Bowman 1 165 Ferndale Road West Wayzata, MN 55391 Re: Proposed Subdivision for Nature Conservancy Gift Dear Mr. Bowman: Per our conversation a week or two ago, I have reviewed the Orono subdivision ordinances to determine if there are anv shortcuts that would allow you to avoid the complete subdivision process, but have found nothing that provides us an'out'. Nevertheless, please keep in mind that the City applauds your intent to give your wetland property to the Nature Conservancy, and we will try to make the subdivision process as painless as possible. A copy of the Subdivision Application packet is enclosed for your use. As we discussed, the application deadline for the November 15 Planning Commision meeting is Wednesday, October 20 at noon. The items you must submit with your application are listed as items 1 thru 5 at the top of page 10 of the packet. The most critical of these is the survey ("Preliminary Plat Drawing"), which must depict your entire property, on both sides of West Ferndale Road. It should show your house, the shed that may be near the right-of-way, and other features as listed on pages 4 and 5 of the packet. Your surveyor should be familiar with these requirements. Because the City code does not allow creation of unbuildable lots, we are suggesting that your surveyor depict the land you will give to the Nature Conservancy as unbuildable 'Outlots'. This designation will allow the City to approve separate tax parcels that have specific restrictions and a specific purpose, and avoid any future confusion as to what was in^..:­ided. I've attached a rough sketch of how I think your surveyor should show the final parcel la%okit. I'm enclosing a copy of the original 1902 plat of North Shore Cottage Acres from which your property was carved by various actions. The interesting facet of this is that the "Town Road" (the cutoff) was not originally platted, but may have been platted or created later at the time County Road 15 «as built and platted. It is unclear at this point how the cutoff was legally dedicated to the public. This is something we would have to know if you decided to pursue the vacation. Bowman October 8, 1999 Page 2 Additionally, it is may be critical for us to know the dedication history of the portion of West Ferndale Road adjacent to your shed. On the survey you provided me, the shed scales off to just about 33' from the centerline of West Ferndale as of 1964. If the shed is determined to be totally out of the dedicated right -of way, my guess is that it would not have to be removed; if it encroaches into the right-of-way, that will be an item for discussion.
