Lot area and lot width variances are also requested. The property is 14,000 square feet or 0.24 acre in area and has 160 feet in width where 2.0 acres in area and 200 feet in width are required . The home is proposed to meet the 30 foot side yard setback on the north side at 55 feet and on the south side at 49 feet; a pool in a conforming location is also proposed. Planning Commission Recommendation On September 21, the Planning Commission held a public hearing and reviewed the application including the evidence submitted. Draft Resolution Proposed Survey Proposed Plans & Elevations PC Staff Report & Exhibits 09/17 /15 Draft PC Minutes 09/21/15 A RESOLUTION GRANTING LOT AREA, LOT WIDTH AND SETBACK VARIANCES FROM ORONO MUNICIPAL CODE SECTIONS 78-420 FILE NO. 15-3775 Council Exhibit A WHEREAS, Jeffrey Zitzloff and Brenda Zitzloff, a married couple (hereinafter the "Applicant") are the owners of the property located at 1380 Briar Street within the City of Orono (hereinafter "City") and legally described as: the West half of Lots 3 and 4, Block 2, Markville, Hennepin County, Minnesota (hereinafter "the Property"); and WHEREAS, the Applicant has made application to the City for a variance from Orono City Code Section 78-420 to permit redevelopment of a property having substandard area and width which includes setback variances; and WHEREAS, the Applicant has made application to the City for variances from Orono City Code Section 78-420 to permit construction of a new residence on a property which is 14,000 square feet (0.32 acres) in area where 87,120 square feet (2.0 acres) is required; and with a width of 160 feet where 200 feet is required; and WHEREAS, the Applicant has made application to the City for a variance from Orono City Code Section 78-420 to permit construction of a new residence 22 feet from the front lot line and 20 feet from the rear lot line where 50 foot setbacks are required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on September 21, 2015, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: 1. This application was reviewed as Zoning File #15-3775. 2. The Property is located in the RR-1 B One Family Residential Zoning District which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'. 3. The Planning Commission reviewed this application on September 21, 2015, the Planning Commission voted 6 in favor and O opposed on a motion to recommend Page 1 ofS approval variances as requested based on the following findings: a). The Property is a lot of record which contains 14,000 square feet in area and has 160-feet in width. b). The variance to allow construction of a new home on the Property which is substandard with respect to area and width will alleviate a practical difficulty inherent to the Property which was not created by the Applicant. c). The Applicant's proposal results in 3,770 square feet of hardcover or 26.9% where 30% is the maximum permitted by code; the proposed structural coverage is conforming at 14% or 2,022 square feet. d). The proposed front and rear setbacks for the new home are not out of character with the neighborhood; the 30-foot side yard setbacks will be met. e). The variance to construct a home on the Property which results in less than 15% structural coverage is in harmony with the general intent and purpose of the Ordinance. f). The variance to permit construction of a new residence in a residential district is consistent with the comprehensive plan. g). The Applicant has provided a survey reflecting the limited building envelope on the Property which is substandard in lot area and lot width establishing that there are practical difficulties. h). The Applicant proposes to use the property in a reasonable manner not permitted by the official controls. i). The front and rear setbacks on the subject property overlap resulting in no legal buildable area; this condition was not created by the landowner. j). The Property is shallow with respect to the RR-1 B requirements and the required setbacks result in no legal buildable area; this is relatively unique for the City however consistent with many of other properties in the immediate neighborhood. Further, not granting the variances will alter the essential character of the locality. The proposed home will be consistent with the neighborhood, and will not adversely impact adjacent properties. k). The Applicant has stated that the requested lot area, lot width and setback Page 2 of5 variances are necessary to allow redevelopment of the Property for preservation and enjoyment of a substantial property right of the owners. I). The proposal centers the home on the Property and will not alter the essential character of the locality. m). The granting of the proposed variances will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter. n). The granting of the requested variances will not merely serve as a convenience to the Applicant, but is necessary to alleviate demonstrable difficulty. 4. The City Council considered this application at a meeting on October 12, 2015 including the findings and recommendations of the Planning Commission, reports by City staff, comments by the Applicant and the public, and the effect of the proposed variances on the health, safety and welfare of the community as well as the impact on properties in the vicinity. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicant, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based on the above findings, City Council of Orono, Minnesota hereby grants variances from 78-420 to permit construction of a new residence on the Property having 14,000 square feet in area where 87,120 square feet (2.0 acres) is required; and with a width of 160 feet where 200 feet in width is required; and a variance from Orono City Code Section 78-420 to permit construction a new residence 22 feet from the front lot line and 20 feet from the rear lot line where 50 foot setbacks are required, in order to build a new single family home; subject to the following conditions: 1. Council approval is based on the survey and building plans submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibits A & B. Any amendments to these plans may require further Planning Commission and City Council review. Page 3 of5 2. Hardcover is proposed at 3,770 square feet or 26.9%, however shall not increase above 4,200 square feet or 30% as permitted in Tier 2. Any changes to the plans or the Property which result in an increase in hardcover above the allowed levels are not approved as part of this variance request. 3. Structural coverage is limited to 2,022 square feet or 14% as shown in the proposed plans. Any changes to the plans or the Property which result in an increase in hardcover above the approved levels are not approved as part of this variance request. 4. Authorities granted by this resolution run with the Property not with the Applicant, but are permissive only and must be exercised by obtaining a building permit for the new construction and commencing construction of said project. A framing inspection must be completed within one year of the date of Council approval, or the variances will expire on that date (October 12, 2016). 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned Applicant has read, understands and hereby agrees to the terms of this resolution and on behalf of their heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property. Substandard properties within the Shoreland Overlay District, like the subject lot, are able to be redeveloped without variances if specific standards are met; such as: 1. All setback requirements can be met; 2. A Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, can be installed or the lot is connected to a public sewer; and 3. The impervious surface coverage meets all hardcover location and square footage restrictions of this chapter and the total square footage of hardcover does not exceed 25 percent of the entire lot area. 4. All other zoning district standards can be met. The applicant's property cannot conform to #1 above therefore, lot area and width variances are required in order to redevelop the property. Because the property is not adhering to the administrative approval allowance of Section 78-72 the Tier 3 hardcover allowance (30%) can be applied in addition to the requested variances. Applicable Regulations: Setback Variance (Section 78-420) FILE# 15-3775 17 Sept 2015 Page 3 of 4 The small lot size and the 50-and 30-foot required setbacks within the RR-B district result in a 15' x 40' buildable envelope. Setback variances are necessary in order to build a reasonably sized home on the property. The new home will be set at a similar setback from the road as existing allowing for an open front yard area. The proposed setback of 31.5 feet from the rear for the garage portion of the home still affords adequate open space between the proposed home and the neighboring home to the east. Governing Regulation: Variance (Section 78-123) In reviewing applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause practical difficulties because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Economic considerations alone do not constitute practical difficulties. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06, subd. 2, when in harmony with this chapter. The board or the council may not permit as a variance any use that is not permitted under this chapter for property in the zone where the affected person's land is located. The board or council may permit as a variance the temporary use of a one-family dwelling as a two-family dwelling. According to MN §462.537 Subd. 6(2) variances shall only be permitted when: 1. The variance is in harmony with the general intent and purpose of the Ordinance. 2. The variance is consistent with the comprehensive plan. 3. The applicant establishes that there are practical difficulties. a. The property owner proposes to use the property in a reasonable manner not permitted by the official controls; The applicant's request for variances to construct a new home is reasonable. b. There are circumstances unique to the property not created by the landowner; The front and rear setbacks on the subject property overlap resulting in no legal buildable area; and c. The variance will not alter the essential character of the locality. The applicant's proposal centers the home on the property and is not out of character with the surrounding neighborhood. Additionally City Code 78-123 provides additional parameters within which a variance may be granted as follows: 4. The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property. The applicant's property is unique in that the front and rear setbacks overlap. 5. The conditions do not apply generally to other land or structures in the district in which the land is located. The applicant's property is shallow with respect to the RR-1B requirements and the required setbacks resulting in no legal buildable area; this is relatively unique for the City however consistent with many of other properties in the neighborhood. The applicant has stated that the requested lot area, lot width and setback variances are necessary. 7. Practical Difficulties Analysis Staff finds practical difficulties exist to support redevelopment of this property, such as the substandard lot area and width are not the result of actions by the landowner; the applicant is proposing to construct a new single family home which is reasonable and consistent with the comprehensive plan. The hardcover and structural coverage proposed meet the requirements of the Zoning code. Granting front, rear and side setback variances in addition to the lot area and lot width variances to redevelop this property will not merely serve as a convenience to the applicant.
