Your contractor has told you that he has been issued permits for other steps without an engineering review. In reviewing the file I was reminded that the project also included 40 cubic yards of grading to create a wheelchair path, which required a conditional use permit. This is what triggered the need for the City Engineer to review the plan. Enclosed are copies of his reviews. Two were required because the first plan did not provide all the necessary information. A RESOLUTION GRANTING A HARDCOVER VARIAN CE FROM MUNICIPAL ZONING CODE SECTION 78-1288 AND A CONDITIONAL USE PERMIT FOR LAND ALTERA TIO NS WITHIN THEO -75 FOOT SHORELAND ZONE PER SECTION 78-966 FILE NO. 06-3205 WHEREAS, Mary J. Jundt and James R. Jundt, wife and husband, (hereinafter "the owners") are the owners of the property located at 1440 Bracketts Point Road within the City of Orono (hereinafter the "City") and legally described on Exhibit A attached to this resolution; and WHEREAS, the owners have made application to the City of Orono for a variance from Orono Municipal Zoning Code Section 78-1288 to allow replacement of the fourth set of lake access steps on the property; and WHEREAS, the owners have made application to the City of Orono for a conditional use permit per Orono Municipal Zoning Code Section 78-966 to allow grading within the 0-75 foot shoreland zone to create a path for a wheelchair adjacent to these steps; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on June 19, 2006, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #06-3205. Page 1 of 5 2. The Planning Commission reviewed this application at a public hearing held on June 19, 2006 and recommended approval of the variance based on the following findings: a. The proposed steps would replace a set of steps approved in Zoning File # 94-1867 that have deteriorated. An asphalt path to those steps approved in Zoning File # 95-1992 has already been removed. b. The hardcover associated with the new steps would be less than the hardcover associated with the existing steps. c. The proposed steps would have less visual impact than the existing steps. 3. The Planning Commission also recommended approval of the conditional use permit for land alteration within the 0-75 foot shoreland zone based on the following findings: a. The grading will provide a path that will facilitate access to the dock by persons using wheel chairs and person who have difficulty negotiating stairs. b. There will be no hardcover associated with the path. 4. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the owners and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the owners, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial Page 2 of 5 property right of the owners; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to Orono Municipal Zoning Code Sections 78-350 and 78-1288 to allow construction of a new house, subject to the following conditions: 1. Council approval is based on the site plan submitted by the owners and annotated by City staff, attached to this Resolution as Exhibit B. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Hardcover associated with these stairs shall be limited to 167 square feet. Owners are advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. Once the existing steps have been removed the variances granted in Zoning File # 94- 1867 for the steps and in Zoning File # 95 -1992 for an asphalt path to these steps shall terminate 4. Authorities granted by this resolution run with the property not with the owners, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (June 26, 2007). 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned owners have read, understand and hereby agree to the terms of this resolution and on behalf of the owners and the owners' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property. Page 3 of 5 Based upon one or more of the findings noted above, the Orono City Council hereby grants a conditional use permit per Municipal Zoning Code Section 78-966 to allow grading within the 0-75 shoreland zone per the grading plan attached to this Resolution as Exhibit B and as annotated by City staff, subject to inclusion of erosion and sediment control details on the final plans. A conditional use permit for land alteration within the 0- 75 foot zone is also requested to allow regrading to provide a wheelchair path to the dock. (a) No hard cover or impervious surface shall be placed, located or constructed within 75 feet of the ordinary high water level of any lake or tributary, except for stairways, lifts, landings and lockboxes as regulated elsewhere in this Code. (b) Between 75 feet and 250 feet of the OHWL, there shall be no greater than 25 percent hard cover. Between 250 feet and 500 feet of the OHWL there shall be no greater than 30 percent hardcover. Plat Map Background FILE #06-3205 June 19,2006 Page 2 of 2 The zoning code allows each lakeshore property to have a single stairway access to the shore down a steep slope. This property has four sets of stairs to the lake. Three are stone steps associated with the grotto area near the house. The fourth set, located near the south property line, provides access to the dock. It was approved in 1993 under a variance. It has deteriorated to the point it needs to be replaced. The replacement steps would have a turn in them so the amount of hardcover would be slightly increased, since the existing steps run straight up the slope. The path for a wheelchair would have a grass surface. Hardship Statement Applicant has completed the Hardship Documentation Form attached as Exhibit B, and should be asked for additional testimony regarding the application. Hardship Analysis In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. The reasons for granting the variance for the existing steps still exist. The proposed steps would be less visible than the wood steps. Originally there was an asphalt path to the top of the wood stairs (approved with a variance). The path has been removed and would not be replaced. The Shoreland Regulations allow access for to be considered in granting variances and conditional use permits. While the City Engineer has not completed a thorough review of the applicant's response, it appeared to adequately address his concerns. The Jundt's have done a remarkable job of historic preservation. A part of this preservation consists of an old 2 foot wide stairway going down to a pump house on the other end of their property. In the middle of their property there are a few stone treads allowing access along there center shoreline and down by their south property line there exists the stairway we want to rebuild which is their main stair to their dock. On a property this large it would be impractical to think that you could get by with one stair to the lake. Subject: Remove old wood stair system to the dock originally permitted by variance action approximately 13 years ago. Remove wood landing going to irrigation control shed. Original variance allowed for 131.5 sq ft stairs and landings and 114 sq ft of deck to control box. New stairs without deck are 167 sq ft plus 12 sq ft of control box resulting in a total of 179 sq ft a reduction of 66 square feet of hardcover. Replace old stair system with 4' wide Chilton in ground treads and landings curving the treads so that they become hidden as we are going to plant an Alpine Currant hedgerow and Lily's ( see future photo attached). The photo also shows the planting of Arborvitae, Techne, hiding the irrigation control box and dock storage area. Further creating a grass lawn path with Juniper buffer area at shoreline for water runoff. The path will allow better wheelchair access to the dock reducing the total wheel chair tread usage to two treads. At present they have two makeshift wood ramps that are laid on the stairs and look pretty dangerous. path will require adjusting approximately 40 cubic yards of soil and new sod. Because a previous variance was given for the wood stair system. A new variance would not have been necessary if we would have built the new stair system in exactly the same location as the original stairs going straight up the hill. However, a great effort is being made to hide the new stair system and clean up the ugly look that is there now. The City of Orono desires that stair systems turn and be hidden with vegetation, so I always do when I design a new system for someone in Orono. I had no idea that an old variance existed on the old stair and obviously my new design serves both Orono's desires and Jundt's much better, so now I am stuck going to meetings.
