' 1 .. <br />7334860 <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO . 4 180 <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTIONS 10.22, SUBDIVISIONS 1 AND 2, <br />10.55, SUBDIVISION 8, AND <br />Metro L eg fi 1 Se nlD:Bs , !SUBDIVISION 16 (C & L) <br />Box 491 FILE NO. 2421 <br />WHEREAS, James and Joann Jundt (ll~reinafter "the applicants") are the owners <br />of the property located at 1400 Bracketts Point Road within the City of Orono (hereinafter "the <br />City") and legally described as follows : <br />(Exhibit A attached); and <br />WHEREAS, the applicants have applied to the City for renewal of variances to <br />Municipal Zoning Code Sections 10.22 , Subdi visions 1 and 2 , 10 .55 , Subdivision 8 and 10.56 , <br />Subdiv ision 16 (C & L) to permit the restoration of an existing retaining wall , underground <br />grotto and lakeshore stairway sy stem located within the 0-75' lakeshore setback zone w here no <br />har dcover or structure is normally allowed . <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono , <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #2421. <br />2. The property is located in the LR-IA Single Family Lakeshore Residential <br />Zoning District. <br />3. The Orono Planning Commission originally reviewed this variance request on <br />September 16 , 1996 and recommended approval of the proposed variances to <br />restore the lakeshore stairway system, retaining wall and underground grotto , <br />based upon the following findings : <br />Page 1 of 6
