A�S�LUTION I2EGARDING A1�T
ARRAI�TGEMENT WITH THE FAIRVIEW COVENANT CIY�JI2CI�
F0�2�iCCESS TO THE SAGA�I,I,PARK AR�A
BV�iEId�AS, the City of Orono is interested in obtaining a workable, long-term
access to the Saga Hill park area; and
WI��AS,the Fairview Covenant Church owns land adjacent to the�Saga Hill park
area; and
WHEREAS, the City currently owns a 10' wide alleyway right-of-way that runs
through the middle of the Church property to the park area; and,
� • . � WI�REAS,the current alleyway does not provide complete access to the park area
because it does not extend to a public roadway; and
VV�REAS,the alleyway is a hindrance to the potential use of the property by the
Church; and �
� W��AS, the City has had discussions with the Fairview Covenant Church
regarding obtaining access to the park using the Church property; and
WgIE�A�,the Church has requested the City adopt a resolution that sets out the
City's position regarding an arrangement with the Fairviedv Covenant Church for access to t�ie Saga
Hill park area; and
. � . .W�E12E�s5,�the Ghurch lias indicated to the City�they would be inferested in the � .
following arrangement for access:
. A. The City vacate the alleyway right-of-way on the Church property in exchange for
an"L" shaped right-of-way providing access from Tonkaview Aveizue into the park
area. �

B. The Church will make available to the City the Church property adjacent to the park
, area for park use for a period of approximately 15 years.
C. The City will maintain the property to be used for park use and will provide for a
bituminous overlay of the main Church parking lot.
NOW, 'T�iEREFORE, BE I�' ItESOI,VED that the Orono City Council does
hereby authorize the Mayor, City Staff, and City Attorney to work with the Fairview Covenant
Church to develop an agreement that reflects the arrangement outlined above.
Adopted by the City Council of the City of Orono, Minnesota at a 'regular meeting
held this 13th day of July, 1998. �
