between Gerald M. Blohorn, 1595 Bohns Point Road, Wayzata,
Minnesota 55391, herein called Licensor, and William J. Ulrich,
1535 Bohns Point Road, Wayzata, Minnesota 55391, herein called
Licensee.
In consideration of the mutual promises herein contained,
the parties agree as follows:
The Licensee desire:: to constr::ct a retaining wall along
the shoreline of his prcperty on Lake Minnetonka. Said shoreline
is situated in a laqoon on which Licensor also owns shoreline
property. Both Licensor and Licensee desire the Licensee to
extend his wall approximately fifteen to twenty feet along the
shoreline and onto '-.he property of Licensor.

and use, subject to all of the terms- and conditions hereof, a
portion of the shoreline of the following described premises:

The premises may be occupied and used by Licensee solely

provided.
SECTION THREE
This permiLsion is given to Licensee for the benefit

In order to complete the processing of the subject permit applical-ion, we
request that a metes and bounds legal description be submitted. Any permit
for a retaining wall mutt tie title registered and therefore, this: informa-
tion is needed.
Also, as we discussed over the telephone-, the Department of Natural Resources
(DNR) regulations generally discourage the construction of retaining walls
excelt where other measures of erosion control are precluded or direct ,;hore-
land docking is needed. The DN1,1 review criteria for retaining walls are con-
tained in the DNR Public Waters Permit!. holes 6 MCAk $ 1.5023 (E) (photocopy
enclosed). Based on our review to this point on Mr. Ulrich's proposal, there
appear, to be an erosion problem and a demonstrated need for muskrat control.
A retaining wall would be one method of controlling these problems. Our re-
view is not complete as to other alt.ernativen available to Mr. Ulrich, but
it seems that the retaining wall. propo^al is net, inconsisten* with DNR rulcz.
Please forward two (2) copies of the mete and bounds legal description for
Mr. Ulrich's property. If you have any further qut-stions, please do not
hesitate to contact me.

Ulrich seeks a permit for a seawall to control the erosion
caused by muskrats of the shoreline of his portion of the
lagoon and 20' of his neighbor's lagoon shoreline. The neighbor
has signed an agreement.(Exhibit G) to permit the extension
of the seawall into his property. This is actually protection
for the neighbor, Blohorn, because when a seawall is installed
for the purpose of controlling bank rats, the rats usually
move to the noighbcrinq_ properties. The lagoon is an ideal
habitat for the muskrat. Trapping is not the answer as we
learned in :2ter Switenki's seawall application #569.
The DNR has in- �cte(' the site and confirms the muskrat problem.
Unfortunatelv. ie only effective urofection against this type
of intruder is ;he seawall. Review D.:k GM CAR SS1.5023 L.
Retaining Walls (Exhibit E). Review in addition, the DNR letter
to the applicant (Exhibit F) - "a retaining wall would be one
method of controlling these problems" - outside of trappinq,
what others are there? Remember rip rapping does not work
with muskrats because they burrow in between the rocks.

REVIEW OF SEAWALL. INSTALLATION
The seawall will be of an earthen tone aluminum installed in
sections (size of individual sections not noted). The wall
will be 20" above the ordinary hiqh water level and the total
wall 8' high. 6 1/3' of the wall will be located u:ider the
water and lake bed (See Exhibits I1 & I). Exhibit K, does
show the number of deadmen/anchoring devices to be placed
within defined areas of the shoreline. Exhibit J does show
an optional redwood walk along the edge of the retaining wall.
We must recommend against this ad-,itional improvement and recommend
instead a natural rock walkway. How is the wall to be capped
and with what material?
STAFF RECOMMENDATION
Staff recommends that Planning Commiss�un review the Council
minutes of July 28, 1980 (Exhibits I, & M) that reviews the
Switenki application. I would suggest that Planning Commission
make a similar recommendation for this auplication as follows:
To approve a conditional use permit for William Ulrich for
the installation of a seawall along the lagoon area of his
property and 20' of his neighbor's property subject to the
following conditions:
1) Seawall to be faced with natural stone rip rap -
Planninq Commission may recommend against this
finding the wall to be only 20" above high water
mark and lagoon is loclited in secluded, protected
area.
2) Any pathway or walkway along edge of seawall must
be pervious to water and made of a natural material.
3) Applicant must obtain a building permit from
the Building Inspector for seawall construction.
4) Applicant. must obtain a seawall permit from the
M.C.W.D. - A DNR permit has been applied for.

CONDITIONAL USE PERMIT William Ulrich and contractor, were present. Mr.
Ulrich presented pictures of the lagoon area. Mabusth
reviewed with the elanning Commission that the DNR
confirmed that Mr. Ulrich's property is being damaged
by muskrats.
McDonald noted that when Mr. Ulrich's property is
fixed by putting the seawall up that the muskrats would
go to the neighboring properties.
Mabusth noted that this application was similar to the
Switenki's muskrat problem in 1980.
Goetten noted that by installing the seawall that they
would be disturbing the area. She asked what type of
machines would be used.
Shawn, contractor, stated that a jackhammer would be
used. He noted the sectic.-i would be 9" wide and the
thickness would be 8" al,..,minuni. Shawn presented an
example of the seawall structure that is proposed.
Applicant's contractor stated that the wall would be
constructed 20" above the water line. He noted that
crushed rock would be installed behin.1 the wall so that
the water on the back side from the soil will f i 1 ter out
through the crushed rock and out through the little
holes in the wall. He noted that the hardcoat on the
outside and stated that the alg-ie will not stick to it.
He stated that he has this type of seawall already
installed in the City of Orono right now for muskrat
control. He stated that in Pheasant Lawn (Bergess
Family) this type of seawall is working beautifully.
Also in Walters Port (Hartman residence) has aluminum
which is hol-iing upnicely. Fie noted that the DNR does
approve these types of seawall installations and that
the DNR does not like to try to trap the muskrats. He
noted that these seawalls are installed in the bay
marshy areas not right along the shoreline of Lake
Minnetonka.

they take their home away from them.
Applicant's contractor stated that the muskrats would
preferrably pick a marshy area for their new home.

acceptable method to the DNR.

the muskrat holes and break a leg or a small child could
fall into one of thos,r and drown.
Mr. Ulrich stated that he raid fill in the holes caused
by the muskrat,.;.

Enclosed is a copy of the Department of Natural Resources' Permit
No. 83-6150 which has been issued to Mr. William Ulrich for a re-
taining wall on Lake Minnetonka.
I have reviewed the notice of the City of Orono's Notice of Planning
Commission Action on the conditional use permit for Mr. Ulrich's re-
taining wall. This letter is in response to the special condition
number two (A2) of that notice which requests a report from the DNR.
I made a field investigation of Mr. Ulrich's property on May 10, 1983.
At that time, I noted evidence of shoreline erosion problems in the
small lagoon. The erosion is, in my opinion, a combination of muskra'
activity combined with poor soil types. The DNR's issuance of Permit
83-6150 is based on the minimal impact of the proposed wall. Also,
other alterantives (such as riprap) would no4- provide greater protection
than the proposed wall.

refused the Department of Natural Resources permit Peter Switenki
requesting seawall construction Decause the
property did not abut a channel. I recommend rip
rapping.
Mr. Switenki then recontacted me and informed me
of the severity of the erosion along the lakeshore
and the pot holes that create hazardous conditions
for his young children at play, all apparently
coming from muskrat activity.
It should be noted that the entire shoreland area
of this and the neighboring properties consists
of dredge spoils and fill p'.aced over a former
wetland some years ago. Th.s apparently makes
the area especially susceptible to muskrat habitat.
There are holes in the lawns, but a personal
inspection is necessary to determine the relative
severity of the situation. 7 cannot say that it
is any worse here than in many other areas of
the City.
The Department of Natural Resources and the
Minnehaha Creek Watershed District would normally
approve of seawall construction as an acceptable
method for controlling muskrats. Rip rap would
apparently not be effective against the bank rats
because they could tunnel between the rocks.
Mr. Switenki has hired a trapper but he gave up -
the area was an ideal breeding ground and trapping
was never going to solve his problem.
The local game warden has been out to the site
and approves the seawall as a sure method of
success but could not recommend another method
more acceptable to City's policy of shoreline
protection. The City Engineer approves the
engineering plans and feels it is an expensive
method but sure to be successful. He cautions
that the neighboring properties will get the overflow
of bank rats and that before the City approves of
the project, owners of adjacent properties should
submit letters stating they approve of the proposal.
The Planning Commission questioned whether other
methods more in keeping with the City's shoreland
policies might not be available. Eventually the
Planning Commission did recommend seawall approval
in this particular casc. (Continued)

Staff wou14 suc,gest that if indeed a steel sheet
is desirable to control the muskrats (is that control
desirable?), then perhaps rip rap might be added
on the face of the wall to protect it and to
preserve a more natural appearance. The bank is
only about a foot above the water at this point
and the lake bottom is very shallow.
Council Meeting - July 28, 1980
Mr. Switenki was present to discuss his application.
Mayor Van Nest: The City requires rock or rip rap
and does not approve of a seawall or steel sheeting.
A seawall creates disruption of the lake bottom
because of the lack of a shock absorbent effect
prevalent with rip rap.
t'r. Switenki commented that a seawall is very
expensive and it would not be financially feasible
to construct a seawall faced with rip rap at this
time.
Hannah moved, Butler seconded, to approve the
conditional use permit request of Peter Switenki,
4510 North Shore Drive, to construct a seawall not
to include rip rap. Hardship is topography of the
land. Motion, Ayes (2) - Nays (3). Mayor Van Nest,
Councilmembers Hurr and Paurus Nay. Motion failed.

We have reviewed the proposed seawall on the William Ulrich property at 1535
Bohns Point Road. The proposal would not have an; adverse effect on Lake
Minnetonka with the exception of a visual impact. The wall will improve the
lake by preventing further erosion of the shoreline.
The plans presented are adequate in concept but we would recommend that the
City require the plans be signed by an engineer registered in the State of
Minnesota.

At your July 18, 1983 meeting, Planning Commission asked for
additional information on the following:
Additional Information From DNR
Mr. Stine has submitted a follow up letter dated July 21, 1983,
and then another follow up memo dated July 22, 1983, in order
to clarify his statement "other methods of controlling
these problems." Very briefly to review - Seawall is only method
known to sup^essfully combat muskrat investation - rip rap is
ineffective. His site inspection confirmed "muskrat problems
combined with poor scil types".
It should be noted for the public record that the DNR issued
a permit. to Ulrich prior to the City's action on the application;
in fact prior to the Planning Commission meeting of July 18,
1983.
Draina4e Concern
The City Engineer and I inspected the drainage area in order to
determine if the seawall would have any impact on the drainage
basin located between the Ulrich and 31ohorn properties. The
seawall will have no effect on the watershed finding adequate
grassed area within the basin to contain surface runoff.
Notices to Neighbors
Blohorn's property, given the location of the lagoon in relation
to abutting properties, is the only effected property owner.
Blohorn has consented to a 20' extension of the seawall along
the north property line of his portion of the lagoon. There
is 200'+ of shoreline that separates Louis E. Navin's s►oreline
from the lagoon area; this is the property owner to the immediate
north of the Ulrich property. Please note Louis E. Nevin received
notice of the Ulrich application.

only condition for approval is that the plans must be signed
by an engineer registered in the State of Minnesota. This

Mabusth stated that the City Engineer is in favor of
the porous pavement and that the Engineer recommended
reducing effects of excessive hardcover by making
holding pond more pervious to water, by adjusting
outlet for holding pond so that drainage leaves
property at a slower rate than the allowed rate and the
use of porous pavements for sections of parking lot.
Heglund noted that with the porous -avement for every
square foot of area the block consumes 85% of that
square foot, so the hardcover may vary.
Howard Johnson noted his concern for the drainage. He
stated that he didn't want to get flooded out any more
than he is now.
Heglund noted that the holding pond would take care of
that drainage problem.
Callahan moved to approve the conditional use permit
and hardcover variance application of Calvary
Memorial Church to permit the construction of an 91' x
104' sanctuary and the expansion of a parking lot based
on the finding that the proposal is consistent with
guidelines setforth in Resolution 188F with this

Ulrich seeks a permit for a seawall to control the erosion caused by
muskrats of the shoreline of his portion of the lagoon and 20' of his
neighbor's lagoon shoreline. The neighbor has signed an agreement
(Exhibit G) to permit the extension of the seawall into his property.
This is actually protection for the neighbor, Blohorn, for when a seawall
.Ls installed for the purpose of contolling bank rats, the rats usually
move to the neighboring properties. The lagoon is an ideal habitat for
the muskrat. Trapping is not the answer as we learned in Peter Swatenki's
seawall application #569.

The DNR h3- aspected the site and confirms the muskrat problem. The
seawall is the only method known to successfully combat muskrat infestation
riprap is ineffective. The inspection confirmed muskrat problems with poor
soils.
The seawall will be of an earthen tone aluminum installed in sections
(9" wide and 8" thickness). The wall will be 20" above the ordinary
high water level and the total wall 8' high. 6-1/3' of the wall will
be located under the water and lake bed (See Exhibits H & I). Exhibit K,
does show the number of deadmen/anchoring devices to be placed within
defined areas of the shoreiine. Exhibit J does show an optional redwood
walk along the edge of the retaining wall. Staff must recommend against
*his additional improvement and recommend instead a naL�jral rock walkway.
The City Engineer asks that the plans be signed by an engineer reaistered
in the State of Minnesota. Staff will require that at the time the
applicant applies for a building permit for the seawall that the plans
be signed by a licensed registered engineer.
The City Engineer and I inspected the drainage area .in order to determine
if the seawall would have any impact on the drainage basin located
between the Ulrich and Blohorn properties. The seawall will have no
effect on the watershed finding adequate grassed area within the basin
to contain. surface runoff.
Planning Commission recommends approval of the conditi-inal use permit
for William Ulrich. Please review their findings and conditions recuLded
in the minutes of August 15, 1983. The enclosed staff resolution has
been drafted for your review and approval.
Staff asks that you review Exhibits R, S, F, & U. The DNR appro%
the permit on July 15, 1983. The Planning Commission's first rev4e,
of the application was held on July 18, 1983 and .jgain on Auy�.,st 15,

Whereas, Willi,:m Ulrich is the owner (hereafter "owner") of
property located at 1535 Bohns Point Road and legally described as Lot
2, Lydiard's Park, Lake Minnetonka (hereafter "property"); and
Whereas, the owner has applied to the City of Orono
(hereafter "City") for a conditional use permit to construct a seawall
along the lagoon shoreline of the property and 20 feet along the west
lagoon shoreline of Lot 1 , Lyd i ard's Park, Lake Minnetonka as required
by Municipal Zoning Code Section 31.700 and a variance to Municipal
Zoning Code Section 31.831 which does not permit the construction of
permanent structures within 0' to 75' of the lakeshore.

Findings
1. This application was reviewed as Zoning File No. 760.
2. The property is located in the LR-1B Lakeshore Residential
Zoning District.
-I. The shoreline along the lagoon of tho property has sustained
.-were damage caused by muskrats.
4. The Department of Natural Resources has inspected the site
and confirms severe shoreline erosion caused Ly the infestation
of muskrats and poor soil types.
5. The seawall has been found to be tie best solution to
alleviate the prc;blems at the site.
5. Rip rap is not effective in combating erosion from muskrat
infestation.
7. The City Engineer in his report, dated August 5, 1983, found
the proposal would not have an adverse effect on Lake
Minnetonka ...... and will improve the lake by preventing further
erosion of the shoreline.

8. The property owner most affected by the installation of the
seawall, Gerald Blohorn, has entered into a license agreement
approving the 20 feet extension of the seawall along the west
whore of the lagoon.
9. The City has received no negative comments from the
surrounding property owners notified during the review of
application #760.
10. The visual impact on the lake is slight by the fact that the
lagoon area is not visible from the main lake.
11. The Department cf Natural Resourses issued permit 83-6150
approving tl,e installation of the seawall on July 15, 1983.
12. The City Council has considered this application including
the findings and recommendations of the Planning Commission,
reports by staff and comments of the applicant and the effect of the
proposed land alteration on the health, safety and welfare of the
community.
13. The City Council finds that granting a Conditional Use Permit
to install a seawall along the shoreline of the lagoon on the
property as proposed will not be detrimental to the health,
safety or general welfare of the public, would not adversely
affect light, air nor pose a fire hazard or other danger to
neighboring properties, nor will it depreciate surrounding
property values and that the land alteration and the manner in
which the excavation is to be carried out to be in keeping with the
intent and objectives of the Zoning Code and Comprehensive Plan
of the City.
14. The City Council finds that granting a variance for the
installation of the seawall as proposed is necessary to alleviate
a demonstrable hardship, is necessary to preserve a substantive
proper ty r ight o f the owner and would be in keeping with the sp' r i t
and intent of the Zoning Code and Comprehensive Plan of the C ,y.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a
variance to Zoning Ordinance 31.831 and grants a Conditi,)nal Use
Permit as required per Zoning Ordinance 11.700 to permit the
installation of a seawall along the shoreline of the lagoon on the
property subject to the following conditions:

SPECIAL PROVISIONS
VII. This permit must be recorded in the Register of Deeds office by the property owner
and certification thereof provided to this Department before the permit is valid.
At that time, a Notice of Permit card will be sent to you. This card must be posed
at the site prior Lu construction.
V111. All Gener,il and Special Provisions of this permit shall bind permittee, his heirs
and assigns and shall run with the land.
1X. Permittee 0411 maintain the authorized wall in a stable and safe condition, and
shall repair or replace it at any time that the Commissioner, finds the wall is
subject to instability, creates a navigation hazard, or has become an aesthetic
nuisance.
X. This permit may be terminated by Commissioner's Order for any violation of the
purposes of said Permit, or of a general or special, or a Notice, of a maintenance
provision thereof, or at any tir:e the Comm-issioner deems it necessary far the con-
servation of the water resources, or for any cause for the protection of the public
interest.
Xi. Any Commissioner's Order terminating this permit nay also require the permittee,
dt his own expense, to remove within + time specified in said Order, any un-
authorized structure in violation of )emit. Said Order shall also require the
permittee to restore, if necessary, t 'ic waters or beds thereof to the
condition existing before the unauthoi --tivity.

XII. The permittee shall comply with all rules, regulations, requ;.rei".ents, or standards
of the Minnesota Pollution Control Agency and other applicably federal, state, or
local agencies. This permit does not obviate any rcquirc•ment for federal assent
from the U.S. Army Corps of Engineers, 1135 U.S. Post Office 6 Custo.z Howie, St.
Paul, Minnesota 55101.
After completion of the project authorized, pernittee shall notify the Regional
Waters' office se that a final inspection can be conducted and the permittee shall
supply the Regional Waters' office with photographs of the proje,-t area.
Spoil material shall not be placed on the beds of protected water.!, and wherever
possible, such material should not be placed anywhere within areas %ubjeck to
flooding. In the event spoil must be placed within flood plain areas because
areas free from flooding are not readily available, the spoil should be placed
parallel to the direction of flood flow and/or spread over a large .rea so as to
minimi any possible obstruction to the passage of flood waters..
Future maintenance excavation of this project shall not exceed the dimensions
herein authorized. P~:or to commencing any maintenance excavation, permittee
shall advise the Department of Natural Resources in writing of the volume of
material to be removed, the manner of removal, and thr- spoil disposal site(s)
proposed. If the Department determines that a field inspection is necessary
prior to approving such maintenance work, the pvrinittee shall submit a check
payable to the State Treasurer to cover the actual coat of the 'lspection, or
$25.00, whichever iu greater, pursuant to Minne:.;ota Regulations 6 MCAR $ 1.5000,
Paragraph G. Maintenance excavation shall not be commenced until pe-mitt:�e's
receipt of the Department's approval. This approval will incluci:--, a permit card
to be posted at ti.? site.
XIV• Permittee r,hall ensure that the contractor has received and thoroughly understands
all conditions of this permit.
Xv. Permittee and contractor are hereby advised that any violation of the conditions
of this permit constitute a misdemeanor, punirhabl.� by a fine of $500.00 and/or
90 days in jail.
Adequate erosion control (straw bale dikes, filter fence:., sediment ponds) shall
be installed prior to commencement of authorized work and shall he maintained
throighout project until site has been restored and stabilized as indicated in
*he following Special Provision.
