RESOLUTION OF THE CITY COUNCIL
NO. 1181
DETERMINING THAT SERVICE
WILL BE PROVIDED TO VACANT PROPERTY LOCATED
ON WEST FERNDALE ROAD KNOWN AS PORTIONS OF
LOT 6, NORTH SHORE COTTAGE ACRES T-A MmNBTONKA
WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, Sewer Project 80-1 was initiated by the City to solve
existing on -site sewage treatment problems in the Minnetonka Bluffs -West
Ferndale area, within which the following legally described property is
located:

That part of Lot 6, North Shore Cottage Acres Lake Minnetonka
lying northwesterly of a straight line parallel with the
extreme southeasterly lire of Lot 6 running through a point
in the northeasterly line of said lot a distance 40 ft.
northwesterly from the most easterly corner thereof.

The northeasterly 25 feet of the northwesterly 25 feet of
Lot 9 North Shore Cottage Acres Lake Minnetonka; and
WHEREAS, said parcel is under single separate ownership not
owned in common with any other abutting or bearby properties; and
WHEREAS, all adjacent lots are occupied or are considered as
designated wetlands; and
WHEREAS, the total area of the parcel is approximately 3.0 acres,
of which approximately 0.6 acres is dry buildable land according to all
information the City has available, as compared to the existing zoning
regulation requiring 2.0 acres per building site; and
WHEREAS, said parcel is not buildable without one or more
variances from the existing zoning code; and
WHEREAS, construction of a single family residence on the parcel,
if done according to all zoning performance standards, would not be contrar
to the intent of the Cora unity Management Plan; and
WHEREAS, failure to provide sewer service would make the parcel
unbuildable because of insufficient room to provide for house, well, and
primary and future septic system dretinfield; and
WIIERF.AS, sewer will he available in the street or right-of-way
,idjacent to the property upon completion of sewer project 80-1,

THEREFn^.L, HE IT RESOLVED, by the City Council of the City
of Orono that it is reasonable to provide sewer service to the property
so as to preserve a substantial property right of the owner. Sewer
service will be provided to the property, however, providing this sewer
service does not in itself constitute granting of any zoning variances
which may be required now or in the future to permit construction on the
lot which variances if applied for shall be reviewed on their own merits
and circumstances at that time.

Dear Mr. Skarp,
The enclosed letter is provided for your information regarding
the sewer project now completed on Orono Lane. Because your
property is vacant land the connection requirements obviously
do not apply in this case.
A copy of resolution 1181 is also enclosed for your information.
Sewer service is available should this property ever be considered
for development. All RR-lB 2 acre lot standards will apply.
