or concerns with this application?
