C. Summary
The Ulrich property (Lot 2. Lydiards Park) drains in two directions, one to the
west directly to Lake Minnetonka, one to the south to an existing pond. The
increase in runoff to the pond from added rooftop and blacktop would result in
the pond rising a small amount (0.4 feet) in a 100 year storm. The runoff
directly to the lake to the west increases 52 from 12.4 CFS to 13.0 CFS due to
additional rooftop and blacktop in that drainage area.

The applicant is constructinq a ro,idence on this parcel of
approximately 3.5 dry acres. He has also acquired the Biohorn
residence to the south and is anticipating a lot line rearrangement
between the two properties which will increase applicants lot to
nearly 5 acres and leave the former Blohorn property with about 2
acres. (That is the subject of a future application.)
Mr. Ulrich was qranted a building permit to construct a new home
at 1539 Bohn's Point Road. Grading plans had been submitted for that
property and sere considered as normal and customar•; for the residence
in question. Note that applicant had been per teal to fill portions
of the property in the years prior to construe. jn it anticipation of
the project.
on October 21, 1985, staff became aware that gradinq was occurinq
in the 0-75' lakeshore setback area. Staff subsequently visited the
site, noted the work that had been done, and discussed with the owner
the immediate protection measures necessary and the application pro-
cess for an after -the -fact conditional use permit. Applicant was told
►-y staff that he should finish -grade the area and seed it as soon as
possible. This was completed as of 11/8/85 and at that time staff
requested further shoreline protection measures including additions:
hay hales and silt fence, which has also now been installed.
Staff review of the site and grading plan indicates that the
major changes in contour occurred outside the 0-75' area. There would
appear to be some minor fillinq and smoothinq of the :anti surroundinq
the lagoon; however, this leaves a fairly flat slope and slowed run-
off within 50' of the lagoon and the lakeshore, conRis.ent with what
previously existed but a more uniform appearance.

The engineer, in his review, has requested that the applicant
indicate the location of the outlet of the pond near Bohn's Point Road
on the Blohorn property since this pond receives the drainage from
about half of the Ulrich acreage. Applicant should also be advised
that the Cit7 will require a drainage easement to be qranted over the
drainaqeways and the pond area.
There has also arisen the question of the final gradinq of the
berms located on either side of the driveway entrance. These are
indicated in the grading plan as "temporary storage" with final qrade
undetermined, depending on the need for fill at oti.er locations on the
site. Applicant has been requested to move these berms off the right-
of-way and is in the process of complying as of this writing. Because
these berms are so visually evident along the road, their final
grading and appearance is an item for discussion.
Staff would suggest that these berms be the subject of a separate
conditional use permit application in order to help cover the costs of
staff time, especially the engineer's reviews. Applicant should also
be made aware that in the event the conditional use permit and
variances are aranted for the work at the lakeshore, that there is an
actual lakeshore grading permit fee required in the amount of $400
($2U0 fee, $200 after -the -fact investigation fee) in addition to the
$400 conditional use permit application fee already paid. Note that
the above application and permit fees are required because the current
work does exceed the "normal and customary grading in the area of a
newly constructed bui ldinq" per Section 10.03, Subdivision 21.
Any motion for recommendinq approval should address these items:
1. maintain adequate shoreline protection until lakeshore area
is fully vegetate(]
2. notify applicant that no hardcover or structure is allowed in
the 0-75' setback area
3. notify applicant. that the araIinq outside the 0-75' is also
subject to conditional use permit review, and that the City
engineer has requested additional information on the pond outlet
and discharge, that drainage easements will be necessary, and
that. the roadside berg: configuration is subject to review.

absent a survey of property containing the existing house and
septic site information necessary for assurance of an

Mr. & Mrs. Ward Ferrell were present for this matter. Mr.

auxilliary system being the lot is 3/4 acre, therefore not

Chairman Callahan advised applicant that they would give him
their general opinions regarding his request although

Goetten stated she was personnally opposed to three lots.
Kelley, referring to his statement in the Planning
Commission minutes dated 4/15/85, felt that Lots 7 6 8 should
be combined into one lot to allow the existing home and one
other lot.
Taylor and ;":.Donald agr^ed with Kelley's opinion.
Rovegno and Callahan felt that two lots with dwellings would
probably be reasonable with the rope septic site testing,
three lots would be setting p•ecedent.

background construction to date and further propos ,d grading
plans. He noted that t1 ity Engineer has re% ewed the
current revision of a se .f plans within the 0- ' , which
has been minimal, and is no problem with it and has
determined that applicant has done an adequate job of
protecting the lakeshore.
William Ulrich was present for this matter, as was his
project representative, John L. Noble.
John Noble stated that they are stock piling soil until the
amount of backfill needed is determined.
There was some discrapency between applicant and staff
regarding attainment of required permits for the work
already done.
Virginia Sweatt, 3225 Bohn's Point Lane, was present stating
that the construction was destroying the character of the
neighborhood and was conceri,ed by the size and height of the
home being built.
Lisa Dayton, 1655 Bohn's Point Road, stated that the Planning
Commission should really analyze the situation and she felt
that a commercial venture is being 6)ne in a residential
area.
Kathy Sweatt, 3225 Bohn's Point Lane, stated chat there is a
problem with dump trucks excessively speeding. She also
noted the removal of several mature trees from the site.
Margene Fox, 1645 Bohn's Point Ruad, stated that the road is a
mess and breaking up badly due to this construction and
suggested that applicant be responsible for repairing and
maintaining the road on a weekly basis. She also noted that
this construction has created unsafe conditions for chi ldren
on the road.
Ginny Wagener, 1420 Bohn's Point Road, stated that for th
past two years they have endured dirt and dust mess from th
project along with the seemingly constant seven day per we
constructic n.
There were no other comments from the public at this time.

This is to advise yo- +-h;L the Planning Commission called for a stop
work order for all building and grading activities at the Ulrich site.
They demanded immediGte action because of the filling and grading viola-
tions within the 0-75' etback area and major filling and grading performed
by the applicant out ui the scope of the original building permit and the
original grading plans.
The Bohn's Point neighbors reported that filling has bo�en going on for
the past year and that now they were excavating the wetland. on the Blohorn
property.
Staff had worked with Ulrich after a straight line wind storm had
knocked down over 10i mature trees on the site and allowed him to do
grading and filling where trees were removed and repairs to a drainage
system that had been damaged. Ulrich has admitted that he did bring in
approximately 4000 cubic yards of fill later that year to prepare the
building site. This all appears mute in consideration of the building site
now. The huge stock piles of earth cover everything. The neighbors claim
the house has been raised above existing grade.
The filling within the 0-75' setback area does not involve major
changes in elevation but does involve filling of about 3 to 6 inches top
soil for planting of grass. Staff has requested silt f-_nc_ng along the
entire disturbed area adjacent to the lagoon. It is my understar _ng from
staff that this wall was done sometime around the tnird week of October.
The applicant was advised to file an after -the -fact conditional use permit.
The additional filling and grading completed within the original
Blohorn property and the Ulrich property is not covered by this land use
application and staff will ask that a separate after -the -fact application
be filed. From reports of the neighbors and building contractor's staff on
site, this work was completed on November 9th & 10th, a week refore the
November 18th Planning Commission meeting. This involves major f i i 1 i nq and
grade changes never reviewed with staff.
Staff has been advised by the Public Works Department that the re-
ported excavati-)n of the �tlands involved the sewer connection and a
clean out pipe installed at the edge of the wetlands. The elevation of the
baserient floor is at 933, the flood plain elevation of 931.5 requires that
the :loor be at a minimum elevation of 932.5; most City codes would ask for
a 933.) elevation. Tle first floor or ceiling of the basement is 12 feet
high. The west portioi or one third of the foundation will require 2 feet
cuts into the uppe_ slopes. There is nothing in our code that limits the
height of a basement. The height of a structure is determined per :iiagram
enclosed for your re iew. The house does not exceed 30 feet from proposed
finished grade.

After the Planning Commission meeting, staff called for a meeting with
the architect, project manager and builder. They advised that Ulrich hired
an outside contractor to tome in and perform the job and that they, the
architect, project manager or builder had no knowledge of his intention to
move this fast.
Staff has advised both those in attendance at this meeting and the
supervisor at the site that all grading and filling will cease until the
City reviews and acts on the final grading and landscape plan for the site.
Staff has allowed the following activities:
1. Complete filling of sewer trench from Bohn's Point Road.
2. Complete back filling around house to save frost
footings/foundation - this involves filling of crushed rock and top
soil from stock pile from foundation excavation. Unfortunately, the
crushed rock will be transported by approximately 70 dump trucks.
3. Removal of stockpiled dirt from City right-of-way.
Once again, staff can find no problem with the proposed structure. We
are dealing with a house of some 33,000 s.f. The foundation excavation and
stock piling of earth is not unusual for a house of this size. The
original grading and drainage plans showed nothing unusal with a house of
this size. Staff recommends that we do not stop work on the house but stop
a l l grading and filling as outlined above.
Please advise me if you want staff to issue citations or limit other
activities on the site.

SUBJECT: Ulrich Property, 1535 Bohn's Point Road
Jeanne Mabusth and Tom Jacobs met with the project manager and
contractor for the s ibject property on Wednesday, November 27th.
At that meeting they discussed their intended landscape plans and
conditional use permit. In ad(:ition to outlining the permit fees
and work that needs to be done prior to the next consideration by
the Planning Commission on this matter, it was indicated to these
individuals that should any furtt.er landscaping work be done
which has not been expressll approved by the staff in advance of
the work being done will result in a citation to the parties
involved.
HEIGHT OF BUILDING - Having reviewed the applicable ordinances
together with the site i_ is our opinion that the height of the
building as constructed is legal and under our codes had the
house had a different design that conformed to the original
contours they could have resulted in a structure that was 4 to 6
feet higher than the one being constructed. The facts of the
situation as it relates to this house are as follows:
- Basement - Constructed at 933. total 12 foot height.
- Gradc_ and-Original_Building_Envelope - Presently
investigating the amount of fill that was possibly done
on the site prior to issuance of the original foundation
permits back in „uly of 1985. Based on the estimates
this filling would have possibly raised the site a
maximum of 2 feet. Although not possessing original
contours for the site we are aware that the site
originally had a ridge that ran through part of it, and
in fact, the original topography in one area where th(,
house is going in was at least 6 fect above what will be
the finished grade for the house. On t:he other hand
there was extensive moving of soils from one area to
fill-in in the other area to flatten out the site.
Within the purview of the code this is considered normal
and usual gradir,g of the site undr r the excf.ption
allowed in section 10.93 subdivision -41. This site
modification is within the bounds of site molifications
done in several other ireas including:

zoning code is 5 feet out from the foundation of the
highest point to the highest gable on a hip roof on the
front yard side of a structure. Under our definitions
lakeshore lots do not have a front yard and in this case
since the front yard is normally the street side in non-
lakeshore lots we would use the street side in this
case. Froin the finish grade to the top peak of the
structure at the highest gable, however, the height in'
total will be 8 feet. As a side note the height of
this building is in concert with the heights found in
other developments including the developm-nt at the Pink
Palace, the de.,elopmelt sout'i of 15 on 19, and the
Stielow Additio-. (Oxford Road).
NEIGHBOR'S VIEW - While the Swcatts, :is non-lakeshore
owners, will 'lose a portion of their view by this
construction they will gain a portion upon removal of
the existing structure on the site. The new structure
does sit hack substantially from the average setback and
does not impact the la -re view of abutting lakeshore
owners.
The problem with our current orainances ?s t:lat they addressed
ground height as being that from finished grade, not original
grade, together with having the maximum height measured as the
mean distance rather than total distance to the top. Staff has
been reviewing other way:, of handling extensive site alteration
in conjunction with buildings Lo,eth -,r wit'a ways of dealing with
maximum height, however, they would not. be applicable in this
case and if drawn too tightly would require everyone who builds
in Orono to come :n for a conditional use permit if it
significantly limits site grading.

Mr. Jessen explained the background of the Park
District's structure noting that Minneapolis is no
longer a part of the Park District. He reported the
significant changes within the past year.
Mr. Jessen presented a proposed site plan for Noerenberg
Park.
At this point, a short slide and sound presentation was
made regarding the makeup and budget of the Park Reserve.

City Administrator Bernhardson reviewed staff's memo
regarding the height of building. He noted that based
on Orono's current code, the building is in conformance
based on the "mean" height.

issue of grading and filling, a landscape plan will be
submitted along with an application for an after -the -
fact conditional use permit to the Planning Commission
at their January meeting.
Councilmember Adams stated that tie felt a maximum height
should be addressed in the ordinance rather than a
"mean" height.
Zoning Administrator Mabusth stated that slip felt being
more restrictive in height might tend to dictate the
size and design of homes.
M.L. and Virginia Sweatt, 3225 Bohn's Point Lane, were
present for this matter. Mrs. Sweatt stated that she
felt the height and massiveness of the structure does
not conform with the spirit of Bohn's Point. She
believes the City should have maximum size restrictions.
Councilmember 11ammerel stated he felt projects this size
should be presented before the Council for review before
issuance of a building permit even though they conform
with existing code.

Dear Jeanne:
I am writing this letter in response to your request for additional informa-
tion regarding the construction of a geothermal heating and cooling system,
the completion of construction of the seawall around the existing lagoon and
the drainage relief system which was previously installed on the property.
Regarding the geothermal proposal, I have included a brochure that explains
the general principles of the system. Basically, a geothermal system pumps
water from a well, circulates it through a heat exchanger and discharges the
water into the lake. Our system is in the design stages and will not he
completed for approximately 60 days. We are aware that a conditional use
permit will be necessary for installation of underground pipes. At this
poLit, it is premature to make an application to the City for work that may
be necessitated within 75 feet of the lakeshore.
Your second request was for more information regarding the seawall. You may
recall that at an earlier Planning Commission meeting Mr. Ulrich and I
presented pictures showing the existing lagoon and seawall. I believe we
indicated that Mr. Ulrich had a desire to extend the existing seawall around
the balance of t.ie lagoon. At present, because of other priorities, we have
not obtained the necessary engineering drawings nor had the opportunity to
obtain installation bids. Those two steps are necessary before we can
finalize plans for thii particular project. Again, we understand that a
conditional use permit from the City will be necessary. As you are aware,
we will also .ie,' ippro,als from the Department of Natural Resources. Quite
frankly, this has een a priority project because of the immediacy and
Fignificance of the requests currently pending before the City.
With regard to the drainie `ief system, you may recall that we had a
meeting with various City Sty., including yourself, Bruce Schmitt and me.
During that meeting the Citv Sta. iuthorited backfilling, removal of stock-
piles from the right-of-way and th,- •ompletion of the drainage relief system.
That system consists of a twn foot d. n sewer rock with filter fabric buried
entirely below grade. The System was .3spected and approved by Tom Jacobs.
The function of the system is to relie•e hydrostatic pressure by diverting
water away from the foundation walls of the project.
We would like the 'Tanning Commission members and City Council members to
understand the full scope of this construction project. As a result, we have
shared this additional information with you so that you may include it with
your staff reports. However, we do feel it is premature for us to submit
conditional use permits for the geothermal system +rd for the construction of

of the seawall. Both these aspects of the project involve approvals by the
Department of Natural Resources as well as the City. Additionally, there is
certain engineering work that needs to be completed. These two aspects of
the project are not of the same significance as the necessity of obtaining
the lot split and dealing with the issue of fill previously placed on the
property.
In any event, I hope this provides sufficient information for you and the
Planning Commission and City Councilmembers so that there is a full and
complete understanding of the scope of this project. As you well know, it
is vital to our interest that the lot split issue be resolved immediately
in order that we can deal with our financing options.

We have aviewed the current ite grading plan Co determine what elevations
hive been cie. ,ed frou the original grading plan. We have also reviewed the
basement elevation relative to the original contours. The original site grad-
ing plan indicated a uasemen. floor elevation of 933.4. The attached site
plan (Figure I) indicates various depths between original ground and the base-
ment floor. Area I required an excavation of 4 to 7 feet. Area 11 required
an excavation of 7 to 10 feet and Area III required an excavation of 10 to 17
feet. 'the developer has proposed to outlet the footing drain to the lagoon
area. We would not see this as a problem if properly constructed.
The current site grading plan directs storm water runoff from the east 1/3 of
the lot south and east to the take. This plan directs the runoff through a
pond which should improve the water quality prior to entering the lake. The
original site grading plan iirected all storm water runoff west to the boat

agoon on the property and then into Crystal Bay. We feel the revised site
plan is an improvement to the overall drainage plan for the area.
The current site grading plan proposes changes from the original site plan in
three primary areas as shown on Figure it. Area I would be south of the home
and has become an option because of the lot line rearrangement. Area II con-
sists of a proposed berm south of the driveway near Bohns Point Road. Area
Ill consists of a berm north of the drivewav near Bohns Point Road.
the changes proposed to Area I are beneficial as a level area on the lot would
be provided to improve groundwater percolation, fill above original ground in
this area would range from 0 to 8 feet. Area II would consist of a berm and
plantings to screen the property from the road. We recommend that no filling
be allowed on City right-of-way and that no slope exceed 3:1 unless retained.

3.5 feet in height. Slopes above the wail should not exceed 4:1. Fill above
original ground in this area would range from 0 to 10 feet. Area III would

Assistant Zoning Administrator Gaffron explained the
preliminary subdivision request to divide a 4.27 acre
lot into 2 lots of 2.14 and 2.13 acres noting both lots
meet. the 2-acre requirement. He noted that the
Woodhaven plat was created in 1977 prior to the
requirement of septic system soil testing for all newly
created lots. The soil testing done since that time has
been found suitable soils on the proposed lots. Primary
and alternate drainfield sites have been tested and are
suitable for mound systems.
There were no comments from the public on this matter
and the Public Hearing was closed.
It was moved by Taylor, seconded by Chairman Kelley, to
recommend approval of the preliminary subdivision

William J. Ulrich was present for this matter along with
his representatives: Attorney Thomas Humphrey Jr.,
Engine:?r Don Brauer, Project Coordinator John Noble, and
Surveyor Mark Gronberg.
Zonina Administrator Mabusth explained the four areas
involved:
l) Alteration of lagoon area located within 75 feet
of the lakeshore. This was not noted on the
original building permit plans and requires a
separate permit.
2) Construction of an underground 2 feet deep trenct
from foundation of structure to th

4) Major filli►-,g between Ulrich and former Blohorr
properties.
Chairman Kel ley questioned how many loads of fill was
brought in.
Mr. Ulrich stated there was approximately 400 truck
loads (4000 yards) of fill brought in and none removed
from the site.

Planning Commission requested applicant to provide
construction logs to confirm elevations and amounts of
fill brought in.
City Engineer Cook explained the changes in elevations
and his recommendations:
-berms should be graded flatter
-found no major problem with the drainage in the 75'
setback area to lagoon
-foundation drain is not unusual - water quality
would be no prof lem but to be effective drain must
outlet at lower level elevations in lagoon area
-as for the fill placed between properties, the
final plans provide more treatment area for the
surface runoff than that which was approved for the
Ulrich site with the building plans and that which
existed on the Blohorn site.
Applicant's Attorney, Thomas Humphrey, stated that they
were oppposed to removal of the berms. He stated that
they are legally permitted and felt that applicant was
bein- penalized for the after -the -fact application,
noting that after they were notified of the problems,
they hove done everything the city has asked in order to
comply.

Mr. i Mrs-. Kalweit, 1540 Bohn's Point Road - stated they
had concerns regarding the drain under the Blohorn
driveway.
Dave Fox, 1645 Rohn's Point Rd., stated that he thought
the neighbors, Prowbridge 6 Swandstrom, would also be
concerned with the drainage.
Chairman Kelley instructed staff to notify the affected
neighbors regarding the proposed plan.
There were no more comments from the Public and the
public hearing was closed.
It was moved by Chairman Kelley, seconded by Taylor, to
recommend approval of the joint after -the -fact
conditional use permits subject to the following
conditions:
Area 1 - approved the filling of top soil or

The applicant does plan to continue a sea wall along the lagoon area and
install a geothermal heating and cooling system but final plans and
supportive data for such are not complete for this review. Applicant
understands that separate conditional use permit reviews will be required
for each proposal.

The area had been filled with 3 to 6 inches of top soil in preparation for
sodding or seeding. Erosion control was provided as needed. No major
grade changes. Obvious attempt to "smooth out" shoreline. This type of
filling is typical when developing lakeshore properties where ground cover
is to be instal led. Staff has never required conditional use permit
reviews for this type of land alteration when a bui lding permit has been
issued on a property. In review of the plans submitted with the building
hermit, this specific land alteration within the lagoon was not noted and
Vines require separate review.

Planning Coirunission Recommendation - To deny the quest to install 6 feet
high berms along the street/lot line and to complete the restoration of the
road right-of-way and the entire area restored to its original state.
Area (4) Major filling between Ulrich and former Blohorn properties -

Clearly the filling within the Ulrich property 30 feet north of the
original dividing line was not approved with the building permit. The
original showed the lower elevations of 938 - 940 (remains of the old bowl
area) that funneled drainage down to the lake.
The plans approved with the building permit and current proposal show a
decrease in drainage towards the lake and a shift in approximately 1.24
acres of drainage area to the ponding area to the south (see Exhibit J).
Per Exhibit L, the applicant's engineer in his summary (page 3) notes the
increase in runoff to the pond would raise the pond level 0.4 feet in a 100
year storm and finds no appreciable effects on retention pond.
The M.C.W.D. does not require permit review for the proposed shift in
drainage. The applicant's consultant claims little effect on the pond and
local watershed.
Cook states (Exhibit M) the final grading plan is superior because the east
1/3 of the property drains to the pone. before entering the main lake.
The plans appr-ved with the building permit provide for grassed slopes
ranging from 94b to 938' elevations within 51 feet along the southern yard
area (15% grade) Exhibit 0. Drainage from both the former 9lohorn and
Ulrich properties would drain down to the 938 elevation and out directly to
the lake. The original banks along the north side of the Blohorn property
would be much steeper than those proposed on the Ulrich side of ;ghat would
h-,ve become a ra�yine area.

The original bowl area (majority of area now occupied by principal
structure) we determined to have been at approximately the 938 elevation.
The finished grade around the house is at the 946 elevation. The original
ground elevation of the previous residence is at the 946 elevation but the
garage elevation was at approximately 944 elevation.
The foundation required excavations of 5 feet 3t the southern end ranging
to 15 feet cuts to the north side. The majority of the fill and mounds of
earth found on the site remain from the removal of all native soil from the
foundation excavation in order to make room for the sand base under the
foundation block and footings. The basement floor elevation is at 933.3 -
code would require a 932.5 elevation (1 foot above the flood plain eleva-
tion of Lake Minnetonka).

the 4 areas to be dealt with in this matter:

Area 4 - Fill between 1535 6 1595 R.:A n's Point Rd.
Zoning Administrator Mabusth s- 12d that the Planning
Commission recommended approv.; the final grading
plans except for the berming, i thy recommended
removal of the berms and restorz on to the natural anti
original state. She noted that the water quality from
the foundation drain was found to be excellent.
Mr. Ulrich stated that the purpose of the berm was for
privacy due to the scale of the house. He stated that
the neighbors were agreeable to a 6' berm.
Councilmember Frahm stated that a 6' fence is not
allowed therefore a 6' berm should not be allowed. He
recommended a 3-1/2' berm in relation to the allowed 3-
1/2' fence. It was noted that the ordinance does not
address berms, however, Frahm stated that he felt the
intent of the fence ordinance would include berms.
Mayor Butler stated that evergreen plantings would
serve the same purpose and blend in with the character
of the neighborhood.
Councilmember Frahm stated that he had concerns
regarding the installation of the foundation drain to
the lake and that the City should define the standards
before approved.
Mayor Butler suggested requiring a letter of credit and
developer's aqreement for the landscape plan in order to
assure the completion of this project.
Councilmember Grabek stated that it should be noted that
no fence could be erected on top of the 3-1/2' berm.
Attorney Tom Humphrey stated that they have no problem
with submitting the letter of credit and defering action
on drain ditch until standards are established, however
they were opposed to limiting the berms to 3-1/2' feet
as the ordinance is silent regarding height of bermr and
that there is no iactuaI basis to impose a limitation on
the height of the berm.

Mayor Butler stated that the Council has the right to
place a limitation on the height of the berm because
they need a conditional use permit to have the berms.

include berms then it should be stated as such, which
the code currently does not.
It was moved by Councilmember Frahm, seconded by

from the DNR and MCWD regarding standards and specifications for

of 5/23/86, the DNR has confirmed that Ulrich's geothermal
drainage system will require DNR review but that as long as the
outlet for the foundrt-ion drain is above the 929.4 elevation, DNR
review is not required. The WCWD wants to review their standards
and get back to us but: preliminary review suggests a permit will

The City Engineer will meet with staff on I.ednesday, May 28,
1986 in order to discuss appropriate specifications and standards

WHEREAS, William J. Ulrich (hereinafter "the applicant") is
the owner of the properties located at 1535 any 1595 Bohn's Point Road
within the City of Orono (hereinafter "City") and legally described as
Lots 1 6 2, Lydiard's Park, Lake Minnetonka, (hereinafter "property');
and
WHEREAS, the applicant has applied to the City of Orono per
Municipal Zoning Code Section 10.03, Subdivision 19 for after -the. -fact
and proposed conditional use permits to allow the completion of
certain land alterations on the property not authorized under Building
Permit No.. 5737 c.r a conditional use permit and per Municipal Zoning
Code Sections 10.21, Subdivision 2 and Section 10.55, Subivision 8
seeks variances to permit after -the -fact and proposed land altertions
within 75 feet of the shoreline of Lake Minnetonka.

NOW, THEREFORE, BE IT RF.SOLV F.n by the City Council of Orono,
FINDINGS
1. This application was reviewed as 'Zoning Files i991 and t1018.
2. The properties are located in the LR-lB, Lakeshore
Residential Zoning District.
3. The properties ccnsist of approximately 7.64 total acres in
area.
4. The land alterations, approved with the grading plans on
August 26, 1985 with the issuance of the building permit for a
rew residence on Lot 2, Lydiard's Park, Lake Minnetonka, did not
include the land alterations reviewed under the current
applications.
5. The City has completed a comprehensive review of both after -
the -fact Applicaticns 991 and 1018 defining each of the majcr
land alterations as specific: areas for consideration as follows:
Area 1- Alteration of "lagoon area' located within 75 feet
of lakeshore. The area has been regraded with 3 to 6 inches
of top soil in preparation for seeding.

Area 2 - Two trenchts 2 feet wide have been constructed from
the foundation at approximately the 933 elevation and extend
to within 75 feet of the lake. The trenchs consist of PVr
pipe surrounded with crushed rock with a silt fabric barrier
over gravel. Applicant wishes to discharge underground
drainage into the lake.
Area 3 - Applicant proposes 6 feet high berms along the
street lot line of the property.
Area 4 - Applicant has placed from 4' to 8' of fill within a
100' by 36V corridor located along the shared lot line of
Lots 1 6 2 Lydiard's Park.
6. The Orono Planning Commission reviewed this application on
April 21, 1986, and recommended approval of the after -the -fact
variances for land alterations performed within 75 feet of the
lake and for the proposed installAtirin of a ground water drain -
field placed 10 feat from the shoreline per Municpal 7oning Code
Section 10.21, Subdivision 2 and Section 10.55, Subdivision 8 and
recommended approval of certain after -the -fact and proposed
conditional use permits to permit the fill to rer:ia i n along the
shoreline (Area 1) and along the ahaied lot line (Area 4) and to
install a foundation ground water drainf.ield (Area 2) and denied
applicant's request to berm along the street lot line of I.ot 2
Lydiard's Park (Area 3) based on the following findings:
A) The 6 f eet high berms are not compatible ,., .
surrounding neighborhood. The rroperty is located off a
limited use road that serves an old established lakeshore
neighborhood on a small peninsula.
A) The six feet. berms would destroy the natural open yard
appearance and ambiance )f this neighborhood.
C) The use or 1 ocat i r.g of solid, privacy wa 1. 1 s or fences or.
lakeshore lots is limited because the intent and standards
of Orono's code is to preserve the view of the lake for all
lakeshore property owners.
D) The applicant has failed to demonstrate the need for
screening from noise or lights and has only stated that •he
herms would provide privacy.
7. They Orono Counci 1 at thei r meet ing of May 12, 1986
conceptually adopted the Planning commission recowmendation and
in addition advised the applicant that 3 1/2 foot beans would be
permitted along the street lot line (Area 3) finding such
improvement compatible with the intent and purpose of the
Municipal zoning code Chapter as set forth in Section 10.01.

8. At that same neeting the Orono City Council directed staff to
prepare a resolution of approval for Applications 991 and. 1018
and to include the following findings in that resolution:
A) The alt-rations proposed in t..he lagoon area (Area 1)
involved ro major changes in elevations or in local
drainage. Tnis type of filling is typical where new ground
cover is to be installed. Applicant maintained adequate
erosion control thoughout entire restoration.
B) The alterations proposed within 75 feet of the lake to
permit the installation of the foundation ground water
drainfield as proposed in plan by Mark S. Gronberg referred
to as Drain Ti le De,ails (Area 2) and as am`-ided by Glenn.
Cooksreport dated J ine 2, 1986 is found to t,e superior to
drainage al lowed to surface on ground] to col lect sediment,
fertilizers ind other debris.
C) The berminq rlorq Bohn's Point Road right-of-way (Area
3) as approved by Council will be consistent with the height
of a 11 a l l owed man-made i mprovement s a l ong t he st reet 1 of
line of lakeshore lcts adjac-ent to minor thoroughfares and
such improvement wo,ild he consistent with the intent and
guidelines for all de-velopmcnt within larvshore rpsilpntial
Ali stricts.
D) The filling within tte corridor along the shared lot
line of the property (Area 4) providers more uniform or
flatter grades providing a more suitable treatment area for
surface drainage rather than the more extreme elevations
approved at the time the building permit was approved. The
east 1/3 of the property now drains to a pon-i before
enterinq the main. lake.
9. The City Counci l finds that the conditions existing on this
property are peculiar to it rind do not apply generally to other
property in this zoning district; that granting the variances
would not adversely affect trAlfic condition%, light, air not
pose a fire hazard or of `ier danger to neighboring properties;
would not merely serve as a convenience to the applicant, but is
necessary to alleviate a dt-monst.able hardship or difficulty; is
necessary to preserve a substantial property right of the
.applicant; and woull be in keepinq with the spirit r:d intent of
the Zoning Code and ccmprehens i ve I' 1 an of the City.

10. The City Council finds that granting a conditional use
permit to allow the land alterations as noted above will not be
detrimental to the health, safety or general welfare of the
public, would not adversely affect light, air nor pose a fire
hazard or other danger to neighboring properties, nor will it
depreciate surrounding property values and that the amended level
of use of the property will be in keeping with the intent and
objectives of the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City
Council hereby grants variances to Municipal Zoning Code Section
10.21, Subdivision 2 and Section 10.55, Subdivision 0 and grants
conditional use permits per Section 10.03, Subdivision 19 to permit
the land alterations as amended and noted above the property
subject to the following co,iditions:
1. A fence or wall can not be installed within herm area along
street lot line.
2. The public right-of-way of Bohn's Point Road :rust be
completely restored by July 1, 1986.
3. The former residence on I cat. 2, I,ydiard's Park rust be
completely removed ty September 1, 1986.
4. Drain Tile Plan by Mark Gronberq is approved by the City
subject to the outlet elevatir,n being raised to 930.5 elevation;
and drainfield cannot be closer than 10 feet from lakeshore.
5. Applicant to execute a Developer's Agreement and submit an
acceptable form of security prior to the issuance of a land
alteration permit by the City to assure the completion of the
following improvements:
A) Removal of all excess soils not to be used in final
grading of property - applicant to determine approximate
amount of cubic yards to be removed.

City Administrator Bernhardson reviewed th4 conditional
use permits and variances and the drafted resolution
addressing the following items: berms are limited to 3-
1/2' with no fences on them, staff has devised standards
for the drainfield a7-3 the -)lan will be approved in
accordance with those standards, alteration of the
lagoon, fill between the the two properties, and letter
of credit and developers agreement has been secured.
Staff recommends adoption of the resolution. He noted
that Planning Commission wi i 1 review the requests for
a geothermal system and extension of seawall in lagoon
at their June 16th meeting.
Present repregentina applicant were: Attorney Gregory
Fa1bert, Surveyor Mark Gronberq, and Engineer Don
Brauer. Mr. Halbert stated that they have reviewed the
proposed resolution ana request amendment of Condition
03 being that the former residence on Lot 2 must be
removed by July 1, 1986. He stated that they are
currently using the house for storing materials, housing
and sanitation facilities for the laborers, therefore
requesting that they allow the house to remain until
Sept_cmber 1, 1986 subject to- kecpinq the property neat
and orderly.
Staff stated that. they had ne problem with that request.
City Administrator Bernhardsc.^ noted that they have not
received my more complaints regarding the construction
hours.

Gentlemen:
We hereby authorize you to draw on the Wayzata Bank b Trust
Co., 900 E. Wayzata Boulevard, Wayzata, MN 55391 for the
account of William J. Ulrich up to the aggregate amount of
Twenty -One Thousand Dollars ($21,000.00) available by your
draft at sight. All drafts must be marked "Drawn under
Letter of Credit No. 517".
This draft must be presented to the Wayzata Bank 8 Trust
Co., no later than 3:00 P.M. on December 31, 1987, after
which time this Letter of Credit will expire. When the
draft is presented, it must be accompanied by this Letter of
Credit.
The draft must bear upon its face the clause, "Drawn under
Letter of Credit No. 517 dated June 9, 1996, of the Wcjzata
Bank b Trust Company of Wayzata, Minnesota".
This Letter of Credit is given to secure performance by
William J. Ulrich in regard to the Sibdivider's Agreement
for the Ulricn residence.
We hereby agree with the drawer;, endorsers and bona`ide
holders of drafts drawn under and in campliance with the
terms of this Letter of credit that such drafts will be
duly honored on due presentation to the drawee.

WHEREAS, the Developer has made application to the City
Council for approval of

AND, WHEREAS, the City Council has granted approval for
such development on the condition that the Developer enter into this
agreement to provide for the installation of improvements hereinafter
described on the terms and c(-)nditic.ns hereinafter set forth.

NOW, THEREFORE, in consideration of the premises and of
the mutual promises and conditions hereinafter contained, it is
hereby agreed as follows:
1. Property Description: Lot 2 Lydiards Park

2. Improvements: In accordance with the policies and
ordinances of the City, the following described public or private
improvements (hereinafter collectively called the "Improvements")
shall be constructed and installed on the terms and conditions
hereinafter contained:
1. Removal of all excess soils not to be used in final grading - iivtermine
what has to be removed from site.
2. Preparation of entire disturbed area for planting.
3. Estimate cost of seed or sod for entire disturbed area.
3. Construction Plans: The following described detailed
plans and specifications for the complete installation of the
Improvements shall be submitted by the developer for the approval of
the City prior to the start of construction. The Plans and specifications
shall conform to a..►' current City standards for all applicable work.

4. Construction of Improvements:
A. Commencement Date - The construction of
Improvements shall begin no later than
(Under construction)
B. Completion Date - All Improvements shall be
completed no later than
C. Contractors - The Developer shall select,
retain and supervise the Contractor(s) responsible
for Improvement construction. The City reserves
the right to require satisfactory proof of successful
experience and adequate financial status of any such
contractor. Where required by City ordinance, the
contractor shall first obtain a license from the City.
D. PreConstruction Conference - Prior to the start
of any construction, the Developer and the Developer's
Contractor shall meet with the responsible City official
to review construction plans and schedules.
E. Permits - Prior to the start of any construction,
the Developer's Contractor shall apply for and receive
all necessary permits from the City and/or government
agencies having jurisdiction.
F. Construction - The construction, installation and
materials shall be in accordance with the plans and
specifications approved by the City.
G. Insurance - The Developer will cause each person
who constructs and installs any Improvement to maintain
complete insurance coverage including Workmen's
Compensation, Liability and Property Damage.

5. Performance Degosit_: For the purposes of assuring
to the City that the Improvements will be completed according to
the terms of this agreement, and that the Developer will pay all
claims for work done and materials and supplies furnished, the
Developer has deposited with the City at the time of the execution
of this agreement, a surety performance bond or an irrevocable
letter of credit in a form satisfactory to the City providing that
the City is able to draw upon such bond or letter of credit in its
sole discretion to complete the Improvements if the Developer fails
to satisfactorily complete the work prior to the completion date
specified in Section 4 above. The amount of such deposit shall not
be reduced before substantial completion of. the Improvements.
A. Surety Performance Bond - If a surety performance
bond is deposited with the City, said bond shall
be written in a form satisfactory to the -'ity and
shall name the City as obligee thereunder. The
bond shall be conditioned upon performance by the
Developer of its obligations here+tnder.
B. Letter of Credit Expiration - If an irrevocable
letter of credit is deposited with the City, said
letter of credit shall expire no sooner than six
months after the completion date specified in
Section 4 above, or no sooner than. _
whichever is later.
C. Performance Deposit Amount shall be 150% of the
estimated construction cost.
Estimated Construction $ 14,000.00
X 150% - Deposit Amount $ 21,000.00
6. Fees and Expenses: The Developer agrees to pay all
City fees required per the current City Fee Schedule and further
agrees to completely reimburse the City for all the variable additional
expenses it incurs in regard to the review and approval of the
Improvements incluuing, but not limited to, direct City payroll and
overhead, costs, and fees paid to consultants and other professionals.

7. Resolutions of City: Developer agrees to be bound
by the provisions set forth in all resolutions of the City Council
approving the Development.
8. Binding Effect: The terms and provisions hereof
shall be binding upon and inure to the benefit of the heirs,
representatives, successors and assigns of the parties hereto.
References herein to Developer, if there be more than one, shall
mean each and all of them. This agreement at the option of the
City shall be placed of record so as to give notice hereof to sub-
sequent purchasers and encumbrancers of all or any part of the
property.
9. Notices: Whenever in this agreement it shall be
required or permitted that notice or demand be given or served by
either party to this agreement to or on the other party, such
notice or demand shall be delivered personally or mailed by United
States certified mail (return receipt requested) to the addresses
set forth below. Such notice or demand shall be deemed timely given
when delivered personally or when deposited in the mail in accordance
with the above.

10. Incor; ration by Reference: All plans, special pro-
visions, proposals, specificlt_ions and contracts for the Improvements
furnished and let pursuant to this agreement shall be and hereby are
made a part cf this agreement by reference as fully as if set out
herein in full.
11. Disclai-mer by City: It is understood and agreed that
the City, the City Council, and the agents ane employees of the City
shall not be personally liable or responsible in any manner to the
Developer or Developer's contractors, subcontractors, materialmen,
laborers, or any other person, firm or corporation, for any debt,
claim, demand, damages, actions or causes of action of any kind or
character, arising out of or by reason of the execution of this
agreement or the performance and completion of the Improvements.
12. Hold Harmless and Indemnification: The Developer
shall indemnify and hold harmless the City, the City Council, and
the agents and employees of the City from and against all claims,
damages, losses or expenses, inc:uding attorney fees, which the City,
City Council and agents and employees of the City may suffer or for
which it may be held liable, arising out of or resulting from the
assertion against them of any claims, debts or obligations in con-
sequence of the performance of this agreement by the Developer, its
employees, agents or subcontractors, whether or not caused in part
by a party indemnified hereunder.
13. Remedy for Default: Default by the Developer of any
of the terms of this agreement shall automatically result in the
suspension or withholding of all permits, licenses, occupancy
certificates or other authorizations issued by the City in connection
with the property included in this development.

A. The Developer hereby grants to the City, its agents
and its employees, the right to enter on the property
for the specific purpose of constructing or completing
any and all of the agreed upon Improvements should the
Developer not complete those Improvements by the date
specified in Section 4-B.
B. The remedies afforded to the City under this Section
shall be in addition to any other remedies to which the
City may be entitled by law or other agreement.
