Gountanis -Continued) Callahan said the letter from the DNR was a standard-type form and not necessarily specific to the property. Jabbour responded that the proposed residence was too large for the lot. Callahan said the applicant was entitled to 1500 s.f oflot coverage. Jabbour said there was a safety factor with the driveway. Although the code allows for 1500 s.f of coverage, Jabbour noted there are still lakeshore setback and hardcover requirements to be met. It was his opinion that the applicant was not making structural concessions. Tne applicant said he looked at reducing the footprint but needed the four basic rooms on the first floor. Jabbour said it cannot be assumed that all lots can handle the four basic rooms. Some lots are only large enough to accomodate a smaller home. The applicant said the only other real alternative was to repair what was there, which Jabbour said would be all right, and then to add a garage, which Jabbour said he would not be in favor of The owner of 1090 Loma Linda voiced his support of the proposal. The moving back of the home out of the 0-75' zone would enable this neighbor a better view. Jabbour said he understood this, but questioned what the City would end up with in time with houses corner to corner on lots . Kelley said he was not in favor of seeing several proposals in front of him for approval. It was bis request to send the application back to the Planning Commission until one proposal could be presented to the Council. Kelley moved, Hurr seconded, to deny Application #2036 . Goetten said the applicant should have the opportunity to table the application to review the proposal so he would not be required to wait six more months until he could present another proposal. The applicant agreed with Goetten. Kelley moved, Hurr seconded, to table Application #2036 . Ayes 5, Nays 0 . The applicant asked what parameters would be acceptable. Kelley said the proposal as drawn is too ambitious. The lot coverage should be limited to 1500 s .£ with a tuck under garage as a viable solution. Goetten concurred with the dimensions being too large for the lot and said the applicant should speak with Staff regarding options. Callahan said he would have supported the Planning Commission recommendation. Jabbour concurred with Kelley and Goetten. Hurr asked if Gountanis had already purchased the lot. The applicant said he had. Ann Stevens said it was done based on the Planning Commission recommendation. The Council refuted that remark as the applicant had been made aware of the advisory status of the Planning Commission and the approval needed from Council. Additional Exhibits J -DNR Letter of 8/21/95 received after 4:30 p.m. Description of Application Applicant proposes the replacement of an existing deck 5'x15' with a new expanded deck at approximately 12'xl 7', refer to Exhibit I. The new deck will encroach approximately 3' beyond the average lakeshore setback line (refer to Exhibit G). The topography and distance between the two residences will minimize any impact created with the expansion of the deck. The deck will not be seen from the view windows of each residence. The existing deck is approximately 137' from the shoreline of French Lake. Applicant proposes the new deck at 131'. Both the existing deck and proposed deck will be located within the required 150' structural setback from the natural environment lake. Review Exhibit J, the DNR representative asks that structure not extend any closer to the lake than the existing deck setback at 137' and that applicant provide natural screening to protect views from French Lake. Planning Commission felt the DNR representative should visit the site as there is an extensive yard with existing natural screening. The house is located to the extreme southeast corner of property and not within direct view of shoreline of French Lake. 310 s.f. deck will be placed over 95 s.f. of existing landscape and paved areas. A corner of the proposed deck will extend 131' from the shoreline. The remainder of the deck will be behind the 131' setback. Planning Commission Recommendation The Planning Commission recommended unanimous approval of the application as proposed. The enclosed approval resolution has been drafted per the findings and conditions of the Planning Commission recommendation. Frank and Barbara L. Frank (hereinafter "the applicants") are owners of the property located at 1233 Briar Street within the City of Orono (hereinafter "City") and legally described as follows: Lots 1 through 15 inclusive, Block 3, "Maxwell's Addition" to Crystal Bay, Lake Minnetonka, and the Northerly 12' of Lots 4, 5 and 6, Block 8, Monterey on Minnetonka, according to the plat thereof on file or of record in the office of the County Recorder, Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, tht~ applicants have applied to the City for variances to Municipal Zoning Code Section 10.28, Subdivision 5 (B) and Section 10.56, Subdivisions 16 (C-1) and C- 6) to permit construction of a replacement deck at the lakeside of the existing residence to be located 131' from the shoreline of the natural environment lake where a 150' setback is required and existing deck is 137', the structure will encroach 3' beyond the average lakeshore setback line and the deck will be placed 42' from the street lot line where a 50' setback is required and where a 27. 7' setback exists. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This :_;i:p!.)lication was reviewed as Zoning File #2042. 2. The property is located in the RR-lB, Rural Residential Zoning District requiring 2 acres in area. The property consists of 39,400 s.f. of dry buildable land. Page 1 of 5 3. The Orono Planning Commission reviewed this application on August 21, 1995, and recommended approval of the variances as proposed based upon the following unique findings and hardships: A. Because of the curvature of the shoreline and the angle of the residence on the property, the deck will not be visible from the public view of the French Lake shoreline. B. French Lake is not used by public boaters. C. The deck cannot be seen from the residences on the adjacent properties because of the distance between residences, topography and natural screening. D. The deck at approximately 310 s.f. will be placed over 95 s.f. of existing hardcover improvements. E. Only a comer of the deck will extend 131' to the Ordinary High Water Level of the shoreline of French Lake. The majority of the deck will be placed behind the 131' setback. F. The interior layout of the upper level of the residence and the uses at the lower level limit feasible areas for extending deck. G. The majority of the residence is located within the 150' structural setback. 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicants and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to the Municipal Zoning Code Sections referenced above to permit construction of a lakeside deck at approximately 12'x17' and as shown on a survey by Mark S. Gronberg of Coffin and Gronberg, Inc. dated November 10, 1993, most revised date June 28, 1995, subject to the following conditions: 1. Authorities granted by this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (August 28, 1996). 2. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 3. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property. The Certificate of Mailing and Affidavit of Publication were noted. Mr. & Mrs. Carson were present, along with their contractor, Mark Gronberg. The application is for a decorative pond within a type 1 wetland. It is presently under review with the Corp of Engineers, who is reviewing the project with other agencies and checking for effect on the wetlands. The property is a 3-acre parcel with 1 acre of type 1 wetlands . The residents within the subdivision are asking for assurance that the pond would not affect their properties. Gronberg said the 1650+ cubic yards of fill will be used for back filling . The ·watershed District was said to believe there would be no negative impact from the pond construction. Peterson asked for the reason for building a pond. Gronberg said there was a two-fold purpose. One reason is for beautification of the site to create a higher type 3 wetland , and the other is to use the fill for the house pad. Peterson said the question is always what is a pond . The Planning Commission does not want a round bowl with gravel and mowed grass up to its edges. The Commission would like to see more type 3 wetland ponds, which would include no mowing within 1 O' of the pond to encourage native growth. Mabusth said this was noted in the Engineer's recommendation. Gronberg said this was shown in the configuration for the pond. Mabusth asked the applicant what the maximum depth would be of the pond. It would be 6-8' deep. Smith asked Staff to ensure the standards are consistent with the pond development plans made for another project on Orono Orchard Road. Schroeder moved , Smith seconded, to recommend approval of the conditional use permit for a 6' deep pond with the moving of 1650 cubic yards of fill to create a type 3 wetland with the standards developed with the pond on the Spencer property on Orono Orchards. Mr. & Mrs. Frank were present. 7 MINUTES OF THE ORONO PLA."NNING COMMISSION MEETING HELD ON AUGUST 21, 1995 (#5 -#2042 Thomas Frank -Continued) Mabusth reported that the property is a lakeshore lot on a natural environment OHW, French Creek Lake. There are no improvements within the 75' setback. A structural on a OHW requires a 150' setback. There are some hardcover improvements at 75'. The proposal requires an average lakeshore setback variance. The house is within the 50' street setback. The proposed deck requires a setback variance. The deck exists at 137' and is proposed at 13 l '. The proposal requires a 3' average lakeshore setback variance. Peterson read into the minutes a letter from the DNR, which recommends the proposal, with two conditions. They ask for screening and relocation of the deck to another area of the home. Peterson did not see where the deck could be repositioned. Mabusth said the setting is very natural and no visual screening is needed. It was determined that the DNR had not been on site in reviewing the proposal. Schroeder asked if the deck could be smaller. Mrs. Frank said, although it could be a little smaller, the steps for the deck allow access to the driveway, and the deck only extends 6' from the house. Mr. Frank said the hardcover is within the 25% allowable at 19.14% and ask for approval as proposed. Mabusth asked the Commissioners if they would give approval for structure within the street setback. Lindquist and Peterson saw no problem. Mabusth will contact M.r Richter oftheDNR There were no public comments. Schroeder moved, Lindquist seconded, to approve Application #2042 to extend the deck base<l on the lack of another area in which to relocate the deck and the proposal having no impact on its surroundings. The existing residence was constructed prior to the current Shoreland Regulations that now classify French Lake as a natural environment lake. 2. Applicant notes the actual open water area of French Lake is 500' + from rear yard. The topography of the area and the distance between residences on adjacent lakeshore lots minimizes the visual impact of both existing and proposed deck. Issues for Consideration 1. Will you approve an increase in hardcover within the 0-150' setback area? 2. Will you allow the additional 6' encroachment into the lakeshore setback? Can a deck be extended into the rear yard without being located in the 150' setback area? Can the deck be relocated further to the south over the garage? 3. Will you approve a new structure within the required street yard. 4. Other issues raised by Planning Commission members. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; ( c) any known consequence arising from his supplying or refusing to supply private or confidential data; and (d) the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible authority, an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Subd. 4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data concerning himself. To exercise this right, an individual shall notify in writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (a) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or (b) notify the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determination of the responsible authority may be appealed pursuant to the provisions of the administrative procedure act relating to contested cases. 11 LIST OF LEGAL NAMES 1.
