Absent: Steve Persian. Staff present: City Administrator Adam Edwards, City Clerk Christine Lusian. SOLID WASTE ORDINANCE The City Council held a work session to review the city’s solid waste regulations for consistency with state and county standards and offer input on potential future related goals or initiatives. Staff provided an overview of the city’s solid waste system, the existing ordinance, as well as resident and hauler feedback. The presentation focused on a proposed clarification to hauler licensing language to improve transparency and ensure compliance with state requirements for volume-based pricing, while also identifying possible areas for longer-term policy review. Council provided direction to staff to proceed with the draft ordinance language provided for consideration of an ordinance amendment at their March meeting. DECA Student Advocacy Joe Huber, DECA teacher at Orono High School, and Sydney Nguyen, a senior at Orono High School and DECA’s advocacy campaign leader, shared how the organization supports students in developing leadership and business skills while contributing to the Orono school community. She also invited Council Members to serve as judges for the upcoming State Career Development Conference on March 2 and welcomed ideas for partnerships and youth engagement. 15. Community Day at Saints CHS Field 5 Minutes City Council Regular Meeting Monday, February 23, 2026, 6:00 PM City Council Chambers 2780 Kelley Parkway, Orono, MN 55356 Page 2 of 3 Will Young of the St. Paul Saints, presented an opportunity to host an “Orono Community Day” at CHS Field to have the Orono-area community attend and recognize people the City Council identifies as community “stars” and/or local businesses. A special ticket offer would be available to community residents as well as opportunities for a community charitable drive and youth group involvement. The Council expressed interest and directed that staff be available to support their work as needed, including facilitating connections and providing information. PUBLIC COMMENTS There were no public comments. 2. Claims/Bills Pulled by Council Member Ricks to allow for a deeper discussion regarding an invoice for “Hackberry Park Revitalization” and to review the status of the park project. Ricks moved, Benson seconded, to approve the claims and bills. VOTE: Ayes 5, Nays 0. 13. LA26-000004, 3590 North Shore Drive, Variances – Resolution 7667 Pulled by Council Member Ricks to confirm the variance approval includes a condition for two required native tree plantings to be located within the lakeyard. The resolution approved variances necessary to construct a new home on the property. Persian moved, Schwingler seconded, to adopt Resolution 7667 approving LA26-000004 North Shore Drive, Variances. VOTE: Ayes 5, Nays 0. COMMUNITY DEVELOPMENT REPORT 14. LA25-000036, 1200 Wildhurst Trail, After-the-fact Variances and Conditional Use Permit The Council was requested to review and provide guidance on an application related to unpermitted patio, retaining wall, and shed improvements. The Council directed staff to prepare a resolution with findings for denial for formal action at the next council meeting. The City will continue working with the property owner on next steps to bring the property into compliance. Ricks moved, Benson seconded, to direct staff to prepare findings for denial. Upcoming Work Sessions City Administrator Edwards presented changes to the upcoming work session schedule, including canceling the March 23 City Council meeting and work session. Several topics for spring work sessions were discussed. The Council discussed a date and time to conduct interviews with commission applicants, selecting Feb. 26 from 2 to 4 p.m. Benson rejoined the meeting at 7:13 p.m. 16. Lilac Lane Pavement Restoration The City Engineer provided an update on coordination with the Metropolitan Council Environmental Services (MCES) project, including a discussion regarding the road at the end of Lilac Lane near French Creek Park. The consensus of the City Council was to postpone a decision until the next meeting. MAYOR/COUNCIL REPORT 17. Minnesota Mayors Coalition – Safety over Partisanship Tunheim asked if the City Council was willing to have him sign a joint letter concerning public safety and the ICE Surge, or if councilmembers considered it partisan. The consensus of the council was that the letter is non-partisan and is important. Mayor and Council provided reports. COUNCIL ACTION REQUESTED Consider a motion to approve the work session schedule. 24 Date: March 9, 2026 Item: 4 Presenter: Joe Ruthenberg, Superintendent - Parks, Facilities Section: Consent Agenda Title: Commission Appointments - Resolution 7669 1.Purpose: The purpose of this action item is to make appointments to the Park and Planning Commission. 2.Background: Following City Code Sections 6.04.020 and 3.08.120; the Planning and Park Commission is composed of seven members, who serve staggered three-year terms. The council may, by majority vote to appoint one or more alternate park commission members to serve when regular members are absent. Currently, there are three (3) open positions on the Parks Commission. Two park commission applications have been received. The Planning Commission has 2 commissioners who were appointed in 2025 that were set for a 1 year terms following the staggered terms limits and 1 new applicant for an alternate position. 3.Summary: The City Council conducted an interview with Bruce Lemke an applicant for the parks commission and Stacy Royal an applicant for the planning commission alternate position. Council directed staff to draft a resolution to appoint the Bruce Lemke as a regular commissioner and to re-appoint current commissioner Gordy Stofer as an alternate at his request, and reappoint Michael Huddy to another term on the commission. Shane Weltzin and Sam Tift were newly appointed planning commissioners in 2025. Due to the staggering term limit requirements they were appointed to a 1 year term. The draft resolution renews there planning commission appointments for a 3 year terms. In response, staff reviewed the city’s solid waste ordinance (the primary authority that guides city services and compliance), along with state law, policies, and contracts. Staff also gathered resident and hauler feedback and reviewed service data to better understand the concerns. Since 2025, city staff have been reviewing our ordinance to simplify the language, e nsure it follows state law and county requirements, clarify the city’s role, and make sure residential pricing supports waste reduction. In February, the City Council held a work session to review the current regulations and discuss possible updates. Staff presented an overview of the city’s waste system, the current ordinance, and feedback received. The discussion focused on clarifying licensing language for waste haulers to improve transparency and ensure compliance with state requirements for volume-based pricing (where customers pay based on the size of their garbage cart). Council directed staff to move forward with draft ordinance changes, which are being presented today. The proposed updates: Clarify that the city does not approve garbage rates Require clearer itemization of fees so customers understand billing components Require residential service to use volume-based pricing (larger carts cost more than smaller carts) Establish minimum cart size options and meaningful price differences between sizes Align local requirements with county reporting and waste-reduction goals Residents and taxpayers are our primary customers and licensed haulers are key partners in providing service. These updates are intended to make the rules clearer and easier to follow, reduce confusion about the city’s role, improve how the rules work in practice, and allow haulers flexibility while supporting shared environmental goals. The overall goal is a system that is clear, workable, and supports waste reduction. 3.Cost: Supplemental updates to the code, made in between full revisions (which occur every 10–15 years), are billed at $22 per page. Newspaper publication costs $12.60 per column inch, so publishing a summary is more cost-effective than publishing the complete ordinance. 4.Process: February 24: Haulers received the proposed ordinance by mail and were invited to share feedback March 9: Council will consider adopting the proposed updates. STORAGE AND DISPOSAL Sec. 5.20.110. Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Commercial establishment means any premises where a commercial or industrial enterprise of any kind is carried on, and shall include restaurants, clubs, churches, conference centers and schools where food is prepared or served. Multiple dwelling means any building used for residential purposes consisting of more than three dwelling units with individual kitchen facilities for each. Refuse means all organic material resulting from the manufacture, preparation or serving of food or food products, and spoiled, decayed or waste foods from any source, bottles, cans, glassware, paper or paper products, crockery, ashes, rags, and discarded clothing, tree or lawn clippings, leaves, weeds and other waste products, except human waste or waste resulting from building construction or demolition. Residential dwelling means any single building consisting of one through three dwelling units with individual kitchen facilities for each. (Code 1984, § 9.01(1); Code 2003, § 54-31) Sec. 5.20.120. Storage. (a) It is unlawful for any person to store refuse on residential dwelling premises for more than one week. All such storage shall be in five- to 50-gallon metal or plastic containers with tightfitting covers, which shall be maintained in a clean and sanitary condition. Tree leaves, weeds and grass clippings may be stored in plastic bags and tree limbs must be stored in bundles weighing no more than 75 pounds and no longer than four feet. The cul-de-sac was constructed as part of the 2020 Road Project. The easement was never recorded with the County. The property has a new owner who is looking to complete an addition to the existing home. The easement impacts the building envelope and setbacks related to the proposed addition. City staff has partnered with the property owner to execute new easements that protect the city's roadway and utility rights in a manner that mitigates the setback issues for the home. The original easement was a singular right of way easement based on a 50-foot cul-de-sac radius. The new easements consist of a right of way easement based on a 42ft radius of the cul-de-sac with an additional 10-feet of drainage and utility easement. The city's zoning code measures the front setback from the proposed right of way line from the 2020 easement. Reducing the right of way by 8-feet will provide relief to the required yard, allowing the owner to site his addition and meet the front setback, while still protecting the space around the cul-de-sac with a 10-foot utility easement. Once signed the easement will be sent to Hennepin County for recording. 3.Cost: As part of the creating the new easements the resident agreed to complete the necessary survey work for the easement documents and the city agreed to have the city attorney prepare the easement documents. The city will compensate the property owner $2,000 for the surveying expenses and to secure the easement. The Property is legally described as the property identified as “Parcel A” on the attached Exhibit A, and is located at 45 Smith Avenue, Orono, Minnesota. 2. Grant of Easement. For valuable consideration, receipt and sufficiency of which is hereby acknowledged, Grantor hereby grants and conveys to City a permanent, non-exclusive easement in, on, over, under, across, and through that portion of the Property that is legally described on the attached Exhibit A, and depicted on the attached Exhibit B (the “Easement Area”). The Easement is granted for public right-of-way and public drainage and utility purposes. 54 2 238461v1 3. Scope of Easement Rights. The Easement includes the rights of the City, its employees, contractors, agents, and assigns, to enter upon the Property at all reasonable times for the following: A. Public Right-of-Way Purposes. i. To locate, construct, reconstruct, operate, maintain, inspect, alter, and repair within the Easement Area, public right-of-way for roadway use; and ii. To grade, level, fill, drain, pave, and excavate the Easement Area; and iii. To remove trees, bushes, undergrowth, and other obstructions interfering with the location, construction, and maintenance of the public right-of-way for roadway use. B. Public Drainage and Utility Purposes. i. To locate, construct, reconstruct, operate, maintain, inspect, alter, and repair within the Easement Area, storm sewer, sanitary sewer and water facilities, ground surface drainage ways, or other public facilities or improvements of any type that are not inconsistent with public drainage and utility use; and ii. To grade, level, fill, drain, pave, and excavate the Easement Area; and iii. To remove trees, bushes, undergrowth, and other obstructions interfering with the location, construction, and maintenance of the public drainage and utility system. 4. Duration of Easement. The easement is permanent and remains in effect until vacated by the City. 5. Warranty of Grantor. The analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above-mentioned meetings, and all other materials distributed at these meetings are hereby incorporated by reference. A2. The Property is located in the LR-1B One-Family Lakeshore Residential Zoning District. A3. The Property contains 0.63 acres in area and has a defined lot width of 93 feet. A4. The Property is within Tier 1, and hardcover is limited to 25% according to the Stormwater Quality Overlay District. A5. The Applicant has applied for after-the-fact approval of the following: a. Side Yard Setback Variances b. Conditional use permit for retaining walls within the shore setback zone 63 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7670 3 A6. In considering this application for after-the-fact variances and CUP, the Council has considered the advice and recommendation of the Planning Commission and the effect of the proposed application upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. VARIANCE ANALYSIS: B1. “Variances shall only be permitted when they are in harmony with the general purposes and intent of the ordinance . . . .”The Property is subject to the dimensional and shoreland performance standards of the Orono Municipal Zoning Code, including minimum side yard setbacks and shore setback requirements applicable to retaining walls, patios, landings, and accessory structures. The Applicant has failed to demonstrate how the variances are in harmony with the code or necessary for the enjoyment of the Property. B2. “Variances shall only be permitted . . . when the variances are consistent with the comprehensive plan.” The requested variances would permit structural improvements directly up to the side property line and within required shore and yard setbacks, thereby reducing open space and separation between properties in a manner inconsistent with the goals outlined within the Comprehensive Plan. B3. “Variances may be granted when the applicant for the variance establishes that there are practical difficulties in complying with the zoning ordinance. ‘Practical difficulties,’ as used in connection with the granting of a variance, means that: a. The property owner in question proposes to use the property in a reasonable manner, however, the proposed use is not permitted by the official controls. The Applicant has not demonstrated that strict enforcement of the ordinance would preclude a reasonable use of the Property. The Property is capable of reasonable residential use in conformity with the Zoning Code. b. The plight of the landowner is due to circumstances unique to his property not created by the landowner. The Applicant constructed or caused to be constructed the patio, landing, retaining walls, and associated improvements without required permits and within required setback areas prior to seeking relief. Any difficulty in complying with the setback requirements is self-created, as the improvements were installed without first obtaining zoning approval or building permits. The property in question shares similar characteristics to surrounding properties and does not possess any unique qualities. 64 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7670 4 c. The variance, if granted, will not alter the essential character of the locality.” Granting the requested variances would undermine the purpose of setback requirements, which include protection of neighboring properties, preservation of light and air, stormwater management, and maintenance of neighborhood character. B4. “Economic considerations alone do not constitute practical difficulties.” The Applicant has not cited economic considerations in support of the request. B5. “Practical difficulties also include but are not limited to, inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06, subd. 2, when in harmony with Orono City Code Chapter 78.” This criterion is not applicable. B6. “The board or the council may not permit as a variance any use that is not permitted under Orono City Code Chapter 78 for property in the zone where the affected person's land is located.” The requested relief pertains to structural encroachments (patio, landing, retaining walls) within the required setback and shoreland areas. A variance may authorize deviation from dimensional standards but may not authorize a use otherwise prohibited in the zoning district. To the extent the improvements constitute structural encroachments rather than a change in land use, this criterion does not independently support approval. Because the Applicant has not provided sufficient documentation demonstrating full conformity with permitted use provisions, the City cannot make an affirmative finding under this criterion. B7. “The board or council may permit as a variance the temporary use of a one-family dwelling as a two-family dwelling.” The request does not involve such a request. Accordingly, this provision does not apply to the request before the Council and provides no independent basis for approval of the requested variances. B8. “The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property.” The Applicant has not demonstrated that special conditions peculiar to the Property necessitate the requested setback encroachments. No topographic survey, grading plan, or engineering documentation has been submitted to establish unique physical constraints such as extreme slopes, irregular lot configuration, or other site-specific limitations. The record instead reflects that the improvements were constructed without prior approval and located within setback areas by choice. Self-created circumstances do not constitute special conditions peculiar to the land. Therefore, this criterion is not satisfied. 65 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7670 5 B9. “The conditions do not apply generally to other land or structures in the district in which the land is located.” Setback and shoreland restrictions apply uniformly to properties within the same zoning district. The Applicant has not demonstrated that the Property is subject to constraints materially different from other similarly situated residential lots. Absent evidence of unique physical limitations, the circumstances underlying the variance request appear common to properties in the district. Granting relief in this instance would therefore risk establishing a precedent inconsistent with the uniform application of the Code. This criterion is not met. B10. “The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant.” The Property is capable of reasonable residential use in compliance with applicable setback and shoreland standards. The requested variances relate to patio placement, retaining wall location, and accessory improvements, none of which are necessary to preserve the fundamental residential use of the Property. The Applicant has not demonstrated that denial would deprive them of a substantial property right enjoyed by others in the district. Rather, the request seeks to preserve specific constructed improvements in their current nonconforming locations. This criterion is not satisfied. B11. “The granting of the proposed variance will not in any way impair health, safety, comfort, or morals, or in any other respect be contrary to the intent of this chapter.” Shoreland setback and structural setback standards are intended to protect water quality, prevent erosion, preserve drainage patterns, maintain separation between structures, and safeguard neighborhood character. The Applicant has not provided sufficient engineering data, drainage analysis, or slope stability documentation for the City to determine that the retaining walls and related improvements within the shore setback area do not adversely affect erosion control or stormwater management. Without the requested supporting materials, the Council cannot affirmatively conclude that granting the variance would not impair health, safety, or the regulatory intent of the Chapter. Accordingly, this finding cannot be made in support of approval. B12. “The granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable difficulty.” The record reflects that the improvements were installed without required approvals and that no additional materials were submitted to the Planning Commission after they requested further documentation. The Applicant has not demonstrated a practical difficulty arising from the land itself that necessitates the encroachments. Instead, the requested variances would allow retention of improvements constructed in noncompliance with the Code. Relief under these circumstances would function primarily as a convenience to the Applicant rather than as a remedy for demonstrable land-based hardship. This criterion is therefore not satisfied. 66 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7670 6 CONDITIONAL USE PERMIT ANALYSIS: Section 6.12.6240 (5)(c) states that walls in the shore setback zone shall require a conditional use permit. New walls and replacement walls greater than 4 feet in height must meet the following conditions. The wall must be: B13. Designed to correct an established erosion problem; the Applicant provided a professional opinion from a professional engineer, which stated that the retaining walls eliminated a steeply sloped eroded area that was difficult to maintain and provided additional storm runoff retention over the flatter planted areas they created. The walls were also designed to preserve mature trees. While this narrative supports a functional and aesthetic benefit, the ordinance standard is evidentiary and retrospective in nature. The term “established erosion problem” implies the presence of documented, pre- existing erosion conditions prior to construction activity. The record does not contain objective documentation demonstrating that a documented erosion condition existed prior to the Applicant’s intervention. Instead, the engineer’s statement characterizes the area as “steeply sloped” and “difficult to maintain,” which does not, in itself, establish active or ongoing erosion as contemplated by the ordinance. Accordingly, because the evidentiary record does not substantiate that the walls were constructed to correct a previously existing and demonstrable erosion problem, this criterion has not been met, and B14. Suitable given the demonstrated need; the engineer’s letter further states that the walls provide stability to the slope, the trees, and help to reduce erosion. The engineer also indicates that the construction of the walls and associated grading improves stormwater runoff and increases opportunities for infiltration. This criterion has been met, and B15. Designed by a registered engineer or landscape architect, depending on the project scope; Based on the professional engineering opinion that the slope required stabilization and that the wall system functions to control runoff and improve infiltration, the design appears proportionate and technically responsive to the site’s topographic constraints. This criterion has been met, and B16. Designed to be the minimum size necessary to control the erosion problem. The documentation demonstrates professional involvement in evaluating the wall design and construction relative to slope stability and drainage considerations. The requirement that the wall be designed by a registered engineer or landscape architect has therefore been satisfied. 67 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7670 7 CONCLUSIONS, ORDER, AND CONDITIONS: Conditional uses may be approved only upon demonstrating that the proposed use meets the standards and criteria outlined in the Orono Municipal Zoning Code, including compatibility with the surrounding area, protection of natural resources, and consistency with the City’s Comprehensive Plan and shoreland management objectives. Shore setback requirements are intended to protect water quality, prevent erosion, preserve natural topography and vegetation, and minimize adverse impacts to lakes and adjacent properties. The Applicant has not provided sufficient engineering, grading, drainage, or erosion control information to demonstrate that the retaining walls within the shore setback area meet applicable performance standards. Because the improvements were installed without prior review, the City lacks adequate documentation to determine whether the structures adversely impact drainage patterns, slope stability, or shoreline protection. The Applicant has failed to provide the information necessary to demonstrate that the requested CUP satisfies all applicable standards and conditions required for approval. Accordingly, the City Council finds that the Applicant has not met the burden of proof required to justify approval of a Conditional Use Permit. Based on the foregoing, the City Council finds that the Applicant has failed to demonstrate practical difficulties as required by Minnesota law and the Orono Municipal Zoning Code. Therefore, the Orono City Council hereby denies the Applicant’s request for after-the-fact variance approvals, which include a patio, landing, and associated improvements constructed within the required side yard setback; retaining walls constructed to the side property line, where a minimum five (5) foot setback is required. Further, the City Council hereby denies the Applicant’s request for an after-the-fact conditional use permit for retaining walls to remain, as constructed within the shore setback zone, less than 75 feet from the ordinary high-water level. VARIANCE ANALYSIS: B1. Variances shall only be permitted when they are in harmony with the general purposes and intent of the ordinance; although the proposal involves an 8-foot encroachment towards the lake, it is a minor expansion within an area once covered by a patio, prior to the redevelopment of the Property, and involves a decrease in total hardcover on the site and in the lakeyard; and B2. Variances shall only be permitted when consistent with the comprehensive plan; the proposed variance to allow for amenities to a residential use in RR-1B zoning district is consistent with the comprehensive plan; and B3. The variance, if granted, will not alter the essential character of the locality; the character of the locality will not be altered with the granting of a variance, as the Property has an existing variance for a pool and patio within the shore setback zone. B4. Economic considerations alone do not constitute practical difficulties; economic considerations do not impact the finding of practical difficulties with the Property; and B5. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06, subd. 2, when in harmony with Orono City Code Chapter 78; this condition is not applicable; and B6. The board or the council may not permit as a variance any use that is not permitted under Orono City Code Chapter 78 for property in the zone where the affected person's land is located; this condition is not applicable; and B7. The board or council may permit as a variance the temporary use of a one-family dwelling as a two-family dwelling; this condition is not applicable; and B8. The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property; the Applicant has preserved many of the site’s existing conditions and features, including the septic system and much of the driveway. These existing improvements are all partially within the building envelope of the Property, making it extremely difficult to relocate the pool and patio into a conforming location; and B9. The conditions do not apply generally to other land or structures in the district in which the land is located; the layout of the Property is unique, including the existing improvements on site such as the septic system and tennis court; and B10. The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the Applicant; a variance would allow for a reasonable shift in the pool and patio location to accommodate improvements to the existing septic system 73 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7671 4 and decreasing the hardcover in shore setback. Being able to maintain a reasonable use of the site with this new variance is necessary for the rights of the property owner; and B11. The granting of the proposed variance will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter; the home was demolished in 2023 and variances were granted for a new home and accessory improvements. The hardcover of the patio lakeward of the original house was approximately 95 feet away from the OHWL and the new proposed pool and patio are located 88 feet from the OHWL. Although the proposal involves shifting hardcover closer to the lake, there will be a decrease in the total hardcover for the site and in the shore setback zone based on the proposed reorientation and removals. Given that many of the improvements on properties on French Lake are within the shore setback zone, the variance should not impact the health, safety of welfare of residents in the area; and B12. The granting of such variance will not merely serve as a convenience to the Applicant, but is necessary to alleviate demonstrable difficulty; the granting of the requested variance is reasonable and would allow for a relocation of hardcover outside of a shallow building envelope. CONCLUSIONS, ORDER AND CONDITIONS: Based upon one or more of the above findings, the Orono City Council hereby grants variances from Orono Municipal Zoning Code Section 6.12.6240 and 6.12.9110 for a new in- ground swimming pool, patio, and hardcover, respectively, within the 150-foot lake setback, subject to the following conditions: 1. Council approval is based on the entire record, above Findings. 2. The approved project shall conform to the site plan submitted by the Applicant, attached to this Resolution as Exhibit A. 3. Any amendments to the plans which are not in conformity with City codes may require further Planning Commission and City Council review. 4. Authorities granted by this resolution run with the Property not with the owners, but are permissive only and must be exercised by obtaining a permit for the sauna building and commencing construction of said project.
