The applicants' property is 0.47 acres in total area and has 61' of width at the shoreline and 125' at the 75' setback from the OHWL of Lake Minnetonlca. No additional land is available to make the property nearer confoimity as to area or width. b. The existing stair�vithiil the 0-75' zone will remain. c. The boat house within the 0-75' zone will be removed during the winter of 2006 at such time when access can be gained from the lake so as to avoid damage to the lake yard of the property. d. The proposed home will meet all setback, hardcover, and lot covera�e requirements. e. The site regrading in the 0-75' zone after home and boathouse removal is necessary in order to restore the site to appropriate grades. 4. The City Council has considered this application including the findings and recominendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variances and conditional use permit on the health, safety and welfare of the community. 5. The City Council finds that the conditions existinJ on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance and conditional use permit would not adversely affect traffic conditions, light, air nor pose a fire hazard or otl�er danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in lceeping with the spirit and intent of the Zonin� Code and Comprehensive Plan of the City. Council approval is based on the site plan submitted by the applicants a�ld annotated by City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan which are not in confonnity with City codes will requi.re further Planning Commission and City Council review. 2. Hardcover in the 0-75' zone shall not increase above the level of 415 s.f. or 6.1% to account for tlie lake side stair. Hardcover in the 75'-250' zone shall be limited to 3,500 s.f. or 25% per the proposed plan and hardcover allowance suinmary as depicted on Exhibit A. Applicants are advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in eYisting hardcover. 3. Applicants shall remove all plastic or fabi-ic liner material from the decorative landscape beds on the property to ensure their permeability as non-hardcover surfaces. 4. Required removals of the boathouse, additional structure atid hardcover shall be completed by June 1, 2006, but in no case shall a final Certificate of Occupancy be issued for the new home before such removals are cornpleted and grades are restored. 5. Authorities granted by this resolution nin with the property not with the applicants, but are permissive only and must be exercised by obtaining a buildin� pennit for the new construction within one year of the date of Council approval, or the variance and conditionai use permit wiil expire on that date (July 11, 2006j. 6. Violation of or non-compliance with any of the tenns and conditions of this resolution shall constitute a violation of the zoning code, shall automatically tenninate any authority granted herein, and shall be punishable as a misdemeanor. 7.
