(b) The descriptions used in the Application and at Paragraph 'I" hereof include portions of Center Avenue and of County Road No. 7. I find no record of the vacation of these portions of said public highway:. but there is an allegation in the Application that said portions of sale highways have been discharges from the public e:,,e.-,ent by abandonment. In order that there may be evidence on the subject at the hearing and a finding of fact in the Decree of Registration from which the Court may determine whether the premises are subject to or free fro-. said public easements, I recommend as defcnJar,ts the County of lie rnep:n and the Village Teanskitp of Orono. In order for the applicant to prove abandonment of said portions of Center Avenue aril said County Road a»r-W there nust ue evidence showing a substitution of another road for the abandoned por- tions of the road. There is a plat in Torrens Case No. 12483 which show the abandoned portiont of the roar' anJ also tt:e substitution of a road as now travelled. This plat may bf, introdu.e,i into evidence as proof to show the substitution 0f a ne^ road tur tte aoan.loned road. A building permill was issued on June 3, 1982. Lynn received approval from Council for a street setback variance to permit construction of a tennis court on June 30, 1980 with an expiration data of June 30, 1981. The hardships were reviewed as follows: 1 - Narrowness of lot - 175' width and 75' lakeshore setbac! and 50' street setback. 2 - Location of travelled road as opposed to platted road. The applicant accepted the fact that a new application had to be filed with the ^ity in keeping with the requirements of the Ordinance. Lynn's real concern was with the delays involved in waiting for the cent- scheduled meeting of the Planning Commission on June 21, 1981, and final action by Council on the 28th of June. Members of Council contacted by staff agreed to approve the renewal variance with the condition that Council establish an abbreviated review procedure for all residents with renewal variance applications that present no chances from the oriuinal application. The following is a sk.i(a(aestion for such procedural change: #687 Michael Lynn Page 2 Renewal Variance All renewal variance applications could be presented as consent items at Council meetings if staff finds that all of the following criteria can be met: 1 - No change from original application 2 - No more than 2 years has expired since expiration date of original application 3 - No zoning changes have occured since approval date A Council member may refer the renewal application to the Planning Commission for further review without the need of public explanation on the meeting night. Any changes in the review process will be reviewed by the Planner for possible conflicts with existing zoning code and in light of the 1982 (--hangr-s in the Zoning laws of. the State. The I.ynns request a front yard variance setback of 16' for a tennis court 60' X 120'. The subject lot is 3+ acres, but a long, narrow lakeshore property. The court will be constructed in a heavily wooded area of the property. The On -Site Septic Systems Manager advises that the location of the tennis court will not effect the existing or future drainfield area. Thu improvement will not create a hardcover problem.
