construction o: a tennis court at the North end of their
property on Brackett's Point. Appended to the application
are two copies of a survey of the property showing the loca-
tion of the proposed tennis court certified by C. R. Winden
and Associates, Registered Land Surveyors, a list of property
owners certified by the Hennepin County Finance Department,
a picture depicting the proposed tennis court, ten stamped,
legal siz,- envelopes, pre-addre.3sed with no return :ddr.ess
for each of the names on the list of property owners and
our check made to you in the amount of $50.00 for your application
fee.

SUBJECT: #567 Variance - 1265 Bracketts Point Road
Septic System Review
The septic system for this property is shown on the attached sketch.
The system, while not visibly discharging to the ground surface or
the lake, is non -conforming by Shoreland Management Standards in
that the drainfield lines and the :.ank are within 75' of the lake
and less than 3' above the water table. Eventually this system will
be required to be brought into conformance with the Code.
Proposed placement of the tennis court will not effect the existing
or future drainfield areas. Nothing in the Code would require
reconstruction of the septic system prior to approval or construc:'In
of the tennis court. I, therefore, see no reason to deny the permit
or variance based on septic system location.

heard. Planning Commission had no problems with 2690 Pheasant Road

Wilson moved to recommend approval of the variance
based on the hardships of no adjacent land available,
angle of house location on lot and the deck on the
rear of the house, subject to the review of the roof
drainage by the inspector to verify that th,, drainage
is directed south.
Mrs. Haverberg was present. The screen porch h.is
already been constructed without a building permit
Duwavne Schibilla, 3235 Crystal Bay Road, was also
present. He stated he was not opposed to the
screen porch as long as it was not enclosed (he
also sent a letter to that effect to the City which
is on file). Planning Commission was very concerned
with the enforcement of this condition, and requested
that the applicant and Mr. Schibilla also work it out
among themselves.
Wilson moved to recommend approval of the variance
subject to the following conditions-
1. Accurate survey of the improvement with setback
encroachment certified for Council.
2. Approve the variance for the screen porch with
the express condition that it will not be
enclosed in the future.
3. Drainage from roof must be reviewed and approved
by the building inspector.
Motion seconded by Frahm. VotE:.,: Ayes (7), Nays (0).
Motion bussed unanimously.
Mr. and Mrs. Lynn were present. Planning Commission
had not problems with this application.
Adams moved to recommend approval of the variance
for the tennis court based on the hardships of
configuration of the lot and the location of the
lake and street. Motion seconded by Hannah.

The Lynns request a front yard variance setback of 16' for a tennis
court 60' X 120'. The subject lot is 3+ acres, but a long, narrow
lakeshore property. The court will be constructed in a heavily
wooded area of the property. The On -Site Manager advises that the
location of the tennis court will not effect the existing or future
drainfield area. The improvement will not cr.zate a hardcover problem.
