Dear Ms. Bullock:
This office is legal counsel for the City of Orono (the "City"). For
convenience, Burnet Title is referred to in this letter as "you." This letter ("Escrow
Instructions") constitutes Escrow Instructions for the closing between the City and
James R. Jundt and Mary Joann Jundt, husband and wife, (Developer) relating to PID
# 114l7-23-32-0020.
The City's closing documents shall be disbursed strictly in accordance with the
Escrow Instructions. Attached to this letter is an acknowledgement by you of the
receipt of this letter and your agreement to hold and disburse the closing documents in
accordance with the Escrow Instructions. Prior to undertaking any actions related to
the Escrow Instructions, you must first sign and return a copy of this letter to me via
fax or email (original to follow by mail).
1. Documents. The following Documents will be delivered to you on
the Closing Date:
A. Certified Copy of City Resolution No. 6836 (Street Vacation);
Be Development Agreement;
C. Plat.

2. Record documents in the following order and prior to any additional encumbrances being
recorded azainst the Plat or property within the Plat:
(i) Documents necessary to release any recorded liens or mortgages at the time
of closing;
(ii) Resolution No. 6836 (Street Vacation);
(iv) Development Agreement;
(v) Final Plat.
3. Deliver copies of all executed closing documents to me; and
4. Return the following original recorded documents to Jeremy Barnhart at the City of Orono,
2750 Kelley Parkway, Orono. MN 55436
(i) Resolution No. 6836 (Street Vacation);
(ii) Development Contract.
5. Unless you are able to close this transaction before the end of business on December 8, 2018,
you shall return the Escrowed Documents to me, unless you receive other instructions from the
respective parties.
