The involved properties include the 0.92 acre Crosby lot with existing house, and the vacant Pillsbury pr�lnerty consisting of 3 parcels totaling 2.01 acre-. The proposal would result in an increase in size of the Crosby lot to 1.15 acres and reduction of the Pillsbury lot to 1.78 acres. Both the pruperties are relatively low, mostly less than 5' above lake level. The existinq septic system for the Crosby house was inspected in Fall 1984 and appears to be quite functional. A new water softener discharge drainfield was added last fall. Because of the low elevations, Mr. Pillsbury did have septic testing done on the south end of his vacant property. A specially designed "mound" drainfield system would be required in order to meet current codes if a new house is ever constructed. .n addition, por- tions of the southwesterly quadrant of this lot are below elevation 931.5, or within the protected Flood Fringe District, hence any fil- linq or grading in this area would be subject to a CUP, and MCWD and DUR review. The low area does not continue to the lakeshore, and will need some study to determine whether fillinq would be detrimental. Based on the draintit•ld site location-, and the low land at the site, the subdivision does slightly decrease the possible buildinq envelope for the Pil lshury lot. Note, however, that a line of existing trees near the north end of the lot does seem to move ILhe logical house site further to the south. Assistant 'Zoning Administrator Gaffron asked for Zoning Administrator Mabusth's comments on takinq a lot of over 2 acres (in a 2 acre zone) and t-reaking it down to a smaller 'ot and making the adijcent lot larger, thus making two subbtandard lots. Zoning Adminisrator Mabusth explained this is an acceptable procedure as long as no harm is dor►e to the original lot that you are taking land from, and if you are improving a substandard condition. There would be no new lot created or an unbuildable to in an unsewered area. The septic testing has been done and found to meet al I rural standards. Thus if you are assured you have a buildable lot you may rearrange lOt lines to improve the substandard lots. Goetten stated her concern that by doing this you would be in a sense granting a variance on the newly created substandard lot. Zoning Administrator Mabusth stated that the fact remains that you are improving a smaller lot building envelope and still not making the larger lot non - buildable. Assistant Zoning Administrator Gaffron explained that the f loodpljin area on the Pillsbury lot below 931.5 can't be filled or ex vated without Council approval. Further study bhould be done on this area to tell if filling would be a problem. If a house is proposed to be built in this area, (encroaching or the I loodplain), then a review would have to be do• Assistant Zoning Administrator Gaffron stated that by approving this lot line rearrangement you are pushing the building envelope on the Pillsbury lot further south, thus encroachinq onto the floodplain. Councilmember Frahm asked st-iff if each lot has 1 acres of dry buildable. Frahm asked this because he felt there are some wetlands on the E:,roperty. Assistant Zoning Administrator Gaf f ron felt that the area in question is dry buildable but stated that staf f would again check the area tc see if it ihould qualify for wetlands. Gaffron also noted that testing for an alternate drainfield site for the existing house had not yet been completed. The combination papers are required to consolidate the lots for tax purposes and to avoid their being conveyed as independent, small lots in the future.
