Cheyenne Land Company - Henry f4uhich, Building & Zoning Administrator, reviewed the various staff reports that had previously been submitted to the City Council and Planninq Commission concerning this application for rezoning. iie stated that he had _inspected the property in question on four separate occasions and that on one of those occasions he was almost involved in a car accident while attempting to drive from Highway #12 onto Orono Orchard Road. Ile noted that three cars were waiting in front of him to take a left hand turn onto Orono Orchard Road and several ears were attempting to come from Orono Orchard Road onto Highway #12. This area has always been known as being hazardous in nature and such a development would increase the traffic flow measurably at this dangerous point. Mayor Searles noted that this area has alw,.ys been dangerous for pedestrians and vehicular traffic. iluhich noted that another dangerous traffic point was the overpass on Orono Orchard Road. At the overpass, only one car is able to travel and on several occasions he has met other cars there and has :-ad to pull over to allow them to pass under the b,idge. Muhich stated that he spent half the day walking through the project cn one cc anion and noted that the project is very hilly in nature and there are numerous marshlands and wetlands throughout the property. Benson #76 FROM: Ii. F. Muhich DATE: November 26, 1975 RE: Roger Swanstram - 1580 Bohns Point Road Wetlands Variance Mr. Swanstrom is requesting a variance from our Wetlands Ordinance No. 125 an,'. Ordinance No. 167, regulating filling and grading of property, for the purpose of providing a high dry area on which to store his cruiser. It might be better if the boat were not stored in an area that might crest a visual obstruction for the neighbors. The proposed fill would appear to obstruct the natural drainage and ponding the the area also. It would be more appropriate to store the cruiser in the area between the house and ',Aeshore. PL.A 4N I NG 001M M I SS I ON MEET I NG - Decembe i 1975 The Planning Commission recommended to the t:ouncil that request of Roger Swanstrom be denied becauxr there are suitable boat storage areas at the site that do not neea tilling and that 4r. Butler moved, Massengale seconded, to deny the request of Roger Swanstrom, 1580 Bohn's Point Road, because there are suitable boat storage areas at the site that do not need filling and that I1r. Swanstrom be advised that the boat could not be stored within the front setback line of the house, and also that a variance to wetlands Ordinance No. 125 can only be granted when public interest is benefited. Butler moved, Welsh seconded, to approve the variance request for Odd Rovick, 1055 Nest Ferndale Road, due to the hardship caused by the small size of the lot, because no adjoining land was available and because the property was in single separate ownership provided the following conditions are met: 1. Percolation tests meet approval of the Village Engineer. 2. The! building permit cites specific Village restrictions on building, grading and tree removal and must be 75 ft. from the lakeshore. 3. In addition to the variances requested, a 23% variance on hardcover be allowed. 4. The deck construction, as shown on the plan, within 75 ft. of the lakeshore be allowed provided it is of open type, raised construction with rock beneath and that no concrete be used. The Planning Commission continued the Public Hearing until November 18th to allow for Commission members and the pbulic to view the site.
