To approve per the findings and conditions of the resolution previously mailed to you.
Please arrange to sign the 3 original resolution copies at the City Offices (Monday through
Friday, 8:00 to 4:30). All persons with an interest in the property must sign the resolutions.
Variance approval is limited to the extent shown on approved plan and as noted in the approval
resolution. Changes in approved plans are subject to further review by the City. Variance approval
expires one year after date of approval. A building permit application must be submitted no later
than June 24, 1997.
Applicants are asked to review the conditions of approval of Council's resolution in order to meet
the requirements of the building permit application when a variance has been approved. The legal
combination of the two parcels can be completed at the City offices without charge.

OVER NAVARRE LANE
The applicant was present.
Mabusth reported that the request was for approval of a drainage easement over
unvacated Navarre Lane. The vacation of 33' Navarre Lane was completed adjacent to
the O'Sullivan/Smith project. The Council had previously decided not to vacate the
remainder of the right-of-way . Drainage tiles will be installed in right-of-way to take the
runoff to the church property and then to the wetlands . It was noted that a conservation
easement was taken over on the wetlands within Outlot C of Lafayette Ridge by the City.
The title company has asked for a drainage easement from the City in completing the title
work. Mabusth said the granting of the easement '\.vill have no impact on a future bike
trail.

Brief Review of Application
Applicant seeks approval of a side street setback variance to permit construction of a 16' x 20'
detached single stall garage within the west rear yard of property. The detached garage will
replace a 1 0' x 8.4' shed. The property does not contain a garage. Access to the garage will
be via the unimproved extended right-of-way of Minnetonka A venue. Minnetonka A venue
consists of grassed-over areas and gravel drive that serves both applicant's property and property
to immediate north.
The structural coverage is proposed at 13.2% (allowed = 15%) and hardcover within the 500-
1,000' setback area is proposed at 22.3% (allowed= 35%). The variance for side street setback
is reviewed as follows:
Allowed = 1 0'
Existing = 1.8'
Proposed= 2'
Variance = 8' or 80%
The Planning Commission recommended unanimous approval of the setback variance as
proposed. The enclosed approval resolution has been drafted per the findings and conditions
of the Planning Commission recommendation.

A RESOLUTION GRANTING A VARIAN CE
TO MUNICIPAL ZONING CODE
SECTION 10.03, SUBDIVISION 6 (D)
FILE NO. 2141
WHEREAS, Roberta Jean Roth (hereinafter "the applicant") is the owner of the
property located at 1251 Briar Street within the City of Orono (hereinafter "the City") and
legally described as follows:
Lot 1 and north half of Lot 2, Block 3, Crystal Bay Minnetonka, Hennepin
County, Minnesota (hereinafter "the property"); and
WHEREAS, the applicant has applied to the City for a variance to Municipal
Zoning Code Section 10.03, Subdivision 6 (D) to permit construction of a 16' x 20' detached
garage to be located 2' from the side street line instead of the required 1 0'.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #2141.
2. The property is located in the RR-lB Single Family Rural Residential Zoning
District requiring two acres in area. The property consists of 10,500 s.f.
3. The property is also located within 500' of a natural environment lake, French
Lake. The property is subject to hardcover and setback regulations for properties
located within 500-1,000' of the shoreline of protected lake.
4. The Orono Planning Commission reviewed this application on June 17, 1996 and
recommended unanimous approval of the proposed variance based upon the
following unique findings and hardships:

A. The garage will be located adjacent to an unimproved dead end right-of-
way not maintained by City.
B. The section of unimproved roadway currently serves as a shared drive for
two adjacent properties and is, for the most part, grassed over.
C. To place the structure and access drive further south in rear yard to meet
required 1 O' setback would result in the loss of mature trees.
D. It is the applicant's desire to preserve as much of their limited grassed
yard as possible.
E. The structure will have no visual impact upon the surrounding properties.
F. The residence to the south is located 60+' from the proposed garage.
G. The property is not served by a garage.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicant; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicant and the effect of the proposed variance on the health, safety and
welfare of the community.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above unique findings and hardships, the Orono
City Council hereby grants a variance to Municipal Zoning Code Section 10.03, Subdivision
6 (D) to permit the construction of a 16' x 20' single stall detached garage within the rear yard
of the property granting an 8' or 80% side street setback variance, subject to the following
conditions:
1. Prior to the City issuing a building permit for construction of garage, applicant
shall have applied for the legal combination of Lot 1 and the north half of Lot
2, Block 3, Crystal Bay Minnetonka.
2. Authorities granted by this variance run with the property not with the applicant,
but are permissive only and must be exercised by application for a building
permit within one year of the date of Council approval, or this variance will
expire on that date (June 24, 1997).
3. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
4. The undersigned applicant has read, understood and hereby agrees to the terms
of this resolution and on behalf of herself, her heirs, successors and assigns,
hereby agrees to the recording of this resolution in the Chain of Title of the
property.

Smith said the setback was appropriate to the neighborhood . Mabusth added that it was
also located on higher elevations .
There were no public comments .
Lindquist moved, Berg seconded, to approve the two street setback variances with the
condition that the applicant be responsible for providing an updated survey locating
approved family room addition upon application for a building permit.
Peterson asked to include that the addition would be the limit for additional structure on
the property agreeing that the setback was appropriate to the neighborhood .
Vote: Ayes 7 , Nays 0 .
Mabusth said the applicant has asked the application to be presented at the June 24
Council meeting.

The Applicant was present.
Mabusth reported that the property is located in the Crystal Bay neighborhood . The
application involves a setback variance for a proposed detached garage. The garage
would be single stall at 16'x20' and a back-out apron to be located 2' from unimproved
Minnetonka Avenue . If the garage were to be located 8' into the yard with gravel drive, it
would result in the loss of trees.
Stoddard asked if it was the City's intent to make any improvements to Minnetonka
Avenue. Mabusth reported that at the time of the French Creek subdivision, the posibility
of a through road was considered but neighbors objected. Response times for emergency
vehicles were found to be adequate using existing county roads . Mabusth said there was
no intention of the City to extend the roadway noting the 20' commons outlet. Mabusth
said the French Creek Homeowners Association has installed high berms with landscaping,
and the City has received no negative comments from the property owners notified .
Mabusth reported that the shoreline of French Lake was located in an earlier application
and that property is located within 500-1000' of French Lake. 35% hardcover is allowed ,
and the applicant's property is well below that amount. There are no structural coverage
issues .

Smith asked if the shed was to be removed. The applicant said it would be. When asked
where the items in the shed would go, the applicant said there was 9' of storage on one
side of the proposed garage and 5' on the front. The applicant said one car would be
sitting outside.

Smith moved, Lindquist seconded, to approve the side street setback variance for the

VARIANCES-PUBLIC HEARING-8:15-8:28 P.M.
The Affidavit of Publication and Certificate of Mailing were noted.
The Applicant was present along with Scott Gikling.
Mabusth reported that the property is located on North Shore Drive, and the majority of
the residence is within the 0-75' setback. The proposed improvement requires lakeshore
setback, average lakeshore, and hardcover variances. The improvements include a two
story addition at 6'x23' to the west side of the 2 story home, a new side entry with stoop, a
realigned stairway, and a bay addition at lakeshore. The upper level would allow an
additional bedroom. A 17.5 s.f bay currently exists and a 52 s.f bay addition is proposed.
Elevations were shown. Both structures encroach the average lakeshore with the west
addition 21' in front of the average lakeshore setback and 42' from the lakeshore. The bay
is located 23' in front of the average lakeshore setback and 39-1/2' from the lakeshore.
The existing structure is 21' from the shoreline. The improvements would increase the
hardcover in the 0-75' setback by 193.8 s.f. or 0.90%.
Peterson commented that the variance is a result of the entire home being located jn the 0-
75' setback.
Mabusth said the increases are a result of the new entry and stoop and would be
considered minor if the home was not in the 0-75' setback. She added that the house was
centrally located on the 280' wide lot, and there was no visual impact on the lake view of
the adjacent residences.
Lindquist asked if the 193 s.f was all in the 0-75' setback. Mabusth said it was and
recommended removal of a boat house v.-ith deck. Lindquist said any hardcover increase
would require a decrease in the 0-75' setback.

Review of Application
The applicant proposes the removal of the 1 O' x 8.4' shed to the rear yard of the property and
replacing shed with a 16' x 20' single stall detached garage. The existing shed is approximately
1. 8' from the unimproved extension of Minnetonka A venue. The proposed garage is to be
located 2' from the lot line. The right-of-way itself is unimproved and consists of grass and
light gravel. The two abutting property owners use portions of the access for parking of
vehicles and as a shared driveway. The applicant seeks approval of the variance because to
move structure an additional 8' with an expanded driveway would result in the loss of mature
trees within their limited rear yard.
The only setback sought by applicant for the improvement is the setback to the unimproved
street right-of-way. Hardcover is proposed at 22.3% where 35% would be allowed and
structural coverage is at 13.2% where 15% would be allowed.
Statement of Hardship
Please refer to Exhibit A, applicant notes the road right-of-way is a dead end unimproved road
not maintained by City and serves as a shared drive for the two adjacent properties and is, for
the most part, grassed over. To place the structure and access drive further south in rear yard
would result in the loss of mature trees and, as applicant notes, it is their desire to preserve
as much of their limited grassed yard as possible.
Staff would add that the structure will have no visual impact upon the surrounding properties.
Upon your inspection, note the existing vegetation and high berm to the west. Properties in
French Creek will not receive any visual impact from the single story garage. The residence
to the south is located 60'+ from proposed garage. It is sta:ff s understanding that the neighbor
to the immediate north will also be asking for setback variances to install a similar garage in
their side street yard. The property is not currently served by a garage.

NOTICE
The Planning Commission will hold public hearings in the Council Chambers at 2780 Kelley
Parkway on Monday, June 17, 1996, the meeting commences at 7 :00 p.m., on the matter of
reviewing the following land use applications:
1. #2138 Joan and William Wroblewski, the owners of 630 Park Lane, seek approval of lot
coverage , hardcover (75-250' setback area) and street setback variances that would permit
construction of a roof and screen porch over an existing deck located to the street side of
the residence.
2. #2140 Troy Anderson of 1490 Long Lake Blvd. seeks approval of a street setback variance
that would allow a single story family room addition to be placed at the west side of the
residence.
3. #2141 Roberta J. Roth of 1251 Briar Street seeks approval of a side street setback variance
from an unimproved public road to permit construction of a single car detached garage to
