_ WHEREAS,the City of Orono(hereinafter th.e"City")is a municipal corporatioii
organized and existing under the laws of the State of Minnesota; and
WHER�AS, the City Council af the City of Orono (hereinafter "City Coun:cii'�}
has adopted land de�velopment regulations for the orderly, economic aud safe developmeut of
latti.d withiri the City; and
VVHEREAS, Bohland Development, Inc. (hereinafter the "Developer") has an
znterest in the properties at 190 Willow Drive North a.nd 177 Glendale Drive legally described in
Exhfbit A attached hereto (hereinafter the"Property"); and
WHEREAS, the City Council has considered the application by the Developer
for rezonu�zg of portions of the Froperty to RPUD - Residential Plaraned Unit Developrnent as
well as subdivision and development of the Property by the Planned Unit Developm�ent (PUD)
process; and
'WHEREAS, on February 13, 2006 the Ci�ty Counci� adopted Resolutioa No.
5420 granting Gen�ral Concept Plan Approval for the proposed development, which approval
ineludes the following elements:
1. Subdivision platting of the Property to create eight devalopable single family residential
bui�ding lots to be served by a new public road, as well as two additional lots
encompassing tlze existing residence at 190 Willow Drive North and the existing church
at 177 Crlend.ale Drive, to be designated as I,ots 1 through 10;
�. Rezoiung of Lot 1 and Lots 3 through 10 from RR-1B Sin;le Family Rural Residential
District to RPUD Residential Planned Unit Development Distri.ct;
3. PUD conditions for development of single family residences oi�.Lots 3 through 10; and

'W�EREAS, the Develaper has a.greed to execute the Planned Unit Development
No. 5 Agreenlent praviding for the inst�ilation of certain improvements as a coi�ditian af site
plan approval for the cozlstruction of certain public and private improvemeuts on the Property,
aud which Agreement documeilts th.e general a��d detailed conditions for develop�ne,�:t and use of
tlie Property; and
V�HEREAS, the Developer has agreed to construct a public road and mtanicipal
sewex and water facilities to be turn.ed over ta the City upon satisfactory conlpletion, and to grant
public easenlenrts to the City over the proposed trails to be constructed by the developer or by the
City withn�the Property; and
W.HEREAS, the Develoger has completed or has agreed to complete all a�tlier
requirements of the Zoning Code, platting ardinaxices and related 4rdinances of the City
zncludin;:
I. Coinpletion of a11 platting requirements of Resolution No. 5420.
2. Dedicatian an the plat of Draiiiage and Utility Easemeats.
3. Snbmittal of Minnehaha Creek Watershed District(MCWD}per�it approving the
grading and stormwater management facilities plan for the development of the
Property as proposed per the a,pproved Grading, Dzainage and SWPP Plan as
noted herein.
4. Payment to the City of Stonnwater and Dra.inage Tr��lc Fees for the development
of the Praperty in the amount of�23,940.00 as established in Genezal Concept
Plan Approvat Resolution No. 524Q.
5. Payment of a Park Dedicatioil Fee in the amo�znt of$4�,400A0 as established in
General Concept Plan Approval Resolution No. 542Q.
6. Payment to the City far the legal review and fili�g of the plat agreements,
easements and covenants in the amount of$250A0.
7. payment of the final plat fee in the amount of$280.00.
8. Crranting to the City of public easements aver pxoposed trails within the Property;
and

WI�EREAS, City staff and consultants have reviewed the plans for this PUD
application and hereby specify approval of each attached plan and identify them as part of#he
official record for Planned Unit Development Na. 5:
1. Approva.l af site plan and grading/drainage plans per the "Grading, Drainage and
Storzn�vater Pollution Frevention Plan" dated May 11, 2006 subject to any
a.dditaonal requirements of the MCWD axu2 subject ta the addi.tional requirements
and conditzons specified by the City Engineer in his letter dated June 12, 2006.
2. Approval of road a�d storm sewex plans per tlie "Roa.d. & Stozm Sewer Pian &
Profile" da�ted May 11, 2006 sub}ect to the additional requirements zuld conditians
speci�ed by the City Engineer in his letter dated June i2,2006.
3. Approval of municipal sewer and water plans per the "Water and Sauitary Sewer
Plan & Frofile" dated May 11, 2006 subject to the additional requirements and
conditions specified by the City Engineer in his letter dated 3une 12,2006.
4. Approval of site landscaping per the "Landscaping Plaix" dated Ma� I1, 2006
� �ubject to incorporation of additional site preparation, plantings and mazntenance
in compliance with the "Ecological R.estoration & Management Program for
Glendale Cave"by AES, Inc. dated May 26, 2006.
NQW, THEREFORE, BE IT RESOLVED that based an tlie findings of
Resoiution No. 5420, the City Council of the City of�rono does hereby approve the plat of
GLENDALE COVE, Hennepin County, 'vlinnesota and does hereby grant General Developrnent
Plan Approval far Planned Unit Developrnent Na. 5, subject to the following conditions:
l. General Development Plan Approva.l is granted subject to conditions established
wi.thin Resolution No. 5420 and subject to the con,ditions established withiu the
Planned Unit l�e�velopment No. 5 Agreement and other pertinent documents.
2. Upon the final approval an.d execution of this resolution and thc Planned Unit
Development No. 5 Agreem.ent, the City Councii shall formally approve an
ordinance asnending the official zoning map of the City to rezone Lot 1 and Lots
3 thxough 10 frorn RR-1B Single Family Rural Residential District to RPUD
Residential Flanned Unit Development District, and amending the �rono Zaning
Code by adding langua.ge establ'zshing Planned Unit Development No. � to
include the Property.

3. Upon appro��al of tliis Resolution the City Council shall direct the Nlayor axzd

not limited to�.e"Planned Unit I7evelopmezz't No. 5 Aaraement".
4. Residenee stxuctures developed on the pzop�rCy shall be in con#`oxzl}.i.ty r�rith the
�ocatio�a, desian and size reqYzi,zements esta.blished in �esolution 5420 and in
couformity with the Plaztn,ed Unit Development No. 5 A.�reernent. Any proposed
devel�pment detezxx�iz�ed b'y the Plannin� Directox to nat be in confozx�.xi�y with
said Ab�emez�t m�� be made only afier a public hearing coz�ducted by the
Council. Ax�y claanges shall be recoz'ded as azzzendments io the zecorded copy of
the final development plan.
5. If substantial developmen.t k�as not octurred within ar�e year aRer approval af
PYJD No. 5 as set forCh iu the Planned Unit DeveXopment No. 5 Agreement, �he
Cify Council may declare t�le approvals �'anted witlun this resoiution and withzr�
said Agreemant as null and void.
6. The aforesaid plat s1�a1I i�e�led�x7ith the Hennepin Couniy on or be�oxe December
26, 2006 togetner with a cextified original copy of this resolution aaad executed
copies of�ie l�gr�emez�,�s, easements, and co��en,an�s pertinent thereto. The pl�at
a�proval granted by th�,s Resolut�on shall expzze if-fhe �lat has z�ot been filed by
the daze specified abo�e. In that event, zt will be necessax� to f le a �e�r
application with the City of Orano for subdivision review.
7. The ap�rovals �ranted in this �Resolution shali not become effectzve until sucJa
time that �i,e peweloper successfizlly completes purchase and provides suztable
evidence of ownershig o�the Property (wz�h the e�ception of'Lots 1 a.t�d 2 which
will reznain in separate ownership).
S. The approvals jranted iz� tk�i,s Resolutioz� sk��,ll become e�ective only when a,11
conditioz�.s of ap�roval z-squirind aetions by the A�pliean,ts haz�e been satzsfied.
