Kelley suggested that the entire width of the road be made consistent rather than vary from being
56 feet wide at the north end and 33 feet wide at the south end. Kelley commented that he would
like to see the road also be platted as a through road, but that the City probably would not want to
see access off of County Road 6. Kelley stated he is in favor of the subdivision .
Kelley inquired whether the Applicant was aware that a cul-de-sac will be constructed on Stubbs
Bay.
Deanovic replied that he was.
Sansevere moved, Kelley seconded, to approve Application #2479, and adopt RESOLUTION
NO. 4330, a Resolution Granting Preliminary Approval of a Class Ill Subdivision Located at
555 Stubbs Bay Road for Peter Andrea Company, subject to City Staff notifying Mn/DOT
of the preliminary plat for this area and the impact on the north lot as it relates to the new
Highway 12 corridor, and further subject to the inclusion of t he provision that a through
street be platted for this subdivision.
Kelley inquired whether the easement to the south should be vacated.
Weinberger stated that the easement to the south could be dedicated as a through area and that
City Staff may want to review whether or not a portion of the are~ is needed for future access .

Jenson stated the Applicants are requesting variances in order to construct a 12 by 20' home
addition, an addition to the existing deck, and construction of an inground swimming pool. The
initial application by the Applicant included a request to construct a split-rail fence along the
property line, from the driveway to the lakeshore. The Applicant withdrew the request for the fer.ce
at the Planning Commission meeting.
The Planning Commission recommended approval of the variances for the addition to the house.
the deck addition, and the inground swimming pool, but recommended denial of the variances to
allow construction of a five foot high split-rail fence.
Jenson stated that a mature stand of trees would prohibit the neighbors from having a view of tt:e
new addition and swimming pool.
Garrett commented he has read the resolution before the City Council tonight. Garrett stated he
will withdraw his application for the fence due to some complaints by one of the neighbors. The
fence was designed to help deter trespassers onto his property from the adjoining Long Lake park,
but the number of trespassers has declined this past year.
Mayor Jabbour stated that the City does not like to have fences constructed within 75' of the
lakeshore.
Kelley moved, Peterson seconded, to approve Application #2504, and adopt
RESOLUTION NO. 4332, a Resolution Granting a Variance to the Average Lakeshore Setback
to Allow the Construction of a 12' by 20' Addition to the Home, an Addition to the Existing
Deck, and an lnground Swimming Pool Surrounded by a Deck, and to Deny the Variances
to Construct a Five Foot High 3-Rail, Split-rail Fence Along the South Property Line from
the Driveway to the Lakeshore. VOTE: Ayes 5, Nays. 0.

PLAN REVIEW
Marty Campion, Bancor Group, was present.
Weinberger stated the Applicants are proposing to construct a 52 lot subdivision consisting of
single family units over 58 acres located at the southwest corner of County Road 6 and Willow
Drive North. The Applicants have submitted a proposal to subdivide the property into 52 lots, with
an average density of less than one acre per lot. This is assuming the total property dedicated for
right-of-way, ponding and wetlands will exceed six acres on the site.
The property is currently zoned RR-1 B requiring two acres per unit. The Applicants are requesting
that the property be rezoned to R-1A to allow one acre per unit density and to develop the property
as a Planned Residential Development. The purpose of a PRO is to enhance the appearance of
neighborhoods through preservation of natural open spaces and to counteract the effects of urban
congestion. A PRO would allow the property to be developed at one unit per acre while allowing
the lots to be less than one acre leaving the remaining land as open space by the creation of
conservation outlets. City sewer and water are available to this property. Weinberger stated that
this property would not be able to sustain individual septic systems due to the high water table and
soil types present in this area.
Weinberger stated that the surrounding properties to this site include a two acre development east

of Willow Drive, low density residential consisting of two acre lots north of County Road 6, the
Orono School to the west, and some possible townhome/office use along Highway 12 and Kelley
Parkway to the south. This property may be appropriate to act as a buffer zone between the mixed
uses surrounding the proposed development.
Mayor Jabbour commented that a prior application was submitted for this property proposing
approximately 42 units.
Weinberger stated that the prior application proposed two acre density to the north and one acre
density to the south, with the property being set up as a PUD, and did not appear before the
City Council.
Campion, Bancor Group, stated that the wetlands were delineated a number of years ago and that
a new wetland delineation has been undertaken, which, in his opinion, will show that the wetlands
are diminished from what was originally charted.
Campion commented that there are a number of benefits to this proposal, such as this property
acting as a transitional zone to the surrounding areas, with no access being proposed off of County
Road 6. Bancor Group is proposing to preserve the natural environment as much as possible in
this area as well as creating a trailway and open green space in this development.
Campion stated due to the costs associated with developing this property with City sewer and
water, the higher density is necessary. Campion commented that more housing in this area will be
needed due to the new Highway 12 corridor and the displacement of a number of families.
Mayor Jabbour inquired whether the Applicant would be willing to consider a two-tier zoning for this
property.
Campion remarked that they are not aware of the exact amount of wetlands in this area, which
would impact the size of the lots, and that if they are required to have a minimum of one acre dry
buildable, that would mean a significant reduction in the number of lots.
Mayor Jabbour inquired whether the Applicant wished to recess this matter temporarily to discuss
some of these issues with the other Bancor representatives.
Campion requested that they be allowed to discuss this matter.

(#10) DNR CONVEYANCE OF LUCE LINE PARCEL TO LONG RIDGE ASSOCIATES
Gaffron stated that the DNR has determined that a portion of the south half of the Luce Line
right-of-way west of the Orono Golf Course was in fact owned by Long Ridge Associates. Long
Ridge Associates has agreed to deed the trail right-of-way to the DNR in exchange for conveyance
to Long Ridge a portion of the trail right-of-way further east, adjacent to the Orono Orchard Road
bridge. The portion to be conveyed to Long Ridge is now and will continue to be used by DNR and
the public as a walking/driving access to the trail with the DNR retaining an easement over the strip
for these purposes.

WHEREAS, Warren Garrett and Tana Garrett (hereinafter "the applicants") are
owners of the property located at 650 Brown Road North within the City of Orono (hereinafter "the
City") and legally described as follows:
That part of Government Lot 1, Section 34, Township 118, Range 23 lying South of
a line drawn East at right angles to the West line of said Government Lot 1 from a
point thereon distant 1170.7 feet south along said West line from the Northwest
corner of said Government Lot 1. Except that part lying Easterly of the
Northeasterly extension of the Northwesterly line of Block 8, Town of Long Lake,
according to the United States Government Survey thereof, Hennepin County,
Minnesota.

WHEREAS, the applicants have applied to the City for a variance to Municipal
Zoning Code Section 10.56, Subd. 16(C)(6) for an average lakeshore setback variance to allow the
construction of a 12' x 20' addition to the home, an addition to the existing deck, and an inground
swimming pool surrounded by a deck. The applicants have also applied for variances to Municipal
Zoning Code Sections 10.03, Subd. 15(D), Section 10.22, Subd. l(B), and Section 10.56, Subd.
16(C)(l), (5), and (6) to construct a 5' high 3-rail, split-rail fence along the South property line
approximately 800', from the driveway to the lakeshore.

NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #2504.
2. This property is located in the LR-IA Zoning District where the minimum lot area
requirement is 2 Acres. The property consists of approximately 3. 9 acres.
3 . During the Public Hearing, the applicants verbally withdrew the request for variances
to construct a fence.
4. The Orono Planning Commission reviewed this application on July 19, 1999 and
recommended approval by a vote of 7-0 on the proposed variance based upon the
following findings of fact:
A The neighboring residences were constructed after the applicant's home.
B. The applicants' home is located approximately 400' from the lake shore of
Long Lake.
C. Mature stands of trees are located along both the North and South property
lines, extending well past the average lakeshore setback line.
D. The proposed house addition, deck addition, and inground pool will not block
or interfere with the neighbors' views of the lake.
E. The construction of the house addition, deck addition, and inground pool will
not exceed the allowable hardcover for the 250'-500' zone, and the total
hardcover for this zone after the additions will be 21. 9%.
5. The Orono Planning Commission reviewed this application on July 19, 1999 and
recommended denial by a vote of 7-0 on the proposed variances to construct a fence,
based upon the following findings of fact:

A The applicant's withdrew the request for variances to construct a fence.
6. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
7. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variance on the health, safety and
welfare of the community.
CONCLUSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants
an average lakeshore yard variance per Municipal Zoning Code Section 10.56, Subdivision 16(C)(6)
to permit the construction of a 12' x 20' addition to the home, a 400 sq. ft. addition to the existing
deck, and the construction of a 28' x 56' inground pool surrounded by a deck, and denying variances
to construct a fence. Approval was subject to the following conditions:
1. Authorities granted by this variance run with the property not with the applicants, but
are permissive only and must be exercised by application for a building permit within
one year of the date of Council approval, or this variance will expire on that date
(August 9, 2000).
2. Violation of or non-compliance with any of the terms and conditions of this variance
shall constitute a violation of the zoning code, shall automatically terminate and
authority granted herein, and shall be punishable as a misdemeanor.
3. The undersigned applicants have read, understood and hereby agree to the terms of
this resolution and on behalf of themselves, _their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.

Planning Commission recommends the following:

lakeshore setback. The applicant verbally withdrew that portion of the application which dealt with
the fence at the meeting.

Smith moved, Stoddard seconded, to recommend approval of Application #2502, Orono
Self Serve, 2160 Wayzata Boulevard, granting an amendment to his conditional use
permit to add a canopy, and a variance to allow the canopy to be located six feet from

Jenson stated that the City of Orono is requesting vacation of a dedicated alley in the Bergquist
and Wickland's Addition to Bergquist & Wickland's Park in order to provide better public access
to the Saga Hill Preserve and to replace it with a shorter, more direct access. This public hearing
is required for the vacation of the current alley and not the dedication of the new alley.
Hawn inquired whether there were any public comments regarding this application.
Wally Holzer, 1130 North Shore Drive West, inquired whether the easement was being eliminated.
Hawn stated that it is. Hawn commented that this application relates to a larger agreement.
Weinberger stated that the vacation of the alley will return the land back to the individual property
owners and a new access to the park will be proposed .
Lindquist inquired whether Holzer had seen the new proposed access.
Holzer stated he has and is not opposed to it.
Lindquist noted that the Planning Commission is just voting on the vacation.

Warren Garrett, Applicant, was present.
Jenson stated the Applicant is proposing to add an addition to the northeast corner of the home, a
deck addition, which will be located on the southeast comer of the existing deck, and an inground
swimming pool. The existing hardcover, including the tot al surface area of the additions, will not
exceed 30 percent. A variance is needed to the average lakeshore setback. Staff feels that the
proposed location is the most logical and will not block o r i nterfere with the view of either neighbor
towards the lake, with heavy vegetation between the res idences.
Jenson stated the Applicant is also requesting to install a three rail , split-rail fence, 5 feet in height,
along the south property line to the lakeshore. The president of the West Shore Townhome
Association has written a letter to the City protesting any fence being erected on the Applicant's
property. The Applican ts are proposing th e f ence due to the fact that the neighboring lakeshore
owner to the south is a Long Lake City Pa rk , and the Applicants have had people trespass on their
property and dock. The Applicants feel that the proposed fence will be high enough to deter
trespassers, but will not block the view of the adjoining homes.
Garrett commented that the letter was written before his application was written, but that he is
willing at this time to not construct the proposed fence . Garrett stated he was considering the
fence to help deter people from using his dock.
Hawn suggested that perhaps he consider installing a sign indicating that it is private property.
Garrett inquired whether a fence located on the dock wou ld be a problem, noting that he has some
concerns regarding liability. Garrett indicated that the neighbor who has expressed disapproval of
the fence was here at tonight's meeting but has left.
Weinberger stated a fence located on the dock would be outside the jurisdiction of the City, and
the impact that the fence located along the property line would need to be taken into consideration.
Garrett stated he could install a fence on the dock with a gate which would require any trespassers
to enter the water in order to obtain access to the dock.
Lindquist indicated he does have a problem with a fence in the 0-75' setback .
Gaffron stated the City of Orono has not adopted any codes relating to docks, but that he personally
does not have any objection to a fence surrounding the dock to deter trespassers.
Garrett indicated that he is willing to drop the fence portion of his application tonight.
There were no public comments.
Lindquist moved, Smith seconded, to recommend approval of Application #2504, 650 Brown
Road North, granting of a variance to the average lakeshore setback to allow for a deck
additition, addition to the house, and an inground swimming pool, with denial of the
variance for any fence. VOTE: Ayes 7, Nays O.

Weinberger stated that the Planning Commission and City Council has recently approved a
subdivision of a lot line reararngement for properties located at 325 South Brown Road and 2150
Abingdon Way. City Code requires that the Applicants dedicate drainage and utility easements
along all newly created property lines, which have been granted along the new property line.
However, the previous underlying drainage and utility easement along the old property line was
not vacated at the time the subdivision was approved, which should be vacated.
Staff is recommending approval of this application.
Wilson had no comment.
Hawn inquired whether the Applicant would be agreeable to affirming the agreement with
Abingdon Way.
Wilson stated it would not be an affirmation, but merely notifying the owners of each lot in this
division that they are liable for each easement. Wilson stated he would approach the homeowners
association requesting that the 60 foot pathway be eliminated from their agreement, which requires
City agreement.
Hawn inquired whether that portion was before the Planning Commission as part of this application
and whether any legal notice must be given to the adjoining property owners.
Gaffron stated that it was, noting that technically action by the Planning Commission may not be
required. Gaffron stated that in his opinion no notice is required.
There were no public comments.
Smith moved, Berg seconded, to recommend approval of Application #2474, 325 Brown
Road South/2150 Abingdon Way, vacating the 10 foot wide drainage and utility easement
along the previously existing property line between 325 South Brown Road and 2150
Abingdon Way based, and as a result of the lot line rearrangement, the obligation to
maintain Abingdon Way will be maintained solely by Lot 5, west of the east 60 foot line,
and not Lot 6. VOTE: Ayes 7, Nays 0.

to subdivide the property into 52 lots, with an average density of less than one acre per lot. The
property is zoned RR-1 B, which requires two acres per unit. The Applicants are requesting
that the property be rezoned to R-1A, allowing one acre per unit density, and to develop the

Application: The applicant proposes to install a 3 rail , split-rail fence, 5' in height, along
the south property line to the lakeshore as well as a home addition, a deck
addition and an inground swimming pool with decking around the pool, all
located between the house and the lake.
STAFF SUMMARY
First, the applicants are planning an addition to the Northeast comer of the home. The
addition is 12' x 20' and will line up with the existing North wall of the home and the existing East
side of the deck.
Second, the applicants are proposing a deck addition and inground swimming pool. The total
surface area of the additions , along with the ex isting hardcover in the 250'-500' will not exceed 30%.
The proposed deck addition will be added to the southeast comer of the existing deck, with the
inground pool located approximately 30' east of the existing deck. The variance required for these
items is the average lakeshore setback. Since the applicant's home is located closer to the lake than
either of its neighbors, the average lakeshore setback is their existing home, or approximately 3 85'.
Along the north and south property lines are mature stands of trees that buffer the view to either
property owners to the north and south. Staff feels that the proposed location is the most logical ,
and it will not block or interfere with the view of either neighbor towards the lake.
Finally, the applicants are proposing a 3-rail, split rail fence , no more than 5' in height, to run
along the south property line, from the driveway to the lakeshore , approximately 790' in length. The
applicants want a fence due to the fact that the neighboring lakeshore owner to the south is a Long
Lake City Park, and the appl icant's have had people trespass on their property and dock. The
applicant's feel that the proposed fence will be high enough to deter trespassers , but will not block
the view of the townhome owners. The President of the West Shore Townhome Association has
written a letter to the City protesting any fence being erected on the applicant's property. A copy
of the letter is included in the exhibits.

In order to place a fence along the South property line, variances from several codes would
be required. The Shoreland Overlay District does not allow any unsewered structures within 100'
of the OHWL. Other variances include height, as in side yards no fence over 42" may be located
closer to the shoreline than the average distance from the shoreline of existing residences on
adjacent lots.
Staff is also unsure as to the need for a fence for the entire proposed area, as a significant
portion of the fence will run along the wooded area on the south property line. The only place the
proposed fence could be placed without a variance is in the side and rear yard.
Variances from the following ordinances:
I. Section 10.22, Regulations for "LR-IA" ... , Subd. 1, Lakeshore Set Back Regulations, (B)
No principal or accessory structure shall be located within 75 feet of the lakeshore nor closer to the
lakeshore than the average distance from the shoreline of existing residence buildings on adjacent
lots except that this does not apply to structure allowed in subsection A above.
2. Section 10.03, General Provisions, Subd. 15, Non-Encroachments, (D) Side Yards
In side yards, no fence or over 42 inches in height above original grade may be located closer to the
shoreline than the average distance from the shoreline of existing residence buildings on adjacent
lots, such fences shall not be constructed within 75 feet of the shoreline. (pg 256)
3. Section 10.56, Shoreland Management, Subd. 16, Shoreland Overlay District Standards, (C)
Placement of Structures on Lots, (1) Setbacks from OHWL, (5) Fences, Docks, Retaining Walls, and
(6) Average Lakeshore Setback. Number (1) states: Structure setbacks from the Ordinary High
Water Level: Long Lake is classified as a Recreational Development Lake, which has a 100' setback
for unsewered structures. Number (5) states: No fence shall be placed within the shore setback
zone. Number 6 states: No principal or accessory structure shall be located closer to the lakeshore
than the average distance from the shoreline of existing residence buildings on adjacent lots ....
The average lakeshore setback line shall be a straight line connecting the most lakeward protrusions
of the residence buildings on the immediately adjacent lakeshore lots. (pgs 376-11 & 376-12)

STAFF RECOMMENDATION

We are submitting a request for variance for average lakeshore set back for a fence
and for the following proposed plans to our house and property at 650 N. Brown Rd.:
1. 18' X 36' lnground Swimming Pool -Vinyl lined
Location will be east side of house(lakeside) &
30-35 ft from house.
2. 400 sq. ft. addition to existing deck on east and southeast
corner of house. Footage is split up into 2 levels.
3. Addition to house structure main and walkout level, NE corner
-Total sq. ft. 480
4. Split rail fencing not to exceed 5' in ht. extending east along south property
line from our driveway to lakeshore. We believe this is the most aestheticly
looking fence.
See enclosed drawing and survey for further detail on all of the above proposed plans.
Description of hardship:
a. Our property is located on the west end of Long Lake and all improvements
we would like to make are located between main dewelling and Long Lake.
b. Lakeshore property owner on northside-(690 N. Brown)
-home was built after ours and setback further from lake than ours
c. Lakeshore property owner on southside is Long Lake City Park
-Westshore Townhomes are not lakeshore property owners, therefore, we
believe not be applicable to the avg lakeshore setback variance.
Note: Next possible affected lakeshore property is east of Long Lake City Park.
d. With our property ajoined to the City of Long Lake's park at the shoreline, we
have had park patrons trespass on our property and dock. Therefore, we are
requesting that we be allowed to erect a split rail fence extending all the way to
the shoreline. A 3 rail, split rail, fence is needed to help keep would be
trespassers from stradling over a shorter 2-rail fence.
Pictures have been enclosed to help illustrate views from and around our property
which depicts heavy vegetation between us and our neighbors to the north and south.
Also, proposed structures would not inpede on our neighbors' views of the lake.
We hope this information is sufficient for your review and meets the criteria for
approval.

of the property located at 650 Brown Road North. The property owner(s) have
applied for one or more variances to the Zoning Code to permit a pool and deck
addition on the property, and an average lakeshore setback variance to allow a 5' fence

The Planning Commission will hold a pubic hearing on:

Re: Request for Variance

We are submitting a request for variance for average lakeshore set back for a fence
and for the following proposed plans to our house and property at 650 N. Brown Rd.:
1. 18' X 36' lnground Swimming Pool -Vinyl lined
Location will be east side of house(lakeside) &
30-35 ft from house.
2. 400 sq. ft. addition to existing deck on east and southeast
corner of house. Footage is split up into 2 levels.
3. Addition to house structure main and walkout level, NE corner
-Total sq. ft. 480
4. Split rail fencing not to exceed 5' in ht. extending east along south property
line from our driveway to lakeshore. We believe this is the most aestheticly
looking fence.
See enclosed drawing and survey for further detail on all of the above proposed plans.
Description of hardship:
a. Our property is located on the west end of Long Lake and all improvements
we would like to make are located between main dewelling and Long Lake.
b. Lakeshore property owner on northside-(690 N. Brown)
-home was built after ours and setback further from lake than ours
c. Lakeshore property owner on southside is Long Lake City Park
-Westshore Townhomes are not lakeshore property owners, therefore, we
believe not be applicable to the avg lakeshore setback variance.
Note: Next possible affected lakeshore property is east of Long Lake City Park.
d. With our property ajoined to the City of Long Lake's park at the shoreline, we
have had park patrons trespass on our property and dock. Therefore, we are
requesting that we be allowed to erect a split rail fence extending all the way to
the shoreline. A 3 rail, split rail, fence is needed to help keep would be
trespassers from stradling over a shorter 2-rail fence.
Pictures have been enclosed to help illustrate views from and around our property
which depicts heavy vegetation between us and our neighbors to the north and south.
Also, proposed structures would not inpede on our neighbors' views of the lake.
We hope this information is sufficient for your review and meets the criteria for
approval.
